Effective January 1, 1996, AB 2937 (Brulte) required each air district in California to develop a rule governing issuance of a Notice to Comply for minor violations. A California Air Pollution Control Officer Association (CAPCOA) task force was convened that year to draft core rule language for adoption by all districts statewide, subject to minor local modifications as required. Following numerous CAPCOA public consultation meetings held throughout the state in 1997 and a recent local District workshop, comments were evaluated and rule language modified as necessary. Proposed Rule 112 represents the culmination of this effort to meet the requirements of AB 2937. This item was reviewed by the Stationary Source Committee on September 18, 1998.

3. Set Public Hearing November 13, 1998 to Amend Rule 1610 - Old Vehicle Scrapping

At its August 14, 1998 meeting, the Board postponed action on staff's proposal to amend Rule 1610 for 60 days and referred this item to the Technology Committee to resolve issues associated with the parts destruction requirement. The Technology Committee reviewed staff's August 14 proposal to address U.S. EPA comments on rule approvability, and indicated that the proposal reasonably responded to issues raised by the car collectors. In addition, staff was directed to continue working with impacted parties to further resolve remaining issues. Subsequently, staff met with the impacted parties to develop a revised parts destruction requirement. Although complete agreement was not obtained, proposed rule language was developed, representing staff's best effort to bridge differences among impacted parties. This item was reviewed by the Technology Committee on September 25, 1998.

4. Adopt Resolution Amending Compensation for AQMD's Hearing Board Vice Chairman; Reinstating Hearing Board's Authority to Hold Single-Member Hearings; and Clarifying Hearing Board Members' Attendance

In 1995 when the salary of the member elected by fellow Board members to act as Chair was increased to reflect additional responsibilities and duties of the office over and above other Hearing Board members, a compensation differential for the Hearing Board Vice Chair was not addressed. This action is to address that inequity by increasing the compensation for the Hearing Board Vice Chair when assuming duties normally performed by the Chair in the Chair's absence. Amendments are also proposed to clarify Board Members' attendance requirements, and under what circumstances a Board member and his or her alternate may be compensated for attending hearings on the same day. This action will also reinstate the Hearing Board's authority to hold single-member hearings pursuant to Health and Safety Code Section 40501.3. This item was reviewed by the Administrative Committee on September 18, 1998, and recommended for approval.

5. Approve Modification of Compensation Package for Certain Designated Deputies to Equalize Benefits

Three Designated Deputies are serving under contracts originally executed several years ago, the terms of which provide lower benefits than are currently afforded to the remaining Designated Deputies. The Acting Executive Officer proposes to modify the compensation package for these individuals to update benefit provisions consistent with those provided to all other Designated Deputies. This action is to approve the modified compensation package for these Designated Deputies.

6. Authorize Twelve New Positions and Transfer of Funds for Enhanced Compliance Inspections Program for Gasoline Dispensing Facilities

Additional Air Quality Inspector and clerical positions are required by Stationary Source Compliance to implement an enhanced compliance inspection program for gasoline dispensing facilities. The Board, as part of the FY 1998-99 Budget, allocated $1,000,000 in Stationary Source Compliance to fund an enhanced service station compliance program. This action is to approve twelve additional positions and transfer program funding from the Professional and Special Services Account to the Salary and Employee Benefits, Fixed Assets, and Services and Supplies accounts within Stationary Source Compliance to implement the program. This item was reviewed by the Administrative Committee on September 18, 1998, and recommended for approval.

7. Execute Contract to Develop Additional Technologies to Monitor and Reduce Fugitive Emissions at Dry Cleaners

On August 14, 1998, the Board authorized the release of an RFP to select a qualified contractor to develop new technologies to reduce these fugitive emissions and to simplify, reduce, or streamline monitoring by dry cleaners. This action is to execute a contract with Aves. A total of $200,000 is available in the AB 2588 Air Toxics Fund for this purpose. This item was reviewed by the Stationary Source Committee on September 18, 1998, and recommended for approval.

8. Issue RFQ to Acquire Scientific Computer

The AQMD currently uses one scientific computer to perform complex air quality modeling. The existing computer is based on three-year-old technology and is nearing its maximum utilization. This action is to issue an RFQ to obtain an additional scientific computer to provide improved modeling performance and more timely model execution. Funds for this fixed asset ($109,947) are included in the FY 1998-99 Budget. This item was reviewed by the Administrative Committee on September 18,1998, and recommended for approval.

9. Establish List of Prequalified Vendors to Provide Library Services and Supplies

On July 10, 1998, the Board approved release of an RFP to prequalify vendors for library services and supplies. As a result of successful responses to this RFP, six vendors were identified as capable of providing library services and supplies. This action is to approve these six vendors to provide their services to the AQMD for a period of two years. Funds totaling $100,000 have been allocated in the FY 1998-99 Budget for this purpose. This item was reviewed by the Administrative Committee on September 18, 1998 and recommended for approval.

11. Execute Contracts for AQIP Proposals Received During Second Quarter of 1998

Rule 2202 - On-Road Motor Vehicle Mitigation Options was adopted on December 8, 1995. One of the compliance strategies under Rule 2202 allows employers to invest in the AQIP. Monies received are placed in a restricted account to fund programs that result in equivalent emission reductions that would otherwise have been achieved by the participating employers. Staff evaluated the proposals received during the second quarter of 1998 and this action is to execute a contract with Pick Your Part Auto Wrecking. The amount available for this quarter is $515,966. This item was reviewed by the Mobile Source Committee on September 25, 1998, and recommended for approval.

12. Amend Current Contracts or Issue RFPs for Legislative Consulting Services in Washington, DC, and Sacramento, CA

Current contracts for legislative representation in Washington, DC, and Sacramento, CA, expire January 25, 1999. This action is to either extend current contracts for legislative representation in Washington, DC, and Sacramento, CA, for one additional year or issue RFPs for legislative consulting services. If RFPs are issued, any contract to be awarded will be subject to Board approval. This item was reviewed by the Legislative Committee on October 9, 1998, and recommended for approval.

13. Amend Contract with Pacifica Interchange for Lease of South Bay Field Office

On April 14, 1995, the Board approved the execution of a lease for the South Bay field office. This action is to amend the contract to renew the lease with Pacifica Interchange, LLC, et al. for a three-year term. Funding has been included in the FY 1998-99 Budget and will be requested in successive fiscal years for this contract. This item was reviewed by the Administrative Committee on September 18, 1998, and recommended for approval.

14. Execute Contract for Third-Party Workers' Compensation and Liability Adjusting Services

On February 13, 1998, the Board approved the release of an RFP for Third-Party Workers' Compensation and Liability Adjusting Services. The RFP was released and three proposals were received by the March 13, 1998 deadline. Staff reissued the RFP on June 16, 1998, to incorporate requirements for liability adjusting services, not identified in the previous release. Five proposals were received by the August 7, 1998 deadline. This action is to execute a three-year contract with JT2 Integrated Resources in an amount not to exceed $34,508 per year, commencing November 1, 1998 through October 31, 2001. Sufficient funds have been allocated in the FY 1998-99 Budget with appropriation of funds requested for each successive year. This item was reviewed by the Administrative Committee on September 18, 1998, and recommended for approval.

15. Authorize Purchase of Forty Vehicles for AQMD Fleet

The AQMD's Equipment Replacement Plan was established to replace obsolete and worn equipment and vehicles over a five-year period. In accordance with the Plan's replacement guidelines, up to forty vehicles are needed to replace high-mileage vehicles that are no longer cost effective to maintain and repair. The authorization allows the AQMD Purchasing Manager to purchase vehicles through the California Department of General Services at a lower cost resulting from the economy of scale purchasing. The total expenditure will not exceed $720,000. This item was reviewed by the Administrative Committee on September 18, 1998, and recommended for approval.

16. Recognize and Appropriate Funds, and Execute Contract with National Oceanographic and Atmospheric Administration to Provide Upper Air Wind and Temperature Monitoring Services

During the 1997 Southern California Ozone Study, the National Oceanographic and Atmospheric Administration (NOAA) provided supplemental upper air meteorological monitoring for the Basin. The data provide valuable information on pollution transport through the region. This action proposes to execute a contract with NOAA to maintain a network of four upper-air radar profilers in the Basin for a one-year period. The data will provide technical support for the MATES-II study as well as fine particulate monitoring for the Technical Enhancement Program for the 2000 AQMP. Total cost of the contract will not exceed $350,000. This item was reviewed by the Administrative Committee on September 18, 1998, and recommended for approval.

17. Implement Recommendations to Modify AQMD Policies and Procedures for New Finance and Human Resources System

As part of the implementation of the new integrated Finance and Human Resources System, the consultant has recommended changes to our current business practices to streamline our processes and make the best use of the new system's capabilities. The changes, if approved by the Board, will require revision to the Procurement Policy and Procedure, administrative policies and procedures for fixed assets and related policies as needed. Final changes to these AQMD policies will be brought back to the Board for approval. Approval in concept is required at this time in order to meet the January 1, 1999 "live" date for implementation of the new Year 2000 compliant system. This item was reviewed by the Administrative Committee on September 18, 1998, and recommended for approval.

18. Amend Contract with Vargas, Lopez and Company LLP for Independent Audit Services

On June 14, 1996, the Board awarded a three-year contract to Vargas, Lopez and Company, Certified Public Accountants, for financial audit services. The contract for the FY audit ending June 30, 1998 expires on June 30, 1999. The AQMD is in the process of transitioning to new financial systems which are Year 2000 compliant. Staff recommends that Vargas, Lopez and Company's contract be extended for one additional year and amended to include additional consulting services for internal control review. The total cost of this amendment would not exceed $35,000; $20,900 for financial audit services to be included in the FY 1999-2000 budget, and $15,000 for consultant services available in the current budget. This item was reviewed by the Administrative Committee on September 18, 1998 and recommended for approval.

19. Issue RFP for Demonstration of Electric Vehicle Rental Program

Successful commercialization and acceptability of electric vehicles by end users are important factors in reducing emissions from on-road vehicles. This action is to issue an RFP to solicit proposals for demonstration of electric vehicles in a rental program. AQMD's contribution to this program shall not exceed $200,000. The ARB will co-fund the project with $100,000 in funds and $100,000 in-kind services, and the AQMD will act as a pass-through for the ARB funds. Additional cost sharing by the proposer is desired. This item was reviewed by the Administrative Committee on September 18, 1998 and the Technology Committee on September 25, 1998, and recommended for approval.

20. Recognize Revenue from California Energy Commission and Execute Contract to Establish Electric Vehicle Charging Infrastructure Network

At the April 1998 Board Meeting, the Board approved amending an existing contract with the California Energy Commission (CEC) to revise the work statement in order to use CEC funding of $122,000 to provide vehicle chargers for an EV loan program. As a separate Board item at the September 1998 Board Meeting, the Board approved execution of a contract with the ARB to implement an EV loan program for state and local government agencies. The CEC funding of $122,000 which was allocated for expenditure during FY 97-98 needs to be appropriated to the FY 98-99 budget, and re-directed towards a "EV Charger Program for Southern California." This item was reviewed by the Administrative Committee on September 18, 1998 and the Technology Committee on September 25, 1998, and recommended for approval.

21. Execute Contract to Cost-Share Update of Website Information on Clean Fuel Station Locations and Provide Related Support Services

There is a need to provide updated information on the location of clean fuel stations and recharging stations via a highly visible and accessible internet website. Bids were obtained from four firms to update and expand on information on the location and operational attributes of refueling and recharging stations for all alternative fuels. Based on bids received, a contract with CALSTART is proposed to provide up to 500 additional website maps for sites that offer CNG, LNG, ethanol, methanol, propane, hydrogen and/or electricity. The $112,225 project includes cost-sharing from the ARB, Federal Transit Administration, Bay Area Air Quality Management District and CALSTART. AQMD cost-share will not exceed $67,225. This item was reviewed by the Technology Committee on September 25, 1998, and recommended for approval.

22. Execute Lease of Toyota RAV4 Electric Vehicle

The AQMD demonstrates new clean fuel vehicles to public and private organizations so potential purchasers may familiarize themselves with available low emission clean fuel technologies. As part of the Technology Advancement Alternative Fuel Vehicle Loan Program, vehicles are procured as new technologies become available. It is proposed that the AQMD lease a 1999 model year Toyota RAV4 electric vehicle. Total cost to the AQMD will not exceed $27,000. This item was reviewed by the Technology Committee on September 25, 1998, and recommended for approval.

23. Issue Request for Qualifications to Prequalify Source Testing Firms to Provide Supplemental Source Testing Services

This action is to issue a Request for Qualifications to establish a list of prequalified source testing firms to supplement AQMD emissions testing and test protocols and/or test method development efforts, as needed, over a one-year period. Total funds for this purpose are not to exceed $100,000. Sufficient funds are available in the FY 1998-99 Budget. This item was reviewed by the Administrative Committee on September 18, 1998, and recommended for approval.

24. Execute Contract for Management Audit of Contract, Administrative, and Technical Support Provided to MSRC and AB 2766 Discretionary Program
Winterbottom

H&S Code 44233 stipulates that not more than 5% of the fees collected may be used for administrative costs toward the AB 2766 Discretionary Program. It is estimated that contract, administrative and technical support for FY 1998-99 will be 4.8%. The MSRC has decided to conduct a management audit to determine if staff support functions can be streamlined or consolidated and administrative costs reduced. With assistance from AQMD staff, the MSRC conducted an informal bid process using a list of management audit firms that previously worked with the AQMD. The MSRC considered the results of the informal bid and a contract recommendation at its September 24, 1998 meeting. The MSRC requests approval of a contract with this management firm for an amount not to exceed $10,000.

At the July 1998 Board meeting, the Board approved amendments to Rule 1401. This report fulfills the Board's directive for staff to return to the Board in October 1998 to provide a progress report on source tests for metal plating processes and an assessment of the cumulative risk requirement for the motion picture film processing industry. Staff will also recommend updates to some risk factors to reflect recent changes by OEHHA.

The proposed amendments will modify existing Rule 2202 to be consistent with amended Health & Safety Code Section 40458, effective June 19, 1998, and repealed Section 44243.5 (SB 432 [Lewis]). The law directs AQMD to raise the employer applicability threshold for Rule 2202 compliance from 100 to 250, thus permanently exempting worksites with 100 to 249 employees. Rule 2202 Implementation Guidelines will be updated in order to reflect current legal requirements and policy and practice. This item was reviewed by the Mobile Source Committee on September 25, 1998.

44. Adopt Proposed Rule 1469 - Hexavalent Chromium Emissions from Chrome Plating and Chromic Acid Anodizing Operations; and Repeal Rule 1169 - Hexavalent Chromium - Chrome Plating and Chromic Acid Anodizing

Proposed Rule 1469 - Hexavalent Chromium Emissions from Chrome Plating and Chromic Acid Anodizing Operations will incorporate and implement CARB's amended Airborne Toxics Control Measure (ATCM) requirements for control of hexavalent chromium emissions from chrome plating operations and will replace AQMD's existing Rule 1169- Hexavalent Chromium - Chrome Plating and Chromic Acid Anodizing. The state ATCM has been recently amended to reflect the new requirements of the federal air toxic regulations for chrome platingoperations. This item was reviewed by the Stationary Source Committee on July 24, 1998.
