Proposed amendments will address various issues cited by CARB and EPA. In December 1997, EPA indicated that the SIP could not be approved until this and other AQMD rules were modified. The deadline for completing this task is June 1999. In addition, staff is proposing several modifications to clarify rule language. This item was reviewed by the Stationary Source Committee on January 22, 1999.

3. Set Public Hearing March 12, 1999 to Amend Rule 1142 - Marine Tank Vessel Operations

The proposed amendments to Rule 1142 will add the maintenance, monitoring, reporting and recordkeeping requirements necessary to ensure compliance of emission control equipment with the emission limitations. The proposed amendments will also clarify rule requirements by specifying a procedure for identifying organic liquids that comply with the emission standard without control and a protocol for determining the amount of required emission reductions for emission trading programs. This item was reviewed by the Stationary Source Committee on January 22, 1999.

4. Execute Contract to Provide Outreach Assistance to Basin Cities Regarding Low-Emission, Clean Fuel Vehicle Technologies

On September 11, 1998, the Board authorized the release of an RFP to select a qualified contractor to provide information to Basin communities on the status of low-emission, clean fuel vehicle technologies as part of the AQMD's Clean Fuels Program which supports programs to develop and demonstrate low-emission, clean fuels technologies for commercialization. This action is to execute a contract with Gladstein & Associates. Total cost to the AQMD will not exceed $99,988. Funds for this contract are available in the FY 1998-99 budget. This item was reviewed by the Technology Committee and the Mobile Source Committee on January 15, 1999, and recommended for approval.

5. Execute Contract for Demonstration of Electric Vehicle Rental Program

Successful commercialization of electric vehicles is an important factor in reducing emissions from on-road vehicles. Based on the results of a competitive solicitation, EV Rental Cars has been selected to conduct an electric vehicle rental program. Total project cost is $552,000 in funds and $623,755 in-kind. AQMD's contribution shall not exceed $200,000 in funds. ARB's contribution will be $100,000 in funds to be passed through the AQMD, and $100,000 in-kind. The remaining balance will be co-funded by the contractor and other entities. This item was reviewed by the Technology Committee on January 15, 1999. Less than a quorum was present during the discussion of this item; those Committee Members who were present communicated their concurrence.

6. Amend Litigation Services Contract with Shute, Mihaly & Weinberger to Increase Contract Amount by $150,000 and Authorize Appropriation of $90,000 from the Undesignated Fund Balance

In October 1996 the Board approved three-year contracts for three law firms, including Shute, Mihaly & Weinberger, to handle future litigation involving CEQA and air quality issues. The total authorized amount of $360,000 has been expended before completion of the contract because of unanticipated litigation involving the 1994 SIP and the lawsuits against EPA for failing to act on the 1997 plan and failing to implement federal measures. Additional litigation against EPA may be necessary to challenge the proposed disapproval of the 1997 plan. It is requested that the Board authorize an additional $150,000 to fund the contract to completion in October 1999. Since this exceeds the current budget for litigation services, it is further requested that the Board authorize an appropriation of $90,000 from the Undesignated Fund Balance.

7. Amend Contracts with Metamor Information Technology Services and Majesco Software, Inc. to Provide Short- and Long-Term Systems Development and Maintenance Support

The AQMD currently has task-order-type contracts with four companies for short- and long-term system development services. These contracts are amended as additional automation needs are identified. This action is to amend the contracts with two of the four companies. Funds for these services ($254,875 to Metamor Information Technology Services and $373,940 to Majesco Software, Inc.) are included in the FY 1998-99 Budget. This item was reviewed by the Administrative Committee on January 22, 1999 and recommended for approval.

8. Issue RFQ to Acquire Telemetry Computer and Data Loggers

The AQMD Telemetry System currently uses a Data General MV7800 host computer and Environmental Systems Corporation data loggers to perform ambient air monitoring. This 11-year-old equipment has reached its maximum utilization and is obsolete. This action is to issue an RFQ to obtain a computer and data loggers to adequately support the Telemetry System, which collects air quality data from 35 air monitoring stations throughout the Air Quality Basin. A total of $263,500 is available for this purchase. $71,000 is available from a PAMS U.S. EPA grant, and $42,500 from a 105 U.S. EPA grant. In addition funding in the amount of $140,000 is available in the AQMD FY 1998-99 Budget. This was reviewed by the Administrative Committee on January 22, 1999, and recommended for approval.

9. Issue RFQ to Purchase Compressed Pure Gases and Cryogenic Liquids

AQMD expects to spend approximately $60,000 to purchase compressed pure gases and cryogenic liquids in each of the next two fiscal years. These gases are used in a wide variety of analytical and monitoring needs. The laboratory uses compressed pure gases as carrier gases and purging agents, and cryogenic liquids are used to concentrate samples for gas chromatographic analysis for PAMS and other network samples. This action is to issue an RFQ to purchase compressed pure gases and cryogenic liquids in FY 1999-2000 with an optional extension to cover FY 2000-2001. This item was reviewed by the Administrative Committee on January 22, 1999, and recommended for approval.

10. Issue Request for Qualifications to Prequalify Providers of Blended Mixed Gases for Laboratory Use

AQMD expects to spend approximately $70,000 in each of the next two fiscal years to purchase blended mixed gases for use in a wide variety of analytical and monitoring needs. The laboratory uses compressed gases as quality control standards. This action is to issue a Request for Qualifications to establish a list of prequalified vendors from whom competitive bids may be solicited for the purchase of blended mixed gases for use in FY 1999-2000 and FY 2000-2001. This item was reviewed by the Administrative Committee on January 22, 1999, and recommended for approval.

11. Authorize Executive Officer to Contract with Joseph V. Contaoi for Human Resources Related Services and Approve Findings Supporting the Contract

Staff proposes to contract with Joseph V. Contaoi, the former Director of Administrative and Human Resources, to perform certain Human Resources tasks occurring over the next nine months, including negotiating a contract with the AQMD's labor unions this Spring. Health and Safety Code Section 40426.7 requires the Board to make certain findings before contracting with certain AQMD employees within 12 months following retirement. Although Section 40426.7 applies to Mr. Contaoi's contract, the Board can make all the findings with regards to his proposed contract. This item was reviewed by the Administrative Committee on January 22, 1999, and recommended for approval.

12. Approve Application Package and Eligible Funding Categories for EVCharge Program as Part of FY 1997-99 AB 2766 Discretionary Fund Work Program; Authorize Execution of Agreements by Contracts Manager; and Authorize MSRC the Ability to Adjust Up to 10%

As part of its FY 1997-99 AB 2766 Discretionary Fund Work Program, the MSRC established a $2 million EVCharge Program to reduce mobile source emissions by providing public charging infrastructure to support EVs in the Basin. Through a simplified application process, this program provides match funding to retrofit existing EV stations or construct new stations in deficient areas within four eligible categories. Eligible categories include major destinations (70% match), workplaces/fleets (40% match), charging site expansion (70% match), and municipal sites (50% match). The MSRC requests Board approval of the application package and eligible funding categories. To streamline the process since approximately 100 applications are anticipated, the MSRC also requests authority to execute agreements by the Contracts Manager and the ability to adjust up to 10% on EVCharge contracts.

13. Reclassify Two Air Quality Inspector Positions to Air Quality Specialist

Based on results of a consultant-conducted classification study of positions in Stationary Source Compliance, Human Resources staff recommends reclassifying one Air Quality Inspector II and one Air Quality Inspector III position to Air Quality Specialist. This action recognizes changes that have occurred in duties.

State law requires the AQMD to prepare and submit annually to the state board a three-year budget forecast based upon existing programs and rules, and new programs or rules to be adopted. This is the ninth annual Three-Year Budget Forecast. This item was reviewed by the Administrative Committee on January 22, 1999.

20. Status Report on Efficiency of Aqueous Solvents on Hard to Clean Heavy-Duty Truck Parts Subject to Rule 1171

On February 13, 1998, the Board authorized the Chairman to execute a contract with CE-CERT to conduct a study to identify and evaluate the cleaning efficiency of water-based cleaning systems on "hard to clean" parts with "extra heavy-duty" grease and grime for repair and maintenance operation of heavy-duty trucks subject to Rule 1171, and to report the results to the Board. This item was reviewed by the Technology Committee on January 15, 1999, and recommended for approval.

30. Amend Rule 1401 - New Source Review of Toxic Air Contaminants

At the January 8, 1999 public hearing, hydrochloric acid and sodiumhydroxide were added to Rule 1401; and 41 additional compounds for which the state Office of Environmental Health Hazard Assessment recently finalized risk values were also added. In order to provide adequate public notice, the public hearing was continued to February 12, 1999 to consider proposed changes to some of the effective dates in Table I. The Board also delayed until its February meeting consideration of adding nickel and nickel compounds, pending a peer review meeting of the Toxicology Excellence for Risk Assessment report on the carcinogenicity of soluble nickel.

31. Amend Rule 1610 - Old-Vehicle Scrapping

At its January 8, 1999 meeting, the Board adopted Rule 1610 amendments related to operational improvements of the rule. The Board continued the public hearing on Rule 1610 amendments related to engine destruction to the February 12, 1999 Board meeting. The purpose of engine destruction amendments is to address U.S. EPA's last remaining technical approvability issue relative to the engine destruction requirement. Further Rule 1610 amendments related to conforming with ARB's statewide regulation governing vehicle scrapping will be brought to the Board subsequent to ARB finalizing their regulation in mid-1999.

32. Amend Rule 1106.1 - Pleasure Craft Coating Operations

Staff is seeking to amend Rule 1106.1 to address issues raised by the filing of several product and group variances associated with the use and application of compliant pleasure craft coatings. Proposed Amended Rule 1106.1 will temporarily raise the VOC limits for Extreme High Gloss Topcoats and Finish Primers, increase the VOC limits for Antifoulants, and remove the requirement that sprayed coatings be applied using high-volume, low-pressure spray equipment. Rule 1106.1 amendments are being proposed to provide compliance relief to the affected sources and allow the rule to reflect current coating technologies while still encouraging manufacturers to continue their development of low-VOC coatings. This item was reviewed by the Stationary Source Committee on December 18, 1998.
