The proposed amendments will: (1) allow thirty (30) days for a permit applicant to petition the Hearing Board upon receipt of notification of the denial of a permit and (2) allow thirty (30) days for a person to petition the Hearing Board following any decision or action pertaining to the issuance of a permit. These amendments result from recent changes in California Health & Safety Code Section 42302 and Section 42302.1. (Review: Stationary Source Committee on March 24, 2000).

(B) Rule 219 - Equipment Not Requiring a Written Permit Pursuant to Regulation II and Rule 222 - Filing Requirements for Specific Emission Sources Not Requiring a Permit Pursuant to Regulation II

The proposed amendments to Rule 219 will clarify permit requirements for categories of equipment which are exempt from operating permits. Specifically, the amendments will clarify requirements for cleaning, combustion, food processing, powder coating, dip coating, electrolytic plating and anodizing equipment. The proposed amendment to Rule 222 will require boilers and process heater emission sources that are exempt from permit requirements pursuant to Rule 219 to submit a filing. This amendment will add approximately 12,000 boilers and process heaters with a rated heat input from 1,000,000 Btu per hour up to and including 2,000,000 Btu per hour to the filing program. This will enable staff to simplify and streamline the permitting process in a filing program for low-emitting equipment as an alternative to the conventional permitting process. (C) Regulation III - Fees

Proposed Amended Regulation III includes a 2.9% across-the-board California Consumer Price Index increase in fees in addition to an 8% increase for annual operating permit emissions fees; implements the second-tier fee increases for gasoline dispensers and Title V permits; adjusts the Hearing Board fees to reflect some of the AQMD's cost. A $50 per person fee is proposed for employee transportation coordinator training pursuant to Rule 2202. Other changes necessary for clarification are proposed. 3. Execute Contract to Co-Sponsor Development and Evaluation of Battery Dominant Hybrid Electric Vehicle Systems

The Hybrid Electric Vehicle Center at UC Davis has been pioneering the development of battery dominant hybrid electric vehicle (BDHEV) systems. UC Davis has proposed the development of grid-charged BDHEVs with the latest clean engine technology to achieve super ultra low emission vehicle targets. In the proposed project, the powertrain and control algorithms of a recently developed light-duty BDHEV will be optimized, and a new medium-duty battery dominant Chevrolet Suburban HEV will be designed and constructed. AQMD's contribution to this project shall not exceed $400,000. Co-funding will be provided by the Defense Advanced Research Projects Agency, $2,090,500: Visteon, $175,000; and Sacramento Municipal Utility District, $100,000. This was reviewed by the Technology Committee on February 25, 2000, and recommended for approval.

4. Execute Contract for Independent Audit Services for FYs Ending June 30, 2000, 2001, and 2002

On December 10, 1999, the Board approved the release of an RFP for independent financial audit services. An evaluation panel composed of outside and AQMD Legal and Finance staff evaluated the proposals. Three proposals were submitted to the Administrative Committee for consideration at their March 10, 2000 meeting. After the committee interviewed representatives of each of the firms, Simpson & Simpson was selected, at a maximum three-year cost of $59,775, to be recommended to the full Board.

5. Authorize Purchase of Twenty-nine Vehicles for AQMD Fleet

To reduce the number of high-mileage vehicles in AQMD�s aging fleet and promote the use of dedicated CNG vehicles, staff recommends purchasing up to twenty-nine Toyota Camry dedicated CNG vehicles. After reviewing specifications of dedicated alternative fuel vehicles available through the State of California Multiple Award Schedule and those available through local dealerships, staff determined that the Toyota Camry best satisfies the AQMD�s needs in terms of driving range, cargo capacity, fuel economy, ease of handling and product availability. The Toyota Camry dedicated CNG model is available only from Toyota Motor Sales, U.S.A. Inc., fleet sales division at a per vehicle cost of $25,044 including sales tax. This item was reviewed by the Administrative Committee on March 10, 2000, and recommended for approval.

6. Issue RFP to Conduct Performance Audit for FY Ending June 30, 2000

Health & Safety Code Section 40453 requires the AQMD to contract by July 1, 2000 with a qualified auditing firm to conduct a performance audit of AQMD programs. This action is to issue an RFP to seek a qualified firm to perform the audit. Sufficient funds will be budgeted in the FY 2000-01 budget. This item was reviewed at the April 14, 2000 Administrative Committee, and recommended for approval.

7. Recognize and Appropriate Funds from ARB for Children�s Health Study

In FY 1995-96, AQMD assumed operation of four ARB monitoring sites and enhanced three existing sites as part of the Children�s Health Study. Each successive year, ARB has funded the operation. The last contract extension expired in November 1999, and ARB desires to continue the effort through December 2001. ARB will provide $90,334 to continue the implementation of this program. This action to is recognize $90,334 from ARB and appropriate these funds to the FY 1999-2000 Budget. This item was reviewed by the Administrative Committee on March 10, 2000, and recommended for approval.

8. Approve Purchase of Special Purpose CNG Vans for Servicing Air Monitoring Network

Specially configured cargo vans are used in the calibration and repair of air monitoring equipment at our monitoring stations. The current vans have excessive mileage and require frequent repair. Two vans are included in the FY 1999-00 fixed asset budget. EPA agreed to fund the third van from $35,000 in 5th year PAMS Section 103 Grant funds originally allocated for a pick-up truck with lift gate. This action is to re-designate previously approved fixed asset from a pick-up truck to a van, and to purchase three special purpose vans from the State of California Statewide Vehicle Contract Program, on a sole-source basis. This item was reviewed by the Administrative Committee on March 10, 2000, and recommended for approval.

9. Issue RFQ to Purchase Doppler Sodar Boundary Layer Wind Measurement Systems

As part of the U.S. EPA Photochemical Assessment Monitoring Station (PAMS) program, staff is proposing the purchase of Doppler sodar acoustic sounding systems for wind measurements in the lower atmospheric boundary layer. The additional wind mixing height data will improve air quality forecasting and regional photochemical modeling analyses. Funding has been allocated in the FY 1999-00 Budget from grants awarded by the U.S. EPA for the PAMS program to purchase sodars for two upper air sites, at Los Angeles and Ontario International Airports. This action is to issue an RFQ to solicit competitive bids on the sodar instrumentation. This item was reviewed by the Mobile Source Committee on March 24, 2000, and recommended for approval.

10. Approve Classification Recommendations

Based on the results of consultant-conducted classification studies, reclassifications are recommended for five positions in clerical classifications and establishment of a new classification of Secretary (Confidential) is recommended. Further, based on reporting relationships, reclassification of five Confidential Administrative Secretary positions is recommended. The total AQMD cost for FY 1999-00 to implement these recommended changes is approximately $5,159. This item was reviewed by the Administrative Committee on April 14, 2000, and recommended for approval.

11. Amend Contract with JT2 Integrated Resources Regarding Selection of Legal Defense Attorneys for Workers' Compensation Matters

AQMD contracts with JT2 Integrated Resources (JT2) to administer workers' compensation claims. Under the contract, JT2 selects all related services except legal defense attorneys, which AQMD contracts directly for through an RFP process. Given the cost of the RFP process relative to the contract award, which is estimated not to exceed $10,000 per year for the next two years, staff recommends amending the contract with JT2, at no additional cost, to permit JT2 to select legal defense attorneys.

19. Technical Responses to Multiple Air Toxics Exposure Study-II Final Report

At its March 17, 2000 meeting, the Board directed staff to prepare certain technical responses to the Multiple Air Toxics Exposure Study (MATES)-II Final Report. These include: (1) a position paper compiled from comments received from members of the Air Toxics Study Technical Review Group(ATSRG); and (2) staff responses to the MATES-II comments made by those addressing the Board at the March meeting. Staff has written to each of the ATSTRG members requesting input on the overall evaluation and scientific basis of the report, as well as the adequacy of the ATSTRG involvement. A summary of their positions, as well as copies of the response letters, and the minutes of all ATSTRG meetings, are provided. Also provided is a summary of the MATES-II comments received at the March 17, 2000 Board meeting, along with staff responses.

28. Approve Monitoring, Recordkeeping, and Reporting Task Force Recommendations to Streamline RECLAIM Monitoring and Reporting

The Monitoring, Recordkeeping, and Reporting (MRR) Task Force has developed a consensus proposal to streamline RECLAIM monitoring and reporting. It is recommended that the Board direct the staff to develop rule amendments and implement other parts of the proposal, as detailed in the Board letter, to reduce or eliminate unnecessary recordkeeping burden while maintaining the enforceability of AQMD's RECLAIM program.

29. Amend Rule 461 - Gasoline Transfer and Dispensing

Proposed Amended Rule 461 will further reduce emissions of VOC and toxic compounds from gasoline dispensing facilities and improve compliance. The proposed amendments will improve the reliability and performance of vapor recovery equipment by increasing the test frequencies and enhancing the accountability of contractors who install, maintain, or test the equipment at the gas stations. The proposed amendments will also improve rule clarity and enforceability. The proposal implements Control Measure RFL-02 of the 1999 AQMP Amendment and is one of the key control strategies of the Air Toxics Control Plan. 30. Amend Regulation IX - Standards of Performance for New Stationary Sources

The Clean Air Act authorizes EPA to delegate authority to local districts, for implementation and enforcement of standards set in 40 Code of Federal Regulations (CFR) Part 60, Standards of Performance for New Stationary Sources (NSPS). These standards were initially adopted by reference as AQMD Regulation IX, on December 3, 1976. Periodic amendments to this regulation incorporate new or amended standards by reference. Seven actions regarding NSPS are proposed for incorporation by reference into Regulation IX. Four of these actions pertain to Appendices A and B, which do not appear in Regulation IX. This item was reviewed by the Stationary Source Committee February 25, 2000.
