The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes which occurred since last month’s forecast are summarized. The current schedule reflects the staff’s court filing for the lawsuit brought by environmental groups relative to the 1994 Air Quality Management Plan. However, the rulemaking schedule contained herein is subject to change based on the outcome of the litigation. Some measures may need to be delayed to allow room to incorporate additional measures that may be ordered to be implemented by the court in the SIP litigation case.

Rules to be Rescheduled/Removed and Additions

Rule 1402 – Control of Toxic Air Contaminants from Existing Sources

Proposed amendments to this rule were previously scheduled for two phases (December 1999 and June/July 2000). In response to the Board's direction and public comments to accelerate the second phase amendments, staff proposes one set of proposed rule changes for March 2000.

Rule 1121 – Emission Standards for New Commercial and Residential Water Heaters (CM#97-CMB-06)

Proposed Amended Rule 1121 is rescheduled from November 1999 to December 1999 to allow additional time for the manufacturers and the public to provide input into the rulemaking process.

Reg. XXX - Title V Operating Permits

Proposed Amendment to Reg. XXX is rescheduled from December 1999 to 2000 (month to be determined). This proposed revision is in anticipation of U.S. EPA's revision to the Federal Title V Operating Permits Program (40 CFR Part 70). At this time EPA has not taken action on the program.

Rule # TBD - Fleet Conversion for On-Road Vehicles

This proposed Rule is added to be considered in February 2000 by the Board. Under the California Health & Safety Code 40447.5(a), the AQMD may adopt regulations for public and private fleet operations to purchase alternative-fuel vehicles. The proposed rule would require public and/or private fleet operators with 15 or more vehicles to purchase alternative-fueled vehicles when adding vehicles or replacing vehicles in an existing fleet or forming a new fleet.

Area Source Credits for NOx and SOx

Staff is proposing to amend this rule for December 1999. The amendment will update Table 1 (Emission Rates and Test Methods By Source Category) to reflect lower emission rates for NOx from diesel-fired reciprocating Internal Combustion engine based on additional source test data. The proposed change would result in the reduction of area source credits available, thus benefiting the environment.

The proposed rule will be implemented in two steps. Step one will consist of refining the emissions inventory and assessing control methods for organic waste disposal facilities. Step two will include implementation of cost-effective and technically feasible control methods.

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. In the last half of 1999, U.S. EPA expects to adopt revisions of regulations that define the minimum elements of an approvable operating permit program. Once EPA's revisions are adopted, Regulation XXX will be amended to parallel changes in the EPA program.
