The purpose of the proposed amendments is to harmonize the Best Available Control Technology requirements for attainment and non-attainment pollutants for both New Source Review and Prevention of Significant Deterioration programs, and to clarify that facilities that are in compliance or on an approved schedule for compliance with all applicable District Rules and Regulations may be issued permits in accordance with Regulation XIII. 3. Execute Contract to Evaluate Emission Control Technologies for Further Reducing Sulfur Oxides Emissions from Stationary Sources in SCAQMD SOx RECLAIM Program

On July 11, 2008, the Board approved release of an RFP to obtain proposals from qualified contractors with technical expertise and experience in sulfur oxides (SOx) emissions control technologies. Qualified contractor(s) would be selected to conduct engineering evaluations and cost estimates on existing commercially viable control technologies to further reduce SOx emissions from seven major emitting categories of stationary source equipment in the SCAQMD’s SOx RECLAIM program. This project would assist staff in identifying Best Available Retrofit Control Technologies to be implemented within the 2011-2014 time frame to help the Basin attain the PM2.5 ambient air quality standards. The funding will be reimbursed by the affected industries based on amendments to Regulation III in 2008. This action is to execute the contract with the firms listed in Table 1 for an amount not to exceed the specified amount.
 

4. Execute Contract to Cosponsor Evaluation of Impacts and Benefits of Plug-In Fuel Cell Hybrid Electric Vehicles

In 2000, the Electric Power Research Institute (EPRI) assembled a working group to compare the impacts and benefits of various hybrid electric vehicle (HEV) options. The resulting public study, cofunded by AQMD, evaluated HEV architecture, performance, modeling, costs and commercialization issues. Building on analyses and stakeholder engagement from this earlier study, EPRI is proposing to assemble a working group and develop a scope of work to evaluate the potential for a variety of plug-in fuel cell hybrid electric vehicle options. This action is to execute a contract with EPRI in an amount not to exceed $50,000 to share the initial task cost of $100,000. (Review: Technology Committee, July 25, 2008)

5. Appropriate Funds to Conduct Assessment of Alternate Methodologies for Rule 403 Compliance Monitoring

Recently developed PM monitoring technologies may provide for more efficient methods for Fugitive Dust Rule 403 compliance sampling. The aggregate mining industry has agreed to provide funding for a study to assess alternate sampling methodologies. In April 2008, the Board recognized and appropriated funds and approved the awarding of a contract to carry out the study. Due to unforeseen project delays, the contract was not finalized in FY 2007-08. This action is to appropriate funds in the FY 2008-09 Budget to conduct assessment of alternate methodologies. 6. Issue Program Announcement for Electric Lawn Mower Vendors

Staff proposes to extend the successful Lawn Mower Exchange Program by offering similar incentives in the spring of 2009 to generate cost-effective emission reductions. This action is to issue a program announcement to solicit competitive bids from cordless electric lawn mower manufacturers in sufficient quantities and at the lowest possible price for the expanded 2009 program. 7. Execute Contract to Cosponsor Clean Air Challenge Program

As part of the BP/ARCO Settlement Funds, the Board approved cofunding for development of the Clean Air Challenge Program to train middle and high school science teachers about air quality, health effects, and cleaner technologies. The Clean Air Challenge Program held eight workshops and trained 232 middle and high school science teachers and 27,840 students the district with cofunding from AQMD, Shell, and the City of Riverside. This action is to execute a contract with Clean Air Now to continue and expand the Clean Air Challenge Program. The total cost for this project is approximately $150,000, with AQMD cost share not to exceed $60,000 from the Clean Fuels Fund. (Review: Technology Committee, July 25, 2008)

8. Execute Contracts under Carl Moyer Fleet Modernization Program

On April 4, 2008, the Board approved the release of a Program Announcement to solicit projects at a cost not to exceed $6 million under the Carl Moyer Fleet Modernization Program. These projects are evaluated on a first-come, first-served basis and are submitted on a monthly basis for Board approval. This action is to execute fleet modernization contracts from the Carl Moyer Program Fund SB 1107 Account.

9. Recognize Funds from CARB and Execute Contracts Under Carl Moyer Multi-District Program and Surplus Off-Road Opt-In for NOx Provision of State In-Use Off-Road Vehicle Regulation

CARB has allocated $1,838,865 to the AQMD under the “Year 10” Carl Moyer Multi-District Program. This action is to recognize $1,838,865 from CARB and execute multi-district contracts for projects selected by CARB in an amount not to exceed $1,751,300. The remaining balance of $87,565 is designated for administrative costs. This action is also to execute contracts under the Surplus Off-Road Opt-In for NOx provision of the state in-use off-road vehicle regulation in an amount not to exceed $605,056 from the Carl Moyer Program Fund SB 1107 Account. 10. Allocate and Disburse Funds to Assist in Purchase of Natural Gas Vehicles for Taxicab Services

There continues to be a demand for pre-owned older gasoline Ford Crown Victorias for taxicab service. The AQMD has been providing funding assistance for new natural gas powered Crown Victorias, which are certified by BAF Technologies to the SULEV emissions standard. This action is to authorize the allocation and disbursement of $750,000 from the Clean Fuels fund to assist in the purchase of natural gas powered vehicles for taxicab operations at commercial airports. 11. Approve Expenditures for Activities and Projects During FYs 2008-09 and 2009-10, Execute Contracts, and Recognize Funding from Participating Members of California Natural Gas Vehicle Partnership

On April 5, 2002, the Board approved establishment of a California Natural Gas Vehicle Partnership (CNGVP) Fund and authorized the Executive Officer to approve up to $50,000 for individual expenditures for projects selected by the CNGVP, total amount not to exceed $200,000. The participating members pay two-year membership fees to fund program administration, specific projects, and activities to achieve the goals of the CNGVP. This action is to: (1) recognize funding from participating and future CNGVP members; (2) transfer $25,000 from the Clean Fuels Fund as AQMD’s contribution; (3) execute two contracts with Gladstein, Neandross and Associates for CNGVP web maintenance in an amount not to exceed $70,000 and to organize the Bio-Methane Summit in an amount not to exceed $25,000; and (4) authorize the Executive Officer to approve up to $50,000 for individual expenditures selected by the CNGVP in FYs 2008-09 and 2009-10, total amount not to exceed $250,000 for each fiscal year. 12. Execute Contracts for Short- and Long-Term Systems Development, Maintenance and Support Services

On May 2, 2008, the Board approved the release of an RFP to obtain short- and long-term systems development, maintenance and support services. This action is to execute contracts to obtain these services on a task order basis. Executing contracts with multiple bidders provides a pool of well-qualified professionals who have demonstrated their understanding of and expertise in meeting agency needs and enables AQMD to obtain cost-effective and technically responsive support. 13. Authorize Purchase of Desktop Computer Hardware Upgrades

AQMD operational efficiency is dependent on staffs' desktop computer systems, and many software applications (both off-the-shelf and in-house developed applications) are exceeding the capacity of the present desktop systems. This action is to authorize the purchase of new desktop computer systems, with adequate capacity to support current software applications, to replace older desktop systems. These replacements are in accord with AQMD's Information Management Strategic Plan. Funds ($150,000) for this purchase are included in the FY 2008-09 Budget. 14. Appropriate Funds for Stakeholders Database Development and Software Implementation

AQMD has created a global contacts database on its Microsoft Outlook Exchange Server to hold contact information needed for outreach efforts. Although the MS Office software suite contains functionality to target and distribute emails for outreach efforts, additional software is necessary to provide full functionality for targeted outreach. Other available software packages, such as Customer Relationship Management, that are specifically designed to perform the type of outreach needed across the agency will be reviewed and evaluated. This action is to appropriate $100,000 for the acquisition and implementation of the recommended software package. Funds ($100,000) for this purchase are available in the Undesignated Fund Balance in the FY 2008-09 Budget. (Review: Administrative Committee, July 18, 2008)

15. Amend Contract with Cordoba Corporation to Continue Implementation of Air Quality Institute

Since January 2006, the Board has authorized the implementation of several Air Quality Institute (AQI) programs to disseminate information and educate community, business, and industry leaders and elected officials on air quality issues. On June 1, 2007, the Board approved the last phase of the AQI, through a contract with Cordoba Corporation, with options for two one-year term renewals, upon satisfactory performance, and at the Board's discretion. Much progress has been made in this area, and it is important to keep up the momentum, with focus on special interest groups and policy leaders in the future. Since the previous contract expires in September 2008, this action is to approve the first extension of the Cordoba Corporation contract to continue the implementation of the AQI, at a cost not to exceed $135,300, which represents the amount authorized last year plus a CPI increase. 16. Purchase Wireless Data Service for Compliance Staff

This action would authorize the purchase of wireless data cards and service for 121 Inspectors, 21 Supervisors, and 3 Senior Staff Specialists, to enhance inspection efficiency by providing field staff with real time access to AQMD’s permitting, compliance and financial databases from the field. First year costs to acquire the wireless data cards and provide service for the remainder of FY 2008-09 will not exceed $75,000. Recurring annual cost for the service is estimated at $87,000. To enhance efficiency and meet current program needs, this action is to delete a vacant Senior Staff Specialist position and add a Program Supervisor position in Planning, Rule Development, and Area Sources and to delete a vacant Air Quality Specialist position and add a Public Affairs Specialist position in Public Affairs. The net annual top-step salary and benefits budgetary savings of these changes is approximately $11,562. (Review: Administrative Committee, July 18, 2008)

18. Amend Contract with Allen D. Mednick for Continued Representation in Hearing Board Proceeding

This action is to amend the contract with Allen D. Mednick, former Principal Deputy District Counsel in the District Prosecutor's Office, who retired from AQMD employment in September 2007. The Board, at its June 6, 2008 meeting, authorized a $50,000 contract with Mr. Mednick. This action is to increase the contract amount by $30,000 to provide continued representation in an AQMD Hearing Board case and extend the termination date to January 31, 2009. Sufficient funds are available in the FY 2008-09 budget.
 

19. Award Contract Modifications and Awards under FYs 2007-08 and 2008-09 AB 2766 Discretionary Fund Work Programs

The MSRC approved multiple new and replacement contracts and modifications under the FYs 2004 05 and 2008 09 AB 2766 Discretionary Fund Work Programs. These include additional funding for alternative fuel school bus incentives, contracts awarding funds for the purchase of heavy-duty natural gas vehicles by local governments, and a contract to provide incentives for the purchase of natural gas home refueling units. The MSRC seeks AQMD Board approval of additional FY 2008 09 Work Program elements as well as these new and replacement contracts and modifications under the FYs 2004 05 and 2008 09 Work Programs. On June 6, 2008, the Board approved a list of agencies as prequalified to provide temporary employment services for the next three years. Due to a technical error, eight agencies that met qualification requirements were omitted from the list. 21. Amend Board Member Assistant and Board Member Consultant Policy

The Board Chairman brought to the Administrative Committee a suggestion that Board Consultants be paid on a monthly rather than hourly basis. This item revises the Board Member Assistant and Board Member Consultant policy to permit this option and updates the policy to incorporate other Board-approved provisions related to Board Member Assistants and Board Member Consultants.
