Proposed Amended Rule 1162 removes the requirement of applying gel coats solely with nonatomizing spray application techniques, establishes a list of acceptable low emitting spray application techniques for gel coat, and clarifies the use of hand-held spray equipment for gel coat touch-up and repair. In addition, the proposed amendment will add a transfer efficiency exemption for limited usage of certain specialty gel coat applications. 3. Award Contracts for Natural Gas Refueling Station Infrastructure and Reissue RFP

On January 7, 2005, the Board approved the release of an RFP to solicit proposals for natural gas refueling station infrastructure projects in the amount of $245,428. Seven proposals were received by the closing date. Staff believes that all seven proposals deserve funding; however there are only enough funds to fully fund two of the seven highest scoring proposals in the amount of $224,861. Staff recommends funding these two proposals. Staff also requests the Board a) re-allocate $500,000 from a previous Board approved set-aside in the Clean Fuels Fund, b) use the remaining funds of $20,567 from the current solicitation, and c) allocate an additional $500,000 from the Clean Fuels Fund to reissue the RFP to solicit additional natural gas fueling infrastructure projects with a budget of $1,020,567. 4. Execute Contract to Cosponsor Development and Certification of Heavy-Duty Natural Gas Engine Meeting 2010 Emission Standards

Heavy-duty vehicles are significant contributors to the Basin’s on-road vehicle emissions inventory, contributing over one-third of the NOx and two-thirds of the particulate emissions. For the 2010 Federal NOx standard of 0.2 g/bhp-hr, stoichiometric natural gas fueled engines with three way catalysts and exhaust gas recirculation have shown promise in the test cell, but require real-world demonstrations and testing to verify their performance. This action is to award a sole-source contract award to John Deere Power Systems, Inc. to develop and certify a heavy-duty natural gas engine that meets the 2010 standard by 2007, at a cost not to exceed $695,400 from the Clean Fuels Fund. Cost sharing is being provided by John Deere Power Systems, Inc. and others for the remainder of the $6,582,900 total project costs. (Review: Technology Committee, May 27, 2005)

5. Execute Contract to Cosponsor Demonstration of Particulate Filter and Gas-to-Liquid Diesel Fuel in Transportation Refrigeration Unit Engines

Transportation refrigeration units (TRUs) powered by diesel engines are used to preserve perishable products during transport. CARB estimates particulate matter and nitrogen oxide emissions from statewide TRUs to be 2 and 20 tons per day (tpd). This action is to award a contract to the U.S. DOE’s National Renewable Energy Laboratory (NREL) to evaluate, quantify, and compare emissions from TRUs powered by engines equipped with and without particulate filters and fueled with gas-to-liquid fuel and CARB specification conventional diesel fuels at a cost not to exceed $260,000 from the Clean Fuels Fund. Cost share is being provided by U.S. DOE NREL and its partners for a total project cost of $512,580. (Review: Technology Committee, May 27, 2005)

6. Execute Contracts to Demonstrate Applicability of Cleaire Advanced Emissions Controls’ Longview Systems on Solid Waste Collection Vehicles

In 2004, Cleaire Advanced Emissions Controls received a verification approval from CARB for its Longview System diesel retrofit system which reduces NOx and PM emissions from a wide variety of pre-2003 on-road heavy-duty diesel engines. The Longview System is CARB-verified to reduce PM emissions by at least 85 percent and NOx emissions by 25 percent. Cleaire is in the process of obtaining a verification of the Longview System for current diesel engines. This action is to execute contracts for emissions testing and data analysis of up to four Longview Systems on a variety of 2004 or 2005 model year diesel-fueled engines used in solid waste collection vehicles operating in the South Coast AQMD in an amount not to exceed $285,000. 7. Recognize and Appropriate Funds from U.S. EPA and CARB, and Execute Contracts for Truck Stop Electrification

The U.S. EPA has awarded the AQMD $100,000 in National Transportation Idle Free Corridors funds for truck stop electrification projects. In March 2005, the Board approved $300,000 for truck stop electrification projects with Idleaire Technologies Corporation under the Carl Moyer program. In addition, CARB has also allocated $691,000 from its State Emissions Mitigation Program fund for truck stop electrification projects with Idleaire. This action is to execute a contract with Idleaire to implement truck stop electrification projects in an amount not to exceed $1,091,000, comprised of a $100,000 grant from the U.S. EPA, $691,000 from CARB’s State Emissions Mitigation Program, and $300,000 from the Carl Moyer Program fund already approved by the Board on March 4, 2005. 8. Execute Contract to Continue Monitoring of Microturbine Sites

In 2001, the Board authorized funding from the Clean Fuels Fund for the University of California at Irvine (UCI) to monitor power production at selected microturbine sites. That project ended in 2004. This action will extend the monitoring period for another two years. Results will continue to be available to AQMD and other interested parties on a web site. This information will help advance this cleaner distributed generation technology, and provide other technical data relative to the performance and reliability of microturbine generators. Staff recommends funding for this project in an amount not to exceed $100,000 from the Clean Fuels Fund. (Review: Technology Committee, May 27, 2005)

9. Transfer Funds from Clean Fuels Fund to FY 2005-06 General Fund Budget of Science & Technology Advancement

Since FY 1999-00, revenues from the state-mandated Clean Fuels Program have been directed to the Clean Fuels Fund. Periodically, funds are transferred from the Clean Fuels Fund to the General Fund to support AQMD activities directly related to the Clean Fuels Program. This action is to transfer $500,000 from the Clean Fuels Fund to the FY 2005-06 Budget upon Board approval of the FY 2005-06 Budget to supplement the FY 2005-06 General Fund Budget of Science & Technology Advancement, Services and Supplies Major Object, Professional and Special Services Account to support Clean Fuels Program activities. 10. Execute Contract to Purchase Sulfur Dioxide Analyzers for Ambient Air Monitoring Network

On April 1, 2005, the Board approved release of an RFQ to purchase sulfur dioxide analyzers to replace antiquated units in the ambient air monitoring network. This action is to execute a contract with Thermo Environmental Instruments, Inc. for an amount not to exceed $49,584 to purchase continuous sulfur dioxide analyzers. 11. Execute Purchase Order for Off-site Storage Services

On March 4, 2005, the Board approved the release of an RFQ to select a vendor capable of providing high quality off-site storage services for nightly computer backup tapes, application folders, microfiche, and paper files. As a result of successful responses to this RFQ, Iron Mountain Incorporated was identified as capable of providing these specialized services. This action is to issue a purchase order to Iron Mountain Incorporated for the purchase of off-site storage services. Funds ($62,600) for these services are included in the FY 2004-05 Budget. 12. Approve Transfer of Funds for Purchase of Modeling Computer Workstations

AQMD staff uses computer-based air quality models for MATES, AQMP development, SIP development, rule and control measure effectiveness analyses and other strategic planning efforts. Computer workstations using clustered microprocessors have proven to be both time and cost effective for these modeling purposes and an initial cluster system has been purchased. The purchase of additional computer workstations will further enhance this modeling capability, allowing improved analyses with state-of-the-science air quality models. The cost will not exceed $25,000. This action is to: (1) transfer $21,300 from the Services and Supplies Major Object, Professional and Special Services Account to the Fixed Asset Major Object and (2) reallocate $3,700 in unspent funds from Fixed Asset #26 for the purchase of two additional modeling computer workstations. 15. Appropriate Funds from Designation for Litigation and Enforcement and Authorize Amending Existing Contracts to Appropriate Such Funds

The District is currently involved in several major lawsuits employing outside counsel. These include the Fleet Rules, the challenges to the most recent amendments to the architectural coatings rule, to the refinery ESP rule, to the ConocoPhillips ultra-low sulfur diesel project, to the aggregate mining rule, and to AQMD’s permitting of a power plant in Riverside. This action is to appropriate $300,000 from the Designation for Litigation and Enforcement to the District Counsel budget, Professional and Special Services account, and to authorize the Executive Officer to amend existing contracts with Shute, Mihaly & Weinberger and Woodruff, Spradlin & Smart to appropriate these funds. 16. Approve Award Modifications and Corrections for FY 2004-05 AB 2766 Discretionary Fund Work Program; Grant MSRC Authority to Adjust Project Costs Up to Five Percent; and Authorize Board Chairman to Execute Agreements

The MSRC’s FY 2004-05 Diesel Exhaust After-Treatment Retrofit Program provided funds for the purchase/installation of retrofit devices on heavy-duty diesel vehicles, including a $150,000 cap per entity. In February 2005 the Board approved 17 awards totaling $2,150,500 to fund up to 712 devices. Several proposers requesting funding beyond the cap were placed on a backup list. On May 26, 2005, the MSRC identified $6 million in turnback funds and unanimously approved award modifications to fully fund seven viable projects on the backup list. Additionally, subsequent to the AQMD Board approving FY 2004-05 awards in January 2005, staff discovered clerical errors on some awards. This action requests AQMD Board approval of a corrected award to City of Whittier for three refuse trucks, two aerial vehicles and one sweeper. The award amount remains $130,000. The MSRC requests Board approval of the award modifications/corrections as part of the FY 2004-05 Work Program as well as authority to adjust the contracts up to five percent and for the Board Chairman to execute agreements. 17. Inter-District Transfer of Emission Reduction Credits to Antelope Valley Air Quality Management District

Lockheed Martin has requested transfer of VOC, NOx, CO and PM10 Emission Reduction Credits (ERCs) generated and issued at their Burbank facility in the SCAQMD to their facility located in Palmdale. Palmdale was previously part of the SCAQMD, but is now located in the AVAQMD. California Health and Safety Code Section 40709.6 and SCAQMD Rule 1309(i) specify the requirements that allow ERC transfer between air districts provided, in addition to meeting other requirements, approval of such transfer has been obtained from the Governing Boards of both the air district in which the ERC is generated and the air district to which the ERC is transferred. 24. Notification of Recent State-Approved Health Risk Values for New Source Review

On February 11, 2005, the state Office of Environmental Health Hazard Assessment (OEHHA) finalized a chronic risk value for respirable crystalline silica. The finalized chronic risk value for silica is based on PM4 and no test method currently exists for measuring ambient PM4 for environmental purposes. Since the chronic value for this compound would not be enforceable in the absence of a test method, staff recommends postponing amendments that would have added crystalline silica to Rule 1401 and subsequently postponing the analysis for Rule 1402 until 150 days after a test method has been developed and approved by CARB.

26. Status Report on Web Casting District Governing Board Meetings

In October 2004, the Board approved thirteen enhancements to the Environmental Justice Program. Enhancement II-3 called for staff to assess the feasibility of web casting monthly District Governing Board Meetings. The assessment includes identification of all costs associated with web casting of District Governing Board meetings held at headquarters, including additional software and hardware needs beyond what is currently available. Staff has conducted research to determine the resources necessary to perform these tasks, and reviewed the existing District resources that are available. This action is to authorize implementation of web casting of monthly Governing Board meetings utilizing existing resources, and purchasing additional network transmission resources incrementally, if needed. The Executive Officer's Budget for FY 2005-06 represents the input over the past several months from Board members, staff, and the public. This year's process included meetings of the Budget Advisory Committee; Stakeholders Workgroup; a public hearing on February 4, 2005 to receive input on the AQMD's Program Goals and Objectives; and two budget workshops, one for the public held on April 21, 2005 and one for the Board held on April 29, 2005. 39. Amend Rule 461 - Gasoline Transfer and Dispensing

Proposed Amended Rule 461 implements California Health and Safety Code (H&S Code) Section 40724 to require best available retrofit control technology for agricultural sources by phasing out the exemptions for agricultural operations. Additional amendments are proposed to enhance recordkeeping and reporting, to require personnel training and improve clarity and enforceability of the rule. An exemption from the Phase II requirements is proposed for fueling Tournament of Roses Parade floats. (Review: Stationary Source Committee, March 25, 2005 and April 22, 2005)

40. Amend Rule 403 - Fugitive Dust

Amendments to Rule 403 are proposed to incorporate SB 700 provisions to require Best Available Control Measures for fugitive dust sources at confined animal facilities no later than January 1, 2006. Additionally, Proposed Amended Rule 403 will address an implementation issue related to 2004 amendments affecting weed abatement activities. Comments on the Proposed Amended Rule 403 Environmental Assessment relative to the weed abatement provisions necessitate further evaluation. 41. Amend Rule 1110.2 -Emissions from Gaseous and Liquid-Fueled Engines and Rescind Rule 1110.1 - Emissions from Stationary Internal Combustion Engines

SB 700 eliminates the exemption from the permit system for agricultural operations and requires air districts to implement BARCT for agricultural engines. Amendments are proposed to Rule 1110.2 in order to comply with SB 700. Proposed amendments include removing the exemption for stationary non-emergency, agricultural internal combustion engines, except for orchard wind machines, and requiring them to comply on a tiered compliance schedule. Proposed amended Rule 1110.2 has superceded the requirements of Rule 1110.1, so staff recommends that Rule 1110.1 be rescinded. (Review: Stationary Source Committee, April 22, 2005)

In addition, it is necessary to recess to closed session pursuant to Government Code sections 54956.9(b)(1) to confer with its counsel because, based on existing facts and circumstances, there is a significant exposure to litigation against the agency (one case) (the facts and circumstances are a notice-of-intent to sue letter submitted to SCAQMD by a union group) and 54956.9(c) to confer with its counsel regarding determining whether to initiate litigation (two cases).

Members of the public are afforded an opportunity to speak on any listed item before or during consideration of that item. Please notify the Clerk of the Board, (909) 396-2500, if you wish to do so. All agendas are posted at AQMD Headquarters, 21865 Copley Drive, Diamond Bar, California, at least 72 hours in advance of the meeting. At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under Public Comments may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record, provided 25 copies are presented to the Clerk of the Board. Electronic submittals to cob@aqmd.gov of 10 pages or less including attachment, in MS WORD, plain or HTML format will also be accepted by the Board and made part of the record if received no later than 5:00 p.m., on the Tuesday prior to the Board meeting.
