(A) Rule 1150.1 - Control of Gaseous Emissions from Municipal Solid Waste Landfills

The proposed amendments to Rule 1150.1 incorporate, by reference, the State regulations that specify requirements for final landfill covers and liquid waste disposal. The proposed amendments implement the air quality objective of Control Measure 99#WST-04 that seeks to reduce VOC emissions from waste disposal facilities. The proposed amendments are administrative and intended to be limited in scope. (Review: Stationary Source Committee on January 28, 2000.)

(B) Rule 1401 - New Source Review of Toxic Air Contaminants and Rule 1402 - Control of Toxic Air Contaminants from Existing Sources

Rule 1402 is directed toward reducing risk from toxic air contaminants from existing stationary sources. Proposed changes will lower the threshold for risk reduction and accelerate the time to make reductions unless specific technical or economic criteria are met. PAR 1402 identifies industries that will be required to submit inventories in three years unless a specific rule is adopted. The proposal adds a cancer burden threshold, additional inventory and public notification requirements, and other changes to improve rule effectiveness, remove duplicative requirements, and improve public health. 3. Approve Compensation Packages for Designated Deputies

The Executive Management Agreements of several Designated Deputies expire February 29, 2000 and July 31, 2000. In addition, recruitments have been completed for two Designated Deputy positions. This action is to approve the compensation package for several Designated Deputies.

4. Approve Classification and Compensation Recommendations

Based on the results of classification and compensation studies that included review of internal pay relationships and external labor market comparisons, a salary adjustment of three percent is recommended for the Secretary classification and for the Senior Deputy District Counsel classification. The total cost for FY 99-00 to implement these recommended changes is approximately $23,003. This item was reviewed by the Administrative Committee on February 11, 2000, and recommended for approval.

5. Authorize AQMD Membership in California Fuel Cell Partnership as Full Partner

7. Execute Contract to Co-Sponsor Evaluation of Impacts and Benefits of Hybrid Electric Vehicles

Hybrid Electric Vehicles (HEVs) have potential for significant beneficial impacts on fuel consumption, air quality and emissions of greenhouse gases. The Electric Power Research Institute (EPRI) has assembled a group of public and private stakeholders to compare the impacts and benefits of various HEV options. This group has developed four statements of work for competitive solicitation to evaluate the following areas: 1) HEV architecture, performance, modeling and impacts; 2) costs; 3) customer preference and interest; and 4) commercialization issues. AQMD's contribution to this project shall not exceed $250,000. EPRI and ARB will contribute $250,000 each. This was reviewed by the Technology Committee on January 28, 2000, and recommended for approval.

8. Re-Issue RFP to Solicit Marine Projects for FY 1999-00 Carl Moyer Memorial Air Quality Standards Attainment Program Funding

On September 10, 1999, the Board approved the release of RFP #9900-06 for the Carl Moyer Memorial Air Quality Standards Attainment Program for low-emission on- and off-road vehicles and equipment, including marine, construction and agricultural equipment. However, the marine portion of the RFP, Appendix 4 - Marine Vessels, was withheld from public notification and outreach pending modification of ARB guidelines for marine projects. Those issues have now been resolved and staff recommends release of the marine portion of the RFP. This item was reviewed by the Technology Committee on January 28, 2000, and recommended for approval.

9. Approve Change in Contractor for 14 EVCharge Applications within MSRC's FY 1997-99 AB 2766 Discretionary Fund Work Program; and Approve Additional Funding for Statewide EV Infrastructure Incentive Program within MSRC's FY 1999-00 AB 2766 Discretionary Fund Work Program

At its November 1999 meeting, the Board approved 61 EVCharge applications within the MSRC's FY 1997-99 Work Program, including 14 applications to Edison EV. However, Edison EV has exited the EV supply business and the 14 applications have been sold to the Sacramento Municipal Utility District. The MSRC recommends approval of this change in contractor. In addition, the MSRC's FY 1997-99 Work Program included $250,000 for a statewide EV Infrastructure Incentive Program administered by the CEC. The FY 1999-00 Work Program included an additional $375,000 funding for this program. The MSRC recommends the Board approve a $375,000 contract with CEC as part of its FY 1999-00 Work Program.

10. Execute Contracts for Short- and Long-Term Systems Development and Support Services

On October 8, 1999, the Board approved an RFP to obtain short- and long-term systems development services. This action is to execute contracts with Majesco Software, R Systems, Inc., and Sierra Cybernetics to obtain these services on a task order basis. Executing contracts with three bidders provides a pool of well-qualified professionals who have demonstrated their understanding of and expertise in meeting agency needs and enables AQMD to obtain cost-effective and technically responsive support. Funds for these services ($300,000) are included in the FY 1999-00 Budget. This item was reviewed by the Administrative Committee on January 14, 2000, and recommended for approval.

26. Approve Monitoring, Recordkeeping, and Reporting Task Force Recommendations to Streamline Recordkeeping for Dry Cleaning Operations

The Monitoring, Recordkeeping, and Reporting (MRR) Task Force has developed a consensus proposal to streamline recordkeeping for dry cleaning operations within AQMD. This proposal will reduce or eliminate unnecessary recordkeeping while maintaining rule enforceability. It is recommended that the Board direct staff to implement this proposal as detailed in the Board letter.

27. Final Resolution of Unresolved AB 2766 Program Audit Findings and Recommendations

Health and Safety Code 44244.1 requires any agency that receives fee revenues subvened from the Department of Motor Vehicles to be audited once every two years. This audit of AQMD's share, MSRC's share, and local governments' share of such subvened funds, performed by independent Certified Public Accountants, has been completed and makes certain recommendations for improvement in some areas. This item was reviewed by the Mobile Source Committee on January 28, 2000. Less than a quorum was present during the discussion of this item; those Committee members who were present communicated their concurrence.

28. Receive Public and Board Member Input on Executive Officer's Priority Goals for FY 2000-01

It is necessary for the Board to recess to closed session pursuant to Government Code Sections: 54956.9(a) to confer with its counsel regarding pending litigation which has been initiated formally and to which the District is a party--the actions are SCAQMD v. EPA, United States District Court Case No. CV 98-9789-HLH (ANx) and In re Affected Coatings Cases, Judicial Council Coordination Proceeding No. 4094; and 54956.9(c) to confer with its counsel to decide, based on existing facts and circumstances, whether to initiate litigation (1 case) and to discuss a case in which it has decided to initiate litigation (1 case).

30. Employee Transportation Coordinator Training Services

Under Rule 2202 - On-Road Motor Vehicle Mitigation Options, employers choosing to implement Employee Commute Reduction Programs (ECRPs) are required to designate an Employee Transportation Coordinator (ETC) who is responsible for developing, implementing, monitoring, and marketing an ECRP. The designated ETC must attend a one-time 16-hour AQMD certified training course designed to educate the ETC about Rule 2202. The current training contract expired 12/99. Previous direction was given from the Mobile Source Committee to determine the impacts of internalizing this training function. This item was discussed at the January 28, 2000 Mobile Source Committee meeting. Less than a quorum was present; the Committee Member who was present communicated his recommendation to take this item to the February Governing Board meeting for consideration.

31. Adopt Resolution Supporting Railhaul of Non-Hazardous, Non-Recyclable Solid Waste to Distant, Environmentally-Sound Landfills

The Board will consider adopting a resolution supporting railhaul of non-hazardous, non-recyclable solid waste to distant, environmentally-sound landfills. Urban landfills located close to homes and businesses are a documented source of nuisance odors, impacting the quality of life for entire communities. Long distance railhaul disposal of appropriate waste will alleviate these problems.
