(A) Set Public Hearing May 11, 2001 to Amend Rule 1166 - Volatile Organic Compound Emissions From Decontamination Of Soil

The proposed amendments will improve enforceability of Rule 1166 by requiring: (1) that contaminated soil stockpiles be sprayed with a vapor suppressant and covered with plastic sheeting; (2) a daily inspection of the covered stockpile; and (3) that records be kept of chain of custody between generator, transporter, storage and treatment facilities. (B) Set Public Hearing May 11, 2001 to Amend Regulation III - Fees

Proposed amended Regulation III includes an across-the-board fee adjustment to reflect the change in the California Consumer Price Index and implements many of the state auditor and the 1999 Fee Structure Study recommendations to recover costs of permit processing and related activities, currently not fully recovered. PAR realigns and simplifies the permit fee structure; adjusts fees to reflect findings of the time tracking study and recover costs of services rendered; extends time to claim refunds; establishes a streamlined, low-cost, standardized permit provision; establishes a minimum annual emissions fee for all sources; requires larger sources to pay annual emission fees for their unpermitted source emissions; and revises the fee structure for gasoline dispensing facilities from nozzles to product grade dispensers. (C) Adopt Proposed Rules 1631 – Pilot Credit Generation Program for Marine Vessels, 1632 – Pilot Credit Generation Program for Hotelling Operations, 1633 – Pilot Credit Generation Program for Truck/Trailer Refrigeration Units, and 2507 – Pilot Credit Generation Program for Agricultural Pumps

Proposed Rules 1631, 1632, and 1633 will provide opportunities for generation of NOx mobile source emission reduction credits (MSERCs) and Proposed Rule 2507 will provide opportunities for generation of NOx Area Source Credits (ASCs). These proposed rules are designed as a pilot program where NOx MSERCs and ASCs can be used in the RECLAIM program. Credits can be generated from repowering of marine vessels and the use of clean technology for hotelling of marine vessels, diesel-powered truck and trailer refrigeration units, and diesel-fueled agricultural pumps. (D) Set Hearing May 11, 2001 to Adopt Proposed Changes to RECLAIM

At the January 19, 2001 Board Meeting, the Board directed staff to initiate rule development to help stabilize RTC prices and address California energy issues. Key proposed changes for power producing facilities include temporarily removing the influence of power producing facilities from the market and requiring installation of controls. For other RECLAIM facilities, compliance plans are proposed for larger facilities and forecast reports are proposed for medium sized facilities. Other changes include development of temporary credit assistance programs to offset excess emissions from utilities and assist certain small or new RECLAIM facilities. Information requirements for trade registration and revised procedures for late electronic reports will also be proposed. (Review: Stationary Source Committee, February 23, 2001.)

This action is to promote Elaine Chang, currently Assistant Deputy Executive Officer for Planning, Rules and Area Sources, to the position of Deputy Executive Officer of that office, effective April 7, 2001, the date following the effective date of Jack Broadbent's departure, and to increase Dr. Chang's compensation to $112,184.

4. Issue RFP to Demonstrate Passive Particulate Trap Technologies on Existing Off-Road Heavy-Duty Construction Equipment Fueled by Low-Sulfur Diesel Fuel

The contribution of heavy-duty diesel construction equipment to mobile source NOx and PM emissions inventory is projected to increase over other mobile sources in the near future. AQMD, together with CARB, recommend an RFP be issued soliciting proposals for the investigation of emission benefits and durability of passive particulate trap technologies in existing off-road heavy-duty construction equipment fueled by low-sulfur diesel fuel. Cost to the AQMD for the proposed $800,000 demonstration shall not exceed $400,000. CARB will provide direct cash contributions of $300,000 as well as $100,000 of in-kind contributions. Additional cost-shares are expected from particulate trap manufacturers. The County Sanitation Districts of Los Angeles, Sukut Construction, and C. W. Poss will supply equipment. The Technology Committee reviewed this item on March 23, 2001, and recommended approval.

5. Execute Contract to Cosponsor Development of Very Low-NOx Heavy-Duty Natural Gas Engine

On July 21, 2000, the Board approved execution of a cost-shared contract for $1,330,996 with Detroit Diesel Corporation (DDC) to develop a very low NOx heavy-duty natural-gas engine, funded with $830,966 from the Clean Fuels Fund and $500,000 from the CEC. CEC's contract was not executed until February 2001, thereby delaying, the DDC contract. DDC has indicated an additional $500,000 is needed to expand the reliability testing and accelerate the commercialization schedule. This action is to recognize an additional $300,000 in co-funding from ARB and CEC, and an additional $200,000 from AQMD's Clean Fuel Funds. Funding will be incorporated into the contract between DDC and AQMD, resulting in a total contract of $1,830,966. DDC's cost-share is $1,627,184 for a total project cost of $3,458,150. The Technology Committee reviewed this item on March 23, 2001, and recommended approval.

6. Execute Contracts to Fund Marine Vessel Repower Projects under AES Settlement Allocation for AQIP and Establish the AES Settlement Projects Fund

At the March 16, 2001 Board meeting, the Board approved $2 million from the AES settlement for pre-funding the AQIP. There is an immediate availability of very cost effective emission reductions from marine vessel projects which were not funded due to insufficient funds under the Carl Moyer Program for Marine Vessels. It is recommended that 13 such marine vessel projects be funded from the AQIP in an amount not to exceed $2 million, resulting in total NOx reductions of 3,892 tons over 20 years. This item was reviewed by both the Technology Committee on March 23, 2001, and the Administrative Committee on April 13, 2001, and recommended for approval.

8. Issue Invitation To Bid for the Construction and Maintenance of a Fast Fill Compressed Natural Gas Fueling Station at AQMD Headquarters

AQMD plans to build and operate a new natural gas fueling station at its Diamond Bar facility that can accommodate the growing alternative fuel vehicle fleet. This station will be designed to incorporate advanced gas metering technology as it is proven in the field. The invitation to bid solicits competitive bids for a turnkey fast fill compressed natural gas fueling station, and provision for 5 years of maintenance service. Proposals will be reviewed by staff prior to making any recommendations to the Board. This item was reviewed by the Technology Committee on February 23, 2001 and recommended for approval.

9. Authorize Purchase and Installation of Microturbines from AES Settlement Fund

At its March 16, 2001 meeting, the Board authorized $1,800,000 from the AES Penalty Settlement to assist in the purchase and installation of microturbines at multiple locations within the Orange, Riverside, and San Bernardino counties for distributed power generation. Staff proposes to purchase Capstone microturbines in an amount not to exceed $1,440,000 and offer assistance to operators for the installation of these machines in an amount not to exceed $360,000. Cost sharing is expected from the operators for the microturbine installations. The Administrative Committee reviewed this item on April 13, 2001, and recommended approval.

10. Execute Contracts for Equipment in Air Monitoring Network

On October 20, 2000, the Board recognized PAMS funding from EPA and allocated funds for fixed assets to support the PAMS program. On February 16, 2001, the Board recognized subvention funding from the CARB and allocated additional funds for fixed assets to improve air monitoring equipment used for compliance with ambient air quality standards and to add one additional fully instrumented mobile monitoring platform. This action is to execute contracts with various vendors for the purchase of certain equipment for the PAMS program and air monitoring compliance efforts, on a sole-source basis, using the funding previously allocated to the FY 2000-01 Budget for these items. The Administrative Committee reviewed this item on March 9, 2001 and recommended for approval.

11. Amend Contract with R Systems, Inc. and Execute Contracts with Applied Knowledge, Inc. and Windsor Technologies, Inc. for Short- and Long-Term Systems Development and Support Services

The AQMD currently has contracts with two companies for short- and long-term systems development services. These contracts are periodically amended to add budgeted funds as additional needs are defined. With Board approval, $190,000 of previous fiscal year funds were encumbered to a previous contractor for work not yet begun. This contract has expired, and AQMD is not renewing further contractual arrangements with them. Authorization is requested to re-appropriate this $190,000 from the Undesignated Fund Balance to start tasks not yet assigned. This action is also to amend the contract with R Systems, Inc. to add $230,500 for needed systems development work and to execute contracts with Applied Knowledge, Inc. and Windsor Technologies, Inc. to obtain systems development service on a task order basis. The Administrative Committee reviewed this item on March 9, 2001 and recommended for approval.

13. Execute Contracts for AQIP Proposals Received During Fourth Quarter of 2000

Rule 2202 - On-Road Motor Vehicle Mitigation Options was adopted on December 8, 1995. One of the compliance strategies under Rule 2202 allows employers to invest in the AQIP. Monies received are placed in a restricted account to fund programs that result in equivalent emission reductions that would otherwise have been achieved by the participating employers. Staff evaluated the proposals received during the fourth quarter of 2000. This action is to recommend five for funding. The amount available for this quarter is $1,642,616. The Mobile Source Committee reviewed this item on March 23, 2001 and recommended approval.

14. Issue RFPs for Community Outreach Program Assistance

AQMD is seeking to solicit bids from individuals and organizations for community relations/outreach services and to provide technical assistance to identify and address environmental justice issues in alignment with the Chairman’s Environmental Justice Initiatives. Sufficient funds are available from the General Fund. The RFPs will cover a two-year period for an amount not to exceed $1.5 million. The Administrative Committee reviewed this item on April 13, 2001 and recommended approval.

15. Execute Contracts for Workers' Compensation Claims Third-Party Administration and General Liability Adjusting Services

On November 17, 2000, the Board approved release of an RFP for Workers' Compensation Claims Third-Party Administrator and/or General Liability Adjusting Services. This action is to execute two contracts: one with Tristar Risk Management for workers' compensation claims administration, in an amount not to exceed $44,200 for the base period May 1, 2001, through April 30, 2002, with two additional one-year options at $45,526 and $46,892, respectively; and the other, a three-year contract with Colen & Lee for general and automobile liability adjusting services, in amounts not to exceed $7,200, $7,560, and $7,920 per year beginning FY 2001-02. Sufficient funds remain for FY 2000-01 for the Tristar contract and funding has been included in the FY 2001-02 budget for both contracts. Funding for subsequent years will be requested in the budget process. The Administrative Committee reviewed this item on March 9, 2001 and recommended approval.

16. Establish List of Prequalified Vendors to Provide Printing Services

On December 15, 2000, the Board approved release of an amended RFQ for printing services that made it easier and more efficient for small businesses to become prequalified and, once on the list, to respond to specific work requests. This item is to add vendors to the previously approved list and to establish an all-inclusive two-year list of prequalified vendors for various categories of printing services. The Administrative Committee reviewed this item on March 9, 2001 and recommended approval.

17. Approve Classification Recommendations and Add and Delete Positions

Based on the results of consultant-conducted classification studies, reclassifications are recommended for selected positions in clerical classifications. Additionally, based on increased contract activity, staff recommends deleting a Contracts Technician position in Finance and adding a Staff Specialist position. The total FY 00-01 cost to implement these recommended changes is approximately $5,809. The Administrative Committee reviewed this item on April 13, 2001 and recommended approval.

18. Appropriate Funds from Undesignated Fund Balance to Prepare CEQA Documentation for Los Angeles Department of Water and Power Valley Generating Station Repowering Project

LA DWP requested the AQMD prepare CEQA documentation for its Valley Generating Station repowering project. AQMD and LA DWP have determined ENSR is the most qualified consultant to perform the work within the timeframe because of ENSR's previous experience preparing an EIR for LA DWP's power plant projects. AQMD's existing contract with ENSR has insufficient funds to perform this task. Staff is requesting the Board amend FY 2000-01 Budget by appropriating $150,000 from the Undesignated Fund Balance to the Planning Rule Development and Area Sources Professional and Special Services account for CEQA consultant assistance. Further, staff is requesting to add $150,000 to the existing ENSR contract. LA DWP will reimburse AQMD for the actual cost of preparing the CEQA documentation. The Administrative Committee reviewed this item on April 13, 2001 and recommended approval.

19. Execute Additional Transit and Heavy-Duty Contracts and Alternative Fuels Subvention Fund Match Program Contracts within FY 2000-01 AB 2766 Discretionary Fund Work Program; Approve MSRC Authority to Adjust Project Costs Up 5%; and Authorize Chairman Authority to Execute Agreements

In December 2000 the Board approved a $17.2 million FY 2000-01 Work Program. The MSRC has released $401,373 from other programs to fund two more projects within this Work Program. The MSRC requests Board approval to execute these contracts, authority to adjust project costs up 5%, and authorization for the Chairman to execute agreements. The Board approved an allocation of $3 million for the Alternative Fuels Subvention Fund Match Program. In September 2000 the Board approved release of the Program Application and Announcement for the Match Program, which provides a 50-75% match for participating cities towards the purchase of alternative fuel vehicles and infrastructure. The application process commenced February 1 and closes June 30, 2001. The MSRC requests approval to execute contracts with local governments for eligible applications to date.

The AQMD is required by law to submit a report to the Legislature on its regulatory activities for the preceding calendar year. The report is to include a summary of each rule and rule amendment adopted by AQMD, number of permits issued or denied, emission offset transactions, draft budget and forecast, AQMD’s response to any recommendations included from the triennial performance audit process, AQMD actions in response to CARB and Legislative recommendations regarding their review of AQMD’s budget, and an update on the Clean Fuels and RECLAIM programs. In the February 16, 2001 meeting, the Board approved an increase in the dollar threshold for a fixed asset from $2,500 to $5,000. As a result of the change, items previously classified as a fixed asset will be purchased and expensed in an appropriate account in the Major Object Services and Supplies. This request is to move already-budgeted funds for the items previously classified as a fixed asset, but whose cost will be less than $5,000, from the Major Object Fixed Assets to the Major Object Services and supplies.

Proposed Rule 1195 will require public and private fleet operators with 15 or more school buses to purchase rule compliant vehicles when adding or replacing school buses in an existing fleet or forming a new fleet.(Review: Mobile Source Committee on January 26, 2001 & February 23, 2001)

38. Amend Regulations IX - Standards of Performance for New Stationary Sources, and X - National Emission Standards for Hazardous Air Pollutants

Local air districts are authorized by EPA to implement federal standards set in 40 Code of Federal Regulations (CFR) Part 60, Standards of Performance for New Stationary Sources and Part 61, National Emission Standards for Hazardous Air Pollutants (HAPs). Periodic amendments to Regulations IX and X incorporate the new or amended standards by reference. Nine actions regarding NSPS and one NESHAP are proposed for incorporation into Regulations IX and X, respectively. Three of these changes will reduce HAPs. The others include clarifications and corrections, administrative changes, and changes to test methods and monitoring. (Review: Stationary Source Committee, February 23, 2001.)

39. Amend Rules 1303 - Requirements and 2005 - New Source Review for RECLAIM

The proposed amendments will revise the applicable modeling requirements in several subregions of the SCAQMD that are in attainment with state and federal ambient air quality standards. New or modified sources in attainment subregions will be allowed to increase their emissions provided such increase over the measured background concentration will not violate any air quality standard; BACT will be utilized; and offsets will be provided. Modeling requirements for sources in non-attainment subregions will remain the same. (Review: Stationary Source Committee, February 23, 2001.)

40. Amend Rule 1309.1 - Priority Reserve

The proposed amendments will allow new electric generating facilities to temporarily access the AQMD's Priority Reserve account to offset their PM10 emission increases provided they meet specific criteria and pay appropriate mitigation fees. 41. Amend Rule 1610 - Old Vehicle Scrapping

The proposed amendments will modify Rule 1610 to conform with CARB's recently finalized statewide vehicle scrapping requirements applicable to all air quality districts that implement vehicle scrapping programs for emission credit generation purposes. Amendments include updating procedures related to vehicle eligibility and processing, emission credit quantification and use, as well as other minor administrative changes. These amendments include, but are not limited to, allowing later model year cars to be eligible for scrapping and using updated emission credit values per scrapped vehicle as provided by CARB. The meeting will be adjourned to May 4, 2001, at 1:00 p.m., for the purpose of conducting the Board’s Workshop on the Executive Officer’s Fiscal Year 2001-02 Budget and Work Program and Proposed Amendments to Regulation III - Fees. The Workshop will be held at AQMD Headquarters, 21865 E. Copley Drive, Diamond Bar, California, in Conference Room CC8.

***PUBLIC COMMENTS***

Members of the public are afforded an opportunity to speak on any listed item before or during consideration of that item. Please notify the Clerk of the Board, (909) 396-2500, if you wish to do so. All agendas are posted at AQMD Headquarters, 21865 E. Copley Drive, Diamond Bar, California, at least 72 hours in advance of the meeting. At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under Public Comments may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record, provided 25 copies are presented to the Clerk of the Board. Electronic submittals to cob@aqmd.gov of 10 pages or less including attachments, in MS Word, plain or HTML format will also be accepted by the Board and made part of the record if received no later than 5:00 p.m., on the Tuesday prior to the Board meeting.
