Proposed Amendments to Title V rules will improve clarity, increase flexibility and enhance enforceability of the program and Title V permits. Amendments will reduce the number of facilities required to obtain a Title V permit during the first three years of the program and streamline the procedures for public, affected State and EPA reviews. Proposed amendments to Rule 212 will revise public notice requirements for permit issuance and modify the notice distribution distance to comply with current legal noticing requirements for hazardous air emissions from sources locating near schools. This item is scheduled for review by the Stationary Source Committee on September 19, 1997.

4. Execute Contract to Cost-Share Development of Low-Cost Natural Gas Compressor and Natural Gas Vehicle Refueling Station

Tecogen has proposed the development of an innovative low-cost natural gas compressor and NGV refueling station. The objective of the proposed project is to substantially reduce a major barrier to the market penetration of NGVs, namely the high cost of purchasing, installing and operating NGV refueling stations in small public and private fleets with 10 to 15 vehicles. The total cost of this project is $1,016,000. The proposed AQMD cost-share is $250,000 for the development phase and, if successful, an additional $150,000 for a future field demonstration phase. This item was reviewed by the Technology Committee on August 15, 1997, and recommended for approval.

5. Execute Contract to Cost-Share Development and Demonstration of Fuel-Flexible Proton Exchange Membrane Fuel Cell Power System for Vehicle Applications

Proton exchange membrane fuel cells (PEMFCs) are zero-emission electrochemical engines with potential to become commercialized power plants for vehicles. In 1994 AQMD executed a $500,000 contract with Torrance-based AlliedSignal Aerospace to research and develop a direct-hydrogen PEMFC system for automobile applications, as part of a $10 million Department of Energy (DOE) project. This nearly completed project has resulted in important manufacturing and technological innovations for PEMFCs. DOE recently selected AlliedSignal to develop a larger and improved PEMFC system that can operate on reformed hydrocarbon fuels. The total cost of the project is approximately $9 million, of which DOE anticipates providing $6.75 million. AlliedSignal seeks matching funds of $2.25 million and has requested $500,000 from AQMD. This item was reviewed by the Technology Committee on August 15, 1997, and recommended for approval.

6. Amend Contract for Demonstration of Natural Gas Engines in Heavy-Duty Trucks to Revise Project Scope and Extend Time of Performance

In 1996, the AQMD entered into a contract with the County Sanitation Districts of Orange County (CSDOC) to demonstrate natural gas engines in on-highway service, transporting biosolids from Orange County to Kern County, California. A reduction in the number of loads assigned by CSDOC to its hauler, Pima Gro Systems, Inc., makes it necessary to revise the project scope. The proposed amendment will revise the project work statement, reduce AQMD funding from $447,000 to $394,813, and extend the contract term. This item was reviewed by the Technology Committee on August 15, 1997, and recommended for approval.

7. Execute Contract to Support and Enhance Emission Reporting System

On June 10, 1997 the AQMD released an RFP for private data network services to support the telecommunication and data processing requirements associated with the Emission Reporting System for RECLAIM. These services must be capable of meeting both the current and anticipated needs of AQMD while incorporating expansion and upgrade capabilities. This action is to execute a contract with Global Payment Systems, Modular Data Inc., which has provided private data network services to AQMD since May 1994, for a sum not to exceed $49,000. Funds for these services are included in the FY 1997-98 Budget. This was reviewed by the Administrative Committee on August 22, 1997, and recommended for approval.

8. Amend Contract for Facility Permits Processing System to Transfer Funds from Phase I to Phase II of Work Scope

Development of the Facility Permits Processing System (FPPS) has two phases: design and implementation. Of the total contract funds ($550,000) $236,000 was targeted for Phase I. Due to a refocusing of the Phase I effort $48,000 of the original $236,000 is available for Phase II. This action is to amend the contract with Sierra Cybernetics to transfer $48,000 from Phase I to Phase II . Funds for these services are already encumbered by the contract. This item was reviewed by the Administrative Committee on August 22, 1997, and recommended for approval.

9. Amend Contracts with COMSYS Technical Services and Majesco Software, Inc. and Issue RFP for Short- and Long-Term Systems Development and Maintenance Support

On February 14, 1997 the Board approved the execution of task order-type contracts to obtain short- and long-term systems development services on a task-by-task basis. As further system development requirements are identified, additional funding must be added to each contract and additional vendors must be qualified. This action is to amend the contracts with COMSYS and Majesco to add $500,000 and to issue an RFP to solicit bids for system development services. Funds for these services ($1,000,000) are included in the FY 1997-98 Budget. This item was reviewed by the Administrative Committee on August 22, 1997, and recommended for approval

11. Execute Contracts for Data Collection to Evaluate Voluntary Ridesharing

SB 836 (Lewis) requires that AQMD and SCAG report to ARB on the effectiveness of voluntary ridesharing on January 1, 1998. A methodology to assess the effectiveness of voluntary ridesharing has been developed over the past six months by a team of consultants selected by the Regional Transportation Agencies` Coalition. This methodology calls for AQMD to conduct two surveys: a telephone survey of deregulated employers to ascertain the trip and emission reduction strategies currently being implemented at deregulated worksites; and an employee travel behavior survey to assess ridesharing participation. Data collection must be completed no later than November 14, 1997. Release of the RFPs was discussed at the Mobile Source Committee meeting on July 25, 1997.

12. Execute Contracts for Local Government Subvention Fund Match Program as Part of FY 1997-99 AB 2766 Discretionary Fund Work Program

Within the FY 1997-99 AB 2766 Discretionary Fund Work Program, the MSRC created a $6.5 million Local Government Subvention Fund Match Program which, through a simplified application process, provides a 25% match to cities and counties within the AQMD’s jurisdiction that receive AB 2766 City Subvention Funds. Eligible match categories include alternative fuels/electric vehicles, transportation related land-use strategies, public transportation (transit & rail), traffic management, transportation demand management (non-Rule 2202), market-based strategies, bicycles, and public education related to clean vehicles or transportation. Funds will be allocated on a first-come, first-serve basis. The six-month application process is May 15 through
November 15, 1997. At this time the MSRC is requesting approval of another round of applications submitted by local governments.

14. Amend Contract for Technical Assistance Services to AQMD in Support of AB 2766 Subvention Fund Program

AQMD currently receives technical assistance services from The Solis Group under a $48,270 contract which was competitively awarded in January 1997. The current contract expires August 31, 1997. There is a need to continue the assistance to local governments. This action is to amend the contract with The Solis Group to modify the Statement of Work, extend the term an additional four months, and increase the contract amount by $25,000, for a total not to exceed $73,270. In July 1997, the Administrative Committee reviewed this item and requested that it be brought back on August 22 for consideration, with additional information. This item was reviewed by the Administrative Committee on August 22, 1997, and referred to the full Board without recommendation.

15. Issue RFQ to Acquire Instruments for Continuous Measurement of Ambient Carbon Monoxide Concentrations

Eight aging carbon monoxide analyzers should be replaced with modern, state-of-the-art equipment. Such analyzers are needed as part of the AQMD’s ambient air quality network. The newer technology is more reliable, easier to maintain, and less costly to operate than existing monitors. This action is to issue an RFQ for this purpose. A total of $56,000 is available in the FY 1997-98 budget. This item was reviewed by the Administrative Committee on August 22, 1997, and recommended for approval.

16. Adopt Update of Technology Advancement Plan for Clean Fuels Program

The proposed update to the Technology Advancement Plan for the AQMD’s Clean Fuels Program outlines planned project expenditures for FY 1997-98 in accordance with Health and Safety Code 40448.5.1. This legislation requires that research, development, and demonstration projects for vehicle applications within the AQMD’s Clean Fuels Program do not duplicate the efforts of specified organizations. Based on communications with these organizations, staff has determined that the proposed projects are not duplicative. The Plan will be updated periodically to reflect new developments. This item was reviewed by the Technology Committee on August 15, 1997, and recommended for approval.

The Board reviewed existing advisory groups, consolidated functions into six advisory groups: AQMP; Ethnic Community; Home Rule; Local Government & Small Business Assistance; Scientific, Technical & Modeling Peer Review; and Technology Advancement, and established charters for each. Staff sent each member of existing groups who had attended at least one meeting of the group in 1996 the final charters requesting indication of interest in serving on one or more of the new advisory groups. This action is to establish membership of the AQMP Advisory Group. This item was reviewed by the Administrative Committee on August 22, 1997, and recommended for approval.

36. Establish Compensation for Acting Executive Officer

At its August 8, 1997 meeting, the Board named Dr. Barry Wallerstein Acting Executive Officer effective August 1, 1997 and continuing until an Executive Officer is recruited and selected. The Board referred the issue of compensation to the Administrative Committee for its review and recommendation. This action is to establish compensation for Dr. Barry Wallerstein for the period he serves as Acting Executive Officer. This item was reviewed by the Administrative Committee on August 22, 1997, and referred to the full Board without recommendation.

37. Establish Panel to Evaluate Executive Search Firm Proposals

At its August 8, 1997 meeting, the Board approved the issuance of an RFP for executive search services and established a panel to evaluate proposals submitted in response to the RFP consisting of the Chair, the Vice Chair, Leonard Paulitz, Nell Soto, and Norma Glover. Thereafter, the Board took action to change the chair and vice chair and expressed a desire to reconsider the composition of the evaluation panel. This action is to finalize the composition of the evaluation panel. This item was reviewed by the Administrative Committee on August 22, 1997, and recommended for approval.

38. Amend Procedures for Standing Committees of the Governing Board

On March 8, 1996 the Board adopted Procedures for Standing Committees of the Governing Board. This action is to make certain modifications regarding appointment of temporary Committee members, the number of members, and Administrative Committee Chairmanship to facilitate the functioning of the Committee process. This item was reviewed by the Administrative Committee on August 22, 1997, and recommended for approval.

Pursuant to Government Code Section 54956.9(b) the Board will recess to closed session to confer with counsel regarding anticipated litigation relating to implementation of the State Implementation Plan, one case. Also, pursuant to Government Code Section 54956.9(c), the Board will recess to closed session to confer with counsel to decide, based on existing facts and circumstances, whether to initiate litigation - three cases. In addition the Board will recess to closed session pursuant to Government Code Section 54956.9(a) to confer with counsel regarding existing litigation which has been initiated formally and to which the District is a party. The title of the litigation is Communities for a Better Environment, et al. v. South Coast Air Quality Management District, et al., before the United States Environmental Protection Agency.

On August 29, 1997, a letter was received requesting the Board to hold a hearing on the Executive Officer’s extension of permits to construct a coal and petroleum coke receiving storage and shipping facility at Pier 300, Terminal Island, Port of Los Angeles. This action is for the Board to decide whether to schedule a public hearing at its October 10, 1997 meeting, pursuant to Section 40509 of the California Health & Safety Code and AQMD Rule 1201.
