In September 2002, the state Office of Environmental Health Hazard Assessment finalized chronic risk values for two compounds. Rule 1401(e)(2) and (e)(3) require an analysis and report to the Board before new and updated risk factors, respectively, are used for air toxics new source review. Proposed amendments to Rule 1401 will update the list of compounds and effective dates in Table I. The amendments will also include a proposal to move to an annual update of state approved risk factors instead of the current 150-day requirement. In addition, Rule 1402(j)(4) requires an analysis of the potential impacts on sources subject to Rule 1402 prior to use of new or updated risk factors for facility-wide health risk assessments. 3. Execute Contract to Cosponsor Development and Evaluation of Multiple Vehicle Type Expansion of Shared Electric Vehicle System

Recent research has shown that in order to maximize the overall effectiveness of shared vehicle systems, multiple vehicle types should be used to capture the widest range of possible travel demand. This project will expand the UCR Intellishare system beyond its current vehicle fleet of 15 homogenous electric vehicles to integrate additional vehicles and vehicle types. This adds complexity, but will be necessary to effectively manage large commercial vehicle allocation systems. Valuable operational data is collected daily on system operation, users, and vehicles. The total cost for this project is $522,094, with AQMD's contribution not to exceed $95,336 from the Clean Fuels Fund. (Review: Technology Committee, October 25, 2002)

4. Amend Recipient for Forklift Projects under the State Emissions Mitigation Program

On March 1, 2002, the Board approved the execution of contracts to generate emission credits under the State Emissions Mitigation Program. Southern California Edison was identified as the award recipient for two forklift projects. These projects involve the replacement of twelve propane-powered forklifts with twelve electric forklifts. In a letter dated November 1, 2002, Southern California Edison indicated they prefer the two contracts for the forklift projects be executed with the equipment owner and operator, Beauchamp Distributing Company. AQMD staff recommends amending the recipient for the forklift projects to Beauchamp Distributing Company, with no change in the amount of funding approved by the Board on March 1, 2002. 5. Execute Contracts for Purchase of Equipment to Establish Air Monitoring Station in Mira Loma

Recent studies have shown the Mira Loma area of Riverside County to have among the highest particulate matter levels in the SCAQMD. Ambient air monitoring currently conducted in Mira Loma under the CARB Children's Health Study is scheduled to expire at the end of December 2004. There has been a desire by staff and the community to establish a permanent air monitoring station to continue to monitor air quality trends in the Mira Loma area. This action is to execute sole-source contracts with various vendors for the purchase of ambient air monitoring equipment necessary to establish the permanent site, at a cost not to exceed $120,000. Staff is requesting that $35,100 of the $120,000 be transferred from the FY 2002-03 Capital Outlays Major Object to the Services and Supplies Major Object. These transferred funds will be used to provide services for, and implement, the new station. Funds for these purchases are available in the FY 2002-03 Budget. 6. Issue RFP for Demonstration of Technologies to Reduce PM Emissions From Airport Ground Support Equipment in South Coast Air Basin

As air travel demands increase, the use of ground support equipment (GSE) to support airport operations has steadily grown and contributed to relatively uncontrolled airport emissions. This action to release an RFP is in response to the need to demonstrate control technologies on GSE to reduce particulate matter emissions. On June 4, 2002, CARB provided $500,000 to the AQMD from the NOx and PM Emission Reduction Credit Program for the purpose of funding ground support equipment emission reduction projects at airports located in the South Coast Basin. The Air Transport Association (ATA) is expected to provide a $500,000 match funding. Of that amount, ATA may use up to 15 percent for its oversight. Total funding available for this RFP may amount up to $1,000,000. (Review: Technology Committee, November 22, 2002)

7. Approve Issuance of Program Announcement & Application to Solicit Projects Under CARB Emission Reduction Credit Bank

On March 8, 2001, CARB was directed by Executive Order of Governor Gray Davis to establish an emission reduction credit (ERC) bank. Subsequently, CARB and the AQMD entered into an agreement to implement this program for powerplant peaking units located in the South Coast Basin. In July 2001, the AQMD issued two letters of transactions to Wildflower Energy and Alliance Colton, LLC for credit usage in offsetting NOx and PM10 emissions. In exchange for these emission reduction credits AQMD collected a total of $675,550 from Wildflower Energy LP and Alliance Colton, LLC. Staff recommends issuance of a Program Announcement and Application to fund emission reduction programs near these facilities and/or within Inland counties with the collected funds. 8. Approve Grants to Purchase up to 65 New CNG School Buses and Infrastructure, and Retrofit up to 447 Diesel Buses with PM Traps

On July 12, 2002, AQMD issued Program Announcement & Application PA2003-05 "Lower-Emission School Bus Replacement and PM Trap Retrofit Program" soliciting applications for new CNG buses and PM traps. Sixteen public school districts applied for 153 new CNG school buses, and seventeen public school districts and private operators applied for 614 PM traps. Staff recommends the approval of school bus replacement awards for 38 CNG buses, in an amount not to exceed $4,951,900. Staff also recommends funding 237 PM traps, to retrofit 1994 and newer diesel buses in an amount not to exceed $1,659,000. In addition, staff recommends funding up to 27 school bus replacements and up to 210 school bus retrofits in a total amount not to exceed $5 million upon receipt of expected funds from U.S. EPA. 9. Execute Contract to Purchase Voice Mail System Upgrade

On September 13, 2002, the Board approved the release of an RFQ to select venders capable of providing the most cost effective voice mail system upgrade. Our current Meridian Mail software (version 13.12.1) has reached its maximum capacity and can no longer be upgraded to more advanced applications. Staff recommends upgrading the voice mail system to CallPilot, the second generation of Nortel voice mail system. This action is to execute a contract for CallPilot voice mail system. Funds for this purchase ($175,000) are included in the FY 2002-03 Budget. (Review: Administrative Committee, November 8, 2002)

10. Execute Contract for Travel Agency Services

On March 1, 2002, the Board authorized the issuance of an RFP for travel agency services. On June 7, 2002, the Board approved the award for travel agency services to Managed Air Resources for one year with an option to renew for two additional years. On November 11, 2002, the contract with Managed Air Resources was terminated due to performance issues. This action is to award a contract to the second ranked bidder, The Bonneville Company, for one year with an option to renew for two additional years. Based on AQMD's current travel volume, the estimated cost for travel agency services is approximately $20,000 per FY. (Review: Administrative Committee, November 8, 2002)

11. Transfer Funds from Executive Officer Mitigation Account and Authorize Establishment of Five-Year Inspector Enhancement Program for the Marine Vessel Credit Generation Rule and Port Area Air Quality Program Enforcement

Staff proposes transfer of $800,000 from the Executive Officer Mitigation Account to the General Fund to support a five-year enforcement enhancement in the port area communities. Two Air Quality Inspector III positions are proposed to enforce Rule 1631 - Pilot Credit Generation Program for Marine Vessels, and other mitigation account and/or power plant emission related activities. 12. Amend AQMD Conflict of Interest Code

The Political Reform Act requires the AQMD to review its Conflict of Interest Code biennially and submit notice to the Board regarding its accuracy or the need to amend to reflect the addition, reclassification, renaming, or deletion of designated positions. As a result of personnel changes during the past two years, the Code must now be amended. Individuals holding designated positions are required to disclose certain investments, income, interests in real property, business entities and business positions and also may have to disqualify themselves from making or participating in the making of governmental decisions affecting those interests.

22. Implementation Status of Control Measure WST-01 - Emission Reductions from Livestock Waste

Proposed Rule 1127 is being developed to implement control measure WST-01 from the 1999 Amendment to the 1997 Ozone SIP. The 1999 Ozone SIP requires that PR 1127 be adopted in 2002 and implemented beginning in 2004. The SIP calls for a 3.3 ton/day reduction of dairy VOC emissions by the year 2006. Control Measure WST-01 calls for reductions associated with dairy relocation and the implementation of water quality regulations adopted in 1999 to be accounted for in determining the additional control required for remaining dairies. This report documents the reductions in dairy waste VOC emissions achieved without air quality regulations and compares them to the SIP requirements. 33. Amend Salary Resolution to Add Terms and Conditions of Designated Deputy At-Will Employment

The Board's Personnel Committee brought to the Board in closed session recommendations regarding negotiations with Designated Deputies concerning terms and conditions of at-will employment, including compensation. Following that discussion, the Board directed the Executive Officer to prepare an amendment to the Salary Resolution to incorporate the basic terms and conditions of existing employment agreements with Designated Deputies, but eliminating the pay-for-performance provision and appointment end dates and making the Executive Officer responsible and accountable for making and ending Designated Deputy appointments. The Board also directed the Executive Officer to recommend salary adjustments that would appropriately compensate for elimination of pay-for-performance, recognize comparable public-sector salaries, and adjust pay differentials with respect to subordinates. The Salary Resolution amendment, including compensation adjustments, would apply to new appointments and to those Designated Deputies who voluntarily agree to give up existing contracts.

34. Approve Blue Ribbon Panel Recommendations Regarding Operations of Board Advisory Groups

In May 2001, the Board's Administrative Committee initiated a Blue Ribbon Panel to review the operation of six Board Advisory Groups and the Advisory Council and make appropriate recommendations to enhance their effectiveness. The Panel has held four meetings and formulated specific recommendations for the following Advisory Groups: AQMP; Ethnic Community; Home Rule; Local Government & Small Business Assistance; Scientific, Technical & Modeling Peer Review; and Technology Advancement. These recommendations address areas of general enhancement, specific charter adjustments, reporting to Board Committees, membership, and annual review of goals and objectives. When Rule 461 was amended in April of 2000, the Board directed staff to evaluate the effectiveness of reverification test schedules in improving compliance and to reassess the test schedules in conjunction with the in-station diagnostic system requirements of the statewide enhanced vapor recovery program. The Risk Assessment Procedures for Rules 1401 and 212 is a dynamic document updated as risk values or procedures are revised pertaining to permitting under Rule 1401 and Rule 212. Recent sampling and analysis efforts associated with the rulemaking process for Proposed Amended Rule 1421 - Control of Perchloroethylene Emissions from Dry Cleaning Systems has resulted in changes to screening values for risk associated with perchloroethylene dry cleaning equipment. Staff is recommending establishment of a financial incentives grant program to assist dry cleaners and accelerate transitioning to non-perchloroethylene (perc) alternative cleaning technologies before the rule compliance dates. This program is independent of proposed amendments to Rule 1421, which will reduce perc from dry cleaning operations through a gradual transition to non-perc alternatives. 38. Amend Rule 1421 - Control of Perchloroethylene from Dry Cleaning Operations

Proposed Amended Rule 1421 will reduce perchloroethylene (perc) from dry cleaning operations through a gradual transition to non-perc alternatives. This amendment was developed to implement part of the Air Toxics Control Plan approved by the Board in March 2000, and the source-specific measures as part of the Rule 1402 adoption process. Proposed amendments to Regulation XIII will improve the effectiveness of AQMD's New Source Review program by providing new and expanding stationary sources with additional options to offset emissions increases. The proposed amendments are in response to AQMD Chairman Glover's Strategic Alliance Initiative #1, approved by the Board in May 2002. The proposed amendments promote the generation and use of short-term credits; increase the time to file for Emission Reduction Credits; and create a new emissions bank as a backstop. 40. Amend Rule 1113 - Architectural Coatings

Rule 1113 Architectural Coatings, which was amended on May 14, 1999, achieves approximately 21.8 tons per day of VOC emission reductions. That amendment has been determined by the appellate court to have been improperly adopted. To ensure that VOC reductions are still timely achieved, staff is proposing to re-adopt the May 14, 1999 amendments with proposed changes to various compliance dates and other clarifying changes, while vacating the specific amendments adopted on May 14, 1999. 41. Amend Rule 1122 - Solvent Degreasers

The proposed amendment will extend the sunset date for the exemption in (k)(l)(D) for degreasers with open-top surface areas less than 1.0 square foot, or with a capacity of less than 2 gallons, and used only for electrical, high precision optics or electronics applications; or aerospace and military applications for cleaning solar cells, laser hardware, space vehicle components, fluid systems, and components used solely in research and development programs, or laboratory tests in quality assurance laboratories. 42. Amend Rule 1173 - Control of Volatile Organic Compound Leaks and Release from Components at Petroleum Facilities and Chemical Plants

The proposed amendments will further reduce fugitive VOC emissions from components at petroleum facilities and chemical plants by requiring an inspection and repair program for heavy liquids, and reducing the leak thresholds and time to repair components in light liquid service. The amendments will also require the monitoring and reporting of releases from pressure relief devices. PAR 1173 implements portions of 1997/99 AQMD control measures FUG-04 and FUG-05. 43. Amend Rule 1610 - Old-Vehicle Scrapping

The proposed amendments will modify Rule 1610 where necessary to be consistent with CARB's recently amended statewide vehicle scrapping requirements. The amendments include the following: an extension of vehicle eligibility to 1982 and later models; changes to Smog Check, vehicle eligibility and registration-related requirements; and updates to the emission credit values for scrapped vehicles. At the April 5, 2002 Board meeting, the Board received and approved a report on controlling VOC and ammonia emissions from composting and related operations. Based on this report, the Board directed staff to proceed with rulemaking and development of a series of rules for this industry. Proposed Rules 1133, 1133.1, and 1133.2 would implement Control Measure WST-02 - Emissions Reductions from Composting, which was included in the 1994 and 1997 AQMPs, and in the 1999 amendments to the 1997 Ozone SIP for the South Coast Air Basin. These proposed rules would: 1) establish a registration and annual reporting program for composting-related facilities (PR 1133); 2) develop holding and processing time requirements for greenwaste chipping and grinding activities (PR 1133.1) to avoid inadvertent decomposition; and 3) reduce VOC and ammonia emissions from co-composting operations (PR 1133.2). Members of the public are afforded an opportunity to speak on any listed item before or during consideration of that item. Please notify the Clerk of the Board, (909) 396-2500, if you wish to do so. All agendas are posted at AQMD Headquarters, 21865 E. Copley Drive, Diamond Bar, California, at least 72 hours in advance of the meeting. At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under Public Comments may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record, provided 25 copies are presented to the Clerk of the Board. Electronic submittals to cob@aqmd.gov of 10 pages or less including attachments, in MS Word, plain or HTML format will also be accepted by the Board and made part of the record if received no later than 5:00 p.m., on the Tuesday prior to the Board meeting.
