Two summaries are attached: Rules From Which Variances and Orders for Abatement Were Requested in 2005 and September 2005 Hearing Board Cases.

It should be noted that 9 of the 26 cases heard in September were Group Order for Abatement petitions involving 29 gasoline dispensing facilities not in compliance with enhanced vapor recovery (EVR) requirements which became effective April 1, 2005.

The total number of appeals filed during the period September 1 to September 30, 2005 is 0, and the total number of appeals filed during the period of January 1 to September 30, 2005 is 10.
