Special Legislative Committee Meeting

SYNOPSIS:

A Special Legislative Committee was held on August 13, 1999. Following is a summary of that meeting. The next meeting is scheduled for September 24, 1999, 8:30 a.m., in Room CC8.

Attendance

The Legislative Committee met in a special meeting on August 13, 1999. Present were Committee Chair Beatrice LaPisto-Kirtley and Committee members Roy Wilson and Michael Antonovich. Pursuant to the Procedures for Standing Committees of the Governing Board, adopted March 8, 1996, Norma Glover, AQMD Vice-Chair, was appointed as an ad hoc member of the Legislative Committee for the August 13, 1999, meeting only.

AB 1571 (Villaraigosa/Brulte) -- Carl Moyer Program

Chair LaPisto-Kirtley stated that the special meeting was scheduled in order to update the Committee on AB 1571 and modify, if appropriate, the Board's position on the bill, which creates in statute the Carl Moyer Memorial Air Quality Attainment Program.

Dr. Barry Wallerstein, Executive Officer, explained that AB 1571 was introduced this year with the intent of identifying long-term funding for the program. The Board adopted a Support with Clarification position at the April Board meeting, seeking clarification to ensure that the money would be required to pass from the ARB to air districts, including the South Coast AQMD. Recently, amendments were introduced that would direct the money through the Mobile Source Air Pollution Reduction Review Committee (MSRC) and require the MSRC and the Board to agree on the use of the funds. Dr. Wallerstein added that directing the funding for the South Coast Basin through the MSRC is different than any other area of the state. In other areas, the money goes directly to air districts. Staff believes that the Board's original direction to staff is appropriate since through the statutes, the responsibility for attainment rests with air districts.

Additionally, there are potential amendments which add great detail regarding electric charging stations, which staff believes should be left open to discussion between the ARB, affected parties and local air districts. AB 1571 is before the Senate Transportation on Tuesday, August 17. Dr. Wallerstein added that staff is working with Speaker Villaraigosa's office on appropriate amendments to the bill.

Dr. Wallerstein added that staff would like to convey to the Senate Transportation Committee that the AQMD strongly supports the Carl Moyer Program, but that the dollars in the South Coast should flow through the District like they do for all other air districts in the state.

Please note that AB 1571 was amended in Senate Transportation to address AQMD's concerns and passed out of Committee 9-0. The bill is now before Senate Appropriations for consideration.
