Joint MSRC/TAC Retreat

The MSRC conducted an offsite half-day retreat with its Technical Advisory Committee on Thursday, November 18, at Cal Poly Pomona's Kellogg West Center. It was well attended with 35 individuals comprised of TAC members, MSRC members, and MSRC/AQMD staff. The MSRC reviewed its past work programs and lessons learned from funded projects and discussed its future direction, including a review by ARB of the California Motor Vehicle Program, the MATES II Study, the Air Toxics Plan, and Technology Advancement's funding priorities for 2000. The MSRC identified several key areas for future consideration, including how it can help the AQMD implement its proposed fleet rule.

Revised Policies on Contract Modifications

The MSRC's Administrative Subcommittee underwent a lengthy review process of the MSRC's policies that guide AQMD and MSRC staff in the RFP and contracting process. The AQMD's Procurement Manager and Legal Counsel were included in the review process to ensure AQMD's contracting requirements were also met. At its November 18 meeting, the MSRC adopted revisions to three key policies to strengthen the contracting process, streamline implementation of projects, and reduce MSRC staff workload. The revised policies are provided for your information (Attachment 1).

Alternative Performance Offer from Calstart

The MSRC's FY 1993-94 Work Program included a $200,000 project with Calstart to deliver a purpose-built electric school bus. Due to problems with its subcontractor, Calstart was unable to meet terms of the contract and no "purpose-built" school bus was completed or delivered. Although Calstart initiated legal action against its subcontractor and obtained a default judgment, no monies are likely to be recovered under the judgment. As a non-profit corporation Calstart is unable to reimburse the MSRC. To realize the most benefit from its investment, the MSRC accepted an alternative performance offer from Calstart. Calstart has agreed to deploy an EBus for the use of the City of Anaheim, for a 12-month period of time at no additional cost to the MSRC and no operational cost to the City of Anaheim. The EBus used in shuttle service should achieve comparable emissions reductions to those of the originally proposed electric school bus.

FYs 1995-96 and 1996-97 Audit of AB 2766 Discretionary Fund

The third biennial audit of the AB 2766 Program has been completed. For the AB 2766 Discretionary Fund Program, the audit included 16 projects randomly selected from the FYs 1995-96 and 1996-97 Work Programs, a SCAG contract to develop a Regional Transit Database Information Exchange, contracts in the ZEV Program including the Outreach Coordinator contract with The Planning Center, and one randomly selected contract from the $5,000 Vehicle Buydown Program. The audit resulted in no findings. The third biennial audit for the AB 2766 Program (all three portions) has been included on the December 10, 1999, Governing Board agenda for our consideration.

Meeting Schedule for 2000

The MSRC adopted a meeting schedule for 2000, retaining the second Thursday at 1:30 p.m. for its Technical Advisory Committee meetings and the fourth Thursday at 1:30 p.m. for the MSRC meetings. The meeting schedule is provided as Attachment 2.

Contract Administrator Report

The MSRC's AB 2766 Contract Administrator provided a written status report on all open contracts from FY 1994-95 through the present. This Contract Administrator Report is attached for your information (Attachment 3).
