Proposed amendments adjust fees equivalent to the change in the California Consumer Price Index for 1997. Other amendments include cost-of-service adjustments, and include reducing some discounts, providing a time and materials fee for Title V permit issuance, voluntary fees for expedited permit processing, amendments to Regulation XVI Plans, notification fees for asbestos and lead demolition/renovation projects; adjusting Toxic Air Contaminant (TAC) fees for perchloroethylene, and TAC fees for benzene and VOC emission fees for transfer, storage, and dispensing of gasoline at retail and bulk loading facilities; reduction of certain protocol evaluation fees; return to higher processing fee for applications for permit to operate without first obtaining a permit to construct; and other administrative corrections. This item will be reviewed by the Administrative Committee on April 17, 1998.

The current Executive Management Agreement with Intergovernmental Affairs Director Oscar V. Abarca expires May 1, 1998. The Acting Executive Officer proposes to execute a new contract with Mr. Abarca, and this action is to approve the compensation package.

5. Recognize and Appropriate Funds from U.S. EPA to Implement Local Program for 1998 Earth Day National Town Meeting

The U.S. EPA has committed $15,000 to develop and implement an event to coincide with Renew America’s 1998 Earth Day Global Warming Event. They have proposed that their contribution to this event be administered by the AQMD. This action is to appropriate a $15,000 supplement to the AQMD FY 1997-98 Budget from a U.S. EPA Grant. The funds are to be used to administer a local program in the South Coast Basin for a "Global Warming: Local Solutions" National Town Meeting on April 22, 1998. This item was reviewed by the Administrative Committee on March 20, 1998, and recommended for approval.

6. Execute Contract to Establish Electric Vehicle Loan Program for State and Local Government Agencies

Attempts by original equipment manufacturers and California state and local agencies to encourage fleet purchases of electric vehicles have met with limited success. Some government agencies are currently required by the federal Energy Policy Act to incorporate alternative fuel vehicles into their fleets. Municipal and private fleets face this requirement in 2003. The proposed program will establish an electric vehicle/portable charger loan program, directed at state and local government fleets. The program will be managed by ARB with the cooperation of the California Department of General Services. Total project cost is $532,000. AQMD cost-share, will not exceed $205,000. California Energy Commission, through an existing contract with AQMD, will provide $122,000; ARB will provide $205,000. This item was reviewed by the Technology Committee on March 27, 1998, and recommended for approval.

7. Execute Contract to Evaluate Diesel Particulate Sampling Methodology and Determine Zone of Influence of Ultrafine Particle Fraction of On-Road Emissions

Diesel sampling and measurement procedures for particle number and size from mobile sources are not standardized, and the applied laboratory procedures do not reflect the actual on-road conditions. The Coordinating Research Council (CRC) has issued an RFP to evaluate and refine the sampling and measurement procedures and compare them to actual on-road conditions. Total project cost is approximately $1,200,000. AQMD’s contribution shall not exceed $100,000, with the balance being co-funded by the CRC, the Engine Manufacturers Association, and the National Renewable Energy Laboratory. This item was reviewed by the Technology Committee on March 27, 1998, and recommended for approval.

8. Execute Contract to Conduct Market Feasibility Study of Zinc-Air Battery Technology

Electric Power Research Institute has proposed to conduct a market feasibility study of mechanically rechargeable zinc-air (MRZA) battery technology, especially with respect to medium-duty and heavy-duty vehicle applications. Low-energy densities of conventional batteries tend to restrict the range of such vehicles. MRZA technology, developed by Electric Fuel, Ltd, has significantly higher energy density and has the potential for overcoming such barriers in delivery vans, transit buses and trucks. The total cost of this project is $95,000 with AQMD cost-share not to exceed $25,000. This item was reviewed by the Technology Committee on March 27, 1998, and recommended for approval.

9. Execute Contract to Provide Technical Support to Facilitate Introduction of LNG Engine Technologies and Establishment of LNG Fueling Facilities

To optimize the effectiveness of the Technology Advancement program, it has been advantageous to supplement in-house technical resources and expertise with outside assistance. The proposed contract with USA Pro, and specifically Gary Pope, principal, will provide technical support to facilitate the introduction of LNG engines and the establishment of LNG fueling facilities. Total cost to the AQMD will not exceed $30,000. This item was reviewed by the Technology Committee on March 27, 1998, and recommended for approval.

10. Authorize Purchase of Alternative Fuel Vehicles for AQMD Alternative Fuel Vehicle Loan Program

The AQMD Alternative Fuel Vehicle (AFV) loan program demonstrates new AFVs to public and private organizations so that potential purchasers may familiarize themselves with available low-emission AFV products. As new technologies become available, vehicles are added to the program. It is proposed that AQMD purchase two CNG vehicles and one propane vehicle for use in the AFV loan program. The total cost of these purchases will not exceed $80,600. This item was reviewed by the Technology Committee on March 27, 1998, and recommended for approval.

11. Transfer Funds Within FY 1997-98 Budget to Purchase Vapor Recovery Analyzers

To establish compliance with the CARB executive orders and AQMD rules at gasoline dispensing facilities with bellowsless nozzle systems, testing is required using CARB-approved methods and equipment. Staff proposes to purchase hand-held units for this purpose. However, the per unit cost is above the threshold amount for fixed assets. This action is to transfer $32,000 from the Stationary Source Compliance, Services and Supplies Major Object, Public Notice and Advertising Account, to the Stationary Source Compliance, Fixed Asset Major Object, in the FY 1997-98 Budget. Purchase and use of the equipment was included in the Rule 461 Action Response Plan. This item was reviewed by the Administrative Committee on March 20, 1998, and recommended for approval.

12. Amend Contracts with COMSYS Technical Services, Cordoba Corporation, Majesco Software, Inc., and Sierra Cybernetics to Provide Short- and Long-Term Systems Development and Maintenance Support

The AQMD currently has task order-type contracts with four companies for short- and long-term system development services. These contracts are amended as additional automation needs are identified. This action is to amend the contract with the four companies. Funds for these services ($195,000 to COMSYS Technical Services, $227,630 to Cordoba Corporation, $410,200 to Majesco Software, Inc., and $335,550 to Sierra Cybernetics, Inc.) are included in the FY 1997-98 Budget. This item was reviewed by the Administrative Committee on March 20, 1998, and recommended for approval.

13. Execute Contract to Lease Radio/Cellular Telephones for AQMD Field Staff and Authorize Surplus and Disposal of Obsolete Radio Communications Equipment

On December 12, 1997 the AQMD released an RFQ to replace its outdated radio communications system with state-of-the-art radio/cellular or cellular telephones. This action is to execute a two-year contract with Nextel Communications, Inc. to lease and operate a maximum of 85 radio/cellular or cellular telephones to support field communications at a cost not to exceed $112,640 per year. Funds for this item are included in the FY 1997-98 Budget. In addition, this action is to declare as surplus the AQMD's obsolete radio communications equipment and to dispose of these fixed assets, pursuant to AQMD Policy and Procedure #20. This was reviewed by the Administrative Committee on March 20, 1998, and recommended for approval.

14. Execute Contract for New Integrated Financial and Human Resources System

AQMD requires an integrated financial system (including accounting, purchasing, payroll, contracts, budgeting, human resources, and fixed asset inventory software that replaces/enhances current functionality, a new computer, and migration of historical data) to achieve efficient unified accounting and finance functions for the agency. This action is to award bid to Mikon Computer Systems to provide a turnkey system for a total cost of $1,185,171. Initial funds ($500,000) for purchase of this system are included in the FY 1997-98 Budget; the remainder will be requested in the budgets for FY 1998-99 through FY 2000-01 as part of a three-year lease/purchase agreement. This item was reviewed by the Administrative Committee on March 20, 1998, the Finance Committee on April 3, 1998, and recommended for approval.

15. Issue RFQ for Security Guard Services at Diamond Bar Headquarters

The current three-year security guard services contract at the Diamond Bar Headquarters expires August 9, 1998. This action is to issue an RFQ, the response to which will be used to select a contractor to provide security guard services. This item was reviewed by the Administrative Committee on March 20, 1998, and recommended for approval.

16. Execute Contracts for Local Government Subvention Fund Match Program as Part of FY 1997-99 AB 2766 Discretionary Fund Work Program

Within the FY 1997-99 AB 2766 Discretionary Fund Work Program, the MSRC created a $6.5 million Local Government Subvention Fund Match Program which, through a simplified application process, provides a 25% match to cities and counties within the AQMD’s jurisdiction that receive AB 2766 City Subvention Funds. Eligible match categories include alternative fuels/electric vehicles, transportation related land-use strategies, public transportation (transit & rail), traffic management, transportation demand management (non-Rule 2202), market-based strategies, bicycles, and public education related to clean vehicles or transportation. Funds will be allocated on a first-come, first-serve basis. The application process was May 15, 1997, through March 3, 1998. At this time the MSRC is requesting approval of applications received from local governments by the application deadline.

17. Recommendation for Coordination Agreement with EPA on BACT/LAER

In order to help ensure that AQMD’s determination of BACT is consistent with the federal definition of LAER, and to ensure that there is adequate public participation and a process for considering public input, it would be beneficial to have a coordination agreement on BACT/LAER determination with EPA. The Home Rule Advisory Group recommends that the proposed BACT/LAER Coordination Agreement be forwarded by the AQMD Board to the Regional Administrator, EPA, Region IX for consideration. This item was reviewed by the Home Rule Advisory Group on March 26, 1998, and recommended for approval.

18. Recommendation from Executive Search Firm on Executive Officer Qualifications

At its March meeting, the Board approved the evaluation panel’s selection of the firm to conduct the executive search services, and authorized the Chairman to execute a contract with Norman Roberts and Associates. After receiving input from Board members, the firm has prepared a recommendation regarding the types of qualifications required for the Executive Officer. This action is to consider the recommendation and make any appropriate changes.

19. Report and Recommendations on Air Quality Assistance Fund

The Air Quality Assistance Fund was established to increase the availability of financial assistance to small businesses for the purpose of complying with AQMD regulations. This report reviews the current status of the program and evaluates alternatives for enhancement of the program. This item was reviewed by the Stationary Source Committee October 24, 1997 and March 20, 1998, and the Administrative Committee November 21, 1997 and March 20, 1998, and recommended for approval.

20. BACT Guidelines Update

The Best Available Control Technology (BACT) Guidelines are hereby updated to reflect new federal LAER for 26 equipment categories including boilers, compressors, connectors, drains, gas turbines, internal combustion engines, ovens, pumps, sampling connections, and vapor degreasers. These emission rates constitute both state BACT and BACT under AQMD rules. This item was reviewed by Stationary Source Committee on March 20, 1998.

21. AQMD’s Comments on EPA’s Interim Guidance for Investigating Title VI Complaints Regarding Permits

EPA has released for public comment its interim guidance on investigating complaints challenging permit decisions under Title VI of the Civil Rights Act of 1964, prohibiting discrimination by federally-funded agencies on the basis of race or national origin. Comments are due May 6, 1998. This action is to approve the comments and the transmittal of the comments to EPA. This item was reviewed by the Stationary Source Committee on March 20, 1998.

This item was continued pursuant to Board meeting procedures. Staff is recommending Board action on a subpart of the original item. For FY 1997-98, staff recommends the transfer of $100,000 from the AB 2588 Air Toxics Fund to be used to lower fee increases for major program sources. With this adjustment, major sources will see a 10 percent AQMD increase; without it, major sources will experience an approximate 25 percent increase over last year`s AQMD fees. This item was reviewed by the Administrative Committee on February 20 and March 20 and the Stationary Source Committee on February 20, 1998.

36. Submittal of the 1997 AQMP 2010 and 2020 PM10 Emission Inventories for Transportation Conformity Use

The Southern California Association of Governments (SCAG) requests the AQMD to submit the 2010 and 2020 annual average emission inventories from the 1997 AQMP to ARB, and to request ARB to forward the emission inventories to the U.S. EPA. The 2010 and 2020 emission inventories will serve as the PM10 emission budgets for 2010 and 2020, respectively. The PM10 emissions budgets are needed by SCAG in order to make transportation conformity findings in 2010 and 2020 as part of SCAG’s 1998 Regional Transportation Plan. This item was reviewed by the Mobile Source Committee on February 27, and March 27, 1998.

37. Amend Rule 210 - Applications, and the List and Criteria Identifying Information Required of Applicants Seeking a Permit to Construct from the South Coast Air Quality Management District Contained in Regulation II

Rule 210 and the List and Criteria Identifying Information Required of Applicants Seeking a Permit to Construct from the SCAQMD (List and Criteria) contained in Regulation II set forth requirements for submitting permit applications to AQMD and identify information required of applicants seeking permits to construct air pollution sources before an application can be determined to be complete. The recent discovery of minor omissions in these requirements has led staff to recommend that Rule 210 and the List and Criteria be modified to conform to Permit Streamlining Act Requirements set forth in the California Government Code. The modifications principally add deadlines for action on permits after completion of CEQA documents. These modifications generally conform to existing practice. This item was reviewed by the Stationary Source Committee on March 20, 1998.

38. Amend Rule 1150.1 - Control of Gaseous Emissions from Municipal Solid Waste Landfills and Rescind Rule 1150.2 - Control Of Gaseous Emissions from Inactive Landfills

Proposed amendments address SIP changes recommended by EPA; to implement the requirements of 40 CFR, part 60, subpart Cc - Emission Guidelines and Compliance Times for Municipal Solid Waste Landfills; to include the requirements of Rule 1150.2 - Control of Gaseous Emissions from Inactive Landfills; and to embody the Guidelines for Implementation of Rule 1150.1 as an attachment to the proposed rule. Proposed amendments were reviewed by the Stationary Source Committee on January 23, 1998 and by the Technology Committee on February 27 and March 27, 1998.

It is necessary for the Board to recess to closed session pursuant to Government Code (1) Section 54956.9(a) to confer with its counsel regarding pending litigation which has been initiated formally and to which the District is a party. The actions are Coalition for Clean Air, et al. v. SCAQMD, et al., United States District Court No. 97-6916 HLH (SHx); and Communities for a Better Environment, et al. v. SCAQMD, et al., EPA File No. 10 R-97-R9, an administrative action before the U.S. Environmental Protection Agency. (2) Section 54956.9(b)(1) to confer with its counsel because, based on existing facts and circumstances, there is a significant exposure to litigation against the agency, one case. The facts and circumstances are termination of the DEO for Technical Support Services.
