This report highlights AQMD rulemaking activity and public workshops potentially scheduled for the year 2009 and portions of 2010.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes that occurred since last month’s forecast are summarized.

Emission Reductions from Livestock Waste (MCS-05)
Control of Emissions from Hog and Poultry Operations (MCS-05)
Rule 223 is added to the Rule schedule for Public Hearing in December. Rules 1127 and 1127.1 are moved to December from October to allow staff additional time for analysis of all 3 rules and review with stakeholders.

Control of Emissions from Refinery Coking Operations (MCS-01)
Proposed Rules 404 and 1114 are moved to the 1st Quarter of 2010 from November to provide staff with additional time for data gathering and analysis.
1111 NOx Emissions from Natural Gas-Fired Fan Type Central Furnaces (CMB-03)
Rule 1111 is moved to November from October to allow additional time for review and work with stakeholders.
1112.1 Emissions of Particulate Matter from Cement Kilns
Rule 1112.1 is moved to November from October to provide the one facility benefited by the amendment with additional time to compile and transmit emissions data to AQMD necessary for staff’s rule making analysis.
1138 Charbroilers (BCM-05)
Rule 1138 is moved to the 1st Quarter of 2010 from December to provide for additional time for staff analysis and public review and comment.
1155 Particulate Matter Control Devices (BCM-01)
Proposed Rule 1155 is moved to November from October to allow time for additional staff analysis and working group (stakeholder) review and input.
1193 Clean On-Road Residential and Commercial Refuse Collection Vehicles
Rule 1193 is moved to December from November to allow staff additional time to continue working with affected parties on implementation of the rule as it pertains to public entities contracting with private fleets.

Regulation XIII is moved to the 1st Quarter of 2010 from November to

Reg. IV, IX, X, XI, XIV, and XX Rules Various rule amendments may be needed to meet the requirements of state and federal laws (e.g., SB 700), address variance issues/technology-forcing limits, or to seek additional reductions to meet the SIP short-term measure commitment. The Air Toxics Control Plan (ATCP) is being updated to include new measures to address toxic emissions in the basin. The revised ATCP will include a variety of measures that will reduce exposure to air toxics from stationary, mobile, and area sources.
