A special meeting of the South Coast Air Quality Management District Board will be held in the Council Chambers at Long Beach City Hall, 333 West Ocean Blvd, Long Beach, California.     Amend Rule 1144 - Vanishing Oils and Rust Inhibitors

    Rule 1144 was adopted on March 6, 2009 which partially implemented Control Measure CTS-01 - Emission Reductions from Lubricants. The current proposal will expand the applicability of the rule to include Direct-Contact Lubricants and Metal Working Fluids by establishing VOC limits. The proposal also prohibits the sale of non-compliant fluids and incorporates a recently-validated test method for determining VOC content.   3. Execute Contract for Insurance Brokerage Services

    The current contract for insurance brokerage services expires March 31, 2010. On December 4, 2009, the Board approved release of an RFP to solicit proposals from firms interested in providing these services for the next three-year period. This action is to execute a contract with Alliant Insurance Services through March 31, 2013, for an amount not to exceed $49,000 per year. Funding for this contract has been included in the FY 2009-10 Budget and will be requested in successive fiscal years. (Review: Administrative Committee, February 12, 2010)

  4. Issue Purchase Order for CNG Passenger Vehicles for AQMD Fleet

    On May 1, 2009, the Board approved release of a Request for Quotes (RFQ) to competitively select a vendor from which to purchase five dedicated-CNG compact cars. This action is to purchase an additional 15 vehicles, using the same RFQ process, to replace high-mileage, high-maintenance-cost vehicles in AQMD’s fleet. The cost of this purchase would not exceed $400,000, and funds are available in the FY 2009-10 Budget. (Review: Administrative Committee, February 12, 2010)

  5. Issue RFP for Operation and Maintenance of Hydrogen Station at City of Burbank

    The U.S. Department of Energy (DOE) contracted British Petroleum to install a hydrogen station at the City of Burbank. This project has ended and the title to the station was transferred to the City of Burbank. However, the City of Burbank does not have the funds to continue the operation and maintenance of this facility. This action is to issue an RFP soliciting bids for a qualified third party to operate and maintain the City of Burbank hydrogen fueling station. The exact cost, scope and manner of the services will be determined as part of the competitive bidding process. (Review: Technology Committee, February 19, 2010)

  6. Issue RFP to Conduct Conceptual Feasibility Studies for Reduction of Near Roadway Pollutant Exposures

    Numerous air monitoring and health studies continue to document elevated pollution levels and health risks in areas immediately adjacent to busy roadways and freeways. In addition to reducing on-road tailpipe emissions, other mitigation measures may be effective in reducing the pollution exposure of those living, working or playing in these affected areas. Potential technologies include sound walls, tree-lines, sunken or raised roadways, flow diversion, active roadside filtration, or enhanced filtration systems in buildings. This action is to release an RFP for conceptual research studies to assess the feasibility and cost-effectiveness of these and other technologies with the total awarded amount not to exceed $250,000.   7. Amend Proposition 1B – Goods Movement Contract Awards

    In September and November of 2009, the Board approved contract awards for truck replacement projects as part of the Proposition 1B - Goods Movement Emission Reduction Program. Due to the speed at which program implementation was required, staff anticipated minor changes as the 1,358 awards were processed into contracts. This action is to make such changes, specifically to correct an applicant name, provide appropriate vehicle identification numbers, and increase funding, at the applicant’s request, for a LNG instead of a diesel truck. All funds are from Proposition 1B – Goods Movement Fund (81). (Review: Technology Committee, February 19, 2010)

  8. Amend Contracts to Provide Short- and Long-Term Systems Development, Maintenance and Support Services

    The AQMD currently has contracts with several companies for short- and long-term systems development, maintenance and support services. These contracts are periodically amended to add budgeted funds as additional needs are defined. This action is to amend the contracts approved by the Board to add additional funding of $495,000 for needed development and maintenance work.   9. Execute Contract to Cosponsor Demonstration of Advanced Fuel Cell Bus

    On September 7, 2007, the Board approved an action to execute a contract with Sunline Transit Agency (Sunline) to demonstrate an advanced fuel cell transit bus. Sunline has been unable to come to an agreement with the original bus integrator. Sunline has contracted with a new bus integrator BAE Systems, bus manufacturer ElDorado National and fuel cell supplier Ballard Power Systems, Inc. Although the total project costs have increased, Federal Transit Administration will cover these costs, leaving the requested AQMD support unchanged. This action is to execute a contract with Sunline in an amount not to exceed $400,000 from the Clean Fuels Fund (31). (Review: Technology Committee, February 19, 2010)

  10. Approve AQMD Annual Investment Policy and Delegation of Authority to Appointed Treasurer to Invest AQMD Funds

    State law requires a local government entity annually to provide a statement of investment policy for consideration at a public meeting, and to renew its delegation of authority to its treasurer to invest or to reinvest funds of the local agency.   11. Approve Purchase of Second Industrial Water Heat Exchanger for AQMD Diamond Bar Headquarters

    Due to a typographical error, the FY 2009-10 Budget included authorization for the replacement of only one building hot water heat exchanger, although funding was approved sufficient for the purchase of two. Appropriate Funds from Undesignated Fund Balance to Information Management, Legislative and Public Affairs, Science and Technology Advancement, Engineering and Compliance, and Planning, Rule Development and Area Sources FY 2009-10 Budget for Activities Relating to Permit Moratorium and Prop 1B Program

    Activities relating to the lifting of the permit moratorium as well as significant work relating to Proposition 1B required substantial overtime and other functions that were not anticipated in the FY 2009-10 Budget. This action is to appropriate funds totaling $588,550 from the Undesignated Fund Balance to the FY 2009-10 Budgets of Information Management, Legislative and Public Affairs, Science and Technology Advancement, Engineering and Compliance, and Planning, Rule Development and Area Sources.   13. Establish Special Revenue Funds: Emission Reduction Education and Outreach Fund; Rule 1118 Mitigation Fund

    South Coast AQMD expects to enter into a settlement agreement with a Supplemental Environmental Project to settle excessive emissions violations. This action is to establish an Emission Reduction Education and Outreach Fund and a Rule 1118 Mitigation Fund with the money collected from the settlement agreement. The purpose of the Emission Reduction Education and Outreach Fund will be to enhance compliance of emission reduction policies by providing source education and consumer education. Rule 1118 monitors refinery and related flaring operations to control and minimize flaring and flare related emissions. The provisions of Rule 1118 establish a mitigation fee payment schedule relating to excessive flare emissions. The purpose of the Rule 1118 Mitigation Fund will be to account for these Rule 1118 mitigation fee payments. (Review: Administrative Committee, February 12, 2010)

  14. Issue RFP for Media Relations Services

    With a continuing need for a high level of media and public outreach, AQMD's Media Office is seeking to solicit bids from qualified media relations/public relation firms to assist with media and public outreach programs. A firm or firms are needed to assist the office, which handles day-to-day media communications services and programs, with proactive media outreach activities including the minority advertising and outreach program and AQMD's Air Quality Index initiative. This action is to issue an RFP for Media Relations Services for a one-year period with an option to renew for two additional one-year contracts upon satisfactory performance and at the discretion of the Board.   15. Proposal for AQMD Sponsorship of Weather Reports on CBS 2-TV

    Following a discussion at the January 15 Administrative Committee meeting, AQMD’s Media Office obtained enhanced proposals from CBS 2-TV and ABC 7-TV for AQMD sponsorship of morning weather reports. The CBS2 sponsorship package offers a better value including on-air advertisements, reporting of the day’s air quality forecast during the weather segment and multiple online features for an approximate total cost of $66,300. This action is to execute a contract with CBS 2-TV for AQMD sponsorship of morning weather reports. This action is to further appropriate funds from the Undesignated Fund Balance to the Executive Office Budget for the sponsorship. (Review: Administrative Committee, February 12, 2010)

  16. Approve Contract Modification under FYs 2003-04, 2008-09 and 2009-10 AB 2766 Discretionary Fund Work Program

    The MSRC approved a replacement contract for regional rideshare database enhancements as part of the FY 2003-04 AB 2766 Discretionary Fund Work Program, as well as a contract modification for A-Z Bus Sales providing additional funds for alternative fuel school buses as part of the FY 2008-09 Work Program. The MSRC also approved a sole source contract with the Coachella Valley Association of Governments to administer a Regional PM10 Street Sweeping Program and a sole source contract to Los Angeles County Metropolitan Transportation Authority to implement Clean Fuel Shuttle Service to Dodger Stadium, both as part of the FY 2009-10 Work Program. The MSRC seeks Board approval of these contract awards and modifications under FYs 2003-04, 2008-09 and 2009-10 Work Programs, respectively.     On November 6, 2009, the Board approved issuance of an RFP to prequalify outside legal counsel having expertise in handling finance matters, including revenue, tax, bond issues, and District funding programs. The evaluation of responding firms has been completed. This action is to establish a list of prequalified counsel to advise and represent the AQMD in finance and related matters.   18. Remove Various Fixed Assets from AQMD Inventory

    AQMD Administrative Policies and Procedures No. 20 requires a biennial Districtwide fixed asset inventory, an annual Science and Technology Advancement inventory, and the disposal of fixed assets declared surplus. In 2009, the biennial Districtwide fixed asset inventory was conducted. This action is to approve removal of surplus equipment, computer software, motor vehicles determined to be obsolete or broken and not worth repairing and fixed assets not located from AQMD's records.   38. Proposed National Ambient Air Quality Standards for Ozone

    U.S. EPA is reconsidering the National Ambient Air Quality Standards (NAAQS) for ozone. U.S. EPA has proposed to lower the primary standard, which is designed to protect public health, from the current 0.075 ppm to a level within the range 0.060 to 0.070 ppm averaged over 8 hours. U.S. EPA also proposed a new form for the secondary standard, which is designed to protect public welfare (vegetation damage). Staff presented an overview of the proposed standards at the January 22, 2010 Mobile Source Committee meeting. The Committee requested that staff prepare draft comments to U.S. EPA on the proposed standards, and bring to the March Board meeting for discussion. This item is to seek Board direction on AQMD’s comments to U.S. EPA regarding the proposed ozone standards. (Review: Mobile Source Committee, January 22, 2010)

Status Report on Clean Air Action Plan and AQMD's Backstop Rules

The AQMD staff will provide a status update on the revised San Pedro Bay Clean Air Action Plan (CAAP). The CAAP establishes emission reduction and risk reduction standards for the San Pedro Bay. To ensure that the Ports of Los Angeles and Long Beach achieve targeted emission and risk reduction standards, the AQMD staff is developing backstop rules. These backstop rules are designed to ensure that the Ports reduce their fair share of emission reductions necessary for the Basin to obtain federal PM2.5 and ozone ambient air quality standards as well as reduce their health risk due to diesel particulate. The AQMD staff will provide a summary of these backstop rules.

  1. Amend Regulation IX - Standards of Performance for New Stationary Sources

    Periodic amendments to Regulation IX incorporate new or amended federal standards by reference. Three actions enacted by U.S. EPA in 2009, for NSPS, are proposed for incorporation into Regulation IX. The NSPS actions cover: compliance alternatives for fossil-fuel fired steam generators and industrial-commercial-institutional steam generating units; amendment of SOx standards for certain stationary combustion turbines burning low-sulfur content biogas; and revision of some emission limits for certain equipment at coal preparation and processing plants. Affected industries include: industries using fossil-fuel-fired steam generators and industrial-commercial-institutional steam generating units; industries using stationary combustion turbines; and industries preparing and processing coal.   2. Approve and Adopt Technology Advancement Office Clean Fuels Program Annual Report and Plan Update

    As a requirement of the Clean Fuels Program funding, the Technology Advancement Office must submit to the Legislative Analyst by March 31st of each year an approved Annual Report for the past year and a Plan Update for the current calendar year. Staff has reviewed the Clean Fuels Program with the Clean Fuels Advisory Group, the Technology Advancement Advisory Group, and other technical experts. Additionally, staff presented the 2010 Clean Fuels Program Draft Plan Update to the Board for review and comment at its October 2, 2009 meeting.   3. Annual RECLAIM Audit Report for 2008 Compliance Year

    The annual report on the NOx and SOx RECLAIM program is prepared in accordance with Rule 2015 - Backstop Provisions. The report assesses emission reductions, availability of RECLAIM Trading Credits (RTCs) and their average annual prices, job impacts, compliance issues, and other measures of performance for the fifteenth year of this program. In addition, recent trends in trading future year RTCs are analyzed and presented in this report.   4. Adopt Proposed Rule 310 – Amnesty for Unpermitted Equipment

    Proposed Rule 310 – Amnesty for Unpermitted Equipment - will exempt owners and operators of unpermitted equipment that meet certain conditions from civil and criminal penalties and late filing fees if the necessary permit applications and fees are voluntarily filed and paid during the amnesty period of February 5 through August 4, 2010. This rule implements the Board Chairman’s January 8, 2010 proposal for a temporary and voluntary permit application penalty holiday.   1. Issue Program Announcement for Heavy-Duty Diesel Truck Retrofit Projects under the Proposition 1B – Goods Movement Emission Reduction Program

    At the February 19, 2010 meeting, the Board issued a new solicitation for additional truck replacement projects for “Year 1” of the Proposition 1B – Goods Movement Program. Subsequently, CARB informed AQMD that the program must include a retrofit option, though this option is not available to drayage trucks due to the statewide drayage truck regulation. Most truck owners/operators prefer to replace their old trucks rather than retrofit. Since CARB has reallocated the balance of funds from the drayage truck category to the other trucks category, this retrofit option has to be offered. This action is to issue a program solicitation for heavy-duty diesel truck retrofit projects under the Proposition 1B program.

At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under Public Comments may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record, provided 25 copies are presented to the Clerk of the Board.
