Two summaries are attached: Rules From Which Variances and Orders for Abatement Were Requested in 2005 and August 2005 Hearing Board Cases. It should be noted that 1 of the 20 cases heard in August was a Group Order for Abatement petition involving 11 gasoline dispensing facilities not in compliance with enhanced vapor recovery (EVR) requirements which became effective April 1, 2005.

The total number of appeals filed during the period August 1 to August 31, 2005 is 2, and the total number of appeals filed during the period of January 1 to August 31, 2005 is 10.
