PROPOSAL:

Approve Contract Modification under FY 2006-07 Work Program and Issue RFP for Telework Demonstration Program under FY 2009-10 AB 2766 Discretionary Fund Work Program

SYNOPSIS:

The MSRC approved a modification to the existing contract for assessing the feasibility of migrating the BikeMetro website as part of the FY 2006-07 Work Program, as well as the release of an RFP to retain a qualified consultant to implement a telework demonstration program as part of the FY 2009-10 Work Program. The MSRC seeks Board approval to modify the contract and issue the RFP at this time.

RECOMMENDED ACTIONS:

  1. Approve modification of contract #MS07079 with the Riverside County Transportation Commission (RCTC), for the upgrade and migration of the existing BikeMetro website to the regional CommuteSmart.info website, to allow reimbursement of maintenance and hosting fees for the existing BikeMetro website as well as coordination with third parties seeking to develop local bicycle routing and mapping systems, and reducing the contract value to $20,000, as part of the FY 2006-07 Work Program, as described in this letter;

  2. Approve a Partial FY 2009-10 Work Program increasing the allocation for the Telework Demonstration Program by $50,000;

  3. Issue RFP for the Development, Implementation, and Administration of a Telework Demonstration Program, with a targeted funding level of $200,000, as part of the FY 2009-10 Work Program, as described in this letter; and

  1. Authorize the Chairman of the Board to execute the modified contract under FY 2006-07 AB 2766 Discretionary Fund Work Program, as described above and within this letter.

Background

In September 1990 Assembly Bill 2766 was signed into law (Health & Safety Code Sections 44220-44247) authorizing the imposition of an annual $4 motor vehicle registration fee to fund the implementation of programs exclusively to reduce air pollution from motor vehicles. AB 2766 provides that 30 percent of the annual $4 vehicle registration fee subvened to the AQMD be placed into an account to be allocated pursuant to a work program developed and adopted by the MSRC and approved by the Board.

FY 2006-07 Work Program

As an element of their FY 2001-02 Work Program, the MSRC co-funded the development of a web-based bicycle routing and mapping system. The system was dubbed BikeMetro. As an element of their FY 2006-07 Work Program, the MSRC awarded funding to RCTC to assess the existing source code and feasibility of migrating BikeMetro to the regional CommuteSmart.info website maintained by RCTC, and to implement the migration if deemed feasible. Contract #MS07079 was executed to effectuate the award. At its May 20, 2010 meeting, the MSRC considered a request from RCTC to modify contract #MS07079 to allow reimbursement of continued hosting and maintenance costs for the existing BikeMetro website; further details are provided below in the proposals section.

FY 2009-10 Work Program

As an element of the FY 2009-10 Work Program, in November 2009 the MSRC approved release of a Program Opportunity Notice (PON) for the Design, Implementation and Evaluation of Telework Programs. The PON solicited conceptual ideas for how the consultant would implement a telework program to meet the MSRC’s goals and objectives. Four responses to the PON were received. Given that multiple pre-proposals with similar approaches were determined to have responded satisfactorily to the PON, in April 2010 the MSRC directed the development of an RFP to retain a consultant to develop and implement a Telework Demonstration Program. At its May 20, 2010 meeting, the MSRC considered the proposed RFP; details are provided in the Proposals section.

Outreach

In accordance with AQMD’s Procurement Policy and Procedure, public notices advertising the Telework Demonstration Program RFP and inviting bids will be published in the Los Angeles Times, the Orange County Register, the San Bernardino Sun, and Riverside County Press Enterprise newspapers to leverage the most cost-effective method of outreach to the entire South Coast Basin.  

Additionally, potential bidders may be notified utilizing AQMD’s own electronic listing of certified minority vendors. Notice of the solicitations will be mailed to the Black and Latino Legislative Caucuses and various minority chambers of commerce and business associations, and placed on the Internet at AQMD’s Web site (http://www.aqmd.gov where it can be viewed by making menu selections “Inside AQMD”/“Employment and Business Opportunities”/“Business Opportunities” or by going directly to http://www.aqmd.gov/rfp/index.html). Information is also available on AQMD’s bidder’s 24-hour telephone message line (909) 396-2724. Further, the solicitations will be posted on the MSRC’s website at http://www.cleantransportationfunding.org and electronic notifications will be sent to those subscribing to this website’s notification service.

Proposal Evaluation and Panel Composition

Proposals received in response to the RFP (further outlined under the Proposals section) will be evaluated by members of the MSRC’s Technical Advisory Committee (MSRC-TAC), a diverse group of individuals appointed by participating members as prescribed in the Health & Safety Code.

Proposals

At its May 20, 2010 meeting, the MSRC considered recommendations from its MSRC-TAC and unanimously approved the following:

FY 2006-07 Work Program

As mentioned in the Background section, the MSRC previously awarded a contract to RCTC to assess the feasibility of migrating BikeMetro to the CommuteSmart.info website. To facilitate the assessment, RCTC identified a need to keep the existing BikeMetro website operational in its current environment. RCTC ultimately determined that it would not be feasible to migrate BikeMetro to the commuter website. However, outside parties have expressed their intentions of developing a similar bicycle routing systems which would be available to the local public. Keeping the original system live would make it easier for such organizations to leverage the BikeMetro data. RCTC requested that their contract be modified to allow the reimbursement of continued BikeMetro hosting and maintenance as long as necessary, but no longer than until December 2011. RCTC would also coordinate with the outside parties and monitor beta testing of bicycle routing sites. The contract value would be reduced to $20,000 with $180,000 reverting to the AB 2766 Discretionary Fund. The MSRC considered and approved RCTC’s requested contract modification.

FY 2009-10 Work Program

The MSRC unanimously approved release of RFP #P2010-27 under the FY 2009-10 AB 2766 Discretionary Fund Work Program. The RFP, with a targeted funding level of $200,000, seeks to retain a qualified consultant or firm to research the reasons why telework has not been more widely adopted, what can be done to remove employer resistance, and to demonstrate these concepts at actual employment sites within this region. The RFP includes a proposal preparation and submission period commencing June 4, 2010 and closing July 20, 2010.

At this time the MSRC requests the Board to approve the contract modification and to authorize the AQMD Chairman of the Board the authority to execute the agreement as part of the FY 2006-07 Work Program. The MSRC also requests approval to release the RFP described in this letter under the FY 2009-10 Work Program.

Resource Impacts

The AQMD acts as fiscal administrator for the AB 2766 Discretionary Fund Program (Health & Safety Code Section 44243). Money received for this program is recorded in a special revenue fund (Fund 23) and the contracts will be drawn from this fund. These contracts will have no fiscal impact on the AQMD’s operational budget.
