3. Staff Recommendation and Rulemaking Action Plan on Intercredit Trading--Increasing
Flexibility for AQMD's Mobile and Stationary Source Emissions

In April 1995, the Board initiated the Intercredit Trading Study.
The objective of this study is to assess the feasibility of linking
the AQMD's mobile and stationary emissions credit trading programs
to increase compliance flexibility while achieving air quality
goals. In October 1995, AQMD staff released for public review
a draft paper on issues surrounding intercredit trading. Four
workshops were held in November. Based on public comments received,
staff is finalizing policy recommendations and an action plan
for rulemaking. Actual rulemaking would occur later. The report
will be made available prior to the February public hearing.
4. Set Hearing to Amend Paragraph (f) (7) of Rule 2202 - On-Road Vehicle Mitigation Options
Pertaining to Fees for the Air Quality Investment Program

At the December 1995 Board Hearing, the Board adopted Rule 2202
- On-Road Vehicle Mitigation Options, and directed staff to bring
back information for further evaluation of appropriate fees for
participating in the Air Quality Investment Program, and to consider
possible exemption of primary and secondary schools. A staff report
is being prepared on these issues and a February hearing is being
scheduled relative to the fees specified in Rule 2202. Any action
to consider exemption of schools would need to occur at a later
date to allow completion of necessary CEQA analysis.
5. Preparation of a Three-Year Budget Forecast

State law requires the AQMD to prepare and submit annually to
the state board a three-year budget forecast based upon existing
programs and rules and new programs or rules to be adopted. This
is the sixth annual Three-Year Budget Forecast.
6. Audit for the Fiscal Year Ended June 30, 1995

This agenda item transmits the annual financial audit performed
by an independent certified public accountant. The AQMD has received
an unqualified opinion on its financial statements.
7. Award Contract for California Environmental Quality Act Analysis Assistance

At its October 13, 1995 meeting the Board approved the release
of an RFP to secure assistance with environmental analysis required
by CEQA. Proposals were reviewed by an evaluation panel and it
is recommended that the most qualified bidders be awarded the
time and materials contracts for a total amount not to exceed
$175,000, divided among three to five consultants.
8. Amend the Agreement for Employee Relations Litigation and Negotiation Services

This recommendation is to amend the Goldstein, Kennedy, &
Petito contract to add an amount not to exceed $200,000 to cover
litigation expenses involving ongoing lawsuits, legal challenges
relating to the June 30, 1994 layoffs and reductions in classification,
and contract negotiation impasse resolution. This item was reviewed
and approved by the Administrative Committee on December 15, 1995.
9. Issue a Request for Proposals to Enhance the Current RECLAIM NOx/SOx Central
Station Computer System

The AQMD is seeking qualified bidders to enhance the current RECLAIM
NOx/SOx Central Station Computer System.
The existing RECLAIM NOx/SOx Central Station
Computer System receives emissions and compliance data in electronic
and paper format; performs rule compliance analysis; and allows
AQMD staff to interact with the results of the analysis. The enhancements
will improve the electronic reporting, add new compliance analysis,
and provide tracking and assignment of compliance analysis results.
This system will help ensure enforceability of the NOx/SOx
RECLAIM Program by performing automated compliance analysis
in a timely manner. This item was reviewed and approved by the
Administrative Committee on December 15, 1995.

15. Feasibility of Monthly Recordkeeping for Flexographic,
Gravure, Letterpress, and Lithographic Printing Operations

On September 8, 1995, the Board directed staff to evaluate the
feasibility of monthly recordkeeping for Rule 1130 - Graphic Arts
printing operations. This report indicates that monthly recordkeeping
may be viable for part of the industry, but some enforcement issues
still need to be resolved. In addition, it recommends that pursuit
of monthly recordkeeping be postponed until after the VOC RECLAIM
recordkeeping protocols and requirements are adopted. In the interim,
the report establishes several simplified daily recordkeeping
procedures for segments of the printing industry.

The Administrative Committee received a nomination by the Advisory
Council to fill two of the existing nine vacancies on the 20-member
council. The Administrative Committee recommends that it first
undertake an evaluation of the Advisory Council's composition,
duties and activities, solicit nominations for membership from
the business and environmental communities, as well as Board Members
themselves, in addition to the Advisory Council's nominations,
and return to the Governing Board with a comprehensive recommendation
for the Board's consideration.
23. Feasibility of Using Rule 1130 (Graphic Arts) Compliant Inks in the Flexographic
Printing of Polyethylene and Polypropylene Bags

On September 8, 1995, as part of the public hearing on PAR 1130
(Graphic Arts), the Board directed staff to conduct a technology
assessment on the flexographic printing of polyethylene and polypropylene
bags and report our findings at the January 12, 1996 Board meeting.
This report will provide staff findings on the feasibility of
using compliant inks (300 grams per liter or less of VOCs) in
the flexographic printing of polyethylene and polypropylene bags
for tortillas, produce (carrots), frozen foods, pharmaceutical
products, and manure. It will also provide staff recommendations
for further rulemaking.

In accordance with Rule 2015 - Backstop Provisions, the first
annual report on the NOx and SOx RECLAIM
program has been prepared and is presented for a public hearing.
The report assesses emission reductions, average annual price
and availability of RTCs, job impacts, compliance issues, and
other measures of performance.
25. Adopt Proposed Rule 518.2 - Federal Alternative Operating Conditions

Proposed Rule 518.2 - Federal Alternative Operating Conditions
(AOC), establishes procedures by which owners/operators of Title
V facilities seeking a variance from AQMD or state rules may obtain
an AOC from the Hearing Board that would be recognized by the
EPA. Five major issues are addressed in the proposed rule: 1)
federal recognition of variances through the approval of this
rule; 2) creation of a SIP Allowance for variances; 3) content
of AOC; 4) public participation; and 5) mitigation of excess emissions.

The rescinding of Rule 1129 and proposed amendment of the other
coating rules are necessary to make AQMD rules consistent with
Section 41712 of the state Health and Safety Code which prohibits
local districts from enforcing or regulating VOC limits on aerosol
coatings. In addition, the proposed amendment of the definition
of "exempt compounds" in each rule will reference Rule
102 - Definition of Terms, to provide a consistent definition
between rules.
