Ambient monitoring, on-going public nuisance complaints, and AQMD staff observations and inspections have shown that the current Rule 1158 is not sufficient in reducing PM10 emissions. To address these deficiencies PAR 1158 will: expand the scope of this rule by including coal and sulfur; establish a No. 1/2 Ringelmann opacity limitation; reaffirm the requirement that all coke piles be enclosed; allow optional open storage of prilled sulfur and coal, under an Executive Officer approved plan; set standards for silt loading on roads and truck exteriors; require paving and maintenance of surfaces and roads where material accumulates; and require covers or slot-tops for material transport trucks.

The proposed amendments are necessary to clarify rule requirements and improve enforceability. The amendments also increase flexibility for RECLAIM facilities. These amendments include clarification to NSR requirements for change of operator and modification to new facilities. For major sources, the proposed amendments clarify monitoring requirements and add calculation methods for cases currently not addressed. For large sources, the proposed amendments add monitoring and calculation methods for cases currently not addressed and clarify source testing requirements. For process units, the proposed amendments establish concentration limits for determining emissions and add guidelines for category specific emission rate. The proposed amendments also correct rule references, extend deadlines for monthly emissions reporting and add clarifying language to enhance enforcement and consistency. 5. Set Public Hearing May 14, 1999 to Amend Rule 1113 - Architectural Coatings

The proposed amendments will implement Phase II of the 1997 AQMP Control Measure for architectural coatings through decreasing VOC limits for industrial maintenance coatings; nonflat coatings; primers, sealers, and undercoaters (PSU); quick-dry enamels; quick-dry PSU; stains; roof coatings; and waterproofing wood sealers. The proposed amendments will also establish new coating categories and VOC limits for rust-preventative coatings; floor coatings; and waterproofing sealers - concrete, as well as provide needed clarifications. Lastly, the proposed amendments will expand the averaging provision to provide additional flexibility to manufacturers. 7. Execute Contract to Purchase Instruments for Automatic Gas Calibration Systems

On August 14, 1998, the Board approved the release of an RFQ to purchase 10 automatic gas calibration systems for the ambient air monitoring network in support of the PAMS program. This action is to execute a contract with Environics Inc. in the amount of $135,312 for the purchase of 10 automatic gas calibration systems. Funding for this purchase is included in the FY 1998-99 Budget. This item was reviewed by the Administrative Committee on February 9, 1999 and the Technology Committee on February 26, 1999, and recommended for approval.

8. Execute Contract for Travel Agency Services

The AQMD's current agreement for travel services expired on December 31, 1998. On January 8, 1999, the Board authorized the issuance of an RFP. This action is to award the bid for travel services to Avenida Travel Services for one year with an option to renew for two additional years. For the current FY, travel and related expenses are estimated to be approximately $191,300.

9. Execute Contract to Cost-Share Development and Demonstration of Advanced Fast-fill Natural Gas Compressor to Refuel Natural Gas Vehicles

A major barrier to the market penetration of NGVs is the high cost faced by public and private fleets to purchase, install and operate NGV refueling stations. OceanAir Environmental has proposed to develop and demonstrate an advanced, fast-fill natural gas compressor with potentially lower capital and operating costs than conventional compressors. The proposed advanced compressor refueling station will refuel NGVs owned and operated by the other participants in the project, namely the cities of Agoura, Calabasas, Hidden Hills, Malibu, and Westlake. Total cost of this project is $592,000. The proposed AQMD cost-share is $200,000. This item was reviewed by the Technology Committee on February 26, 1999, and recommended for approval.

10. Execute Contract to Cosponsor Development and Demonstration of the Mack E7G Natural Gas Engine at 400 Horsepower

The emission reductions exhibited by natural gas heavy-duty engines are well documented. The majority of in-service application of these engines is in local delivery trucks rather than over-the-road trucks. Class 8 trucks demand high horsepower (400 or more) and torque to meet their needs. The only currently available 400 HP natural gas engine is the Caterpillar C-12, a dual fuel engine. Staff proposes to cosponsor the development and demonstration of the Mack E7G 400 HP natural gas engine. Total cost of this project is $2,756,000; AQMD cost-share will not exceed $400,000. This item was reviewed by the Technology Committee on February 26, 1999, and recommended for approval.

11. Execute Contract to Cosponsor LNG/CNG Fueling Station Evaluation and Upgrade

The LNG/CNG fueling station at UPS Ontario Airport has experienced some operational problems since completion. Significant LNG technology improvements and advancements have been made since that time. The proposed project would incorporate this advanced technology into this station. The design, engineering and development completed in this project will be documented and made available to industry, ensuring future LNG and LNG/CNG refueling station advancement. Total cost to the AQMD for this project will not exceed $35,000; the Gas Research Institute will provide $40,000, for a total project cost of $75,000. This item was reviewed by the Technology Committee on February 26, 1999, and recommended for approval.

12. Execute Contract to Cost Share RFP for Demonstration of Small-Scale Natural Gas Liquefaction Plant

A small-scale natural gas liquefaction plant using innovative technology may significantly reduce the cost and increase availability of LNG to the end user. CEC intends to release an RFP for development and demonstration of a small-scale liquefaction plant. The goal of this project is to develop up to two in-state liquefaction plants with a minimum production capability of 5,000 gallons per day of liquefied natural gas at a sustainable fuel cost of $0.30 per gallon of LNG. The AQMD cost share portion shall not exceed $200,000. This item was reviewed by the Technology Committee on February 26, 1999, and recommended for approval..

13. Execute Contract for Design of Interactive Fuel Cell Museum Exhibit at California Science Center

In implementing and commercializing fuel cell technology, it is important to familiarize the public, particularly our youth, with how fuel cells work, what their applications may be, and the technology's environmental benefits. The California Science Center Foundation, in conjunction with the AQMD, will contract for the planning, design and specification of an interactive fuel cell museum exhibit. AQMD cost for this contract will not exceed $75,000. This item was reviewed by the Technology Committee on February 26, 1999, and recommended for approval.

14. Review of a Proposal to ARB for Carl Moyer Memorial Air Quality Standards Attainment Program Funds; Establish Special Revenue Funds for the Carl Moyer Funds

In 1998, Governor Wilson and the California Legislature authorized $25 million to fund an incentive program for low emission, heavy-duty engines. ARB established the Carl Moyer Memorial Air Quality Standards Attainment Program to administer these funds, primarily directed to reducing NOx emissions. ARB has developed program guidelines and funding criteria, and intends to allocate the funds to local air districts for program implementation. Staff requests Board approval to submit a proposal to ARB for up to $12,000,000 of the Moyer funds, and establish a special revenue account for the Carol Moyer funds. This item was reviewed by the Technology Committee on February 26, 1999, and recommended for approval.

15. Amend Contract with Ecotek for Privatization of Portions of Annual Emissions Report Program

In January 1998, the Board awarded a contract to Ecotek for continuation of privatization of portions of the Annual Emissions Report (AER) Program. For the past three years, Ecotek has developed, maintained, and updated the emissions reporting software; produced and distributed reporting materials (forms and instructions); provided public outreach and assistance; collected and compiled reported data; and conducted limited data quality control. Based on Ecotek's responsiveness and satisfactory performance, staff recommends exercising the second-year option to renew and, based upon changed requirements, to renegotiate funding for an amount not to exceed $275,000, bringing the contract total to $525,000. Funding for this contract amendment is allocated in the FY 1998-99 Budget. This item was reviewed by the Administrative Committee on February 19, 1999, and recommended for approval.

16. Issue RFP to Prequalify Temporary Employment Services Providers

17. Amend Authorized Purchase of Vehicles for AQMD Fleet

On October 9, 1998, the Board authorized the purchase of up to 40 alternative-fueled vehicles at a cost of $720,000. To ensure cost effective purchases, staff recommends increasing vehicle manufacturers and model options beyond those approved earlier. In addition, Monitoring & Analysis requests approval to purchase three special-purpose vehicles, at a cost of $65,000. Funds for this request are available in the FY 1998-99 Budget and include $25,000 in EPA PAMS funding. This item was reviewed by the Administrative Committee on February 19, 1999, and recommended for approval.

18. Establish List of Prequalified Vendors to Provide System-wide Hardware/Software Maintenance and Support Services

On January 8, 1999, the Board approved release of an RFP to prequalify vendors for system-wide hardware/software maintenance and support services. As a result of successful responses to this RFP, four vendors were identified as capable of providing support services. This action is to approve these four vendors to provide these services for a two-year period. Funds totaling $241,712 have been allocated in the FY 1998-99 Budget for this purpose. This item was reviewed by the Administrative Committee on February 19, 1999, and recommended for approval.

19. Recognize Revenue from CENCO Refining Company and Issue RFP to Provide Temporary Engineering Services

The AQMD Hearing Board issued a Stipulated Order of Abatement to CENCO Refining Company imposing requirements for the refinery to demonstrate compliance to the Executive Officer and Hearing Board prior to the start-up of the refinery. It is necessary to hire outside engineering services with expertise in refinery operations to assist in reviewing and analyzing such compliance demonstrations. CENCO Refining Company has entered into a contractual agreement with AQMD to reimburse all costs associated with such engineering services. One or more contractors will be selected to provide services as needed. It is also necessary to recognize and appropriate $200,000 to the FY 1998-99 Budget for Engineering & Compliance. This item was reviewed by Administrative and Stationary Source Committees on February 19, 1999, and recommended for approval.

20. Adopt Resolution Revising Claims Procedures in AQMD Administrative Code and Establishing Claims Procedures for Claims Exempted from Tort Claims Act

23. Approve Use of Public Education Materials to Encourage Use of Low-Polluting Consumer Products

The 1997 Air Quality Management Plan included a control measure (CM#97CTS-03) that would establish a program to help consumers select low-polluting consumer products. State law prohibits the AQMD from endorsing any product. Therefore, the AQMD is proposing to develop and distribute brochures and fact sheets that provide general information on emissions from broad categories of products. 32. Report on FY 1999-2000 AB 2766 Discretionary Fund Work Program and Approve Issuance of Three RFPs for Heavy-Duty Category

The MSRC has proposed a $16.275 million Work Program for FY 1999-2000 consisting of three categories: 1) a Light-Duty Vehicle Program--$3.625 million; 2) a VMT Reduction and TCM Strategies Program--$3.05 million; and 3) a Heavy-/Medium-Duty Vehicle Program--$9.6 million. At this time the MSRC requests Board approval for the issuance of three RFPs under the heavy-duty category. These RFPs are as follows: On-Road & Off-Road Heavy-Duty Vehicle Diesel Pollution Reduction Program; Alternative Fuel Transit Bus Program; and Technical Assistance to Fleets (in Support of the MSRC's Heavy-Duty Vehicle Program). The MSRC will also simultaneously release three PONs within the light-duty and TCM categories, which may or may not result in development of RFPs.

(A) Adopt Permit Streamlining Recommendations Presented by Permit Streamlining Task Force

After over ten months of extensive review and evaluation of the AQMD's permit system, the Permit Streamlining Task Force has developed a list of specific recommendations. These recommendations are designed to streamline permitting by reducing steps required to issue permits, improving communications both internally and externally, optimizing permit structure and systems, and enhancing management and organizational effectiveness.

As part of the Board Chairman's permit streamlining initiative, AVES, an Affiliate of ATC Associates, was retained by the AQMD in September 1998 to provide an independent and comprehensive review of the AQMD's permit system and to recommend specific steps for permit streamlining. This final report details its findings and conclusions. Information from this study along with other ideas from Permit Streamlining Task Force members, industry, permit applicants, and staff was used to formulate the Task Force's final recommendations to the Board.

The comprehensive permit streamlining recommendations presented by the Permit Streamlining Task Force cover a wide variety of issues. As a result, implementation of the recommendations would require a focused, concerted and coordinated effort on the part of staff. This Workplan provides staff's initial implementation proposal for each recommended solution, including a preliminary assessment of resource needs and proposed timelines.

43. Amendments to AQMD Permitting Policy E-6, and Development of a Compliance Policy for Portable Equipment Inspections in Support of Environmental Justice Initiative No. 9, Portable Equipment Permitting Practices

Staff has developed proposals intended to be more specific in the way various locations permits are issued, to update the operating conditions on existing various location permits, to establish a compliance protocol for the inspection of portable equipment and to ensure that the proposals complement the statewide portable equipment registration program. These changes in policy are intended to ensure that sensitive receptors are not subject to adverse air quality impacts due to the operation of portable equipment. This item was reviewed by the Stationary Source Committee on February 19, 1999, and recommended for approval.

44. Preliminary Results from Multiple Air Toxics Exposure Study-II

In October 1997, the Board approved the Multiple Air Toxics Exposure Study-II monitoring program as part of its Environmental Justice Initiatives. This major field effort, comprised of both fixed and mobile platform sites, began in April 1998 and will conclude next month. Over six months of samples have now been analyzed and data have been compiled. Staff will provide a summary of the field program to date, and will include preliminary results of the data analysis. Final results are expected this summer.

At the February 12, 1999 public hearing, the Board heard testimony regarding addition of nickel compounds. The public hearing was closed, and deliberations were continued to the March 12, 1999 meeting.

46. Amend Rule 1142 - Marine Tank Vessel Operations

The proposed amendments to Rule 1142 add the maintenance, monitoring, reporting and recordkeeping requirements necessary to ensure compliance of emission control equipment with the emission limitations. The proposed amendments also clarify rule requirements by specifying a procedure for identifying organic liquids that comply with the emission standard without control. This item was reviewed by the Stationary Source Committee on January 22, 1999.

47. RECLAIM Audit Report for the 1997 Compliance Year

The anneal report on the RECLAIM program is prepared in accordance with Rule 2015 - Backstop Provisions. The report assesses emission reductions, average annual price and availability of RECLAIM Trading Credits, job impacts, compliance issues, and other measures of performance for the fourth year of this program. This item was reviewed by Stationary Source Committee February 19, 1999.

48. Amend Rule 1103 - Pharmaceuticals and Cosmetics Manufacturing Operations

Proposed amendments will address various issues cited by CARB and EPA. In addition, staff is proposing several modifications to clarify rule language. In December, 1997, EPA indicated that this and other AQMD rules needed modification before they could be accepted into the SIP. The deadline for completing this task is June 1999. This item was reviewed by the Stationary Source Committee on January 22, 1999. 

49. Annual Report for 1998 on AB 2588 Air Toxics "Hot Spots" Program

The Air Toxics "Hot Spots" Information and Assessment Act of 1987 requires local air pollution districts to prepare an annual report. This report summarizes the program progress during the past year and anticipated activities for the upcoming year. Highlights for 1998 include inventory management and fee regulation activities, finalization of many health risk assessments, and selection of a contractor to accelerate the rate of progress. This item was reviewed by the Stationary Source Committee on February 19, 1999.

At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under Public Comments may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record, provided 25 copies are presented to the Clerk of the Board.
