The proposed amendments to Rule 218 will delete obsolete language, clarify administrative requirements, provide flexibility, delete the stack monitoring system performance specifications and revise the rule title from Stack Monitoring to Continuous Emission Monitoring. Proposed Rule 218.1 will incorporate the continuous emission monitoring system performance specifications, as well as revise and identify performance specifications to meet AQMD requirements for approval. This item was reviewed by the Stationary Source Committee on March 19, 1999.

3. Set Public Hearing May 14, 1999 to Amend Rule 462 - Organic Liquid Loading

The proposed amendments are necessary to address a vapor leak measurement issue identified by USEPA for inclusion in the SIP. The proposed amendments also provide a compliance mechanism for the vapor recovery systems that do not require CARB certification pursuant to Health and Safety Code Section 41954. In addition, other amendments are proposed to clarify rule requirements and improve rule enforceability. This item was reviewed by the Stationary Source Committee on March 19, 1999.

4. Set Public Hearing May 14, 1999 to Amend Regulation III - Fees and Rescind Rule 301.2 - Amnesty for Unpermitted Equipment and Rule 310 - Fee Schedules

Proposed amendments include a 2.0% CPI adjustment; delay for one year the second increase for gasoline nozzles and Title V fees; changes for portable equipment registered with the state; and adjustments to fees for some spray booths. Fees are specified for equipment requiring permits due to amendments to Rule 219. The proposal implements the State AB 2588 fee regulation, with no increases from last year. A small fee is established for MSERC trades. Other changes may also be proposed. Rules 301.2 and 310 have effective dates that have passed, so staff recommends these rules be rescinded. This item was reviewed by the Stationary Source Committee on March 19, 1999, and will be reviewed by the Mobile Source Committee on April 16, 1999, and Stationary Source and Administrative Committees on April 23, 1999.

5. Execute Contract for Temporary Engineering Services

On November 13, 1998, the Board approved the release of an RFP to select contractors to assist with permit processing when needed to respond to temporary work load increases. A panel has reviewed the proposals submitted in response to the RFP and recommends executing a contract with Air Quality Specialists, Inc. Funding for these services, $155,000, has been allocated in the FY 1998-99 Budget. This item was reviewed by the Stationary Source Committee on March 19, 1999, and recommended for approval. 

6. Award Contracts in Response to Learning Institute Program Opportunity Notice

Historically, Technology Advancement funding has been made available to educational institutions (community colleges, colleges, and universities) for projects to develop and demonstrate clean alternative fuel applications for on- and off-road vehicles. In response to Program Opportunity Notice 9899-A issued in October 1998, six proposals were selected for funding. The AQMD cost to fund the six selected research projects shall not exceed $757,800. This item was reviewed by the Technology Committee on March 26, 1999, and recommended for approval.

8. Execute Contract to Cosponsor Development and Demonstration of 250 kW Hybrid Pressurized Solid Oxide Fuel Cell-Micro-Turbine Power-Plant

Distributed generation of electricity is expected to play an increasing role in supplying electricity demands in California's deregulated energy marketplace. This deregulated marketplace will demand high-efficiency, low-emission, cost-competitive generation technologies. An advanced power generation technology that integrates an advanced solid oxide fuel cell with a micro-turbine is being developed to meet these demands. Edison Technology Solutions, in conjunction with Siemens Westinghouse and the University of California Irvine National Fuel Cell Research Center, has proposed the demonstration of a 250-kW hybrid fuel cell-micro-turbine capable of over 55% efficiency and negligible emissions. Total cost of this project is $16.2 million; AQMD cost-share will not exceed $200,000. This item was reviewed by the Technology Committee on March 26, 1999, and recommended for approval.

9. Execute Contract to Cosponsor Evaluation of Methanol Fuel Quality Specifications for Proton Exchange Membrane Fuel Cells

Numerous major auto manufacturers are developing proton exchange membrane fuel cell vehicles with on-board methanol reformers. One of the key issues for this technology is to ensure that fuel specifications are appropriate. DBB Fuel Cell Engine Corp., in conjunction with Ford and the American Methanol Institute, has proposed an evaluation of methanol fuel quality, including analysis of the fuel additives and materials present in the fuel supply infrastructure, the sensitivity of fuel cell reformer catalysts to additives and other impurities, and potential alternatives for a commercial grade methanol fuel specification. Total project cost is $465,000. Total AQMD funding shall not exceed $205,000. This item was reviewed by the Technology Committee on March 26, 1999, and recommended for approval.

10. Execute Contracts to Cosponsor School Clean Fuels Outreach Projects

In October 1998, the AQMD released Program Opportunity Notice (PON) #9899-A, entitled, School Clean Fuels Projects, to solicit proposals from academic institutions for projects to develop and demonstrate clean alternative fuel applications for on- and off-road vehicles. A portion of PON funding has been allocated for clean fuels outreach projects, such as co-sponsorship of specific events, student competitions, and other outreach efforts. A total of five outreach project proposals were received during the submittal period. Of these, the Executive Officer has approved funding for one project. Staff proposes to cosponsor three additional projects under the PON, for which total costs are approximately $236,300. AQMD cost-share will not exceed $67,479. This item was reviewed by the Technology Committee on March 26, 1999, and recommended for approval.

11. Issue an RFP to Solicit Projects for Carl Moyer Memorial Air Quality Standards Attainment Program Funding

The AQMD has submitted a request to ARB for up to $12 million from the Carl Moyer Memorial Air Quality Standards Attainment Program (Carl Moyer Program). This RFP complies with ARB program guidelines and funding criteria for low-emission on- and off-road vehicles and equipment, including marine and agricultural equipment. This action is to issue an RFP for up to $12 million for the Carl Moyer Program. This item was reviewed by the Technology Committee on March 26, 1999, and recommended for approval.

12. Amend Contract with Avnet Computer to Upgrade Business and Development Computers

In February 1996, AQMD entered into a five-year Technology Management Maintenance Service (TMMS) lease with Avnet Computer to acquire DEC Alphaserver 8400 and 2100 computers. The DEC 8400 is the business computer system which supports defined production programs such as CLASS, NSR, compliance, permits, and finance. The DEC 2100 computer system supports development of new applications prior to implementation as production systems on the DEC 8400. This action is to amend the contract with Avnet Computer to exercise the upgrade option (currently valued to be $343,541) in the TMMS agreement to increase storage, backup and processors. This was reviewed by the Administrative Committee on March 19, 1999, and recommended for approval.

13. Issue RFP for Management Firm to Operate Diamond Bar Headquarters Child Care Center

The contract with National Pediatric Support Services, Inc. for the management and operation of the Diamond Bar headquarters childcare center expires on August 31, 1999. This action is to issue an RFP to solicit bids from interested parties in order to secure a new three-year contract for these services. This item was reviewed by the Administrative Committee on March 19, 1999, and recommended for approval.

14. Revise Procurement Policy and Procedure

At its October 9, 1998 meeting, the Board approved in concept changes to the Procurement Policy and Procedure. The changes will streamline our business processes and make the best use of the new Finance and Human Resources system. The revisions will also update the policies and procedures to reflect organizational and policy changes which have occurred since the policy was last revised on January 9, 1998. In addition, the contractor selection criteria used in proposal evaluation has been revised to provide greater flexibility. This item was reviewed by the Administrative Committee on March 19, 1999, and recommended for approval.

15. AQMD Fee Structure Study

In conjunction with the Permit Streamlining Study, the accounting firm of Thompson, Cobb, Bazilio & Associates was retained by the AQMD in June 1998 to provide an independent review of AQMD's fee structure and authority. This final report details the consultant's findings and conclusions; provides specific recommendations to simplify fee information, improve fee equity among all fee payers; and provides greater cost recovery for AQMD programs. This item was reviewed by the Administrative Committee on March 19, 1999, and the Committee recommends approval of staff's recommendation to receive and file the report and defer consideration of the recommendations pending completion of certain related efforts as set forth in the Board letter.

16. Report to Legislature and CARB on AQMD's Regulatory Activities for Calendar Year 1998

The AQMD is required by law to submit a report to the Legislature on its regulatory activities for the preceding calendar year. The report is to include a summary of each rule and rule amendment adopted by AQMD, number of permits issued or denied, emission offset transactions, three-year budget forecast, and an update on the clean fuels program. This is the final report from the Emissions Equivalency Working Group. This working group is charged with the task of evaluating and recommending methods to make up the emissions shortfall caused by the permanent removal of employers with less than 250 employees from regulation.

The proposed amendments are necessary to clarify rule requirements and improve enforceability. The amendments also increase flexibility for RECLAIM facilities. These amendments include clarification to NSR requirements for change of operator and modification to new facilities. For major sources, the proposed amendments clarify monitoring requirements and add calculation methods for cases currently not addressed. For large sources, the proposed amendments add monitoring and calculation methods for cases currently not addressed and clarify source testing requirements. For process units, the proposed amendments establish concentration limits for determining emissions and add guidelines for category specific emission rate. The proposed amendments also correct rule references, extend deadlines for monthly emissions reporting and add clarifying language to enhance enforcement and consistency. This item was reviewed by the Stationary Source Committee on February 19, 1999.

33. Amend Rule 1158 - Storage, Handling, and Transport of Coke, Coal and Sulfur

Ambient monitoring, on-going public nuisance complaints, and AQMD staff observations and inspections have shown that the current Rule 1158 is not sufficient in reducing PM10 emissions. To address these deficiencies PAR 1158 will: expand the scope of this rule by including coal and sulfur; establish a No. 1/2 Ringelmann visible emissions limitation; reaffirm the requirement that all coke piles be enclosed; allow optional open storage of prilled sulfur and coal, under an Executive Officer approved plan; set standards for silt loading on roads and truck exteriors; require paving and maintenance of surfaces and roads where material accumulates; and require covers or slot-tops for material transport trucks. This item was reviewed by the Stationary Source Committee on February 19, 1999.
