demands made of the position, that the Executive Officer contract be revised to

General Counsel Office that would include both District Counsel and District
Prosecutor functions. To appropriately staff the unit, staff recommends
establishing pay rates for General Counsel, District Counsel, and District
Prosecutor and adding an additional Principal Deputy District Counsel and
deleting an existing Sr. Deputy District Counsel position in both counsel and
prosecutor units. The net budgetary impact of these changes is approximately
$18,690, and sufficient funds are available in the FY 2008-09 Budget. (Review:

5. Execute Contract for Air Pollutant

On April 4, 2008, the Board approved release of an RFP to conduct air pollutant
measurements aloft for the AQMD. The contract effort will assist with air
quality model evaluation and the assessment of regional air quality model
boundary conditions, by developing an annual profile of model boundary
conditions and studying seasonal variations of ozone aloft. This will be
accomplished with a combination of measurements from aircraft and balloon
platforms. This action is to execute a contract in the amount of $150,000, with
an option to add funds for additional measurements in FY 2008-09, based upon
availability of funds and satisfactory contractor performance. The initial
funding for this contract in the amount of $150,000 is budgeted in FY 2007-08,
as allocated from the U.S. EPA Section 105 Grant, for the 16th year of the PAMS

Execute Agreement and Contract to Develop and
Demonstrate Stationary Emission Control Systems for Locomotives and Marine
Vessels

In August 2006, the Advanced Locomotive Emission Control System (ALECS) was
demonstrated at a rail yard in Roseville, CA. The ALECS consists of a bonnet
arrangement to collect emissions from locomotives being serviced and a
ground-mounted emission treatment system. Further development of the ALECS is
proposed. In addition, the Ports of Long Beach and Los Angeles are proposing to
demonstrate the Advanced Marine Emission Control System (AMECS) on a berthed
ship. A different bonnet arrangement is used to collect the ship emissions and
treat them with the same emission treatment system as the ALECS. This action is
to execute an agreement with Placer County APCD in an amount not to exceed
$50,000 for ALECS, and to execute a contract with Advanced Cleanup Technologies,
Incorporated in an amount not to exceed $55,000 for AMECS. (Review: Technology

in-use off-road vehicle regulation. These actions are to execute contracts under
the Carl Moyer Program and the SOON Provision with funds from the Carl Moyer

10. Recognize Additional Early Grant Funds
under Proposition 1B from CARB, and Amend Early Grant Awards under Proposition
1B Goods Movement Emission Reduction Program

In January 2008, CARB awarded $13.8 million to the AQMD for Early Grant projects
under Proposition 1B Goods Movement Emission Reduction Program. In May 2008, the
Board recognized $13.8 million from CARB and approved execution of contracts to
replace 260 pre-2003 heavy-duty diesel trucks with 2007 or newer diesel and LNG
trucks. In the June 3, 2008, FY 2007-08 Early Grant Agreements, CARB increased
the total number of trucks to be funded by three trucks, including two drayage
and one non-drayage trucks. In order to allocate funds for the additional
trucks, CARB increased AQMD’s Early Grant amount by $7,500 from $13,800,000 to
$13,807,500 and decreased the administrative funds from $800,000 to $657,500.
This action is to receive these additional funds and amend appropriate

11. Execute Contract to Conduct Natural Gas
Hearth Product Buy-Down Pilot Program

On March 7, 2008, the Board approved release of a Program Announcement to
solicit bids from qualified contractors to implement an incentive program to
provide the public with financial assistance to replace existing wood burning
fireplaces with cleaner gas log sets. This action is to award the contract to
the team of Rasmussen Iron Works/Robert H. Peterson Co. to implement the gas log
buy-down pilot program in an amount not to exceed $500,000 to be executed until
all funds are exhausted. Funding for this action was previously designated from
the AQMD Rule 1309.1 (Priority Reserve) account. (Review: Administrative

12. Execute Contracts for CEQA Analysis for
Expansion and Modernization of Union Pacific Intermodal Container Transfer
Facility

The AQMD has entered into a Memorandum of Agreement with the Intermodal
Container Facility Joint Powers Authority (JPA) to prepare the CEQA documents
for the proposed expansion and modernization of the Union Pacific’s Intermodal
Container Transfer Facility railyard in the cities of Los Angeles and Carson.
The funding for preparation of the CEQA documents will come from the JPA. The
scope and schedule for preparation of the CEQA documents for the proposed
project requires the AQMD to obtain the services of consultants with experience
in assessing impacts on air quality, health risk, noise, light and glare,
traffic, and intermodal shifts. This action is to authorize the Executive
Officer to execute contracts for these services, for the consultants and in the
amounts listed in the Board letter. Total funding for these contracts will
potentially be approximately $750,000, to be paid by the AQMD and reimbursed by
JPA. The JPA has estimated $2.5 million for preparation of the CEQA documents.

13. Execute Sole Source Contract for AQMD

The current service agreement with LexisNexis to provide AQMD with on-line legal
research libraries ends July 31, 2008. This action is to execute a new
three-year contract with LexisNexis. A sole source contract is necessary since
AQMD secures such services under the State of California's Master Service

14. Execute Agreement to Cosponsor Development and
Demonstration of Hydraulic-Hybrid Shuttle Bus

Hydraulic-hybrid drive systems for vehicles are currently under development.
Hydraulic hybrid systems capture braking energy as compressed gas and re-use
this energy for propulsion through the use of special hydraulic pump/motors in
the drivetrain. The U.S. EPA has been developing a series hydraulic hybrid
system with a Homogeneous Charge Combustion Ignition engine. This engine and
drive system have the potential for extremely low emissions and greatly improved
fuel economy in heavier vehicles. This action is to propose a Cooperative
Research and Development Agreement with Navistar, Eaton Corporation, US Army
National Automotive Center and the U.S. EPA for the next stage of development
and demonstration of this system in a shuttle bus. The total cost of this
project is estimated to be $1,960,000 with AQMD funding not to exceed $500,000

15. Execute Truck Fleet Modernization

16. Approve Grants for Replacement of
Remaining Pre-1977 School Buses in Basin and Issue Program Announcement for
Replacement and Retrofit of School Buses

school buses in the Basin. This action is also to approve the release of a
Program Announcement for the replacement and retrofit of school buses with funds

approximately $67.4 million, comprised of approximately $47.4 million for
replacement of pre-1987 school buses with new CNG buses, and $20 million for

contracts, totaling over $65 million, every year. Such large programs have
on-going administrative, outreach, education and other directly-related
activities which require resources and support. Each fiscal year, staff requests
fund transfers to allow support for such activities throughout the year. This
action is to transfer $600,000 from the Clean Fuels Program Fund and $300,000
from the Carl Moyer Program AB 923 Fund to the FY 2008-09 Budget of Science &
Technology Advancement, Services and Supplies Major Object, Professional and

18. Authorize Purchase of Off-site Storage and
Destruction Services

The AQMD maintains over 3,500 cubic feet of paper records in off-site storage.
The AQMD also performs nightly tape backup onto magnetic tape for the various
minicomputers and file servers under Information Management’s control. Record
retention and best effort in vital protection require off-site storage of these
paper records and computer tapes in case of fire, earthquake or any other
natural disaster. The AQMD’s Records Retention Policy also requires the
destruction of all records and information that have reached the limit of their
retention period. This action is to obtain approval for the sole source purchase
of off-site storage services, for one year, for paper records and nightly
back-up tapes, and destruction services for paper records and microfiche. Funds
for this purchase ($79,940) are included in the FY 2008-09 Budget. (Review:

PeopleSoft Integrated Financial/Human Resources System uses Oracle database
software. The maintenance support for this system expires August 29, 2008. The
AQMD’s Liberty Imaging System provides District users access to records
maintained in electronic format. Support for this system will expire on July 31,
2008. This action is to obtain approval for the purchase of PeopleSoft, Oracle
and LibertyNet software maintenance support for another year. Funds ($296,600)

20. Amend Contract for Incentive Buy-Down Program
for CNG Home Refueling Appliance

On May 6, 2005, the Board approved matching funds with the MSRC and provided
$400,000 for a buy-down incentive program for 400 natural gas home refueling
appliances (HRAs) to broaden the consumer base for light-duty NGVs. Funding for
the 400 HRAs was allocated in two contracts: 100 purchases through FuelMaker
Corp. and 300 leases through American Honda. In February 2007, the Board
de-obligated $250,000 from the lease program and apportioned this amount to the
purchase program and commenced an AQMD-only sponsored purchase incentive of
$2,000 per HRA. Overwhelming response to the buy-down incentive program
continues for the purchase of an HRA prompting this action to amend the
FuelMaker contract to add $146,000 from the Clean Fuels Fund. (Review:

administrative functions for permit streamlining and compliance enhancements,
this action is to delete a Senior Air Quality Engineer position and to add an
Air Quality Analysis and Compliance Supervisor position in Engineering and
Compliance. The net annual top-step salary and benefits cost of this change is
approximately $13,965, sufficient funds exist in the approved FY 2008-09 Budget.

The MSRC approved additional funding for A Z Bus Sales’ contract under the FY
2007-08 AB 2766 Discretionary Fund Work Program, enabling A Z Bus Sales to
provide CNG bus incentives to three school districts. The MSRC also approved
multiple awards and augmented funds for eight previously awarded contracts under
its FYs 2007-08 and 2008-09 AB 2766 Discretionary Fund Work Programs for local
government match projects, alternative fuel infrastructure, CNG taxicab
vehicles, and 0.2 gram engines. Additionally, every year the MSRC adopts an
Administrative Budget which includes transference of funds to the AQMD FY 2008
09 Budget to cover administrative expenses. The MSRC seeks AQMD Board approval

Under the rule, street sweeper manufacturers are required to certify their
equipment “pick-up efficiency” is at least 80 percent. It has been more than
five years since any certification testing has been conducted and there is now a
need to ensure that the overall performance of the sweepers can still be
demonstrated in the event the manufacturer changes parts suppliers and/or
modifies any sweeper specification from that on the originally configured model.
The proposed amendment would require submission of data to demonstrate that the
sweeper performance has not been affected by these changes and to establish a
process that aftermarket parts suppliers may qualify to sell replacement parts

rule language. To accomplish this, the staff proposal adds/modifies definitions

Rule 1610 - Old Vehicle Scrapping, encourages the accelerated retirement of
older vehicles which emit a disproportionate amount of air pollution and
provides a mechanism to generate mobile source emission reduction credits. The
objective of the proposed amendment to Rule 1610 is to harmonize the rule with
recent changes made to CARB's Title 13, California Code of Regulations, Chapter
13, Article 1, Sections 2601 - 2610 Voluntary Accelerated Light-Duty Vehicle
