Proposed amendments to Rule 1168 will address issues identified by the U.S. EPA for inclusion in the SIP and extend the sunset date of exemption (j)(17) regarding rubber sheet-applied lining operations from January 1998 to January 2000. The U.S. EPA-identified revisions result in the creation of new subcategories of adhesives, sealants, and sealant primers with corresponding VOC content limits and a change in the small user exemption criteria for non-compliant adhesives. This proposal will delay 0.02 ton per day of VOC emission reductions from 1998 to 2000. This item is scheduled to be reviewed by the Stationary Source Committee on January 23, 1997.

7. Execute Sole-Source Contract with Los Angeles County Weights and Measures Department for Gasoline Vapor Recovery Inspections

In past years, concurrently with their inspections, Los Angeles County Weights and Measures Inspectors have conducted gasoline vapor recovery inspections at retail gasoline dispensing facilities to supplement the AQMD Inspection Program. This action is to execute a contract for inspections for this fiscal year. AQMD contracting policy requires Board approval since the AQMD has contracted with the same vendor on a sole-source basis for consecutive years. In addition, the number of stations to be inspected is being increased, at a cost of $44 each, not to exceed a total of $61,860. Funds are included in the FY 1997-98 Budget. This item was reviewed by the Administrative Committee on December 19, 1997, and recommended for approval.

8. Execute Contract to Cost-Share Development and Demonstration of an Advanced Hydrogen Fuel Storage System Using Chemical Hydride Slurry System

Tecogen has proposed to develop an advanced hydrogen fuel storage system for a 50kw fuel cell vehicle application using a chemical hydride slurry system. Current pure hydrogen storage tanks are either too voluminous or too heavy. Reforming liquid fuels to produce hydrogen, with high enough purity (99.99%) for proton exchange membrane fuel cells, has proven to be a formidable challenge. This project has the potential to overcome these limitations. The total cost of this project is $1.22 million, cost-shared by Department of Energy ($913,500), Tecogen ($57,000), and with in-kind technical assistance from Ford Motor Co., Air Products, and Morton International. The proposed AQMD cost-share is $250,000. This item was reviewed by the Technology Committee on December 11, 1997, and recommended for approval.

9. Execute Contract to Cost-Share the Evaluation of Alternative Specifications to Proposed ARB Standards for Motor Vehicle Grade Liquefied Petroleum Gas

Because of industry concerns regarding ability to comply with proposed standards for motor vehicle grade liquefied petroleum gas (LPG), ARB has postponed promulgation of the standards pending evaluation of alternative LPG formulations. An LPG Task Group has been formed by the ARB and includes the Western Propane Gas Association, National Propane Gas Association, ARCO, Shell, Engine Manufacturers Association, Cummins, Ford Motor Company and the AQMD. This Task Force has developed a test protocol to evaluate alternative fuel formulations to determine their relative impact on engine performance, durability and emission levels. The total cost of the proposed evaluation project is approximately $500,000, with AQMD cost-share not to exceed $100,000. This item was reviewed by the Technology Committee on December 11,1997, and recommended for approval.

10. Execute Contract to Cost-Share Recommended Best Practices for Natural Gas Fuel System Design and Integration

The Gas Research Institute (GRI) is sponsoring a project to develop recommended best practices for natural gas fuel system design and integration for medium-duty trucks and transit and school buses. GRI has requested AQMD participation to expand that effort to include school buses and additional medium-duty truck platforms and applications. Total cost of the entire scope of work is $795,508, with AQMD support not to exceed $150,000. This item was reviewed by the Technology Committee on December 11, 1997, and recommended for approval.

11. Execute Contract to Co-Sponsor Production of an Educational Video Film on Renewable Energy

Hydrogen 2000 Inc. has proposed to produce two educational video films on "Renewable Power: Earth’s Clean Energy Destiny." A 25-minute film will be produced for schools and colleges, while a shorter, condensed 6-minute film will be produced for use at conferences and seminars. These films would cover renewable energy technologies that are expected to play an important role in the recently deregulated electricity market: solar, wind, hydro, biomass and hydrogen. Total cost of this project is $118,000. The project is co-sponsored by DOE ($60,000), Engineering Advancement Association of Japan ($23,000) and Hydrogen 2000 (in-kind cost-share, in terms of video-footage from previous projects). The proposed AQMD cost-share is $35,000. This item was reviewed by the Technology Committee on December 11, 1997, and recommended for approval.

12. Issue RFP to Develop and Demonstrate Zero-Emission Technologies for Utility and Lawn and Garden Equipment Used in Commercial Applications; and Low-Emission, Alternative Fuel and Zero-Emission Technologies for Off-Road Equipment

Internal combustion engines used to power utility and lawn and garden equipment, and off-road equipment are significant sources of emissions in the Basin. This action is to issue an RFP to develop and demonstrate zero-emission technologies for utility and lawn and garden equipment used in commercial applications; and low-emission, alternative fuel and zero-emission technologies for off-road equipment. AQMD’s portion of the $700,000 utility, and lawn and garden project is $350,000. AQMD’s portion of the $1,200,00 off-road equipment project is $600,000. Multiple awards may result from this RFP. This item was reviewed by the Technology Committee on December 11, 1997, and recommended for approval.

14. Amend Rule 2202 AQIP Contract with Envirotest Systems Corporation

On July 14, 1996, the Board approved execution of a Rule 2202 - On-Road Motor Vehicle Mitigation Options AQIP contract with Santa Barbara Research Center (SBRC) for an amount not to exceed $578,956, to implement a remote sensing program. To date SBRC has acted in good faith to fulfill its contractual responsibilities, but has been unable to achieve the expected results. AQMD and SBRC’s successor-in-interest for this contract, Envirotest, have jointly determined that this project should be discontinued. This action is to amend the contract with Envirotest to decrease the amount by $428,956, in order to cover only the cost of work performed and a final report, not to exceed $150,000. This item was reviewed by the Mobile Source Committee on December 11, 1997, and recommended for approval.

15. Transfer $1.5 Million from Air Quality Assistance Fund to General Purpose Agency Fund To Be Held for Regional Transportation Agencies’ Coalition

The AQMD is required by the state Health & Safety Code to provide $1.5 million, on or before January 15, 1998, to the Regional Transportation Agencies` Coalition (RTAC) or its successor agency for the purpose of enabling regional or county rideshare agencies to provide marketing and client services to maximize voluntary ridesharing in the air basin. Since RTAC does not have the authority to receive and safeguard funds, AQMD will transfer the money to an agency fund pending direction from RTAC for disbursement. This item was reviewed by the Mobile Source Committee on December 11, 1997, the Administrative Committee on December 19, 1997, and recommended for approval.

16. Execute Contract for Privatization of Portions of Annual Emissions Report Program

At its October 1997 meeting, the Board approved the release of an RFP to continue to privatize portions of the Annual Emissions Report (AER) Program. All proposals submitted were evaluated by a diverse panel of technically qualified individuals according to the criteria specified in the RFP. This action is to execute a contract with Ecotek, Inc., in an amount not to exceed $250,000, to implement the 1997-98 AER Program. Sufficient funds are available in the FY 1997-98 Budget. This item was reviewed by the Administrative Committee on December 19, 1997, and recommended for approval.

17. Execute Contract for Classification and Compensation Services

On April 11, 1997, AQMD released an RFP for classification and compensation services. Evaluation of the three submitted proposals has been completed, and the panel recommends a contract be awarded to Comp Plus, Inc. for an amount not to exceed $40,000. Because the total of a 1996 contract with this vendor and this recommended contract would exceed $50,000 over a two-year period, Board approval is requested. This item was reviewed by the Administrative Committee on December 19, 1997, and recommended for approval.

18. Approve Consultant Classification and Salary Recommendation, and Add and Delete Positions in Information Management

Based on results of consultant-conducted classification studies of positions in Stationary Source Compliance, Human Resources staff recommends increasing salary levels for the classes of Engineering Technician and Assistant Air Quality Specialist and reclassifying one Engineering Technician position and three Air Quality Inspector II positions. Further, due to changing staffing needs in Information Management, staff recommended that one Air Quality Engineer II position and one Air Quality Specialist position be deleted and two System Analyst positions be added. This item was reviewed by the Administrative Committee on December 19, 1997, and recommended for approval.

19. Issue RFP for Insurance Brokerage Services

AQMD’s one-year contract with Near North Insurance Brokerage, Inc., for brokerage services expires March 31, 1998. This RFP is to solicit bids from qualified firms or sole practitioners to provide brokerage services and represent AQMD’s interest in the insurance market for the next three-year period commencing April 1, 1998. The contract award is expected to be an amount not to exceed $40,000 per year for the three years. Appropriation of funds will be required for each successive year. This item was reviewed by the Administrative Committee on December 19, 1997, and recommended for approval.

20. Establish Lists of Prequalified Vendors to Provide Printing and Photocopy Paper, Printing Services, Automotive Mechanical Repair and Service, and Unleaded Fuel

22. Amend Existing Contracts for Temporary Engineering Services

Two task order contracts to AeroVironment Environmental Services, Inc. and Air Quality Specialists for temporary engineering services at $100,000 each, were approved by the Board on January 10, 1997 for a two-year period. These contracts assist the AQMD in processing non-Title V permit applications. The funds budgeted for the FY 1996-97 are nearly expended and additional funds for FY 1997-98 in the amount of $170,000 need to be added to the contracts. This action is to increase the base amount to a total of $370,000, and the fund will be dispersed pending final bids submitted on new task orders. Funds for these services have been previously approved in the FY 1997-98 Budget. This item was reviewed by the Administrative Committee on December 19, 1997, and recommended for approval.

23. Execute Contracts for Local Government Subvention Fund Match Program as Part of FY 1997-99 AB 2766 Discretionary Fund Work Program

Within the FY 1997-99 AB 2766 Discretionary Fund Work Program, the MSRC created a $6.5 million Local Government Subvention Fund Match Program which, through a simplified application process, provides a 25% match to cities and counties within the AQMD’s jurisdiction that receive AB 2766 City Subvention Funds. Eligible match categories include alternative fuels/electric vehicles, transportation related land-use strategies, public transportation (transit & rail), traffic management, transportation demand management (non-Rule 2202), market-based strategies, bicycles, and public education related to clean vehicles or transportation. Funds will be allocated on a first-come, first-serve basis. The application process is May 15, 1997 through March 3, 1998. At this time the MSRC is requesting approval of additional applications recently submitted by local governments.

24. Amend Technical Guidance Document for Regulation XXX - Title V Permits

The Technical Guidance Document (TGD) provides an explanation of the Title V program and simple guidelines for facilities applying for Title V permits. The document also contains application forms for Title V permits which require EPA approval for program implementation. Staff has revised the TGD consistent with recent changes to Regulation XXX adopted by the Board on November 14 and December 12, 1997.

29. Status Report on Rule 403 Agricultural Operations Working Group

On February 14, 1997, amendments to Rule 403 were adopted to implement Best Available Control Measures (BACM) for fugitive dust sources. Under the amendments, agricultural operations may submit a control plan (Plan) by September 1, 1998 to maintain a Rule 403 exemption. In the Rule 403 adoption resolution, staff was directed to work with the agricultural community to develop appropriate BACM for agricultural activities prior to the effective date. Through a cooperative effort among the U.S. Department of Agriculture Natural Resources Conservation Service, local Resource Conservation Districts, Farm Bureau, and AQMD staff, a draft Plan template based on crop type has been developed. This is a status report on development of the Plan template and acceptability criteria. This item was reviewed by the Mobile Source Committee on December 11, 1997.

31. Report on Certification of VOC-Exempt Compounds as Clean Air Solvents

On July 11, 1997, the Board amended Rule 1122 - Solvent Degreasers, and directed staff to investigate whether VOC-exempt chemicals should be certified as Clean Air Solvents (CAS) along with aqueous materials that meet the requirements of CAS. The CAS program was originally intended to promote the use of water-based cleaning materials that meet all future AQMD rule requirements and were environmentally benign. This report indicates that: (i) VOC-exempt chemicals would be eligible for certification as CAS; and (ii) additional toxicity criteria may be needed for the CAS definition.

During 1997 the Board adopted, and amended, a resolution regarding Advisory Council and Advisory Groups concerning their composition, duties and activities. This action is to adopt a new resolution to reduce the number of Advisory Council members from approximately 31 to approximately 19 and to make several administrative changes.

41. Adopt Proposed Rule 1146.2 - Emissions of Oxides of Nitrogen from Large Water Heaters and Small Boilers

Proposed Rule 1146.2 will establish emission limits for NOx for new water heaters and small boilers rated between 75,000 and 2,000,000 Btu/hr heat input. Beginning January 1, 2000, new units sold or installed in the AQMD would be certified by the manufacturer to comply with NOx standards. In addition, beginning January 1, 2001, existing units rated at 400,000 Btu/hr or greater would be phased into compliance with NOx emission standards. It is estimated that the proposed rule will reduce about 9 tons per day of NOx. This item was reviewed by the Stationary Source Committee on November 21, 1997.

42. Amend Regulation IX - New Source Performance Standards

Federal Clean Air Act Section 111(c)(1) authorizes EPA to delegate authority to local air districts to administer and enforce federal NSPS . These federal standards were initially adopted by reference as AQMD Regulation IX on December 3, 1976. Periodic amendments to Regulation IX incorporate new or amended NSPS by reference as necessary. Currently proposed for incorporation by reference into Regulation IX are NSPS governing municipal waste combustors, sewage treatment plants, municipal solid waste landfills, hospital/medical/infectious waste incenerators and nonmetallic mineral processing plants. This item was reviewed by the Stationary Source Committee on November 21, 1997.

43. Adoption of New Procurement Policy and Procedure

This action is to consolidate/modify existing policies into a new Procurement Policy and Procedure and expand the justification for sole source as recommended by the Ad Hoc Sole Source Committee on November 13, 1997. Relative to adding preference points for small businesses, on December 19, 1997, the Administrative Committee determined to defer such action until after further consideration of the Board’s Ethnic Community Advisory Group’s concerns regarding an appropriate definition of small business.

44. Adopt Proposed Rule 1118 - Emissions from Refinery Flares

Proposed rule will take a stepped approach to potential flare emissions reduction by gathering data on flaring operations at petroleum refineries to assess the need for, or the level of, any future controls to reduce flare emissions. The first step will require refineries to monitor flaring activities for the amount and composition of gases being flared. If the data demonstrates a need to control flaring operations, step two of the rule will be to develop specific control requirements to reduce flare emissions. This item was reviewed by the Stationary Source Committee on November 21, 1997.

All agendas are posted at AQMD Headquarters, 21865 E. Copley Drive, Diamond Bar, California, at least 72 hours in advance of the meeting. All information concerning agenda items may be reviewed in the Library at AQMD Headquarters one week before Board meetings. At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under Public Comments may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record, provided 25 copies are presented to the Clerk of the Board.
