Proposed amendments to Rule 461 will allow limited testing to be conducted on weekend days (Saturday and Sunday) and correct cross-referenced errors. The proposed amendments are administrative in nature and will not affect emissions or add any other regulatory requirements. No socioeconomic or environmental negative impacts are expected. In December 2000 and January 2001, the Scientific Review Panel and the Office of Environmental Health Hazard Assessment, respectively, finalized chronic risk values for 23 compounds. Rule 1401(e)(2) and (e)(3) require an analysis and report to the Board before new and updated risk factors, respectively, are used for new source review. Proposed amendments to Rule 1401 will update the list of compounds and effective dates in Table I. In addition, Rule 1402(j)(4) requires an analysis of the potential impacts on sources subject to Rule 1402 prior to use of new or updated risk factors for facility-wide health risk assessments. 3. Execute Contract to Co-Sponsor Development and Demonstration of Grid-Rechargeable Hybrid-Electric Utility Service Truck and Mobile Electric Power Supply

Utility service trucks with aerial lifts are widely used for service of elevated wiring, and are powered by large heavy-duty diesel engines. AQMD, in conjunction with Southern California Edison, Electric Power Research Institute, Capstone Turbine Corporation, Enova Systems, and Altec Industries, Inc., will develop and demonstrate a grid-rechargeable hybrid-electric utility service truck that will utilize a low-NOx emitting Capstone microturbine to charge the battery pack. The use of hybrid-electric vehicles powered with microturbines on a commercial scale may lead to substantial reduction in air pollutants and toxic emissions from on-road heavy-duty vehicles. Staff recommends AQMD’s participation in this contract with co-funding of $266,348. Total funding for this project is $532,695. 4. Execute Contract to Co-Sponsor Development and Demonstration of Automated En-route Charging System for Heavy Duty Transit Electric Vehicles

One of the major objectives for the advancement of battery electric vehicles is increasing their range. The Los Angeles Department of Water and Power, on behalf of a public/private partnership with Caruso Affiliated Holdings, has proposed to demonstrate an automated, hands-off en-route charging system for the first time in an electric trolley. This will be the first demonstration of an automated, no-contact, drive-over charging system for a heavy-duty vehicle. The proposed electric trolley system is part of a $90 million development at the Los Angeles Farmer’s Market. The total cost of the electric trolley demonstration is approximately $1.8M. The AQMD cost share for the automated charging system and vehicle components shall not exceed $310,000. The Technology Committee reviewed this item on March 23, 2001, and recommended approval.

5. Execute Contract to Co-sponsor Educational Outreach Program of Sunline Transit Agency

Sunline Transit is one of the first transit agencies in the country to convert all of its transit buses to run on clean fuels, primarily natural gas. Sunline is now going a step further; it is acquiring very low emitting buses and zero-emitting fuel cell buses that run on hydrogen. To refuel these buses, Sunline has installed a hydrogen refueling station with onsite hydrogen production - using natural gas reforming, and water electrolysis using solar energy. Sunline's efforts have drawn worldwide attention and public interest. Sunline plans to expand its formal public education and outreach efforts on clean fuel transportation. Staff recommends that AQMD cosponsor this project in an amount not to exceed $50,000. The Technology Committee reviewed this item on March 23, 2001, and recommended approval.

6. Execute Contract to Renew AQMD’s Participation in California Fuel Cell Partnership for Calendar Year 2001

On March 17, 2000, the Board approved joining the California Fuel Cell Partnership (CaFCP) as a full member. The CaFCP is a collaborative group composed of 18 members of government agencies, automobile manufacturers, fuel suppliers, and fuel cell technology providers. Their primary focus is to demonstrate fuel cell vehicles and increase public awareness of these vehicles. Its key achievement last year was the opening and dedication of the CaFCP facility in West Sacramento, where several automakers displayed fuel cell vehicles and the planning of the deployment of a fleet of fuel cell buses. Staff recommends renewing AQMD’s participation in the CaFCP in an amount not to exceed $88,000 for calendar year 2001. The Technology Committee reviewed this item on March 23, 2001, and recommended approval.

7. Execute Contract to Cosponsor Development and Demonstration of Fuel Cell Bus with Major Bus Manufacturer

ThunderPower LLC, a consortium of a major bus manufacturer, (Thor Industries), major fuel cell maker International Fuel Cells, Inc, (IFC), and ISE Research, proposes to develop and demonstrate a fuel cell bus. ISE Research will develop a hydrogen fuel cell bus by integrating a 40 kW PEM fuel stack from IFC into a 30-foot bus built by El Dorado National, a Thor subsidiary. It will be tested and demonstrated in fleets in mid-2002. If prototypes show potential for commercial success, Thor plans to mass produce these buses in its Chino facility in the Basin. Staff recommends AQMD cosponsor this project in an amount not to exceed $350,000. Total project cost is $2.15 million dollars. The Technology Committee reviewed this item on March 23, 2001, and recommended approval.

8. Execute Memorandum of Agreement Establishing the Port of Los Angeles Carl Moyer Air Quality Standards Attainment Assistance Program, and Recognize and Appropriate Funds for Use on Qualifying Projects within Port Jurisdictional Boundaries

Under a proposed Memorandum of Agreement (MOA), the Port of Los Angeles is offering $316,410 to the AQMD for use as local matching funds under the Moyer Program to be used for projects within the Port boundaries. As part of the MOA, the Port will participate in the panel reviewing various processes as they apply to marine applications in areas under its jurisdiction. This action is to approve the MOA, recognize funds of $316,410 from the Port, and appropriate these funds to the Carl Moyer Fund Account. The Technology Committee reviewed this item on April 27, 2001 and recommended approval.

9. Execute Grant Agreement with Jurupa Unified School District to Replace its Existing School Bus Fleet with Lower Emitting Buses and Required Infrastructure

The Board, at its March 16, 2001 meeting, allocated $3 million from the $17 million one-time revenue realized from the AES settlement to Jurupa Unified School District. The proposed funding together with cofunding from Jurupa Unified School District and other potential sources will be utilized to replace 34 type 1 diesel buses with CNG buses, nine type 2 diesel buses with gasoline buses, and to install the required infrastructure for fueling of the CNG buses. The successful implementation of this program will reduce children’s exposure to harmful diesel exhaust. The Technology Committee reviewed this item on April 27, 2001 and recommended approval.

10. Issue RFP for Development and Demonstration of Alternative Fuel or Hybrid-Electric Midsize School Bus

Local school districts have a growing need for midsize (30 feet) buses. This action is to issue an RFP to develop and demonstrate a midsize alternative fuel and/or hybrid-electric school bus powered with microturbines. The RFP calls for the cooperative efforts of Original Equipment Manufacturers in microturbine, electric and hybrid-electric chassis, bus, and technology integration experts. Funding for the development of two alternative fuel buses is $600,000, and funding for the development of the hybrid-electric school buses is $1,400,000. The Technology Committee reviewed this item on April 27, 2001, and recommended approval.

11. Execute Contract to Cosponsor Study of Children’s Pollutant Exposures During School Bus Commutes

CARB is in the process of initiating an interagency agreement with CE-CERT to conduct a study to characterize school bus commute exposures to diesel particles and other air pollutants experienced by children while riding on school buses, waiting at bus stops, or waiting near idling buses. The study is intended to focus on diesel buses, but also includes natural gas buses as well. This action is to execute a contract with CE-CERT to conduct the additional testing for an amount not to exceed $59,000. CARB’s portion of the study is $450,000. The Technology Committee reviewed this item on April 27, 2001, and recommended approval.

12. Execute Contract to Purchase Business Computer Hardware Upgrade

On February 16, 2001, AQMD released an RFQ to select vendors capable of providing the most cost effective computer hardware upgrade for the DEC Alphaserver 8400 business computer. The DEC 8400 computer system is the business computer system which supports all defined production programs such as CLASS, NSR, compliance, permits, and finance. This action is to issue a purchase order to Dec Source, Inc. for the purchase of the DEC Alphaserver 8400 computer upgrade for a total amount of $160,285. Funds for this purchase are included in the FY 2000-01 Budget. The Administrative Committee reviewed this item on April 13, 2001, and recommended approval.

13. Authorize Purchase of Seven Vehicles for AQMD Field Staff

Based on current fleet compatibility and promotion of alternative fuel vehicles, staff recommends purchasing seven new 2001 Toyota Camry dedicated CNG vehicles to accommodate seven new field positions authorized for industrial compliance and area sources, and one 2001 Ford F150 CNG/gasoline pickup truck to support area sources’ Open Burn program. Subvention funds appropriated from the Undesignated Fund Balance to the FY 2000-01 Budget will be used for purchases. The 2001 Toyota Camry dedicated CNG model is available only from Toyota Motor Sales, U.S.A. Inc., fleet sales division at $24,986 per vehicle, including sales tax. The 2001 Ford F150 CNG/gasoline pickup truck is available at $25,962, including sales tax, from Senator Ford.

14. Approve Salary and Benefits Adjustment for Noncontract Management, Confidential, and Attorney Employees

15. Approve Agreement with California Pollution Control Financing Authority to Participate in California Capital Access Program, and Approve Standard Operating Procedures for Participation in CalCAP

On June 16, 2000, the Board approved revisions to the AQMD's small business loan guarantee program, the Air Quality Assistance Fund (AQAF). To implement one of the revisions, staff has developed an agreement with the California Pollution Control Financing Authority (CPCFA) through which the District would become an Independent Contributor to the California Capital Access Program (CalCAP). Under this agreement, the AQMD would transfer funds into a CPCFA account to assist small businesses by paying the borrower's fee, up to 3.5%, for any CalCAP loans for air quality related equipment or processes. The Board previously approved $100,000 of the AQMD's AQAF for this purpose. The Stationary Source Committee reviewed this item on March 23, 2001, and recommended approval.

16. Audit Report of AB 2766 Fee Revenue Recipients for FYs Ending June 30, 1998 and 1999, and Set Public Hearing July 20, 2001 Regarding Final Resolution of Unresolved Audit Findings and Recommendations

Health and Safety Code 44244.1 requires any agency that receives fee revenues subvened from the Department of Motor Vehicles to be audited once every two years. This audit of AQMD's share, MSRC's share, and local governments' share of such subvened funds, performed by independent Certified Public Accountants, has been completed and makes certain recommendations for improvement in some areas. The Administrative Committee reviewed this item on April 13, 2001 and recommended for approval.

17. Execute Memorandum of Understanding with Southern California Association of Governments for Preparation and Implementation of Revisions to South Coast Air Quality Management Plan

AQMD and SCAG have prepared an MOU for preparation and implementation of future revisions to the AQMP. The MOU addresses issues regarding scheduling of product development efforts for the 2001 AQMP, designation of lead agency responsibilities, and the process to resolve any disputes between the AQMD and SCAG regarding plan development. This MOU also provides for the AQMD Board and the SCAG Regional Council to each appoint three members to a Coordinating Committee which will review the progress of plan development and act as a conflict resolution body in the event of a disagreement between the agencies. The Mobile Source Committee reviewed this item on April 27, 2001 and recommended approval.

18. Confirm Clarifying Language Added to Rule 1309.1 - Priority Reserve to Reflect Board's Direction Adopted at April 20,2001 Public Hearing

At the April, 2001 Public Hearing, the Board adopted the staff proposal to amend Rule 1309.1 with a stipulation that the Electric Generating Facilities utilizing the District's PM-10 Priority Reserve account sign long-term contracts with the state, and allocate the power generated to the state grid system.

19. Approve Selection Methodology to Award Funding for Replacement Buses under Lower-Emission School Bus Program

In response to the AQMD Program Announcement & Application PA2001-02 "Lower-Emission School Bus Replacement & Retrofit Program", issued on February 16, 2001, a total of forty-six public school districts and one joint power authority have applied for the school bus replacement component of the program. Due to over-subscription of applications, at the Board's direction, staff developed a point ranking methodology for awarding the school bus replacement funding by taking areas of non-attainment, socioeconomic conditions, and other related factors into consideration. The proposed methodology is in accordance with the requirements of Rule 1195 and all the related resolutions adopted by the Board at its April 20, 2001 meeting. This item was reviewed at the Special Board Meeting on May 4, 2001, and recommended for approval.

33. Amend Regulation III - Fees

Proposed amended Regulation III includes an across-the-board fee adjustment to reflect the change in the California Consumer Price Index and implements many of the state auditor and the 1999 Fee Structure Study recommendations to recover costs of permit processing and related activities, currently not fully recovered. PAR realigns and simplifies the permit fee structure; adjusts fees to reflect findings of the time tracking study and recover costs of services rendered; extends time to claim refunds; establishes a streamlined, low-cost, standardized permit provision; establishes a minimum annual emissions fee for all sources; requires larger sources to pay annual emission fees for their unpermitted source emissions; and revises the fee structure for gasoline dispensing facilities from nozzles to product grade dispensers. 34. Adopt Executive Officer's FY 2001-02 AQMD Budget and Work Program

The executive Officer's Budget for FY 2001-02 represents the input over the past several months from staff, Board members, and the public. This year's process included meetings of the Budget Advisory Committee; a public hearing February 16, 2001 to take input on the AQMD's Program Goals and Objectives; and two budget workshops, one for the public on April 18, 2001 and one for the Board on May 4, 2001. This submittal transmits the required appropriations and reserves necessary to adopt the proposed budget. This item was reviewed by the Administrative Committee on April 13, 2001 and recommended for approval.

35. Adopt Proposed Changes to RECLAIM

At the January 19, 2001 Board Meeting, the Board directed staff to initiate rule development to help stabilize RTC prices and address California energy issues. Key proposed changes for power producing facilities include temporarily removing the influence of power producing facilities from the market and requiring installation of controls. For other RECLAIM facilities, compliance plans are proposed for larger facilities and forecast reports are proposed for medium sized facilities. Other changes include development of temporary credit assistance programs to offset excess emissions from utilities and assist certain small or new RECLAIM facilities. Information requirements for trade registration and revised procedures for late or missing electronic reports will also be proposed. 36. Adopt Proposed Rules 1631 – Pilot Credit Generation Program for Marine Vessels, 1632 – Pilot Credit Generation Program for Hotelling Operations, 1633 – Pilot Credit Generation Program for Truck/Trailer Refrigeration Units, and 2507 – Pilot Credit Generation Program for Agricultural Pumps

Proposed Rules 1631, 1632, and 1633 will provide opportunities for generation of NOx mobile source emission reduction credits (MSERCs) and Proposed Rule 2507 will provide opportunities for generation of NOx Area Source Credits (ASCs). These proposed rules are designed as a pilot program where NOx MSERCs and ASCs can be used in the RECLAIM program. Credits can be generated from repowering of marine vessels and the use of clean technology for hotelling of marine vessels, diesel-powered truck and trailer refrigeration units, and diesel-fueled agricultural pumps. 37. Amend Rule 1166 - Volatile Organic Compound Emissions From Decontamination of Soil

Proposed amendments to Rule 1166 will improve enforceability by requiring: (1) that contaminated soil stockpiles be sprayed with a vapor suppressant and covered with plastic sheeting; (2) a daily inspection of the covered stockpile; and (3) that records be kept of chain of custody between generator, transporter, storage and treatment facilities. 38. Amend Regulations IX - Standards of Performance for New Stationary Sources, and X - National Emission Standards for Hazardous Air Pollutants

Local air districts are authorized by EPA to implement federal standards set in 40 Code of Federal Regulations (CFR) Part 60, Standards of Performance for New Stationary Sources and Part 61, National Emission Standards for Hazardous Air Pollutants (HAPs). Periodic amendments to Regulations IX and X incorporate the new or amended standards by reference. Nine actions regarding NSPS and one NESHAP are proposed for incorporation into Regulations IX and X, respectively. Three of these changes will reduce HAPs. The others include clarifications and corrections, administrative changes, and changes to test methods and monitoring. (Review: Stationary Source Committee, February 23, 2001.)

Cenco Refining Company, et al., United States District Court Case No. 00-05665 AHM (AIJx); Engine Manufacturers Association v. SCAQMD, United States District Court Case No. 00-09065 FMC (BQRx); and SCAQMD v. USEPA, et al., United States District Court Case No. SACV 98-9789 (HLH). It is also necessary for the Board to recess to closed session pursuant to Government Code section 54956.9(c) to confer with its counsel to decide, based on existing facts and circumstances, whether to initiate litigation (one case).

40. Execute Contracts to Fund Marine Vessel Repower Projects Under RECLAM and Executive Order Mitigation Account

The AQMD has recently received $5.4 million from power plant operators for compliance with Rule 118 Executive Order #01-03 for NOx and Rule 118 Executive Order #01-04 for CO, as mitigation fees for emissions in excess of RECLAIM allocations. These funds will be placed in the RECLAIM and Executive Order Mitigation Account. There is an immediate availability of very cost effective emission reductions from marine vessel project applications received in response to the Moyer Program RFP. It is recommended that 46 marine vessel projects be funded from the account in an amount not to exceed $5.4million, resulting in total NOx reductions of 5,563 tons over 20 years.

41. Authorize Purchase and Installation of Additional MicroTurbine Equipment from AES Settlement Fund

The Board previously authorized the purchase and installation of Capstone MicroTurbines. An additional $260,000 is required to purchase and install heat recovery equipment, external silencers, and a MicroTurbine. Funds are available from the accrued interest in the AES Settlement Fund.

Members of the public are afforded an opportunity to speak on any listed item before or during consideration of that item. Please notify the Clerk of the Board, (909) 396-2500, if you wish to do so. All agendas are posted at AQMD Headquarters, 21865 E. Copley Drive, Diamond Bar, California, at least 72 hours in advance of the meeting. At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under Public Comments may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record, provided 25 copies are presented to the Clerk of the Board. Electronic submittals to cob@aqmd.gov of 10 pages or less including attachments, in MS Word, plain or HTML format will also be accepted by the Board and made part of the record if received no later than 5:00 p.m., on the Tuesday prior to the Board meeting.
