Approved September 10, 2009 MSRC Meeting Minutes

The September 10, 2009 MSRC meeting minutes were approved by the MSRC at its October 15, 2009 meeting; they are attached for your information (Attachment 1).

FY 2009-10 AB 2766 Discretionary Fund Work Program

At its September 10, 2009 meeting, the MSRC set aside $3,575,000 in its FY 2009-10 Work Program with the intention of funding in ranked order as many projects on the secondary backup list from the FY 2008-09 Local Government Match Program. At their October 15, 2009 meeting, they indeed funded projects in ranked order up to $3,575,000. Even with these awards, however, there remained on the backup list five projects unfunded totaling $1,277,341. The MSRC’s Technical Advisory Committee recommended that the $2 million the MSRC previously set aside for a FY 2009-10 Local Government Match Program instead should be diverted to fully fund the remaining backup projects, especially since $2 million was an inadequate amount to have a worthwhile program for FY 2009-10. Ultimately, at its October 15, 2009 meeting, the MSRC approved funding totaling $4,852,341 to fund all remaining 12 applications on the backup list, as part of the FY 2009-10 Work Program. These awards will be considered by the AQMD Board at its November 6, 2009 meeting.

During discussion of the above action, the MSRC identified areas where the process for soliciting and funding projects for the Local Government Match Program needed improvement. They reiterated that the Program needs geographic minimums set aside for each county to ensure broad distribution of the funds but also directed staff to address in the FY 2010-11 solicitation how to apply the geographic minimums to any potential backup list projects. In prior years Match Program applications were received on a first-come, first-served basis and all applications received the first day were deemed received concurrently. This created a flood on the first day and potentially reluctance for local governments to apply after the first day even though the program was still open. They directed staff to identify ways to modify submittal requirements to ensure broad participation and distribution of funds across the four counties in this program.

Also as part of the FY 2009-10 Work Program, the MSRC exercised the option clause in its contract with The Better World Group for programmatic outreach services to extend the contract for two years. To fund services during FYs 2009-10 and 2010-11 the MSRC allocated $98,845 to The Better World Group. This contract modification will be considered by the AQMD Board at its November 6, 2009 meeting.

The MSRC also considered the parameters of the three remaining proposed elements under the FY 2009-10 Work Program:

  1. Alternative Fuel Infrastructure RFP ($3.15M) – Eligible fuels would be CNG, LNG, L/CNG, hydrogen, and hydrogen/natural gas blends; funding would provide up to 50% of project costs with a cap of $500,000 for multiple fuel stations or 24/7 public access; $400,000 for new single-fuel stations; and $300,000 for upgrades of existing stations while funding for maintenance facility modifications would not be eligible this cycle.

  2. Alternative Fuel 0.2 Gram NOx Heavy-Duty Vehicles RFP ($2.35M) – Two-tiered incentive structure, providing $50,000 maximum for displacement of greater than 10-liter engines; $35,000 maximum, for 10-liter or less engines; only non-FEL (family emissions level) engines would be eligible because funding FEL engines could potentially assist fleets with regulatory compliance.

  3. Tele-Work Toolkit & Demonstration PON ($150,000) – Solicit concepts for conducting a multi-year tele-work demonstration program. Ultimately, the MSRC would contract with a consultant firm, which would identify a handful of employers for participation in the demonstration program, research and identify why tele-work programs are not widely accepted by management as a cost-savings measure and then identify ways to breakdown those barriers, and finally build a toolkit to assist employers to independently conduct successful tele-work programs.

The MSRC will consider the actual solicitations at its next meeting and it is anticipated they will be considered by the AQMD Board in December.

Contract Modification Request

At its October 15, 2009 meeting, the MSRC considered only one contract modification request from the City of Azusa for Contract #ML08030, which currently provides $25,000 for the purchase of one LPG heavy-duty vehicle. The MSRC unanimously approved the substitution of one CNG aerial truck for the LPG street sweeper, which has comparable emission reductions. This contract modification will be considered by the AQMD Board at its November 6, 2009 meeting.
