This report highlights AQMD rulemaking activity for 1999. Upcoming public workshops are noted at the end of the report.

The Rule and Control Measure Forecast Report provides the Board with a monthly update of AQMD’s rulemaking and control measure implementation schedule. Scheduling changes which occurred since last month’s forecast are summarized. The current schedule reflects the staff’s court filing for the lawsuit brought by environmental groups relative to the 1994 Air Quality Management Plan. However, the rulemaking schedule contained herein is subject to change based on the outcome of the litigation. Some measures may need to be delayed to allow room to incorporate additional measures that may be ordered to be implemented by the court in the SIP litigation case.

Rules to be Rescheduled/Removed and Additions

Rule 1110.2 - Emissions from Gaseous- and Liquid-Fueled Internal Combustion Engines

Proposed amendments to Rule 1110.2 are being moved from February 2000 to August 2000. Staff has not yet received a response from EPA on AQMD comments on their proposed SIP actions. The proposed amendments need to be coordinated with EPA SIP requirements and have adequate time for public comment on rule development.

Rule 1610 – Old-Vehicle Scrapping

Rule amendments to Rule 1610 are necessary to conform with ARB'S statewide vehicle scrapping rule, which is expected to be finalized in December, 1999 at the earliest. Since these amendments may result in significant modifications to rule requirements, Rule 1610 is being moved from March 2000 to June 2000 to allow additional staff time which is needed to analyze these potential modifications and obtain public input.

Emissions from Hydrogen Plant Process Vents

The purpose of this rule is to reduce VOC emissions from Hydrogen Plant process vents at refineries and chemical plants.

Clean Fuel On-Road Vehicles for Government and Airport Operations

Under the California Health & Safety Code Section 40447.5(a), the AQMD may adopt regulations for public and/or private fleet operations to purchase alternative-fuel vehicles. The proposed rule would require public and airport fleet operators with 15 or more vehicles to purchase alternative-fueled vehicles when adding vehicles or replacing vehicles in an existing fleet or forming a new fleet.

Volatile Organic Compound Emissions from Decontamination of Soil

Proposed amendment will further limit the emission of VOCs from contaminated soil as a result of leakage from storage or transfer facilities, from accidental spillage, or other deposition or excavation.

Disposal of Materials Containing VOCs (CM#97WST-04)

The proposed rule will be implemented in two steps. Step one will consist of refining the emissions inventory and assessing control methods for organic waste disposal facilities. Step two will include implementation of cost-effective and technically feasible control methods.

Control of Toxic Air Contaminants from Existing Sources

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. Proposed amendments will reduce the number of facilities required to obtain a Title V permit during Phase Two of the program and may reduce the facilities previously permitted during Phase One of the program. Also, amendments will improve clarity, increase flexibility and enhance enforceability of the program and subsequent permits issued.

Regulation XXX was developed to establish the parameters for an operating permit program that satisfies the requirements of Title V of the Clean Air Act Amendments of 1990. U.S. EPA is expected to adopt revisions of regulations that define the minimum elements of an approvable operating permit program. Once EPA's revisions are adopted, Regulation XXX will be amended to parallel changes in the EPA program.
