2. Set Public Hearing August 8, 1997 to Amend Rule 1134 - Emissions of Oxides of Nitrogen from Stationary Gas Turbines

The proposed amendment to Rule 1134 (d) clarifies that CEMS are required only on cogeneration and combined cycle units, 2.9 megawatts and larger. This clarification is needed to make the rule language consistent with AQMD practice and the intent stated in the Rule 1134 Administrative Record. The proposed amendment to paragraph (f)(5) addresses EPA’s requirement that a person operating an emission control system maintain a daily record of continuous system operation and maintenance to demonstrate proper operation and compliance. District Counsel has determined that a public workshop, CEQA and socioeconomic report are not necessary for these specific minor proposed rule amendments. This is scheduled for review by the Stationary Source Committee on July 18, 1997.

3. Remove Fixed Assets Being Transferred to Antelope Valley Air Pollution Control District from AQMD Fixed Assets Inventory

In FY 1997-98, the AQMD will transfer control and operation of the Lancaster Air Monitoring Station to the Antelope Valley Air Pollution Control District (AVAPCD). Criteria pollutant monitoring instrumentation currently operating at that location will also be transferred to AVAPCD. AQMD Policy Number 20, Fixed Assets, dated July 5, 1995, requires Board approval to transfer fixed assets to AVAPCD, and remove them from the inventory. This was reviewed by the Administrative Committee on June 20, 1997, and recommended for approval.

4. AQMD/California Trucking Association Implementation Study Regarding Rule 1171 - Solvent Cleaning Operations

On September 13, 1996, the Board amended Rule 1171 - Solvent Cleaning Operations. At that time, the Board also directed staff to conduct an implementation study with the California Trucking Association (CTA) to address their concern regarding aqueous cleaning systems for repair and maintenance of heavy-duty trucks, and report back to the Board no later than July 31, 1997. While the study is well in progress, additional time is required to complete this project. This action is for the Board to direct staff to continue the implementation study with CTA and return back to the Board with further recommendations no later than December 1997. This was reviewed by the Stationary Source Committee on June 27, 1997.

5. Amend Contract to Evaluate Factors Affecting Diesel Exhaust Toxicity

The AQMD is currently cost-sharing this project with the ARB to evaluate factors affecting diesel exhaust toxicity. The study is being conducted by CE-CERT at the MTA’s testing facility. The original project cost was $450,000, with the ARB contributing $400,000 and AQMD contributing $50,000. This augmentation is for additional testing and costs incurred due to difficulties and delays at the MTA’s testing facility. Total amendment cost is $102,000. AQMD’s co-funding shall not exceed $10,000, with the remaining $92,000 being co-funded by the ARB. This was reviewed by the Technology Committee on June 27, 1997, and recommended for approval.

6. Execute Contract to Evaluate Remote Sensing of Nitric Oxide Exhaust Emissions from Light-Duty Vehicles

There are several organizations working on the development of Nitric Oxide remote sensors. An important step in the development of these instruments is a side-by-side comparison of their performance along with an independent evaluation of the usefulness of the data generated during on-road operation. This evaluation will be conducted by the Coordinating Research Council, with the services of Radian International. Total project cost is $149,984. AQMD’s contribution shall not exceed $49,984, with the remaining $100,000 being co-funded by the Coordinating Research Council. This was reviewed by the Technology Committee on June 27, 1997, and recommended for approval.

7. Execute Contract to Repower Tug Boat with Ultra Low-Emissions Diesel Engines

A demonstration project to repower a tug boat with ultra low-emissions diesel engines has been reviewed and approved by the EPA. The program will be managed by the Port of Los Angeles, with the services of Ocean Air Environmental. Total project cost is $505,000. AQMD’s contribution shall not exceed $77,500. The remaining balance will be co-funded with $350,000 from the EPA through a 103 Grant, $25,000 from the Port of Los Angeles, $40,000 from Connolly Pacific, and $12,500 from Valley Detroit Diesel Allison . This was reviewed by the Technology Committee on June 27, 1997, and recommended for approval.

8. Execute Contract to Cost-Share Development and Demonstration of High-Efficiency, Solar Energy-Based Air Conditioning Technology

Bergquam Energy, Sacramento, CA has proposed developing and demonstrating a commercial-size solar energy-based air conditioning system. The objective of the proposed project is to substantially improve the efficiency and the commercial feasibility of solar energy air conditioning technology using state-of-the-art solar collection and gas-absorption chiller technologies. Total cost of this project is $607,300, with a proposed AQMD cost-share of $75,000. This was reviewed by the Technology Committee on June 27, 1997, and recommended for approval.

9. Execute Contract to Develop and Demonstrate Optimized Design for Liquefied Natural Gas Storage and Dispensing for Fleet Vehicle Applications

LNG is of interest to a growing number of truck fleets; however, storage and dispensing of cryogenic LNG for truck fleet applications has not been optimized. Development and demonstration is needed of a standardized design of LNG dispensing stations to minimize vapor loss, retain fuel composition over extended periods, and minimize construction, operation and maintenance costs. Based on the results of a competitive solicitation, Amoco Oil Company has been selected to develop and demonstrate a state-of-the art LNG refueling station. Total project cost for Amoco is $1,971,470, with AQMD cost sharing of $300,000. This was reviewed by the Technology Committee on June 27, 1997, and recommended for approval.

10. Execute Contracts for AQIP for First Quarter of 1997

Rule 2202 - On-Road Motor Vehicle Mitigation Options was adopted December 8, 1995. As one compliance strategy, Rule 2202 allows employers to invest in the AQIP. Monies received are placed in a restricted account to fund programs which result in equivalent emission reductions that would otherwise have been achieved during the first quarter of 1997. This action is to recommend two for funding. The adjusted amount available for this quarter is $904,282. This was reviewed by the Mobile Source Committee on June 27, 1997, and recommended for approval.

11. Execute Contracts for Local Government Subvention Fund Match Program as Part of FY 1997-99 AB 2766 Discretionary Fund Work Program

Within the FY 1997-99 AB 2766 Discretionary Fund Work Program, the MSRC created a $6.5 million Local Government Subvention Fund Match Program which, through a simplified application process, provides a 25% match to cities and counties within the AQMD’s jurisdiction that receive AB 2766 City Subvention Funds. Eligible match categories include alternative fuels/electric vehicles, transportation related land-use strategies, public transportation (transit & rail), traffic management, transportation demand management (non-Rule 2202), market-based strategies, bicycles, and public education related to clean vehicles or transportation. Funds will be allocated on a first-come, first-serve basis. The six-month application process is May 15 through November 15, 1997. At this time the MSRC is requesting approval of the first round of applications submitted by local governments.

12. Recognize and Appropriate Funds from ARB for Third Year Operation of Monitoring Sites for Children’s Health Study in South Coast Air Basin

In FY 1995-96, AQMD assumed operation of 4 ARB monitoring sites and enhanced 4 existing sites as part of the Children’s Health Study (CHS). Each successive year, ARB has provided $150,000 to fund the operation. In FY 1997-98, CHS monitoring at Lancaster will no longer be under AQMD’s authority. ARB amended our agreement to provide $150,000 to extend operation of the 7 remaining monitoring sites through July 1998. This action is to recognize the $150,000 from ARB and appropriate these funds to the FY 1997-98 Budget. This was reviewed by the Administrative Committee on June 20, 1997, and recommended for approval.

13. Recognize and Appropriate Funds from EPA for Photochemical Assessment Monitoring Stations Program

EPA has allocated Section 103 grant funds to AQMD for the PAMS program. This action is to recognize $1,253,859 ($1,075,800 for FY 97-98, and $178,059 carryover from FY 96-97) from EPA upon receipt, and to appropriate these funds to the FY 1997-98 budget for the PAMS program fifth year implementation; and to reappropriate $313,941, which was unexpended from the PAMS program fourth year operation in FY 1996-97 and which reverted to the Undesignated Reserves on June 30, 1997, to the PAMS program in FY 1997-98. This was reviewed by the Administrative Committee on June 20, 1997, and recommended for approval.

14. Recognize and Appropriate Funds from U.S. EPA to AQMD to Assist States in Developing Small Business Assistance Programs

At the April 12, 1996 meeting, the Board approved a $25,000 supplement to the AQMD FY 1995-96 budget from a U. S. EPA Peer Match Grant. The funds are to be used to assist states in developing small business assistance programs. Of this amount, $2,000 was expended in FY 1995-96 and $8,000 was expended in FY 1996-97. This action is to appropriate the remaining $15,000 to the FY 1997-98 budget. This was reviewed by the Administrative Committee on June 20, 1997, and recommended for approval.

15. Reissue RFP for Employee Relations Litigation and/or Negotiations Services; Execute Interim Contract for Litigation Services and Extend Contract for Work Associated with Ongoing Litigation for a Period not to Exceed November 14, 1997

The Administrative Committee expressed concerns that only three firms deemed qualified responded to RFP 9697-39, Employee Relations Litigation and/or Negotiation Services. Subsequently, it was determined to reissue it in an effort to attract responses from a larger number of qualified firms. To ensure continuing legal representation following expiration on July 11, 1997 of the contract with Goldstein, Kennedy & Petito (GKP), this action is to execute an interim contract with Gutierrez & Preciado for new litigation matters and to extend the contract with GKP for in-progress litigation of cases involving employee relations and cases relating to matters in which they have previous experience, both for a term through November 14, 1997, only while the RFP is reissued and responses evaluated. This was reviewed by the Administrative Committee on May 23 and June 20, 1997, and recommended for approval.

16. Modify Contingency Purchase/Sales Agreement for Real Property Located at 9150 Flair Drive, El Monte, California

On March 14, 1997, the Board authorized the Chairman to sign the Modified Contingency Purchase/Sales Agreement with Commercial Development International/West, Incorporated (CDI/West) for the real property located at 9150 Flair Drive, El Monte, California. Subsequent to this authorization, staff was informed that the City of El Monte opposed locating the County of Los Angeles, Department of Public Social Services (DPSS) in the Flair Business Park. On May 27, 1997, the El Monte City Council withdrew their opposition to siting DPSS in the Flair Business Park. This unexpected delay necessitates extending the performance dates in the Contingency Purchase/Sales Agreement with CDI/West to October 1, 1997. This was reviewed by the Administrative Committee on June 20, 1997, and recommended for approval.

31. Consider Renewal of Executive Management Agreement with Executive Officer

The term of the Executive Management Agreement between AQMD and Dr. James M. Lents ends July 31, 1997. At the May meeting, the Board considered a proposal to extend the Agreement. There were insufficient votes to take action. The item was continued for public hearing at the June meeting at which testimony was received and the public hearing was closed. There were insufficient votes to take action and therefore, by operation of District rules, this item was continued for consideration at the July 11, 1997 Board meeting.

32. Consider Appointment of Interim Executive Officer Pending Recruitment

The Executive Management Agreement between AQMD and Dr. James M. Lents will expire July 31, 1997. This action is for the Board to consider appointment of an Interim Executive Officer effective August 1, 1997 and consider necessary steps to recruit for the position of Executive Officer. 33. Amend Rule 2100 - Registration of Portable Equipment

Proposed amendments will extend the expiration date for portable engine registration from August 1, 1997 to July 1, 1998, to allow time for transition from Rule 2100 requirements to state registration. In addition, the proposed amendments will end registration for other emissions units included in the state registration program, effective July 1, 1998. Further, the proposed amendments will make Rule 2100 sunset July 1, 1998. This was reviewed by the Stationary Source Committee on June 27, 1997.

34. Amend Rule 1122 - Solvent Degreasers

Proposed Amended Rule 1122 will establish VOC limits of 50 g/l for cleaning materials used in cold cleaners; or alternatively, require the use of airless or air-tight cleaning systems. Work practice and design requirements are also proposed for cold cleaners, vapor degreasers and airless and air-tight cleaning systems. VOC emission reductions of 40.2 tons/day are expected by year 2010, mostly through greater use of aqueous cleaning technologies in batch-loaded cold cleaners, at a cost-effectiveness of $1400 per ton of VOCs reduced. This was reviewed by the Stationary Source Committee on June 20, 1997.

35. Amend Best Available Control Technology Guidelines

Proposed amendments to the BACT Guidelines will update and provide a listing of BACT requirements for 46 equipment categories. This is the first phase of the effort to update the entire BACT Guidelines for all commonly permitted equipment. This proposal complies with Regulation XIII - New Source Review, Health and Safety Codes Section 40440.11, and the policies and procedures adopted by the AQMD Governing Board on September 8, 1995, in the BACT Methodology Report. This was reviewed by the Stationary Source Committee on June 20, 1997, and recommended for approval.

36. Final Resolution of Unresolved Findings and Recommendations in the Biennial Audit of AB 2766 Fee Revenue Recipients for FYs 1993-94 and 1994-95

Over the past several weeks representatives of local governments, the auditors and AQMD staff have worked to resolve many of the AB 2766 audit findings. To date, 18 of the 21 local government findings which were reported to the Board on June 13, 1997 have been resolved and will not require further action. In light of this progress, staff is requesting that the remaining two unresolved findings originally set for a July 11, 1997 hearing be moved and combined with the one unresolved finding regarding Los Angeles County set for hearing at the August 8, 1997 Board meeting.

37. Seek Federal Action to Provide Flexibility on the Records and Practices Required to Demonstrate Compliance with Title III Air Toxic Regulations

The Home Rule Advisory Group is requesting Board approval to seek U. S. Congressional support for flexible criteria for local program approval and a one-year extension on recordkeeping, reporting, and work practice requirements for specific federal Title III regulations.

It is also necessary to recess to closed session pursuant to Government Code Section 54956.9(c) to confer with legal counsel to consider whether to initiate litigation - one case. Pursuant to Government Code Section 54957, the Board may also recess to closed session to consider the appointment of an Interim Executive Officer.
