This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2010.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month’s forecast are summarized.

Amnesty for Unpermitted Equipment
Rule 310 is inserted to March to implement Chairman Burke’s initiative to establish a temporary permit application penalty holiday.

Clean Air Act Emissions Fees for Major Stationary Sources of VOC and NOx (CTY-02)
Rule 317 is continued to April by direction of the Governing Board in January.

National Emission Standards for Hazardous Air Pollutants
Regulation X is removed from the calendar for March. U.S. EPA has not issued any new standards in the last year which require a Regulation X amendment.

Clean On-Road Residential and Commercial Refuse Collection Vehicles
Rule 1193 is moved from March to May as additional time is needed for staff to meet with affected fleets and other stakeholders to discuss the proposed changes to staff’s September 2009 proposed amendments.  In addition, staff will be completing the CEQA and socioeconomic analysis for the proposed amendments.

Credit Generation Program for Locomotive Head End Power Unit Engines
Credit Generation Program for Ocean-Going Vessels at Berth
Rules 2511 and 2512 are moved from April to May to allow staff additional time to work on technical details with U.S. EPA, CARB and stakeholders.

Prevention of Significant Deterioration (PSD)
Regulationx XXX and XVII are moved from April to May as more time is needed for U.S. EPA to finalize their Proposed Prevention of Significant Deterioration and Title V Greenhouse Gas Tailoring Rule.

Below is a list of all rulemaking activity scheduled for the year 2010. The last four columns refer to the type of rule adoption or amendment. A more detailed description of the proposed rule adoption or amendment is located in the Attachments (A through D) under the type of rule adoption or amendment (i.e. AQMP, Toxics, Other and Climate Change).

Reg. IV, IX, X, XI, XIV, and XX Rules
Various rule amendments may be needed to meet the requirements of state and federal laws, address variance issues/technology-forcing limits, or to seek additional reductions to meet the SIP short-term measure commitment. The Clean Communities Plan (CCP) which was formerly the Air Toxics Control Plan (ATCP) is being updated to include new measures to address toxic emissions in the basin. The CCP will include a variety of measures that will reduce exposure to air toxics from stationary, mobile, and area sources. Rule amendments may include updates to provide consistency with CARB Statewide Air Toxic Control Measures.
