2. Set Public Hearing September 10, 1999 to Amend Rule 1186 - PM10 Emissions from Paved and Unpaved Roads, and Livestock Operations

As directed by the Board, staff has worked with local governments, and street sweeper manufacturers and contractors to resolve implementation issues arising from the February 1997 adoption of Rule 1186. Staff has completed a trial of the PM10-efficient street sweeper test protocol and full-scale testing of a variety of sweeper designs. Based on this testing, staff recommends the amendment of Rule 1186 to include the sweeper testing protocol, certification limits and procedures. Additional amendments are proposed to address local government and sweeper contractor issues. These amendments do not affect estimated emission reductions from Rule 1186 provisions.

3. Set Public Hearing September 10, 1999 to Amend Rule 1418 - Halon Emissions From Fire Extinguishing Equipment

The AQMD is proposing to amend Rule 1418 to address conflicting local and federal requirements on discharge testing of total flooding systems used in aircraft and military vehicles. The proposed amendments will allow the use of halons during discharge testing of total flooding systems provided specified criteria are met. In addition, minor revisions are proposed to streamline reporting requirements, provide consistency with EPA's halon rule, and clarify rule language. This item was reviewed by the Stationary Source Committee on July 23, 1999.

4. Recognize and Appropriate Funds from ARB and Execute Contract to Cost-Share Demonstration of Electric Vehicle Rental Program

On February 12, 1999, the Board approved execution of a contract with EV Rental Cars for the demonstration of an electric vehicle rental program using Clean Fuels Program funds in the FY 1998-99 Budget. Cost-sharing from ARB is to be passed through the AQMD, requiring execution of a contract between the two agencies. The required contracts were not fully executed prior to the end of FY 1998-99 due to procedural delays. This action will allow the contracts to be fully executed. Total project cost is $552,000 in funds and $623,755 in-kind. AQMD’s contribution shall not exceed $200,000. ARB’s contribution will be $100,000 in funds to be passed through the AQMD, and $100,000 in-kind. This item was reviewed by the Technology Committee on July 16, 1999, and recommended for approval.

5. Execute Contracts for EV Charge as part of FY 1997-99 AB 2766 Discretionary Fund Work Program

Within the FY 1997-99 AB 2766 Discretionary Fund Work Program, the MSRC created the $2,000,000 EV Charge Program, which through an application process, provides co-funding for the development and installation of electric vehicle (EV) charging stations. Funding is awarded on a first-come; first-serve basis to applicants that satisfy specified requirements as stated in the EV Charge Application package. Applications are being accepted within a six-month time frame that began February 12, 1999 and that will end on August 31, 1999. Eligible categories include Major Destination, Work Place/Fleets, Charging Site Expansion and Municipal Sites. The Board at its February 13, 1999 meeting approved the EV Charge Application Package. At this time the MSRC is requesting approval of ten applications submitted in May and June 1999.

6. Authorize Purchase of PeopleSoft Software Support Maintenance for Integrated Financial/Human Resources System

On April 10, 1998, the Board approved purchase of an integrated Financial/Human Resources system to achieve efficient unified financial, human resource, and payroll functions for the agency. The first year of software maintenance was included in the software license fee. This action is to obtain approval for the purchase of PeopleSoft software support maintenance for year two. Funds ($100,294) for the current year's support are included in the FY 1999-00 Budget. This was reviewed by the Administrative Committee on July 23, 1999, and recommended for approval.

7. Execute Contract with Allan Lind and Associates for Legislative Representation in Sacramento, CA

The current contract for Legislative Representation in Sacramento, CA, expires January 25, 2000. Since January of 1998, Allan Lind & Associates has successfully represented the AQMD in Sacramento and was instrumental in obtaining reauthorization of the AQMD's Clean Fuels Program with the passage of SB 98 (Alarcon) in June, 1999. In order to maintain this level of exemplary representation in Sacramento, this action is to approve a contract with Allan Lind & Associates for two additional years, through December 31, 2001, with an option to renew for one additional year. Funding for the first year is contained in the FY 1999-2000 Budget. Funding for the second and third year will be contingent upon Governing Board approval of the Budget for the respective fiscal years.

23. Execute Contracts for On-Road Clean Fuel Projects Awarded Under Carl Moyer Memorial Air Quality Standards Attainment Program

On April 9, 1999, the Board approved the release of RFP #9899-28 to implement the Carl Moyer Memorial Air Quality Standards Attainment Program. This RFP solicited proposals for low-emission on- and off-road vehicles and equipment, including marine, construction and agricultural equipment. $5 million was allocated for on-road clean fuel trucks. Proposal submissions for on-road clean fuel truck projects have been reviewed and staff proposes to award contracts under this program to fund the differential cost of 104 natural gas refuse trucks at a total funding of $4,996,034. This item was reviewed by the Technology Committee on July 16, 1999, and recommended for approval.

24. Adopt Recommendations Presented in Environmental Justice Task Force Final Report

After an 18-month evaluation effort, the Environmental Justice Task Force has completed its review of environmental justice issues related to air quality, and submits this final report. Among the recommendations in this report are design parameters for future emissions credit trading program; suggested follow-up of AQMD's Town Hall meetings; and prioritization of air monitoring activities.

25. Report on Discussions with Industry Pertaining to Amended Rule 1113 - Architectural Coatings

This report summarizes the activities of staff over the past 90 days pertaining to Amended Rule 1113 - Architectural Coatings. At the May 14, 1999 Board meeting, the Board directed staff to meet with members of the industry. Staff received comments pertaining to many issues already discussed during the rulemaking process, as well as some new issues. These comments and staff responses are summarized in the report. Staff also plans to continue the working group process for implementation of the averaging compliance option and the Technical Advisory Committee overseeing the National Technical Systems Study. This item was reviewed by the Stationary Source Committee on July 23, 1999.

27. Amend Rule 465 - Vacuum Producing Devices or Systems

The proposed amendments correct deficiencies identified by EPA. The proposed amendments are administrative in nature and update the definitions for VOC and exempt compounds, update and clarify requirements, and address EPA concerns regarding recording, reporting and recordkeeping. This item was reviewed by the Stationary Source Committee on June 18, 1999.

28. Amend Regulation IX - Standards of Performance for New Stationary Sources and Regulation X - National Emission Standards for Hazardous Air Pollutants

The Federal Clean Air Act authorizes EPA to delegate authority to local air districts, for the implementation and enforcement of standards set in 40 Code of Federal Regulations (CFR) Part 60, Standards of Performance for New Stationary Sources (NSPS) and 40 CFR Part 61, National Emission Standards for Hazardous Air Pollutants (NESHAPS). The NSPS standards were initially adopted by reference as AQMD Regulation IX on December 3, 1976 and the NESHAPS were adopted as Regulation X. Periodic amendments to Regulations IX and X incorporate new or amended standards by reference as necessary. Approximately twenty actions regarding NSPS and six regarding NESHAPS are proposed for incorporation by reference into Regulations IX and X, respectively. This item was reviewed by the Stationary Source Committee on June 18, 1999.

29. Amend Rule 1401 - New Source Review of Toxic Air Contaminants and to Amend Rule 219 - Equipment Not Requiring a Written Permit Pursuant to Regulation II

On February 10, 1999, the Scientific Review Panel and the Office of Environmental Health Hazard Assessment approved acute reference exposure level risk values for approximately 60 chemicals. Rule 1401(e)(3) requires an analysis and report to the Board before new or updated risk factors are used for new source review. Proposed Amendments to Rule 1401 will update the list of compounds and effective dates in Table I. In addition, an administrative change to the Rule 1401 applicability section and the preamble of Rule 219 - Equipment Not Requiring a Written Permit Pursuant to Regulation II is proposed based on a recommendation of the Permit Streamlining Task Force. This item was reviewed by the Stationary Source Committee on June 18, 1999.

30. Amend Rule 1104 - Wood Flat Stock Coating Operations

In response to CARB comments to incorporate all feasible control technologies, the proposed amendment reduces the allowable VOC content for inks and exterior siding coatings to 250 grams per liter. This item was reviewed by the Stationary Source Committee on June 18, 1999.

31. Amend Regulation XVII - Prevention of Significant Deterioration

This proposal will align the AQMD's Prevention of significant Deterioration program with federal requirements. Specifically, the emissions applicability threshold will change from 25/40 tons per year for listed/unlisted sources to the federal level of 100/250 tons per year. The current definition of VOC and federal definition of actual emissions will be incorporated. In addition, the maximum allowable ground level concentration values for particulate matter, beryllium, and hydrogen sulfide will be changed to meet the current federal requirements. These amendments are not expected to affect air quality or emission levels. This item was reviewed by Stationary Source Committee on June 18, 1999.
