The proposed amended rule will implement part of Environmental Justice Initiative No. 10 to reopen for public comment Rule 1401 - New Source Review of Carcinogenic Air Contaminants. The proposed amendments will add toxic air contaminants (TAC) to the list of compounds covered by the rule, add requirements for the protection of public health from the noncancer effects of the TACs, and propose specific exemptions. In addition, the proposed amendments will implement Section 112(g) of the Federal Clean Air Act. This item will be reviewed by the Stationary Source Committee on May 22, 1998 and June 19, 1998.

3. Set Public Hearing June 12, 1998 to Amend Rule 431.1 - Sulfur Content of Gaseous Fuels

Proposed amendments address SIP changes recommended by the U.S. EPA; provide relief to landfill operators from having to remove sulfur compounds from landfill gases to the required level of 40 ppmv since a cost-effective control technology has not been developed; and exempt a person burning landfill gas from the installation and operation of continuous fuel gas monitoring systems or continuous emission monitoring systems until December 31, 1998. This item was reviewed by the Stationary Source Committee on April 17, 1998.

4. Set Public Hearing June 12, 1998 to Amend Rule 102 - Definition of Terms

The proposed amendment adds the following 11 compounds to the Group I list of Exempt Compounds in Rule 102: HFC-161, HFC-236fa, HFC-245ca, HFC-245ea, HFC-245eb, HFC-245fa, HFC-236ea, HFC-365mfc, HCFC-31, HCFC-123a, and HCFC-151a. This proposal also moves parachlorobenzotrifluoride (PCBTF) from Group II to Group I Exempt Compounds in Rule 102.

5. Appoint Medical, Public, and Alternate Members to AQMD Hearing Board

The terms of office for Joseph Auerbach, Medical Member, and alternate Robert Zweig; and Marti Klein and Marcus Lewis, Public Members, and alternates James Manion and Terry Dipple, expire June 30, 1998. Pursuant to California Health and Safety Code Section 40501.1(b), an Advisory Committee, consisting of one representative appointed by each of the Counties of Los Angeles, Orange, Riverside, and San Bernardino, and the City of Los Angeles shall be appointed to interview each candidate and make recommendations to a standing committee of the Board (the Administrative Committee is currently chartered to handle such issues). This action is to appoint the Medical, Public and Alternate Members to three-year terms terminating June 30, 2001. This item was reviewed by the Administrative Committee on April 17, 1998, and recommended for approval.

Budget/Fiscal Impact

6. Execute Contract to Evaluate Low NOx Combustion Systems for Natural Gas-Fired Large Water Heaters and Small Boilers

Large water heaters and small boilers are estimated to emit over 14 tons of NOx per day in the Basin. Rule 1146.2 establishes NOx limits for these units that will reduce their contribution by about 9 tons per day. Based on results of a competitive solicitation, Energy and Environmental Research Corporation has been selected to conduct the implementation study proposed in conjunction with Rule 1146.2 to evaluate the technical performance and costs of low NOx combustion systems for large water heaters and small boilers. The AQMD cost to fund this project shall not exceed $85,000. This item was reviewed by the Technology Committee on April 24, 1998, and recommended for approval.

7. Execute Contract to Assist Relocation of Solar-based Hydrogen Generating Facility

Clean Air Now, Inc. designed and implemented the solar-powered, hydrogen-generating facility to refuel hydrogen vehicles at the Xerox facilities in El Segundo, CA. It is proposed to relocate this facility, which has operated successfully since January 1, 1997, to the Sunline Transit Agency facility near Palm Desert, California. This relocation would assist in the refueling of hydrogen-fueled buses that Sunline Transit Agency plans to purchase in the future. Staff is recommending AQMD support of $50,000. Total project cost is $300,000. This item was reviewed by the Technology Committee on April 24, 1998, and recommended for approval.

8. Execute Contracts to Develop and Demonstrate Zero-Emission Technologies for Utility and Lawn and Garden Equipment Used in Commercial Applications

In January 1998, the Board approved the release of an RFP to solicit bids in the following project areas: (1) develop and demonstrate zero-emission technologies for utility and lawn and garden equipment used in commercial applications, in an amount not to exceed $350,000; and (2) develop and demonstrate low-emission, alternative fuel and zero-emission technologies for off-road equipment, in an amount not to exceed $600,000. Of the two proposals received for Project (1), Metallic Power, Inc. has been selected for award, in an amount not to exceed $350,000. At this time, deferral of an award for Project (2) is recommended to enable completion of a more thorough technical evaluation. This item was reviewed by the Technology Committee on April 24, 1998, and recommended for approval.

9. Execute Contract to Continue Cost-Share Development of Enhanced Efficiency Natural Gas Engines

In February 1997, working in parallel with the U.S. Department of Energy and the Gas Research Institute (GRI), the AQMD entered into a sole-source contract with the Trucking Research Institute (TRI) to bid for and manage projects with the three principal original equipment manufacturers for the development of enhanced efficiency natural gas engines. Project progress was satisfactory and $50,000 was expended; however, key personnel at TRI managing this program have left the company. This proposal would utilize the balance of the funds and initiate the management of the project by GRI. The total cost of this project is $1.2 million. Total AQMD funding for this contract will not exceed $350,000. This item was reviewed by the Technology Committee on April 24, 1998, and recommended for approval.

10. Execute Contract for Phase II Assessment Study of Architectural Coatings

The AQMD requires a study to assess the application and durability characteristics of architectural coatings within the categories of industrial maintenance; non-flats; primers, sealers, and undercoaters; quick-dry enamels; quick-dry primers and sealers; and waterproofing sealers. Proposals from firms specializing in analysis of coatings were evaluated by a technical advisory committee, composed of industry representatives and other interested parties. This action is to execute a contract with the successful bidder at a cost not to exceed $150,000. This item was reviewed by the Stationary Source Committee on April 17, 1998.

11. Issue RFP to Review, Modify, or Prepare Air Toxics "Hot Spots" Information and Assessment Act Health Risk Assessments

AQMD oversees the preparation of and approves health risk assessments (HRAs) submitted by facilities to characterize the potential risk their toxic emissions pose to surrounding communities, pursuant to AB 2588 (the California Air Toxics "Hot Spots" Information and Assessment Act of 1987). This action is to issue an RFP from which qualified contractors will be selected to assist AQMD in evaluating the remaining HRAs. A total of $500,000 is available in the AB 2588 Air Toxics Fund. This item was reviewed the Administrative Committee on April 17, 1998, and recommended for approval.

12. Issue RFP for Ammonia Emission Inventory Enhancements as part of Technical Enhancement Program for 2000 AQMP

At its February 13, 1998 meeting, the Board approved the workplan for the Technical Enhancement Program for the Year 2000 AQMP (TEP 2000), which seeks to provide a sound technical foundation for the next AQMP revision. This action is to issue an RFP for the TEP 2000 project entitled "Ammonia Emission Inventory Enhancements." Funding for this project ($80,000) has been allocated in the FY 1997-98 Budget. This item was reviewed by the Mobile Source Committee on April 24, 1998, and recommended for approval.

13. Execute Contract to Purchase High-Speed Remote Access Upgrade

On February 19, 1998 an RFQ was released for a High-Speed Remote Access Upgrade for AQMD’s voice and data systems. This upgrade will allow AQMD to consolidate its access to the Public Switched Network, lowering annual fees and enhancing calling features. This action is to execute a contract with GTE California Incorporated for the purchase of the network equipment, at a cost of $56,701.92, and a contract with Starcom for the purchase of the testing and diagnostic equipment, at a cost of $15,005.62. Funds for these items are included in the FY 1997-98 Budget. This item was reviewed by the Administrative Committee on April 17, 1998, and recommended for approval.

14. Amend Contract with Cal Poly Foundation for Student Interns

Since August 1995, the AQMD has been contracting with the Cal Poly Foundation for the services of student interns in Finance. These interns perform such tasks as assisting in the fixed asset inventory, financial report reconciliation, and performing miscellaneous tasks in Payroll and Accounting. The total amount of the contract though June 30, 1998 is $42,000. It is estimated that $14,000 of student intern services will be needed in FY 1998-99. Funds for this item has been included in the FY 1998-99 Budget. Because this amount will cause the cumulative contract with Cal Poly Foundation to exceed $50,000, this action is to request Board approval to amend the contract.

15. Issue RFP to Obtain Contractor for Electric Vehicle Charging Station Directional Signage Implementation Program as Part of FY 1997-99 AB 2766 Discretionary Fund Work Program

The MSRC’s FY 1997-99 AB 2766 Discretionary Fund Work Program includes $500,000 for signage implementation for publicly accessible EV charging stations. Implementation will include obtaining signage permitting from three Caltrans Districts and approximately 40 cities and 70 private property site owners; sign fabrication of approximately 1,800 directional word signs and installation at a minimum of 100 publicly accessible EV charging stations; program monitoring, reporting and documentation for all aspects of the word signage program; and seeking approval of a charging station "symbol" to complement the word signage program. The MSRC proposes to issue an RFP to identify a contractor to oversee and implement the signage program. The MSRC requests Board approval to issue this RFP as part of the FY 1997-99 Work Program.

16. Issue Request for Qualifications to Establish List of Prequalified Providers of Blended Mixed Gases

AQMD expects to spend approximately $70,000 during FY 1998-99 to purchase blended mixed gases for use in a wide variety of analytical and monitoring needs. The laboratory uses compressed gases as quality control standards. This action is to issue a Request for Qualifications to establish a list of prequalified vendors from whom competitive bids may be solicited for the purchase of blended mixed gases for use in FY 1998-98. This item was reviewed by the Administrative Committee on April 17, 1998, and recommended for approval.

17. Issue RFQ to Purchase Compressed Pure Gases and Cryogenic Liquids

AQMD expects to spend approximately $60,000 to purchase compressed pure gases and cryogenic liquids in FY 1998-99 for use in a wide variety of analytical and monitoring needs. The laboratory uses compressed pure gases as carrier gases and purging agents, and cryogenic liquids to concentrate samples for gas chromatographic analysis for PAMS and other network samples. This action is to issue an RFQ to purchase compressed pure gases and cryogenic liquids in FY 1998-99. This item was reviewed by the Administrative Committee on April 17, 1998, and recommended for approval.

18. Reallocate Funds and Approve Purchase of Laboratory Equipment Upgrades

For the sixth-year PAMS implementation, $35,000 was approved by the Board in February 1998 for purchase of one concentrator for gas chromatographic analysis of VOCs. The AQMD Laboratory recently received ARB-surplused equipment at no cost to AQMD, including one Entech concentrator and three Entech canister auto samplers. Although the equipment is outdated, upgrades are available from Entech Instruments, Inc. Staff believes that upgrading the concentrator and the three canister samplers is more cost effective than purchasing one new piece of equipment. This action is to reallocate $35,000 to purchase equipment upgrades from Entech Instruments, Inc. on a sole-source basis. This item was reviewed by the Administrative Committee on April 17, 1998, and recommended for approval.

19. Recognize and Appropriate Funds from Los Angeles District Attorney’s Office for Purchase of High-Resolution Video Camera System for Laboratory’s Polarized Light Microscope

AQMD has received $5,000 from the Los Angeles District Attorney’s Office as terms of a court case settlement designated for the purchase of a high-resolution video camera system. The system will enable the laboratory to document, retrieve and archive photographs of particles in compliance samples. This action is to recognize $5,000 and appropriate these funds to the FY 1997-98 Budget for the purchase of the system. This item was reviewed by the Administrative Committee on April 17, 1998, and recommended for approval.

23. Painter’s Guide to Clean Air

"Painter’s Guide to Clean Air" brochure will assist and inform the public by (i) discussing the contribution of architectural coatings to the ozone problem, harmful effects of ozone, and factors to consider when choosing paints; (ii) increasing public awareness of availability of low- and zero-VOC paints; (iii) encouraging consumers to paint during non-smog months; and (iv) discussing pollution prevention concepts pertaining to painting. In addition, the brochure will partially implement Control Measure #97CTS-03, Consumer Product Education and Labeling Program. This item was reviewed by the Stationary Source Committee on April 17, 1998.

26. Implementation of New PM2.5 Monitoring Network

As part of EPA’s promulgation of the new PM2.5 standards, AQMD is required to prepare a PM2.5 Monitoring Network Plan (Plan). The Plan, being coordinated by the ARB, is due to EPA by July 1, 1998. Staff has completed a draft of its portion of the Plan, and has completed a series of public consultation sessions, inviting public comments. The purpose of this presentation is to provide a status report on the progress toward the implementation of the PM2.5 air monitoring network.

The BACT Guidelines are being updated to reflect new federal LAER for two equipment categories for petroleum valves and large internal combustion engines. Proposed amendments adjust fees equivalent to the change in the California Consumer Price Index for 1997. Other amendments include cost-of-service adjustments, and include reducing some discounts; providing a time-and-materials fee for Title V permit issuance; voluntary fees for expedited permit application processing; establish an increased per-nozzle fee for gasoline dispensing facilities; reduction of certain protocol evaluation fees; return to higher processing fee for applications for permit to operate without first obtaining a permit to construct; and other administrative corrections. This item was reviewed by the Budget Advisory Committee on February 26, 1998, by the Finance Committee on April 3, 1998, by the Ethnic Community Advisory Group on April 8, 1998, and Administrative Committee on April 17, 1998.

38. Adopt Executive Officer’s FY 1998-99 AQMD Budget and Work Program

The Executive Officer’s Budget for FY 1998-99 represents input from staff, Board members, and the public over the past several months. This year’s process included several meetings of the Budget Advisory Committee; a public hearing February 13 to take input on the AQMD’s Program Goals and Objectives; and two budget workshops, one for the public on April 16 and one for the Board on April 23. This submittal transmits the required appropriations and reserves necessary to adopt the proposed budget. This item was reviewed by the Finance Committee on April 3, 1998, Administrative Committee on April 17, 1998, and presented to the Board at its workshop on the Draft Budget on April 23, 1998.

39. RECLAIM Program Three-Year Audit and Progress Report

The progress report and audit of the NOx and SOx RECLAIM program’s first three years of implementation is prepared in accordance with Rule 2015 - Backstop Provisions, and Health and Safety Code Section 40440.2(a)(1). The report assesses emission reductions, average annual price and availability of RECLAIM Trading Credits, job impacts, compliance issues, and other measures of performance for the 1994 through 1996 compliance years of the program. The report also provides the basis to commence the public hearings to reassess the program relative to findings pursuant to Health and Safety Code Sections 39616(c) & (e). This item was reviewed by the Stationary Source Committee on April 17, 1998.

40. Discussion of SB 432 (Lewis) to Reach Consensus on Board Position

Based on the evaluation of voluntary ridesharing, SB 836 (Lewis) requires exempted employers with 100 to 249 employees to be brought back into Rule 2202 - On-Road Motor Vehicle Mitigation Options on June 1, 1998. At its March meeting, the Board directed staff to seek advice and direction from the state legislature regarding implementation of SB 836 requirements. In the meantime, SB 432 has been amended to require the permanent exemption of employers with 100 to 249 employees from Rule 2202 compliance. This was discussed at the April 24, 1998 Legislative Committee meeting and recommended for discussion at the May Board meeting.

SCAQMD, et al., United States District Court No. 97-6916 HLH (SHx), and (b) Government Code Section 54956.9(b)(1) to confer with its counsel because, based on existing facts and circumstances, there is a significant exposure to litigation against the agency--one case.
