(A) Proposed Rule 1186.1 - Less-Polluting Sweepers

Proposed Rule 1186.1 will require public and private fleet operators to acquire alternative-fuel or otherwise-less-polluting sweepers when purchasing or leasing these vehicles for sweeping operations undertaken by or for government jurisdictions or agencies with greater than 15 vehicles. (B) Rule 1401 - New Source Review of Toxic Air Contaminants, and Report on Impacts Relative to Sources Subject to Rule 1402 - Control of Toxic Air Contaminants from Existing Sources

In February and April 2000 the Scientific Review Panel and the Office of Environmental Health Hazard Assessment finalized chronic risk values for approximately 39 compounds. Rule 1401(e)(2) and (e)(3) require an analysis and report to the Board before new or updated risk factors, respectively, are used for new source review. Proposed amendments to Rule 1401 will update the list of compounds and effective dates in Table I. In addition, Rule 1402(j)(4) requires an analysis of the potential impacts on sources subject to Rule 1402 prior to use of new or updated risk factors for facility-wide health risk assessments. (C) Rule 109 - Recordkeeping for Volatile Organic Compound Emissions

Proposed amendments would (1) streamline existing daily recordkeeping requirements; (2) allow monthly recordkeeping for sources meeting certain criteria; and, (3) allow sources to implement alternative recordkeeping systems that have been approved by the AQMD. The amendments are based on recommendations by the Monitoring, Recordkeeping, and Reporting Task Force that were presented to and approved by the Board. The changes are administrative and will result in a streamlined recordkeeping system that may result in a cost savings to affected sources. (Review: Stationary Source Committee on June 23, 2000.)

(D) Proposed Rule 1194 - Commercial Airport Ground Access

Proposed Rule 1194 will require airport ground public access services such as taxi, van shuttle, limousine, and courtesy shuttle services to purchase rule compliant vehicles when adding or replacing vehicles in an existing fleet or forming a new fleet. The proposed amendments will separate BACT for RECLAIM and non-RECLAIM sources into LAER for federal major sources, and BACT for minor sources pursuant to state law. Currently, LAER is required for emission increases from all sources. The proposed amendments will allow for cost considerations for minor source categories for BACT. Some minor source relocations will also be treated as modifications to existing sources. No significant adverse emission impacts are expected as a result of the amendments at this time. As part of the rule amendment process, staff has developed BACT Guidelines for minor sources. (Review: Stationary Source Committee on March 24, 2000 and June 23, 2000.)

(F) Rule 431.2 - Sulfur Content of Liquid Fuel

The proposed amendments will establish an immediate sulfur content standard for ultra low sulfur diesel fuel and, on or after January 1, 2004 will prohibit the purchase, sale or burning of diesel fuel which exceeds the sulfur standard. Such prohibition will be applicable to diesel fuel producers beginning on September 1, 2003. The proposed rule amendments will result in emission reductions of sulfur oxides and particulates and will ensure the emission control efficiency of catalyst or particulate trap technology employed on diesel vehicle engines. The proposed amendments will apply to all refiners, importers, distributors, marketers, retailers, and users of diesel fuels. 4. Appropriate Funds from Clean Fuels Fund and Execute Lease and Purchase Agreements for Four New-Technology Vehicles for Alternative Fuel Vehicle Loan Program

The AQMD tests and demonstrates new-technology vehicles with available low-emission and clean-fuel technologies. As part of the Technology Advancement Alternative Fuel Vehicle Loan Program, vehicles are procured as new technologies become available. It is proposed that the AQMD lease for three years, one General Motors EV1 and one Toyota RAV4 EV both with nickel metal hydride batteries, and purchase two Toyota Prius with hybrid- electric drivetrains and advanced batteries. Total cost to the AQMD for these four vehicles will not exceed $104,000. This item was reviewed by the Technology Committee on April 28, 2000, and recommended for approval.

5. Amend Contract to Co-Sponsor School Electric Vehicle Outreach Effort

Following an October 1998 Program Opportunity Notice to solicit clean fuels outreach projects, a contract was executed with California State University, Los Angeles (CSULA) to develop and implement a school/community visitation program featuring the Solar Eagle III, an award winning solar electric vehicle developed and built by the university. CSULA has proposed to extend the term of the project through the 2000-2001 school year and to expand the project to include a school mentoring program for the 2000-2001 school year. Total project cost is $97,582. AQMD�s contribution shall not exceed $37,400, with CSULA contributing $60,182. This item was reviewed by the Technology Committee on May 26, 2000, and recommended for approval.

6. Execute Contract to Co-Sponsor Development of Ultra-Low Emission Natural Gas Vehicle for Use in Shuttle and Package Delivery Applications

Thousands of taxis, shuttles, and small package delivery vehicles operate in and around the airports in the South Coast Basin. These vehicles typically operate within a fixed area or over fixed routes, an ideal application for natural gas-fueled vehicles. Baytech Corporation, in association with Clean Air Vehicle Technology Center and American Livery, Inc., proposes to develop and certify a General Motors 4.3-liter natural gas engine, and demonstrate the vehicle in passenger shuttle application. Total project cost is approximately $398,728; total AQMD funding will not exceed $186,211. This item was reviewed by the Technology Committee on May 26, 2000, and recommended for approval.

7. Execute Contract to Co-Sponsor Remote Sensing Measurements of On-Road Heavy-Duty Diesel Nitric Oxide and Particulate Matter Emissions

Nitrogen oxides (NOx) and PM exhaust emissions from heavy-duty diesel vehicles contribute significantly to the Basin�s emissions inventory. Remote sensing technology can be used to measure NO in the exhaust plume to estimate NOx emissions in a short timeframe. The technology can also be used to measure opacity or absorption to estimate PM emissions. The AQMD will join in efforts with the Coordinating Research Council (CRC) to issue an RFP to evaluate remote sensing measurements of NO and PM exhaust emissions from different types of heavy-duty diesel vehicles. Staff recommends AQMD�s participation in this RFP with a co-funding of $100,000. CRC�s co-funding will be $300,000. This item was reviewed by the Technology Committee on May 26, 2000, and recommended for approval.

8. Execute Contract to Co-Sponsor Development of Very Low-NOx Heavy-Duty Natural Gas Engine

The AQMD with co-funding from the California Energy Commission (CEC) and the U.S. Department of Energy (DOE) /National Renewable Energy Laboratory (NREL), issued an RFP on January 21, 2000 to develop a low-NOx heavy-duty natural gas engine. Five proposals were received, and Detroit Diesel Corporation and Cummins Engine Company are recommended for award. Detroit Diesel�s total project cost is $2,817,349. Staff proposes executing a contract with Detroit Diesel for $1,330,966. This will include $830,966 from AQMD, and $500,000 from CEC to be passed through AQMD. The balance of $1,486,383 will be cost-shared by Detroit Diesel. DOE/NREL will enter into a separate contract with Cummins for $998,586, which will be equally cost-shared by Cummins. This item was reviewed by the Technology Committee on May 26, 2000, and recommended for approval.

9. Issue RFP to Audit AB 2766 Fee Revenue Recipients for FYs 1997-98 and 1998-99

AB 2766 requires any agency that receives fee revenues subvened to the AQMD from the Department of Motor Vehicles to be audited once every two years. This action is to issue an RFP for an independent Certified Public Accountant to conduct the audits. This item was reviewed by the Administrative Committee on June 9, 2000, and recommended for approval.

10. Issue RFP for Coordinator for International Conference on Air Quality Technology and Education to Implement Board Initiative from the Millennium Board Retreat

This action is to release an RFP for consultant services to coordinate a two-day International Conference on Air Quality Technology and Education to be held in the Southland by the fall of 2001. The event would feature speakers from the international community and AQMD to provide the latest information on advanced air pollution technologies and public education programs, and opportunities to visit various technology demonstration projects and sites in the area. The estimated cost of the consultant services is $75,000, with funding available from the Clean Fuels Program ($15,787) and Fuel Cells Conference ($59,213) Special Revenue Funds. This item was reviewed by the Administrative Committee on July 14, 2000, and recommended for approval.

11. Authorize Purchase of Eight Vehicles for AQMD Fleet

Staff recommends purchasing eight new Toyota Camry CNG dedicated vehicles to accommodate the eight new field positions authorized for the vapor recovery program in the FY 2000-01 Budget. The choice of the Toyota Camry was made based on the Board's earlier selection of these vehicles and current availability. The Toyota Camry dedicated CNG model is available only from Toyota Motor Sales, U.S.A. Inc., fleet sales division at a per vehicle cost of $25,044 including sales tax. This item was reviewed by the Administrative Committee on June 9, 2000, and recommended for approval.

12. Approve Amendments to EV Infrastructure Program within the FY 1999-00 AB 2766 Discretionary Fund Work Program

A contract for $375,000 with the California Energy Commission for an EV Infrastructure Incentive Program was approved as part of the MSRC's FY 1999-00 Work Program. This followed a similar MSRC contract in FY 1998-99 program for $250,000, but which expired with funds unspent because the CEC's launch of the program was delayed. At its June 22, 2000 meeting, the MSRC approved reallocating the unspent funds totaling $231,000 to the follow-on contract for a total allocation of up to $606,000 as part of the FY 1999-00 Work Program. In addition, the MSRC approved increasing its match from $250 to $500 at the CEC's request. The MSRC requests the Board's approval of the amendments to the EV Infrastructure Program as part of the FY 1999-00 Work Program.

13. Remove Various Fixed Assets from AQMD Inventory

AQMD Policy and Procedure No. 20 requires a biennial Districtwide fixed asset inventory, an annual Science and Technology Advancement inventory, and the disposal of fixed assets declared surplus. In 1999 the biennial Districtwide fixed asset inventory was conducted. This action is to approve removal of unlocated fixed assets and to declare as surplus the equipment determined to be obsolete or broken and not worth repairing. This item was reviewed by the Administrative Committee on June 9, 2000, and recommended for approval.

30. Annual Status Report on Rule 1113 - Architectural Coatings

At its August 13, 1999 meeting, the Board approved a workplan for implementing the amendments to Rule 1113. This report summarizes the activities of District staff, the Working Group, Averaging/Niche Markets Sub-Group, and the Technical Advisory Committee; and the progress made relative to the Essential Public Service Coating technology assessment. The report also includes staff's recommendations as a result of the technology assessment for flat coatings. Both technology assessments are either requirements contained in the rule or part of the Board's resolution. This item was reviewed by the Stationary Source Committee on June 23, 2000.

It is necessary for the Board to recess to closed session pursuant to Government Code section 54956.9(a) to confer with its counsel regarding pending litigation which has been initiated formally and to which the District is a party--the action is Coalition for Clean Air, et al. v. SCAQMD, et al., United States District Court Case No. 97-6916 HLH (SHx). It is also necessary for the Board to recess to closed session pursuant to Government Code section 54956.8 to provide direction to its negotiator regarding the price and terms for a lease of real property. The property is a portion of the District Headquarters Building at 21865 E. Copley Drive, Diamond Bar, California 91765. The negotiator is Sylvia Oroz. The parties to the negotiations are: AsiaDemand, Inc., Babynet.com, and City of Diamond Bar.
