2. Execute Contracts for AQIP Proposals Received During Second and Third Quarters of 1998 and First Quarter of 1999

Rule 2202 - On-Road Motor Vehicle Mitigation Options was adopted on December 8, 1995. One of the compliance strategies under Rule 2202 allows employers to invest in the AQIP. Monies received are placed in a restricted account to fund programs that result in equivalent emission reductions that would otherwise have been achieved by the participating employers. Staff evaluated the proposals received during the second and third quarters of 1998 and the first quarter of 1999. This action is to recommend three for funding. The amount available for this quarter is $1,682,262. This item was reviewed by the Mobile Source Committee on May 28, 1999, and recommended for approval.

3. Execute Contract for Temporary Engineering Services to Review CENCO Refinery's Compliance Demonstration

On March 12, 1999 the Board approved the release of an RFP to select contractors with expertise in refinery operations to assist the Executive Officer and Hearing Board in reviewing and analyzing compliance demonstrations by CENCO Refining Company prior to the start-up of their refinery. A panel has reviewed the proposals submitted in response to the RFP and recommends executing a contract with MD Environmental. Funding of $200,000 has been allocated in the FY 1998-99 Budget for these services. CENCO has entered into a contractual agreement to reimburse AQMD for all costs associated with the engineering services. This item was reviewed by the Stationary Source Committee on May 21, 1999, and recommended for approval.

4. FY 1998-99 Budget Transfer for Purchase of Videoconferencing Equipment

Videoconferencing makes it possible for Board Members to attend Board Committee and other meetings without being on-site. Additional videoconferencing equipment is desired to expand the current capabilities, and to allow simultaneous multiple sites for videoconferencing. This action is to transfer funds for the purchase of additional videoconferencing equipment and to upgrade existing equipment. This transfer moves moneys to the appropriate expenditure account and does not require additional appropriations. This was reviewed by the Administrative Committee on May 21, 1999, and recommended for approval.

5. Issue RFPs for Projects Related to AB 2588 FY 93-94 Funds

CARB and the AQMD have mutually agreed to a list of projects related to FY 93-94 AB2588 funds. This action is to release RFPs for developing improved emission factors for cadmium from metal plating ($40,000); enhanced emission inventory, risk assessment, and risk reduction guidelines for motion picture film laboratories ($75,000); and more developed emission inventories for rubber ($50,000), welding processes ($50,000), and furniture stripping and other small uses of methylene chloride ($100,000). This item was reviewed by the Stationary Source Committee May 21, 1999. Less than a quorum was present during the discussion of this item; therefore, the report was received by those Committee Members present.

6. Report of RFPs and RFQs Scheduled for Release in June

In an effort to further streamline AQMD business practices, the recently revised Procurement Policy and Procedure no longer requires individual RFPs and RFQs over $50,000 for budgeted services or supplies be brought to the Governing Board for approval. This report summarizes the RFPs and RFQs over $50,000 scheduled to be released for advertisement for the month of June. This item was reviewed by the Administrative Committee on May 21, 1999 and recommended for approval.

7. FY 1998-99 Budget Transfer

At Board direction, staff has periodically brought to the Board all necessary budget transfers occurring during the fiscal year. Budget transfers are the result of Board actions, further definition of programs approved in the budget, reorganizations, or budget corrections. These transfers move moneys to the appropriate expenditure accounts and do not require additional appropriations.

8. Approve Selection of Consultant for Technical Assistance to Heavy-Duty Fleets as part of MSRC's Fiscal Year 1999-2000 AB 2766 Discretionary Fund Work Program

As part of the FY 1999-2000 AB 2766 Discretionary Fund Work Program, the MSRC allocated $200,000 to obtain a consultant team that will provide technical assistance to fleets and operators participating in its On-Road & Off Road Heavy-Duty Vehicle Diesel Pollution Reduction Program. On May 27, 1999, the MSRC considered the TAC's recommendation and approved the twenty-four month appointment of a consultant team. This contract recommendation is being brought forward prior to other Work Program recommendations so that the consultant team can be under contract to meet the timeline needs of the MSRC's 1999-2000 Heavy-Duty Work Program. The MSRC is requesting the Board's approval to contract with this consultant as part of the FY 1999-2000 AB 2766 Discretionary Fund Work Program.

9. Execute Contracts for EV Charge as part of the FY 1997-99 AB 2766 Discretionary Fund Work Program

Within the FY 1997-99 AB 2766 Discretionary Fund Work Program, the MSRC created the $2,000,000 EV Charge Program, which through an application process, provides co-funding for the development and installation of EV charging stations. Funding is awarded on a first-come; first-serve basis to applicants that satisfy specified requirements as stated in the EV Charge Application package. Applications are being accepted within a six-month time frame that began February 12, 1999 and that will end on August 31, 1999. Eligible categories include Major Destination, Work Place/Fleets, Charging Site Expansion and Municipal sites. The EV Charge Application Package was approved by the Board at its February 13, 1999 meeting. At this time, the MSRC is requesting approval of three applications submitted in April 1999.

RFP #9596-23 for soliciting proposals under Rule 2202 - On-Road Motor Vehicle Mitigation Options-Air Quality Investment Program was adopted by the Board in September 1995. This action is to recommend revision of the Proposal Evaluation/Contractor Selection Criteria set forth in RFP #9596-23 to provide better consistency with Board adopted revisions to AQMD's Procurement Policy and Procedure.

26. Environmental Justice Compact

At the October 10, 1997 meeting of the Board, the Environmental Justice Workplan was adopted. In that workplan, the Environmental Justice Task Force was to develop and recommend a set of principles in the form of an Environmental Justice Compact for voluntary consideration by other organizations. The Compact is now available for Board review and approval. This item was reviewed by the Administrative Committee on May 21, 1999, and recommended for approval.

27. Status on Best Available Control Technology Guidelines

The BACT Guidelines are being revised to reflect present Governing Board policies and current federal and state law. Part A explains the process for determining BACT requirements. Part B includes BACT determination listings for internal combustion engines, spray booths, and other permitted equipment. This item was reviewed by the Stationary Source Committee on May 21, 1999 and the Home Rule Advisory Group on May 27, 1999.

28. Amend Rule 1158 - Storage, Handling, and Transport of Coke, Coal and Sulfur

Ambient monitoring, on-going public nuisance complaints, and AQMD staff observations and inspections have shown that the current Rule 1158 is not sufficient in reducing PM10 emissions and preventing public nuisance. To address these concerns PAR 1158 will: expand the scope of this rule by including coal and sulfur; establish a No. 1/2 Ringelmann visible emissions limitation; require that all coke piles be enclosed without allowing alternative open storage; allow optional open storage of prilled sulfur and coal, under an Executive Officer approved plan; set standards for silt loading on roads and truck exteriors; require paving and maintenance of surfaces and roads where material accumulates; and require operators to use material transport trucks which comply with the vehicle code. This item was reviewed by the Stationary Source Committee on February 19, 1999.

SCAQMD, et al., United States District Court No. 97-6916 HLH (SHx); and SCAQMD v. EPA, et al., United States District Court No. SACV98-948 LHM (ANx),

(2) Section 54957.6(a) to meet with designated representatives regarding salaries and benefits of represented and unrepresented employees, or regarding mandatory subjects within the scope of representation of its represented employees. Negotiator: Eudora Tharp Organizations: SCAQMD Professional Employees Association and Teamsters Local 911; and

(3) Section 54956.9(c) to confer with its counsel to decide, based on existing facts and circumstances, whether to initiate litigation [one case].
