| 1. | Public Comment Members of the public are afforded the opportunity to speak on any agenda item before or during the Board’s consideration of the item. At a special meeting, no other business may be considered. Each speaker will be afforded three minutes to address the Board. (Govt. Code Section 54954.3) |
| 2. | Closed Session It is necessary for the Board to recess to closed session pursuant to Government Code section 54956.9(a) to confer with its counsel regarding pending litigation which has been initiated formally and to which the District is a party. The actions are: NRDC, et al. v. SCAQMD, et al., Los Angeles Superior Court Case Nos. BS105728 and BS110792; NRDC, et al. v. SCAQMD, et al., Court of Appeal, Second Appellate District, Case No. B212646; and NRDC, et al. v. SCAQMD, et al., United States District Court Case No. CV-08-05403 GW. |

Call to Order: The meeting was called to order at 10:40 a.m. by Chairman Burke.
Public Comment:
There were no members of the public present in the
meeting room or at any of the teleconference locations.

The Board recessed to closed session pursuant to Government Code
Section 54956.9(a) to confer with its counsel regarding pending litigation
