Proposed amendments to Rule 1158 clarify rule requirements and intent in the rule language. To accomplish this, the staff proposal adds/modifies definitions and adds/restructures exemptions. Other amendments clarify applicability for operations that are not explicitly listed, improve compliance flexibility, and remove obsolete language. 3. Establish Health Effects Research Account from BP Arco Settlement Fund and Future Penalty Monies

In 2003, the Board established and funded the initial research of the Brain and Lung Tumor & Air Pollution Foundation and the Asthma and Outdoor Air Quality Consortium. Recent studies regarding the health effects of air pollution show impacts at ambient levels of exposure. More research is needed. This action is to continue AQMD’s support of research into the health effects of air pollution with financial support from penalty and settlement monies. 4. Execute Contract to Conduct Systems and Performance Audits of Meteorological Monitoring Network

On April 4, 2008, the Board approved release of an RFP to conduct systems and performance audits of the AQMD meteorological monitoring network. The contract will include audits of instrumentation and operations for the five AQMD PAMS upper air meteorological stations, as well as meteorological measurements associated with up to an additional seven AQMD air quality monitoring stations. This action is to execute a contract with Technical and Business Systems, Inc. in the amount of $60,000, with an option to add funds to audit additional stations in FY 2008-09, based upon availability of funds and satisfactory contractor performance. The initial funding for this contract in the amount of $60,000 is budgeted in FY 2007-08, as allocated from the U.S. EPA Section 105 Grant for the 16th year of the PAMS program. 5. Execute Contract to Provide Technical Support for Coachella Valley Meteorological Network

On April 4, 2008, the Board approved release of an RFP to provide technical support for the AQMD Coachella Valley meteorological network. The contract effort will provide field support of the meteorological stations, instrument testing, data management, and data analysis. This action is to execute a contract with Technical and Business Systems, Inc. in the amount of $50,000, with the options to renew in each of the next three fiscal years, based upon availability of funds and satisfactory performance. The initial funding for this contract in the amount of $50,000 is budgeted in FY 2007-08 in the Planning Rule Development and Area Sources Contracts and Special Services account. This contract may be amended up to three times to extend the term and add funds, at AQMD's discretion, contingent on funding availability and contractor performance. 6. Execute Contracts for Rule 2202 Air Quality Investment Program and 2008 Leaf Blower Exchange Program

At its February 1, 2008 meeting, the Board approved release of an RFP to solicit proposals to meet Rule 2202 AQIP emission reduction targets and to solicit competitive bids from manufacturers of low-emission leaf blowers. Proposals for the two funding opportunities have been reviewed. This action is to (1) fund two AQIP projects in an amount not to exceed $500,000; and (2) award a contract to Pacific Stihl to conduct the 2008 Leaf Blower Exchange Program in an amount not to exceed $266,925. 7. Execute Truck Fleet Modernization Contracts for Carl Moyer Program and Transfer Carl Moyer Program Funds to Clean Fuels Fund to Fund Backup Projects

On April 4, 2008, the Board approved release of a Program Announcement to solicit projects at a cost not to exceed $6 million under the Carl Moyer Truck Fleet Modernization Program. These projects are evaluated on a first-come, first-served basis, and are submitted on a monthly basis to the Board for approval. This action is to execute fleet modernization contracts from the Carl Moyer Program Fund SB 1107 Account. This action is also to transfer Carl Moyer Program Funds to the Clean Fuels Fund to fund backup projects.

8. Recognize Funds from CARB under Proposition 1B Goods Movement Emission Reduction Program and Issue Program Announcement for FY 2007-08

In November 2006, voters approved $1 billion in bond funding, which established the Proposition 1B Goods Movement Emission Reduction Program to reduce emissions from the movement of goods along California’s trade corridors. On April 26, 2008, CARB staff recommended the first year award of $24,037,500 to the AQMD and $98 million to the Ports of Los Angeles and Long Beach for selected source categories, which amounts to $122 million for the South Coast region. This recommended award was approved by CARB Board on May 22, 2008. This action is to recognize this $24,037,500 under Proposition 1B contingent upon CARB Board approval and to approve the release of a Program Announcement to solicit on- and off-road goods movement emission reduction projects in the approved categories. 9. Issue Purchase Order for Energy Dispersive XRF Spectrometer System

In November 2007, the Board approved the release of an RFQ to purchase an Energy Dispersive XRF Spectrometer System (EDXRF). Four bids were received and evaluated by staff. Only one bidder was qualified. This action is to issue a purchase order to PANalytical® Corporation for $129,900 for an EDXRF. Funds for this purchase are available in the FY 2007-08 Budget. 10. Issue Purchase Order for Automated Gas Chromatograph System

In February 2008, the Board approved release of an RFQ to purchase a gas chromatograph system. The U.S. EPA has provided funding for this analytical instrument as part of the PAMS grant fund allocation. Only one bid was received and evaluated. This action is to issue a purchase order to Entech Instruments at a cost of $81,362.59 for an automated gas chromatograph system. (Review: Administrative Committee, May 9, 2008)

11. Approve Contract Extension for Investment Consultant Services for Three-Year Period

Since November 1996, the AQMD has utilized the services of an Investment Consultant to assist staff in the administration, compliance, and investment of AQMD cash balances. 12. Adopt Resolution and Memorandum of Understanding Directing Specific Investment of Excess AQMD Funds by Los Angeles County Treasurer

On September 8, 1995, the Board adopted Resolution No. 95-20 authorizing the investment of AQMD funds by the Los Angeles County Treasurer. The Los Angeles County Treasurer, AQMD’s Treasurer, has requested that the AQMD adopt a new Resolution and a Memorandum of Understanding in order to better define the exact roles and responsibilities of the depositor and the Treasurer as related to the Specific Purpose Investment portfolio. 13. Recognize Revenue from CARB and Execute Agreement and Amend Contract to Complete AB 1222 Pilot Program to Assess Remote Sensing Device Technology to Measure Locomotive Emissions

AB 1222 (Jones) directs CARB to conduct a pilot program to determine the feasibility of using remote sensing technology to quantify emissions from locomotives. In July 2006, the Board recognized and received $100,000 from CARB to ensure full implementation of AB 1222. Additional analysis requested by the AB 1222 Advisory Group necessitates an additional $20,000. CARB has agreed to provide $20,000 in support of the additional analysis. This action is to execute an agreement with CARB to receive funds from CARB and recognize the funds into the General Fund; appropriate $20,000 from the Undesignated Fund Balance to the FY 2007-08 Budget; and amend the contract with Environmental Systems Products Holdings, Inc. to complete the AB 1222 pilot program. 14. Cosponsor Research and Demonstration Projects with CARB

CARB research staff has requested cosponsoring on two projects including a health effects research project and an electric transit bus demonstration project. The health effects project will estimate in-vehicle pollutant exposure on freeways and major surface streets and the demonstration project will develop a commercially viable battery electric transit bus with 300 mile range. This action is to execute an agreement to cosponsor the health effects project and execute a contract to cosponsor the battery-electric bus demonstration project in an amount not to exceed $540,000 from the Clean Fuels Fund. The total cost of these projects is $2,785,000, which provides an overall cost-share of 19 percent. (Review: Technology Committee, May 16, 2008)

15. Adopt Resolution Recognizing Lower-Emission School Bus Program Funds Under Proposition 1B and Reallocate Infrastructure Funds

This action is to adopt a resolution accepting $70,100,000 in Proposition 1B Funds from CARB to replace and retrofit school buses in the Basin. Next month, staff will submit the program announcement for replacement and retrofit of school buses for Board approval. In addition, this action seeks approval to reallocate San Jacinto School District’s CNG infrastructure funds to Hemet School District, which will use the funds to expand its refueling facility to refuel San Jacinto’s CNG buses. 16. Authorize Purchase of CLASS System Production and Development Servers

On March 7, 2008, the Board approved release of an RFQ to select a vendor capable of providing production and development servers for a replacement of the current Clean Air Support System (CLASS) production and development servers in the most cost effective manner. As a result of successful responses to this RFQ, Zunesis Inc., on behalf of Hewlett Packard Company, was identified as capable of providing these products. This action is to authorize the purchase of CLASS system production and development servers from Zunesis Inc., on behalf of Hewlett Packard Company. 17. Authorize Purchase of Microsoft Windows Server Operating System Upgrades

On March 7, 2008, the Board approved release of an RFQ to select a vendor capable of providing Microsoft Windows server operating system upgrade licenses. As a result of successful responses to this RFQ, Advance Computer Services was identified as capable of providing these products. This action is to authorize the purchase of Microsoft Windows server operating system upgrade licenses from Advance Computer Services. 18. Issue RFQ to Establish List of Prequalified Vendors for Mailing Services

On December 7, 2007, the Board approved a prequalified list of vendors for mailing services. This prequalified list currently contains only two vendors. 19. Approve One Contract Modification and New Contract under MSRC’s FY 2007-08 AB 2766 Discretionary Fund Work Program

The MSRC approved a new contract award and additional funding for one existing contract under the FY 2007-08 AB 2766 Discretionary Fund Work Program. The new award is for a contract to be funded under the Rideshare 2 School Program. The additional funding was awarded to A-Z School Bus, one of the MSRC’s two school bus vendor contractors, providing alternative school bus incentives to four school districts. The MSRC seeks AQMD Board approval of this new contract award and one contract modification under the FY 2007 08 Work Program. AQMD Administrative Policies and Procedures No. 20 requires a biennial Districtwide fixed asset inventory, an annual Science and Technology Advancement inventory, and the disposal of fixed assets declared surplus. In 2007, the biennial Districtwide fixed asset inventory was conducted. This action is to approve removal of unlocated fixed assets and to declare as surplus the equipment and vehicles determined to be obsolete or broken and not worth repairing. Proposed Rule 314 - Fees for Architectural Coatings sets fees for manufacturers of architectural coatings to recover the cost of AQMD programs, and will provide staff with architectural coating quantity and emissions information for planning, compliance, and rule development. 42. Amend Rules 1186.1 – Less-Polluting Sweepers and 1196 - Clean On-Road Heavy-Duty Fleet Vehicles

Proposed amendments to Rules 1186.1 and 1196 will extend sunset dates by two years to allow acquisition of non-rule compliant vehicles where an approved Technical Infeasibility Certification has been issued based on unavailability of an alternative-fuel refueling station within five miles of vehicle storage or maintenance yards. The proposed amendments are in response to near term public fleet heavy-duty vehicle acquisitions that are located in service areas where alternative fuel refueling stations do not yet exist. 43. Amend Rule 1186 - PM10 Emissions from Paved and Unpaved Roads, and Livestock Operations

Staff recommends that the public hearing be continued to the July 11, 2008 Board meeting in order to fulfill the required 30-day publication of the hearing notice and the set hearing documents (Proposed Amended Rule 1186, Staff Report, and Notice of Exemption) can be downloaded here.  (EXE 92Kb)
Under the rule, street sweeper manufacturers are required to certify their equipment “pick-up efficiency” is at least 80 percent. It has been more than five years since any certification testing has been conducted and there is now a need to ensure that the overall performance of the sweepers can still be demonstrated in the event the manufacturer changes parts suppliers and/or modifies any sweeper specification from that on the originally configured model. The proposed amendment would require submission of data to demonstrate that the sweeper performance has not been affected by these changes and to establish a process that aftermarket parts suppliers may qualify to sell replacement parts while maintaining original certification. 44. Execute Contract with Allen D. Mednick to Provide Representation in Hearing Board Proceeding

This action is to execute a contract with Allen D. Mednick, former Principal Deputy District Counsel in the District Prosecutor’s Office, who retired from AQMD employment in September 2007, to provide representation in an AQMD Hearing Board case. Additionally, this action is to approve findings under Health and Safety Code section 40426.7, which requires the Board to make specific findings before contracting with certain District employees within 12 months following retirement. Sufficient funds are available in the FY 2007-08 Budget.
