The RFP for Employee Relations Litigation and/or Negotiation Services was released on January 21, 2000. The evaluation of fifteen proposals has been completed and the evaluation panel recommended that contracts be awarded to four firms: Best, Best & Krieger; Gutierrez, Preciado & House; Woodruff, Spradlin & Smart; and, Atkinson, Andelson, Loya, Rudd & Romo. The total amount of the four contracts shall not exceed $150,000 per year for the next three years, and funding has been included in the proposed FY 2000-01 Budget. This item was reviewed by the Administrative Committee on May 12, 2000, and recommended for approval.

3. Approve Reallocation of PAMS Funds for Fixed Assets and Execute Contracts for Equipment in Air Monitoring Network

On October 8, 1999, the Board recognized PAMS funding from EPA and allocated some of those funds for fixed assets to replace old air monitoring equipment. On January 21, 2000, the Board approved the release of four RFQs to purchase the designated equipment. Results from the RFQs indicate that some equipment now cost less than the original estimate, and reallocation of the PAMS fixed asset budget is needed to maximize the utilization of federal PAMS funding. This action is to approve reallocation of PAMS funds for Fixed Assets #34, #41, #44, and #45, and execute contracts with four vendors for the purchase of equipment for the air monitoring network and the PAMS program. Sufficient funding is available in the FY 1999-00 Budget. This item was reviewed by the Administrative Committee on May 12, 2000, and recommended for approval.

4. Execute Contract to Co-Sponsor Implementation of Advanced Technology Natural Gas Fueling Station in Banning

The City of Banning proposes a project to evaluate currently-available CNG fueling systems and use this information to provide a template for design and construction of new L/CNG fueling stations providing a lower cost alternative to conventional custom built stations. The recommendations will be used to construct a model L/CNG station in Banning. Total project cost is $725,000; total AQMD funding will not exceed $140,000. This item was reviewed by the Technology Committee on April 28, 2000, and recommended for approval.

5. Execute Contracts to Co-Sponsor Demonstration of School Buses Retrofitted with Particulate Matter Reduction Technologies

Protecting children from exposure to diesel exhaust is a priority to the AQMD. Staff proposes a six-month school bus demonstration program with three local school districts to confirm the performance behavior and particulate matter emissions reduction potential of newly developed retrofit technologies by Johnson Matthey and Engelhard. AQMD proposes to execute multiple contracts with the participants and will coordinate and manage the project. Total project cost is approximately $543,200. AQMD's contribution shall not exceed $300,100. Co-funding will be provided by the ARB, $120,000; Johnson Matthey, $67,500; and Engelhard $55,600. ARCO will supply low-sulfur diesel fuel at the same price as regular diesel. This item was reviewed by the Technology Committee on April 28, 2000, and recommended for approval.

6. Execute Contract to Co-Sponsor Demonstration and Evaluation of U.S. Postal Service Electric Mail Delivery Vehicles

The U. S. Postal Service (USPS) selected Ford Motor Company to provide 500 electric mail delivery vehicles for demonstration. These mail delivery vehicles are derived from the Ford Ranger EV pick-up truck. If this demonstration is successful, the USPS will order an additional 5500 such vehicles for postal operation. Southern California Edison (SCE) was selected by the USPS for testing and evaluation of the electric mail delivery vehicles and has submitted a proposal to the AQMD requesting funding for this activity. The testing would be conducted at the SCE EV Technical Center in Pomona. The total cost of the 500-vehicle demonstration is approximately $23.5 million. The cost share for the testing and evaluation activity shall not exceed $399,617. This item was reviewed by the Technology Committee on April 28, 2000, and recommended for approval.

7. Execute Contract to Cost-Share Demonstration of Hydrogen Refueling Station at Sunline Transit

Hydrogen fuel cell bus technology has the potential to eliminate a range of criteria pollutant emissions. Sunline Transit, a progressive all-CNG bus property, will be the first transit agency in Southern California to operate hydrogen fuel cell buses. Hydrogen Burner Technology (HBT) has proposed to install a complete hydrogen generation and refueling station to provide the needed hydrogen at Sunline Transit facility. The total project cost is $915,000. The proposed AQMD cost-share is $300,000. Cost-sharing will be provided by ARB, HBT and Sunline. This item was reviewed by the Technology Committee on April 28, 2000, and recommended for approval.

8. Execute Contracts for Class 5-6 Vehicles, Transit Buses and Other On-Road Applications Awarded Under Carl Moyer Memorial Air Quality Standards Attainment Program

On September 10, 1999, the Board approved the release of an RFP for the Carl Moyer Memorial Air Quality Standards Attainment Program to solicit projects for low-emission on- and off-road vehicles and equipment. Staff proposes to award contracts to fund the differential cost of alternative fuel class 5-6 vehicles, transit buses, and other on-road applications for a total funding of $4,097,743 from the Carl Moyer Program Fund. Total project cost is $45,171,802. This was reviewed by the Technology Committee on May 26, 2000, and recommended for approval.

9. Issue RFP to Assess, Develop and Demonstrate Low-VOC Cleaning Systems

Rule 1171 � Solvent Cleaning Operations, requires an assessment of the available low-VOC technologies for several cleaning operations to evaluate the feasibility of the year 2005 VOC limits. Staff recommends that an RFP be issued to solicit proposals for the assessment, development and demonstration of effective low-VOC cleaning systems. If cleaning systems compliant with the year 2005 VOC limits are successfully developed and implemented, approximately 9 tons per day of VOC emission reduction could take place. The AQMD funding for this project shall not exceed $150,000. This item was reviewed by the Technology Committee on April 28, 2000, and recommended for approval.

10. Execute Contract to Expand AQMD Socioeconomic Assessment Program

To assist AQMD staff in assessing potential economic impacts of plans, proposed rules and BACT determinations, staff is recommending developing additional assessment tools and enhancing existing models. AQMD uses the Regional Economic Models, Inc. (REMI) model to perform secondary economic impact assessments of air quality regulations and is recommending an upgrade to reflect geographic, social, and economic variations within each county for the 2001 AQMP up to $80,500. Funding is available in the FY 1999-00 Budget. Staff will be recommending an RFP to augment existing socioeconomic analysis tools to include a facility-based and post-rule retroactive analysis framework for Board consideration in July. This item was reviewed by the Administrative Committee on May 12, 2000, and recommended for approval.

11. Execute Contract to Conduct Performance Audit of AQMD for FY Ending June 30, 2000

Health and Safety Code Section 40453 requires the AQMD to contract every three years with a qualified auditing firm to conduct a performance audit of AQMD activities. The Board approved the issuance of an RFP in April 2000, and this action is to award the contract to Thompson, Cobb, Bazilio & Associates at an amount not to exceed $139,860. Funds for this service are available in the FY 2000-01 Budget. This item was reviewed by the Administrative Committee on June 9, 2000, and recommended for approval.

12. Adopt Resolution to Renew General Services Agreement with County of Los Angeles

Since its inception, the AQMD has contracted with the County of Los Angeles for the provision of various services such as treasury services, vehicle oil and gasoline, retirement program administration, and various supply items. The estimated annual cost of these services is $30,000. The current agreement expires on June 30, 2000, and the proposed agreement is for a period of five years beginning July 1, 2000 and ending June 30, 2005. The Board is currently reviewing its Treasury Management options. This agreement would not preclude the AQMD from appointing a new Treasurer other than the County of Los Angeles. This item was reviewed by the Administrative Committee on May 12, 2000, and recommended for approval.

13. Authorize Purchase of Doppler Sodar Boundary Layer Wind Measurement Systems

At its April 21 meeting, the Board approved an RFQ for the purchase of Doppler sodar boundary layer wind measurement systems. As part of the U.S. EPA PAMS program, staff proposes the purchase of two Doppler sodar systems. The sodars will supplement current upper-air measurements from surface-based meteorological towers and radar wind profilers to improve regional modeling analyses and forecasts. This action is to authorize purchase from the recommended bidder, at a cost not to exceed $85,000 with funds identified in the FY 1999-00 Budget from grants awarded by the U.S. EPA for this purchase. This item was reviewed by the Mobile Source Committee on May 26, and recommended for approval.

14. Re-design Air Quality Assistance Fund Program to Provide Financial Assistance for Small Businesses Subject to Air Pollution Control Requirements

The Air Quality Assistance Fund was established as a loan guarantee program to increase the availability of financial assistance to small businesses for the purpose of complying with AQMD regulations. This report reviews past and current performance of the program and recommends enhancements to make the program more effective in the present financial market. 17. Report on Effectiveness of Voluntary Ridesharing and Other Emission Reduction Options

The exemption of Rule 2202 employer worksites with 100-249 employees, as required by Senate Bill 432 (Lewis) has resulted in an emission reduction shortfall. To determine the shortfall, the AQMD commissioned a study to evaluate the effectiveness of voluntary ridesharing. This report summarizes the study results and identifies the Rule 2202 emission reduction shortfall for 1999. This item was reviewed by the Mobile Source Committee on May 26, 2000.

The AQMD is proposing to amend Rule 1146 to address issues raised by a variance. Proposed Amended Rule 1146 will provide a one-time exemption from the NOx emission limit for owners and operators of standby boilers which exceeded 90,000 therms but not greater than 110,000 therms of annual heat input in the calendar year 1996. 35. Adopt Proposed Rule 1191 � Light- and Medium-Duty Public Fleet Vehicles

38. Amend Rule 403.1 - Wind Entrainment of Fugitive Dust

Rule 403.1 is a complementary regulation to Rule 403 - Fugitive Dust and is applicable to certain Coachella Valley activities during high wind conditions. When Rule 403.1 was originally adopted in 1993, a rule reference was included to a specific Rule 403 provision. Since that time, Rule 403 has been amended and the provision referenced in Rule 403.1 needs to be amended. Staff proposes this minor administrative amendment to Rule 403.1 to preserve the original intent of the Rule. (Review: Stationary Source Committee on May 26, 2000.)

It is necessary for the Board to recess to closed session pursuant to Government Code sections: 54956.9(a) to confer with its counsel regarding pending litigation which has been initiated formally and to which the District is a party--the actions are Coalition for Clean Air, et al. v. SCAQMD, et al., United States District Court Case No. 97-6916 HLH (SHx), and Langsam v. SCAQMD, Los Angeles Superior Court Case No. BS055249; 54956.9(b)(1) to confer with its counsel because, based on existing facts and circumstances, there is a significant exposure to litigation against the agency based on notice by an environmental group stating their intent to initiate legal action against the District for violating the Clean Air Act by reinstating Powerine Oil Refinery�s permits (one case); and 54956.9(c) to confer with its counsel to decide, based on existing facts and circumstances, whether to initiate litigation (one case).

It is necessary for the Board to recess to closed session pursuant to Government Code section 54956.8 to provide direction to its negotiator regarding the price and terms for a lease of real property. The property is a portion of the District Headquarters Building at 21865 E. Copley Drive, Diamond Bar, California 91765. The negotiator is Sylvia Oroz. The parties to the negotiations are: AsiaDemand, Inc., Babynet.com, and City of Diamond Bar.

At the May 19, 2000, Board meeting, Councilman Bernson requested staff to provide a report on the potential for requiring low-sulfur diesel and particulate traps for existing diesel vehicles. This is the staff's report.
