PROPOSAL:

Recognize Additional Funds under “Year 10” Carl Moyer Program, Amend Awards under Carl Moyer Program and SOON Provision, and Execute a Contract under “Year 10” Carl Moyer Program

SYNOPSIS:

At its April 4, 2008 meeting, the Board adopted a resolution recognizing $34,782,473 from CARB under the “Year 10” Carl Moyer Program. This action is to recognize additional $88,691 from CARB. Effective January 1, 2009, CARB required all retrofit devices to comply with a lower nitrogen dioxide emission limit. The devices that do not meet this limit are no longer verified and many contractors now must switch to more costly devices to meet this new requirement. This action is to amend existing contracts for retrofit projects to provide additional funding. Other actions are to also execute a new contract under the “Year 10” Carl Moyer Program and amend two awards under the SOON Provision.

RECOMMENDED ACTIONS:

  1. Recognize $88,691 from CARB under the “Year 10” Carl Moyer Program in addition to the original allocation of $34,782,473, and place it in the Carl Moyer Program Fund 32 (SB 1107).
     
  2. Authorize the Chairman to amend the following “Year 10” Carl Moyer Program contracts originally approved on July 11, 2008, with increased funding from the Carl Moyer Program Fund 32 (SB 1107), for one on-road truck retrofit each:
    1. Pablo Shul for an increase of $9,214 up to $24,534;
    2. Leyton, Inc. for an increase of $8,309 up to $19,881 ;
    3. Aurelio Garcia for an increase of $4,986 up to $19,881;
    4. Edgar Miro for an increase of $6,386 up to $19,881;
    5. Norman Canizales for an increase of $6,386 up to $19,881;
    6. Carlos Marquina for an increase of $6,386 up to $19,881;
    7. Conrado Castro for an increase of $6,386 up to $19,881;

  3. Authorize the Chairman to execute a contract with Shaw Diversified Services, Inc. to purchase ten new electric forklifts in an amount not to exceed $36,551 from the Carl Moyer Program Fund 32 (SB 1107).
     
  4. Authorize the Chairman to amend the following awards under the SOON Provision:
    1. D&K Elliot Equipment Rental, Inc. originally approved on September 5, 2008 for the repower of one loader to an award for the replacement of one loader in an amount not to exceed $81,787, reducing the original award amount by $23,708 from the Carl Moyer Program Fund 32 (SB 1107).
    2. D&K Elliot Equipment Rental, Inc. originally approved on October 3, 2008 for the repower of one water truck to an award for the replacement of one water truck in an amount not to exceed $60,368, reducing the original award amount by $33,712 from the Carl Moyer Program Fund 80 (AB 923).

Background

At its April 4, 2008 meeting, the Board adopted a resolution recognizing $34,782,473 from CARB under the “Year 10” Carl Moyer Program. An additional $88,691 has now been allocated by CARB and staff requests these funds be recognized in the Carl Moyer Program Fund 32 (SB 1107).

From July through October of 2008, the Board approved on- and off-road project awards under the “Year 10” Carl Moyer Program and the SOON Provision with SB 1107 and AB 923 funds. As of January 1, 2009, all diesel emission control devices were required to meet a new NO2 emissions limit to receive verification from CARB. This new requirement affected the verification status of many retrofit devices and those that did not meet the new limit are no longer verified. The deadline for installation of formerly verified retrofit devices was February 28, 2009. Other technical factors that affect the selection and installation of the retrofit devices are engine horse power ratings and exhaust flow rates and temperatures. AQMD staff has worked closely with installers to evaluate changes in retrofit devices in accordance with the Carl Moyer Program requirements.
 

Proposals

Recognize Additional Carl Moyer Funds

In order to obligate the additional $88,691 provided by CARB under the “Year 10” Carl Moyer Program, staff requests the Governing Board recognize these funds and place it in the Carl Moyer Program Fund 32 (SB 1107). The total amount of the “Year 10” Carl Moyer Program allocation from CARB will be $34,871,164, comprised of $33,127,606 for projects funding and $1,743,558 for administrative and outreach costs.
 

Funding Increase for New Retrofit Devices

In order to fulfill the retrofit awards with devices which comply with the new CARB requirement, additional funding is required for 31 individual contracts. These contracts are outlined in Table 1 (attached) with the original funding amount, the requested additional amount, and the final total contract amount. Staff requests these contracts be amended to cover these costs, totaling up to $201,317 from the Carl Moyer Program Fund 32 (SB 1107).
 

Electric Forklifts

Shaw Diversified Services, Inc. submitted an application to purchase ten new electric forklifts in response to the Year 10 Carl Moyer Program solicitation issued last year. This project required CARB approval due to the applicability of CARB’s Large Spark Ignition Engine Regulation. AQMD staff worked closely with CARB to determine fleet compliance status and finalize eligibility for the Moyer program. CARB approved this project in February 2009. This action is to execute a contract with Shaw Diversified Services, Inc. to purchase ten new electric forklifts in an amount not to exceed $36,551 from the Carl Moyer Program Fund 32 (SB 1107).
 

SOON Provision

Following contract execution, D&K Elliot Equipment Rental, Inc. requested to replace two pieces of off-road equipment instead of repowering the engines due to the cost savings that would be incurred by the contractor. AQMD staff requested a case-by-case approval from CARB and is now seeking to amend the contract awards to reflect the reduced award amounts based on CARB approval. This action is to amend two awards with D&K Elliot Equipment Rental, Inc. under the SOON Provision. One amendment is to replace a loader instead of repowering it in an amount not to exceed $81,787, reducing the original award by $23,708 from the Carl Moyer Program Fund 32 (SB 1107). The other amendment is to replace a water truck instead of repowering it in an amount not to exceed $60,368, reducing the original award by $33,712 from the Carl Moyer Program Fund 80 (AB 923).
 

Benefits to AQMD

The successful implementation of the Carl Moyer Program and the SOON provision will provide direct emissions reductions for both NOx and PM as required by the programs. Since the vehicles and equipment funded under these programs will operate for many years, the emissions reductions will provide long-term benefits.
 

Resource Impacts

Total funding for the amendment of the retrofit contracts and the execution of a new contract shall not exceed $237,868 from the Carl Moyer Program Fund 32 (SB 1107). There are sufficient funds in the Carl Moyer Program Fund for these activities.
