(C) Rule 403.1 - Wind Entrainment of Fugitive Dust

Rule 403.1 is a complementary regulation to Rule 403 (Fugitive Dust) and is applicable to certain Coachella Valley activities during high wind conditions. When Rule 403.1 was originally adopted in 1993, a rule reference was included to a specific Rule 403 provision. Since that time, Rule 403 has been amended and the provision referenced in Rule 403.1 has moved. Staff proposes this minor administrative amendment to Rule 403.1 to preserve the original intent of the Rule. This item will be reviewed by the Stationary Source Committee on May 26, 2000.

(D) Rule 1146 - Emissions of Oxides of Nitrogen from Industrial, Institutional, and Commercial Boilers, Steam Generators, and Process Heaters

AQMD is proposing to amend Rule 1146 to address issues raised by a variance. Proposed Amended Rule 1146 will provide a one-time exemption from the NOx emission limit for owners and operators of standby boilers which exceeded 90,000 therms of annual heat input in a single previous calendar year. This item was reviewed by the Stationary Source Committee on April 28, 2000.

The terms of office for Edward Camarena, Engineer Member, and alternate Farooq Khan; and Laurine Tuleja, Attorney Member, and alternate Janet Dillon, expire June 30, 2000. Pursuant to California Health and Safety Code Section 40501.1(b), an Advisory Committee, consisting of one representative appointed by each of the Counties of Los Angeles, Orange, Riverside, and San Bernardino, and the City of Los Angeles was appointed, interviewed each candidate and made recommendations to the Administrative Committee. The Administrative Committee reviewed the Committee's recommendations at its meeting on April 14, 2000, and recommended approval. This action is to appoint the Attorney, Engineer and Alternate Members to three-year terms terminating June 30, 2003.

4. Approve Salary Adjustment for Noncontract Management and Confidential, and Attorney Employees

Current labor contracts provide for salary adjustments for union-represented employees effective June 26, 2000. This recommendation is to approve an equivalent salary adjustment for noncontract management, confidential, and attorney employees, also effective June 26, 2000. 5. Execute Sole-Source Contract with Los Angeles County Agricultural Commission Department of Weights and Measures for Gasoline Vapor Recovery Inspections and Testing

This action is to award the sum of $100,000 for FY 2000-01 to the Los Angeles County Agricultural Commission Department of Weights and Measures inspectors to conduct vapor recovery inspections and perform tests at retail gasoline dispensing facilities within the Los Angeles County portion of the AQMD. This action will also authorize at least $100,000 to be awarded in FY 2001-02 and FY 2002-03 if included in the AQMD Annual Budgets for these fiscal years and if the work is approved by the Executive Officer. Funding for the increase over the FY 1999-00 level will come from proposed increased fees for gasoline dispensing facilities. 6. Issue RFP for Management Firm to Operate Diamond Bar Headquarters Cafeteria

The contract with Food Systems, Inc. for the management and operation of AQMD's Diamond Bar cafeteria expires on December 31, 2000. This action is to issue an RFP to solicit bids from interested parties in order to secure a new three-year contract for this service. 7. Execute Contract for Independent Testing Support for Technology Advancement Program

The Technology Advancement office is seeking to develop new clean-fuel technology to assist the District in achieving ambient air quality standards. Staff is frequently asked to assess various technologies that may further reduce emissions from clean-fuel vehicles. These include various fuel compositions, additives, add-on devices, engine flushing systems and unconventional lubricants. Staff has received a proposal from the University of California, Riverside, College of Engineering-Center for Environmental Research and Technology to provide technical support for such assessments. This proposed level-of-effort agreement shall not exceed $100,000. This item was reviewed by the Technology Committee on March 24, 2000. The US Department of Energy has designated the University of California, Davis Fuel Cell Vehicle Center, as one of its two university fuel cell vehicle centers. Located at Institute of Transportation Studies, one of the goals of the Center is to develop a Fuel Cell Vehicle Modeling Program. This program, will assist the development of fuel cells for application in the mobile sector. Since its inception in January 1998, the program has attracted over a dozen corporate sponsorships including several major automobile manufacturers and two government agencies. The AQMD participation is for a period of three years in an amount not to exceed $40,000 for the next 2 years. Total cost-sharing for this period from industry and government partners is $660,000. 9. Execute Contract to Co-Sponsor Study of Electric Hotel Shuttle Service at Los Angeles International Airport

Hotel shuttle vehicles account for approximately 15% of all commercial passenger trips into Los Angeles International Airport (LAX). Collectively, these vehicles emit approximately 20 tons of NOx, 3 tons of hydrocarbons, 28 tons of CO and 1.25 tons of particulate matter each year. CALSTART proposes to examine the feasibility of a consolidated shuttle service, utilizing electric and hybrid electric vehicles at LAX. Project participants include Los Angeles World Airports, Los Angeles Visitors and Convention Bureau, Los Angeles Department of Water and Power, and The Energy Foundation. Total project cost is $220,000; total AQMD funding will not exceed $50,000. This item was reviewed by the Technology Committee on March 24, 2000. 10. Execute Contract to Co-Sponsor Evaluation of Alternative-Fuel Transit Bus Maintenance Practices and Design of Training Curriculum for Maintenance and Repair of Alternative Fuel Transit Buses

The proposed project with the Transportation Foundation of Los Angeles will evaluate existing transit maintenance practices and existing reports to determine the most successful approaches to maintenance and repair of alternative-fuel buses. Upon completion of this evaluation, a determination will be made for the best approach for development of a customized training program for transit personnel and others for the servicing of alternative-fuel buses. 11. Execute Contracts for Class 7 & 8 On-Road Trucks Projects Awarded Under Carl Moyer Memorial Air Quality Standards Attainment Program

On January 11, 2000, proposals were received in response to RFP #9900-06 for the Carl Moyer Memorial Air Quality Standards Attainment Program. Staff recommends award of contracts to fund class 7 & 8 on-road trucks. Additionally, the state Legislature mandated all funding awards for the FY 1998-99 Carl Moyer Program to have fully executed contracts by June 30, 2000. Several companies awarded funding under that Program are unable to commit to their proposed projects before that date. Staff recommends using these returned funds for applications received through the FY 1999-00 Carl Moyer Program solicitation. Total cost to the Carl Moyer Program Fund will be $3,355,046 including all returned funds. This item was reviewed by the Technology Committee on March 24, 2000. 12. Execute Contract to Co-Sponsor Evaluation of Air Quality Benefits of Battery-Operated Emergency Roadside Flares

Traditional chemical roadside flares may create safety hazards and emit approximately 5 to 7 tons of sulfur dioxide per year in the Basin, along with nitrogen oxides, carbon monoxide, and carbon dioxide. The Claremont Police Department (CPD) has submitted a proposal to conduct a pilot-project to evaluate the feasibility and air quality benefits of replacing the traditional chemical flares with safer, non-polluting battery-operated flares. Basin-wide substitution of chemical flares with battery-operated flares could reduce sulfur dioxide emissions by approximately 5-7 tons per year. Staff recommends co-sponsoring the proposed pilot-project. Total project cost is $9,456 and AQMD's contribution will not exceed $7,200. 13. Execute Contract to Co-Sponsor Design Practices for Integration of Fuel Systems and Methane Detection for Natural Gas Trucks

SAE 2343 established recommended practices to ensure the safe design and operation of LNG-powered heavy-duty trucks. The proposed project will develop a similar document (SAE J2406) for compressed natural gas heavy-duty trucks. In addition, SAE J2343 will be amended to incorporate California Highway Patrol requirements for the use of methane detection devices in the engine and driver compartments of liquefied natural gas heavy-duty trucks operating in California. Total project cost is approximately $218,000; total AQMD funding will not exceed $63,000. This item was reviewed by the Technology Committee on March 24, 2000. 14. Execute Contract to Complete Development of Direct Methanol Fuel Cell

On October 10, 1997, the Board awarded California Institute of Technology, with Jet Propulsion Laboratory as subcontractor, a contract to develop a first-generation 1kW direct methanol fuel cell. Total project cost was $638,500, of which AQMD provided $338,500 and ARB provided $300,000. Due to lengthy contract negotiations and failing health of the principal investigator, the project was not completed by its due date of March 30, 2000, and most of the committed funds were unspent. Important progress has been made in this project and additional time is needed to complete it. Staff recommends that the Board execute a contract to complete this project in an amount not to exceed $300,000, the unspent balance of contract #98139. 15. Execute Contract to Co-Sponsor Professional Wet Cleaning Technology Pilot Incentive Program

Water-based professional wet cleaning technology has been used at a few garment cleaners in the Basin, but has not received wide acceptance. Staff recommends awarding a contract to Occidental College to convert dry cleaners, currently using toxic perchloroethylene (PCE), to professional wet cleaners through a financial incentive program. The cleaners thus converted to professional wet cleaning will be used as demonstration sites to enhance further acceptance. Conversion to wet cleaning will reduce the adverse health impacts of PCE. The total project cost is $331,798 and AQMD�s contribution will not exceed $242,798. This item was reviewed by the Technology Committee on March 24, 2000. 16. Execute Contract to Provide Technical Support for Evaluation and Implementation of Compressed Natural Gas Fueling Facilities

The CNG refueling industry builds and installs a wide variety of non-standardized, application-specific refueling systems. Local government agencies, school districts, and others are faced with designing and procuring CNG fueling stations with little or no knowledge of the pertinent technical and regulatory requirements. Due to increased interest in operating CNG vehicles, both from the Carl Moyer Program, and the Proposed Rule 1190 series, AQMD staff has received numerous requests for assistance in accumulating information necessary to specify equipment and estimate costs of establishing CNG fueling facilities. Staff proposes to execute a contract with Burnett and Burnette to provide technical support for the establishment of CNG fueling facilities. AQMD funding will not exceed $45,000. This item was reviewed by the Technology Committee on April 28, 2000, and recommended for approval.

17. Issue RFP for Implementation of Low-Emission, Alternative Fuel Heavy-Duty Vehicles within South Coast Air Basin

Over 60% of the South Coast Air Basin�s NOx emissions inventory can be attributed to on-road mobile sources. Heavy-duty trucks and buses are responsible for 20% of the total NOx emissions. Low-emission, alternative-fuel heavy-duty engines produce one-half or less the NOx emissions of their diesel counterparts and a fraction of the particulates. The purpose of this RFP is to solicit cost-shared proposals to provide both technical and public outreach supports for the implementation of low-emission, clean fuel heavy-duty vehicles within the Basin. Total cost to the AQMD�s Clean Fuels Program will be $250,000. This item was reviewed by the Technology Committee on March 24, 2000. The Request for Qualifications will solicit statements of qualifications from individuals and organizations potentially capable of providing emissions testing services and technical assistance in conducting due diligence investigation of application information supplied for marine vessels under the Carl Moyer Memorial Air Quality Standards Attainment Program. It is anticipated that multiple awards for level-of-effort contracts will be made from this solicitation. Sufficient funds are available from the Carl Moyer Program Special Revenue Fund to support this work in an amount not to exceed $50,000. The AQMD currently has contracts with three companies for short- and long-term system development services. These contracts are periodically amended to add budgeted funds as additional needs are defined. With Board approval, $200,000 of previous fiscal year funds were encumbered in Majesco Software Corporation's (Majesco's) contract for work not yet begun. Majesco's contract has expired, and they are not renewing further contractual arrangements with the AQMD. Authorization is requested to re-appropriate this $200,000 from the Undesignated Fund Balance to complete the work not started by Majesco. This action also is to amend contracts with the remaining three companies approved by the Board to add $330,000 for needed systems development efforts. Funds in excess of the re-appropriated $200,000 (i.e., $130,000) are available in the Information Management FY 1999-00 Budget.

20. Approve Co-Sponsorship of American Lung Association of Los Angeles County's Development of Its "A Is for Asthma" Program, and Expansion of Its "Clean Air Kids Club" Program

The AQMD proposes to provide $57,000 to co-sponsor the American Lung Association of Los Angeles County's development and expansion of two programs. "A Is for Asthma" is an educational video-based program aimed at preschool children to teach them and their caregivers about asthma management and prevention. "Clean Air Kids Club" has two components: a children's website which promotes air quality and environmental health, and a clean air patch program, which promotes education and awareness of air quality through children's organizations. Funds for this project are available in the FY 1999-00 Budget. This item was reviewed by the Administrative Committee on April 14, 2000, and recommended for approval.

21. Recognize and Appropriate Funds to Provide Upper-Air Wind and Temperature Monitoring Services

At its October 9, 1998 meeting, the Board recognized $175,000 in revenue from the ARB to be appropriated to the FY 1998-99 Budget as part of the ARB's commitment to the $350,000 funding of upper air and temperature monitoring services provided by the National Oceanic and Atmospheric Administration. The funds from ARB were not received until FY 1999-00 and, therefore, need to be recognized in this budget year. This action is to recognize the $175,000 from ARB and appropriate the funds to the FY 1999-00 Budget. This item was reviewed by Administrative Committee on April 14, 2000 and recommended for approval.

22. Recognize and Appropriate Additional Funds from ARB for Children�s Health Study

On April 21, 2000, the Board recognized $90,334 from the ARB to provide air monitoring support for the ARB�s Children�s Health Study (CHS). Since then, the ARB has revised its funding level for an additional amount of $219,960. These additional funds are to cover two temporary air monitoring technicians dedicated to the CHS through the termination date of the contract, December 31, 2001. This action is to recognize the additional $219,960 from ARB, and appropriate these funds to the FY 1999-00 Budget. This item was reviewed by the Administrative Committee on May 12, 2000, and recommended for approval.

Recent amendments to Rule 1402 - Control of Toxic Air Contaminants From Existing Sources, require that staff notify the Governing Board and affected parties when the state adds chemicals or changes risk values for toxic air contaminants. In February and April 2000, Office of Environmental Health & Hazard Assessment finalized Chronic Reference Exposure Levels for 39 compounds. Staff will analyze the potential impacts of these changes for Rules 1401 and 1402 and report back to the Board at the August Board meeting.

The proposed amendment would (1) allow thirty (30) days for a permit applicant to appeal to the Hearing Board upon receipt of notification of the denial of a permit; (2) allow thirty (30) days for a person to appeal to the Hearing Board following any decision or action pertaining to the issuance of a permit. These amendments result from recent changes in California Health & Safety Code Sections 42302 and 42302.1.

The proposed amendments to Rule 219 will clarify permit requirements for categories of equipment which are exempt from operating permits. Specifically, the amendments will clarify requirements for cleaning, combustion, food processing, powder coating, dip coating, electrolytic plating and anodizing equipment.

The proposed amendment to Rule 222 will require boilers and process heater emission sources that are exempt from permit requirements pursuant to Rule 219 to submit a filing. This amendment will add approximately 12,000 boilers and process heaters with a rated heat input from 1,000,000 Btu per hour up to and including 2,000,000 Btu per hour to the filing program. This will enable staff to simplify and streamline the permitting process in a filing program for low-emitting equipment as an alternative to the conventional permitting process.

Proposed Amended Regulation III includes a 2.9% across-the-board California Consumer Price Index increase in fees, in addition to an 8.1% increase for annual operating permit emission fees; implements the second-tier fee increases for gasoline dispensers and Title V permits; adjusts the Hearing Board fees to reflect some of the District's cost. A $50 per person fee is proposed for employee transportation coordinator training pursuant to Rule 2202. Other changes necessary for clarification are proposed. The Executive Officer's Budget for FY 2000-01 represents the input over the past several months from staff, Board members, and the public. This year's process included several meetings of the Budget Advisory Committee; a public hearing February 18, 2000 to take input on the AQMD's Program Goals and Objectives; and two budget workshops, one for the public on April 18, 2000 and one for the Board on April 28, 2000. This submittal transmits the required appropriations and reserves necessary to adopt the proposed budget. This item was reviewed by the Administrative Committee on April 14, 2000 and recommended for approval.
