A special meeting of the South Coast Air Quality Management District Board will be held at 9:00 a.m., in the Biltmore Bowl at the Millennium Biltmore Hotel Los Angeles, 506 South Grand Avenue, Los Angeles, California.     1. Amend Rule 1111 - NOx Emissions from Natural-Gas-Fired, Fan-Type Central Furnaces

      The proposed amendment would implement 2007 AQMP control measure CMB03 – Further NOx Reductions from Residential Heating Furnaces through the use of low NOx burner technology and improvements to heat exchange components in residential furnaces. The proposed amendment would lower the NOx emissions limit for the majority of new residential heating furnaces and for the first time establish a NOx limit on new furnaces used in mobile homes. The implementation is proposed to be phased in over a six-year period beginning 2012 with option for an alternate compliance plan.   3. Execute Contracts to Implement Phase II HEROS Program

    On December 5, 2008, the Board approved release of an RFP to implement the second phase of the High Emitter Repair or Scrap (HEROS) program. Implementation of the second phase will focus on increasing the voluntary rate of participation of identified high-emitting vehicles to scrap or repair the identified vehicles. Two proposals were received by the closing date of the RFP. This action is to execute a contract with Valley Clean Air Now for an amount not to exceed $798,960 from the AB 923 Fund to implement Phase II of the HEROS Program. In addition, this action is to execute a sole source contract with the Foundation for California Community Colleges for vehicle testing and repairs in an amount not to exceed $900,000 from the AB 923 Fund. An action is also requested to allocate $1,900,000 from the AB 923 Fund for the low-income eligible vehicle replacement incentives and vehicle scrapping component of Phase II HEROS Program.   4. Execute Sole Source Contract to Demonstrate Natural Gas Powered Police Vehicle

    At its February 2009 meeting, the Board approved the conversion of a Ford Crown Victoria Police Interceptor to run on compressed natural gas for the City of Redlands Police Department. Since the award, there has been interest in evaluating a CNG-powered Police Interceptor as part of the Los Angeles County Sheriff’s Department Annual Law Enforcement Vehicle Test and Evaluation Program. The Los Angeles County Sheriff's Department indicated their willingness to test a CNG-powered Police Interceptor at their test facilities and would provide an existing gasoline-powered Police Interceptor to be converted to run on CNG. This action is to execute a sole source contract with BAF Technologies for the conversion of an existing 2008 model year or newer Los Angeles County Sheriff's Department Police Interceptor to operate on CNG. Following conversion, the vehicle would be evaluated by the Sheriff's Department. The total cost for this project is estimated not to exceed $34,500 from the Clean Fuels Fund.(Review: Technology Committee, September 25, 2009)
     
  5. Appropriate Funds for PAMS Program, Recognize and Appropriate Funds for New Lead Monitoring Network, Reallocate Funds for NATTS Program, and Authorize Purchases

    U.S. EPA has allocated Section 105 funding for the 18th Year PAMS program and the new Lead Monitoring Network requirements. Section 105 revenue for the 18th Year PAMS program has been included in the FY 2009-10 Budget. This action is to: (1) appropriate funds to the FY 2009-10 Budget for the 18th year PAMS program; (2) recognize revenue and appropriate funds for the new Lead Monitoring Network; (3) reallocate funds for the NATTS program; and (4) authorize purchases.   6. Execute Contract with Aerospace Corporation to Develop, Deploy and Demonstrate Light Detection and Ranging (LIDAR) Technology for Remote Sensing of Fugitive Dust Emissions from Stationary Sources

    Fugitive dust emissions are a major source of PM10 and PM2.5 in the South Coast Air Basin. It is often difficult to identify specific fugitive dust emission points or areas within large facilities such as cement plants, construction sites, or aggregate mines. Aerospace Corporation is a federally funded research and development center that has developed and deployed LIDAR for other applications. This action is to transfer funds within the General Fund and execute a contract with Aerospace Corporation for an amount not to exceed $45,056 to conduct a pilot study of this new application of LIDAR technology.   7. Recognize Revenue from U.S. EPA and Execute Sole Source Contract for Optimization and Development and Demonstration of Exhaust Emission Control Technologies for Heavy-Duty Diesel Trucks

    On-road heavy-duty trucks contribute substantially to NOx and PM emissions within the South Coast Air Basin. Selective catalytic reduction (SCR) systems and diesel particulate filter (DPF) technologies are capable of significantly reducing NOx and PM emissions, respectively. Staff proposes to demonstrate both technologies deployed as retrofit emissions control systems. This action is to recognize $4 million from EPA and upon receipt of funding to execute two sole source contracts with Johnson Matthey Inc., to optimize and demonstrate selective catalytic regenerating and continuously-regenerating technologies on on-road heavy-duty diesel trucks at a total cost not to exceed $4,600,000 from the Clean Fuels Fund.   8. Execute Contracts for Technical Assistance for Advanced, Low-and Zero-Emissions Mobile and Stationary Source Pollution Control Technologies under Clean Fuels and Carl Moyer Programs

    On June 5, 2009, the Board approved the release of two RFPs to solicit proposals to provide technical assistance and public outreach support for advanced, low- and zero-emission mobile and stationary source pollution control technologies for the Clean Fuels Program and incentive programs. Eight proposals were received for the Clean Fuels Program and four were received for incentive programs. This action is to execute seven contracts with technical experts to provide consultation services at a total cost not to exceed $555,000 from the Clean Fuels Program. Further, this action is to execute three contracts with technical experts to provide consultation services for the Carl Moyer program at a cost not to exceed $330,000 from Carl Moyer Program Fund SB 1107 Account.   9. Execute Contracts to Cosponsor Demonstration Projects for Renewable Feedstock to Energy and Fuel Technologies

    The use of renewable feedstocks for energy production and transportation fuel is a necessary transition to reduce greenhouse gas emissions and provide for domestic energy diversity. These conversion technologies, however, also need to be made as clean as possible, and the proposed two projects investigate this potential. The first proposed project is with Orange County Sanitation District for the demonstration of retrofit gas clean-up and catalytic after-treatment emission control technology on a biogas engine. This second proposed project is with the College of Engineering-Center for Environmental Research and Technology, University of California, Riverside, for a bench scale demonstration project to produce natural gas from biomass waste using steam hydro-gasification process. The total for both projects is over $2.6 million with cost-share being requested from the AQMD not to exceed $301,369 from the Clean Fuels Fund.   10. Execute Truck Fleet Modernization Contracts for Carl Moyer Program

    On April 4, 2008, the Board approved release of a Program Announcement to solicit projects at a cost not to exceed $6 million under the “Year 9” Carl Moyer Truck Fleet Modernization Program. These projects are evaluated on a first-come, first-served basis, and are submitted on a monthly basis to the Board for approval. This action is to execute fleet modernization contracts from the Carl Moyer  SB 1107 Program Fund.

    At its February 6, 2009 meeting, the Board approved the release of Program Announcement for the FY 2008-09 “Year 11” Carl Moyer Program. Over $39 million of applications were received, but due to a combination of the slow economy and the new CARB regulations, many of the projects either dropped out or were found ineligible. This action is to issue a new program announcement to fund projects and encumber the remaining “Year 11” Carl Moyer Program funds. (Review: Technology Committee, September 25, 2009)
     
  12. Recognize Revenue from Department of Energy and California Energy Commission and Execute Contract to Develop and Demonstrate Fleet of Medium Duty Plug-In Hybrid Electric Vehicles

    The AQMD anticipates an award through the recent American Recovery and Reinvestment Act funding opportunity in the Transportation Electrification category. The funding opportunity was coordinated through the Department of Energy (DOE) with the aim to further research, development and demonstration activities for plug-in hybrid vehicles. This action is to recognize $45,443,332 in revenue from the DOE and up to $5,000,000 in revenue from the California Energy Commission, and execute a contract with the Electric Power Research Institute to develop and demonstrate a fleet of approximately 378 plug-in hybrid electric vehicles in an amount not to exceed $44,522,405.   13. Execute Contract with New Fleets for Off-Road Emissions Reduction Showcase Program

    On October 5, 2007, the Board approved a $1.2 million project to retrofit selective catalytic reduction systems and diesel particulate filters on off-road construction equipment owned by multiple fleet operators. The project presented to the Board identified specific fleets that would participate in the project. One of the identified fleet operators will not be able to participate in the program as a result of the recent economic downturn. This action requests to modify the project to engage new fleet operators in the program and execute a contract with Griffith Company and/or Sanitation Districts of Los Angeles County for a combined total amount not to exceed $232,900 from the Clean Fuels Fund.   14. Issue RFP for Legislative Representation in Sacramento, CA

    Direct representation in Sacramento is necessary to further AQMD policy positions at the state level, and the current contracts for such services expire in December 2009. This action calls for the issuance of an RFP for legislative consulting service for AQMD in Sacramento for 2010. The RFP will also indicate that the services contract may be extended for up to two additional one-year terms. Total expenditures for the contract shall not exceed $389,170 for the initial one-year period which is the current contract amount for such services.   15. Issue RFP for Public Policy Consulting Regarding Local, State and Federal Transportation Issues

    The Board has directed staff to participate in the development of the next federal surface transportation reauthorization legislation as it directly affects mobile source emissions. This effort is to strengthen and incorporate air quality considerations in transportation spending, at the policy level. This action is to issue an RFP for consulting services regarding air quality and transportation issues relative to the development of the federal surface transportation reauthorization legislation.   17. Issue RFP for Development of Land Use Emission Model Software

    Due to the recent legal dispute with Rimpo and Associates, Inc. over the software rights for the Urban Emissions Model (URBEMIS), this action is to release an RFP to provide for the development of a comparable land use emission model software. As background, URBEMIS is a computer model that calculates the potential criteria and CO2 emissions associated with land use development in California. The model estimates construction, area source, and operational air pollution emissions from a wide variety of land use development projects. The model also identifies and calculates emission reductions from mitigation measures selected for each land use development project for criteria pollutants as well as greenhouse gases. The software, once developed from this RFP, will be used by District staff and will be made available to the public, at no cost, for estimating project air emissions. This item also seeks Board approval to appropriate funds not to exceed $200,000 from the Undesignated Funds Balance. (Review: Mobile Source Committee, September 25, 2009)

    AQMD currently has contracts with several companies for short- and long-term systems development, maintenance and support services. These contracts are periodically amended to add budgeted funds as additional needs are defined. This action is to amend the contracts approved by the Board to add additional funding of $417,670 for needed development and maintenance work.     On July 10, 2009, the Board approved release of an RFP for an information technology position audit. An evaluation panel that included AQMD staff and an outside expert reviewed and evaluated the proposals received. Two proposals were submitted to the Administrative Committee for consideration at its September 18, 2009 meeting. The Committee selected Tech/Knowledge, Inc. to be recommended to the full Board.   22. Adopt Resolution Amending Records Retention Schedule

    State law authorizes the governing body of a local district to approve a records retention schedule that classifies district records and establishes a standard protocol for the disposition or destruction of records. The Board adopted the AQMD’s Records Retention Policy and Records Retention Schedule in 2005. Pursuant to the Policy, AQMD staff has conducted a periodic review of the current Policy and the Schedule, and is proposing changes to records categories and retention periods in the Records Retention Schedule. On May 2, 2008, the Board approved the Deferred Compensation Plan Committee Charter formalizing the fiduciary duties and responsibilities of the Committee. The Annual Report addresses the Board's responsibility for monitoring the activities of the Committee and ensuring the Committee carries out its duties and responsibilities under the Charter.     In March 2007, the Board requested that staff bring the Clean Fuels Program Plan Update before the Board as a separate item to solicit more direct input before requesting final approval each year in early spring. This action is to receive and file the calendar year 2010 Clean Fuels Program Draft Plan Update with major emphasis on electric and hybrid vehicles, including plug-in hybrids, clean engine technologies, refueling infrastructure deployments, including upgrades to refurbish older stations, and support for hydrogen and fuel cell technologies.     At its September 11, 2009 meeting, the Board approved awards for truck replacements at the Ports of Los Angeles and Long Beach under the Proposition 1B – Goods Movement Program. Due to on-going negotiations with CARB staff, the Board requested an update on the progress of the projects at its next meeting. This oral presentation will describe the progress and the current status of the program in addition to the future steps required to complete the implementation of the program.

  44. Authorize Purchase of Three Web Servers

    The public, as well as schools, hospitals, other public agencies, youth sports organizations, day care operations, and news organizations, rely on the AQMD website (www.aqmd.gov) for accurate, readily available, up-to-date air quality information. AQMD’s current web servers lack the necessary capacity to provide this information in a timely manner under high demand situations (e.g. wildfires, Stage 1 smog alerts, high temperatures, etc.). This action is to request approval to purchase three (3) additional web servers to provide the necessary scaled-up, load-balanced computing resources that will ensure critical pollution information is readily available to the public at all times. Funds for this recommended purchase are available from the undesignated fund balance.
     
  45. Amend Contract with Sloat Higgins Jensen & Associates for Consulting Services on Current Legislative Activities

    On April 20, 2009, the Executive Officer executed a consulting contract with Sloat Higgins Jensen & Associates to provide expert services to the AQMD regarding current legislative activities. This action is to amend the contract term for one additional month and increase the contract amount by $10,000. Funding is included in the FY 2009-10 Budget, bringing total contract funding to $59,000.

It is necessary for the Board to recess to closed session pursuant to Government Code section 54956.9(a) to confer with its counsel regarding pending litigation which has been initiated formally and to which the District is a party. The actions are:

Members of the public are afforded an opportunity to speak on any listed item before or during consideration of that item. Please notify the Clerk of the Board, (909) 396-2500, if you wish to do so. All agendas are posted at AQMD Headquarters, 21865 Copley Drive, Diamond Bar, California, at least 72 hours in advance of the meeting. At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under Public Comments may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record, provided 25 copies are presented to the Clerk of the Board. Electronic submittals to cob@aqmd.gov of 10 pages or less including attachment, in MS WORD, plain or HTML format will also be accepted by the Board and made part of the record if received no later than 5:00 p.m., on the Tuesday prior to the Board meeting.
