A meeting of the South Coast Air Quality Management District Board will be held at 9:00 a.m., in the Auditorium at AQMD Headquarters, 21865 Copley Drive, Diamond Bar, California.   2. Issue Purchase Order for Laboratory Information Management System and Approve Budget Transfer

    In March 2009, the Board approved release of an RFQ to purchase a Laboratory Information Management System. Five (5) bids were received and evaluated. Based on technical merit and cost, Promium LLC was deemed to be the most qualified bidder. This action is to issue a purchase order to Promium LLC, in an amount not to exceed $245,726 for the purchase of the software and hardware. This action is also to execute a budget transfer between major objects within the 17th Year PAMS grant award budget. Funds for the total amount of $245,726 are available in the FY 2008-09 Budget.   3. Issue Purchase Orders for Purchase of Compressed Gases and Cryogenic Liquids

    In March 2009, the Board approved the release of RFQ to purchase compressed gases and cryogenic liquids. Six qualifying bids for compressed gases and four qualifying bids for cryogenic liquids were received and evaluated. Six bids for supplying these gases were received and evaluated. This action is to issue purchase orders for the purchase of U.S. EPA protocol calibration gases, ultrapure air, and other related gases for FY 2009-10.   5. Approve Implementation Procedures for Carl Moyer On-Road Heavy-Duty Vehicle Voucher Incentive Program

    This action is to approve the implementation procedures for the new Carl Moyer On-Road Heavy-Duty Vehicle Voucher Incentive Program (VIP). On May 1, 2009, the Board adopted a resolution to receive up to $3,400,000 in grant funds from CARB and approved the use of match funds to satisfy CARB’s buy-in provision to implement the VIP. Board approval is now required to run the program in a manner that is consistent with the program guidelines developed by CARB. This action is to approve the implementation procedures for the VIP.   6. Execute Contract to Conduct Performance Evaluation Program on Ambient Air Monitors

    The guidelines of AQMD federal air monitoring programs specify activities to assure the validity of the data which include conducting performance evaluations on air samplers in the network. This action is to execute a contract with Technical & Business Systems, Inc. to conduct a performance evaluation program on the AQMD TSP, PM10, PM2.5 and PM2.5 speciation network for the FY 2009-10 term, in an amount not to exceed $34,883 from the FY 2008-09 Budget.   7. Adopt Resolution Recognizing 2009 State DERA-Funded Lower-Emission School Bus Retrofit Program Funds, Approve Grants to Retrofit School Buses with Particulate Traps, and Approve Back-up Funds and List of Back-up Retrofit Projects for the DERA Funds

    CARB has allocated $898,000 to the AQMD under the 2009 State DERA-Funded Lower-Emission School Bus Retrofit Program. In order to receive additional funds should they become available, the AQMD has requested from CARB up to $1,204,300. These actions are to adopt a resolution recognizing up to $1,204,300 for current and any future awards pursuant to this program, to approve grants to public school districts to retrofit school buses with Level 3 PM traps, and to approve back-up funds and list of back-up retrofit projects for the DERA funds.   8. Execute Contract to Cosponsor Battery Electric Class 4 Truck Demonstration Project

    To address the goal for reducing NOx and PM emissions, the City of Santa Monica has proposed to demonstrate a Class 4 battery electric truck project. The vehicle will be used by the Water Resources Division of the Public Works Department for maintenance, repairs and customer service throughout the city. The project will examine the durability, reliability and lifecycle costs of the vehicle, battery and charging infrastructure in order to determine the prospects of future deployment of this zero-emissions technology. The total cost of the project is $210,910. This action is to execute a contract with the City of Santa Monica to cosponsor this project at a cost not to exceed $87,205 from the Clean Fuels Fund.   9. Issue RFPs for Technical Assistance for Advanced, Low- and Zero-Emissions Mobile and Stationary Source Technologies and Technical Assistance for Implementation of Incentive Programs

    This action is to issue two RFPs to solicit statements of qualifications from individuals and organizations capable of providing technical expertise in a variety of specialized areas to support AQMD’s technology advancement activities and implementation efforts.   10. Recognize Revenue from Green Tech Connect Forum, Authorize Executive Officer to Approve Conference Expenditures, and Execute Contract for Online Registration Services

    In February 2009, the Board approved the Chairman’s ‘Helping Hand Initiative for 2009’ which included the Clean Air Technology Conference. This action is to recognize revenues, transfer funds from S&TA’s Professional and Special Services into Clean Fuels Conference Special Revenue Fund (Fund 26), approve a conference budget and authorize the Executive Officer to approve conference expenditures not to exceed $380,000.   11. Execute Truck Fleet Modernization Contracts for Carl Moyer Program and Switch Source of Funds in Carl Moyer Program Contracts Between SB 1107 Funds and AB 923 and AB 923 Interest Funds

    On April 4, 2008, the Board approved release of a Program Announcement to solicit projects at a cost not to exceed $6 million under the “Year 9” Carl Moyer Truck Fleet Modernization Program. These projects are evaluated on a first-come, first-served basis and are submitted monthly to the Board for approval. This action is to execute a fleet modernization contract from the Carl Moyer SB 1107 Program Fund. This action is also to switch source of funds in selected Carl Moyer Program contracts between SB 1107 funds, and AB 923 and AB 923 interest funds to meet the “Year 9” Carl Moyer Program expenditure requirement.
     

  12. Issue Program Announcement for Local Government Match Program - Tree Partnership

    One of the Chairman’s Initiatives for 2009 is to provide local and county governments an incentive for additional tree planting, along with an opportunity for temporary employment for students. Through the Tree Partnership, the AQMD will provide matching funds to eligible tree planting projects that provide temporary student labor. This action is to issue a program announcement for the Tree Partnership that local governments within the District are eligible to apply for.   13. Amend Contract with Technical and Business Systems, Inc. for Air Pollutant Measurements Aloft

    On July 11, 2008, the Board awarded a contract with Technical and Business Systems Inc. to conduct air pollutant measurements aloft for AQMD.  This amendment exercises a contract option for a modification to incorporate additional funding in FY 2008-09 to continue the monthly aircraft and balloon measurements through a full year in support of the evaluation of model boundary conditions.  Based on the availability of budgeted funds and the contractor’s performance, this action is to amend the contract to increase the funding by $155,000.  Funding in the amount of $45,000 is included in the FY 2008-09 Budget.  The remaining $110,000 is allocated in the EPA 17th Year Section 105 Grant for the PAMS program, bringing the contract total to $260,000.   14. Amend Contract with Technical and Business Systems, Inc. to Provide Technical Support for AQMD Coachella Valley Meteorological Network

    On June 6, 2008, the Board awarded a new contract with Technical and Business Systems, Inc. to provide technical support for the AQMD Coachella Valley Meteorological Monitoring Network, with options for three annual contract renewals. Based on the contractor's responsiveness and performance, this action is to amend the contract with Technical and Business Systems, Inc. to exercise the first renewal option in an amount not to exceed $55,000. This will bring the contract total to $105,000 for ongoing field support of the Coachella Valley meteorological stations and data management.   15. Appoint Members to AQMD Hearing Board

    The terms of office for the Hearing Board Attorney and Engineer Members, and their Alternates, expire June 30, 2009. An Advisory Committee was appointed as required by law. The Advisory Committee reviewed the candidates' resumes and made its recommendation to the Administrative Committee. The Administrative Committee interviewed candidates at a special meeting on May 1, 2009, and made a final recommendation. This action is to appoint members to fill the expiring terms.   16. Establish List of Prequalified Legal Counsel to Provide Employee and Labor Relations Legal Services

    On March 6, 2009, the Board approved issuance of an RFP to prequalify outside legal counsel having expertise in handling employee and labor relations matters. The evaluation of responding firms has been completed. This action is to establish a list of prequalified counsel to advise and represent the AQMD in employee and labor relations matters.   17. Appropriate Funds from Designation for Litigation and Enforcement and Authorize Amending/Initiating Contracts with Outside Counsel

    AQMD District Counsel is currently being assisted in several lawsuits by outside law firms, including multiple lawsuits challenging the District’s Credit Bank, the Architectural Coatings Rules, the ultra-low diesel project at the ConocoPhillips refinery, a lawsuit challenging the recently adopted consumer products rule – Rule 1143, and other matters requiring specialized legal counsel. This action is to appropriate $175,000 from the Designation for Litigation and Enforcement to the Legal Budget, Professional and Special Services account, and to authorize the Executive Officer to amend or initiate contracts to expend these funds with Woodruff Spradlin & Smart and Shute Mihaly & Weinberger or other counsel approved by the Board.   18. Issue RFP for Operation of Diamond Bar Headquarters Cafeteria

This action is to issue an RFP, containing environmental sustainability and “green building” requirements, to solicit proposals from qualified food service management firms interested in providing this service for the next three-year period.   19. Issue RFP to Prequalify Consultants for Assistance Preparing CEQA Documents and Other CEQA-Related Technical Analysis

    This RFP is to prequalify expert services for assistance preparing CEQA documents for AQMD rules, regulations, and non-AQMD permit application projects where the AQMD is the lead agency under CEQA, and other topic-specific CEQA-related analysis, such as GHG analysis, mitigation measure development, or protocol development, which may be used to update the AQMD’s CEQA Air Quality Handbook. The consultant would need to have in-depth knowledge of CEQA and expertise in analyzing environmental impacts resulting from various types of projects. The total amount available for consulting services is $60,000, which is included in the 2009-10 Budget.     The Executive Officer's Budget for FY 2009-10 represents the input over the past several months from Board members, staff, and the public. This year's process included meetings from the Budget Advisory Committee; a public hearing on February 6, 2009 to receive input on the AQMD's Program Goals and Objectives; and two budget workshops, one for the public held on April 29 and one for the Board held on May 15, 2009. This submittal transmits the required appropriations and reserves necessary to adopt the proposed budget.   38. Amend Regulation III – Fees

    Staff is proposing a limited number of amendments to Regulation III - Fees to better align program revenues with program costs. Other proposed amendments clarify rule provisions and have minor fee adjustments. Staff is also proposing administrative amendments that have no revenue impact.   39. Amend Rule 317 - Clean Air Act Non-Attainment Fees

    The public hearing for the proposed amended rule was continued to the June Board meeting. The newly proposed amendments incorporate provisions for an alternative baseline for calculating fees and an exemption for permit units at BACT as requested by the Board at the April 2009 public hearing.   40. Adopt Proposed Rule 433 - Natural Gas Quality

    Fluctuations in natural gas quality may adversely impact emissions from natural gas-fueled equipment. The objective of Proposed Rule 433 is to monitor the quality of natural gas being supplied to end users located within the AQMD and determine the effects of new supplies of natural gas, such as those derived from imported liquefied natural gas (LNG) on natural gas quality and emissions.   41. Amend Rule 1401 - New Source Review of Toxic Air Contaminants to Add Cancer Risk Value for Ethyl Benzene

    The proposal would add a cancer risk value for ethyl benzene to the list of toxic air contaminants (TACs) in Rule 1401 - New Source Review of Toxic Air Contaminants. The cancer risk value was approved by the Office of Environmental Health Hazard Assessment (OEHHA) in November 2007. In addition to impacts for new, modified, and relocated equipment subject to Rule 1401, a preliminary assessment of impacts for existing facilities subject to Rule 1402 - Control of Toxic Air Contaminants from Existing Sources is included because Rule 1402 uses the same list of TACs.   42. Annual Report for 2008 on AB 2588 Air Toxics Hot Spots Program

    The Air Toxics "Hot Spots" Information and Assessment Act of 1987 (AB 2588) requires local air pollution districts to prepare an annual report.  Key accomplishments for 2008 include: (1) approved eight facility health risk assessments (HRAs); (2) conducted one public notification meeting; (3) prioritized 208 AB 2588 facilities for FY 2006-07, requested and evaluated seven detailed Air Toxics Inventory Reports, (4) notified seven facilities to prepare HRAs, (5) developed a new web-based emission reporting tool for facilities to report criteria, toxic, and greenhouse gas emissions, and (6) updated AB 2588 website information.   43. CARB Proposition 1B Grant Agreements and Administrative Costs Update

    The state recently reinstituted the Proposition 1B Goods Movement Program as funding became available through general obligation bonds. From these funds, the South Coast Air Basin is anticipated to receive $44 million for the Lower Emission School Bus Program, $2.5 million for Intermodal Railyards and $49 million for port drayage trucks. The original CARB award for port drayage trucks projects called for the Port of Los Angeles and Port of Long Beach to administer the local incentive program. The two ports and CARB now want to shift the Program administration to the AQMD. The current bond language, as interpreted by CARB staff, does not allow for reimbursement of any administrative costs incurred by the local air districts. Staff estimates the total administrative costs for these grants to be approximately $3.5 million. Although the situation remains fluid, staff believes it is important to update the Board and provide recommendations for Board consideration and possible action.

At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote.
