The proposed amendments have been developed to replace Rule 1421 with the state Airborne Toxic Control Measure (ATCM) Title 17 CCR, Section 93109, except the existing Rule 1421 secondary control requirements will be retained. The amendments propose to eliminate unnecessary requirements not contained within the state ATCM and that have an insignificant impact on airborne emissions from perchloroethylene dry cleaning equipment. Additionally, reporting and recordkeeping requirements are streamlined. This was reviewed by the Stationary Source Committee on April 18, 1997.

3. Set Public Hearing June 13, 1997 to Amend Rule 701 - Air Pollution Emergency Contingency Actions

The proposed amendments to Rule 701 would address changes made in State law which have rendered portions of the rule unenforceable; eliminate references to work trip reduction plans and rescinded Rules 1501 and 1501.1; and modify the source-receptor area map used for forecasting and reporting air quality. The proposed amendments are administrative in nature and will have no significant emissions impact. This was reviewed by the Mobile Source Committee on April 25, 1997.

Proposed amendments add tetrachloroethylene (perchloroethylene), 3,3-dichloro-1,1,2,2-pentafluoropropane (HCFC 225ca), 1,3-dichloro-1,1,2,2,3-pentafluoropropane (HCFC 225cb) and 1,1,1,2,3,4,4,5,5,5-decafluoropentane (HFC-43-10mee) to the "Exempt Compound" definition in Rule 102. Perchloroethylene is proposed to be added as a Group II Exempt Compound. The other three compounds are proposed to be added to the list of Group I Exempt Compounds. The proposed amendments will also allow the use of cyclic branched, or linear, completely methylated siloxanes (VMS) and parachlorobenzotrifluoride (PCBTF), currently listed as Group II Exempt Compounds, and perchloroethylene in operations regulated pursuant to Rules 1106.1, 1151, and 1171. Other definitions were also removed from Rules 1171 and 1302 and referred to in Rule 102. This is scheduled for review by the Stationary Source Committee on May 23, 1997.

5. Recognize Successful Efforts and Conclusion of Coachella Valley PM10 Working Group and Accept Final Semi-Annual Reports

As part of Resolution No. 90-94, the Board established the Coachella Valley (CV) PM10 Technical Working Group (TWG) to assist in the implementation of the 1990 CV State Implementation Plan. As noted in the recently adopted CV PM10 Attainment Redesignation Request and Maintenance Plan, the CV has attained the PM10 standards (1993-1995). Staff recommends that the Board recognize the successful efforts and conclusion of the TWG, accept the final two semi-annual reports (#11 and #12), and further direct staff to continue to provide technical assistance to the CV Association of Governments in their efforts in support of the CV Maintenance Plan.

6. Execute Contracts to Cost-Share Development and Demonstration of Fast Charging Systems for Electric Vehicles

Automotive manufacturers have announced the introduction of EVs. Because of battery capacity and recharging time, these EVs will be limited to a daily range of 50 to 120 miles. Besides higher-capacity batteries, fast charging systems have been identified as an area which can improve the effective range of EVs. Based on the results of a competitive solicitation, AeroVironment has been selected to develop and demonstrate a fast charging systems. AQMD funding for this $1.77 million project will be $500,000. This was reviewed by the Technology Committee on April 25, 1997, and recommended for approval.

7. Execute Contract to Cost-Share Development of Engine and Fuel Systems for Use of Dimethyl Ether in Medium- to Heavy-Duty Vehicles

Dimethyl Ether (DME) is a promising alternative fuel that can provide low emissions with minimal engine modifications. Economic studies indicate that DME produced directly from natural gas in production quantities can be cost-competitive with diesel fuel. AVL Powertrain Engineering, Inc. has proposed a project to develop fuel storage and handling systems for DME-fueled engines, and to perform failure mode and effects analysis and dynamometer testing in preparation for vehicle field demonstration. Total project cost is $584,401 with AQMD cost-sharing of $205,673. This was reviewed by the Technology Committee on April 25, 1997, and recommended for approval.

8. Execute Contracts for the Corridor Community Program as Part of the FY 1995-97 AB 2766 Discretionary Fund Work Program

Through its $7 million ZEV "Quick Charge" Program, the MSRC released an RFP for its $1.675 million Corridor Community Program in March 1996. This Program is intended to solicit the participation of general purpose local governments in a demonstration of EVs and infrastructure within the South Coast District. The demonstration will incorporate infrastructure, the permitting process, and coordination within and between communities utilities and manufacturers. Seven proposals were received by the deadline. On April 24, 1997, after considerable negotiations and resolution of legal issues, the MSRC approved funding for several private/public partnerships within the FY 1995-97 AB 2766 Discretionary Fund Work Program. This action requests Board approval to enter into contracts with these partnerships.

9. Approve Issuance of RFPs for TCM Market-Based Incentive Programs and Student Education Projects for the FY 1997-98 AB 2766 Discretionary Fund Work Program

The MSRC’s FY 1997-99 AB 2766 Discretionary Fund Work Program includes a $2.5 million TCM element to solicit projects for bicycle, video conferencing, smart shuttles, intelligent transportation systems, market incentives and student education. A Program Opportunity Notice was released in early February to solicit prep-proposals for market-based incentive programs and student education projects. Based on the 61 pre-proposals received, the MSRC has decided to release two separate RFPs, providing funding to reduce mobile source emissions through: 1) student education projects that educate pre-driving youth about the social and environmental impacts of traffic congestion and unhealthful air quality, and 2) market-based incentive programs that utilize the market to reduce travel demand. The MSRC requests the Board’s approval to issue both RFPs.

10. Execute Contract to Acquire Automated Gas Chromatograph System

On January 10, 1997, the Board approved an RFQ to acquire an Automated Gas Chromatograph System to enhance the Burbank monitoring station for the PAMS program. This action is to execute a contract with Entech Instruments, Inc., in an amount not to exceed $69,361. Sufficient funds are allocated in the FY 1996-97 budget. This was reviewed by the Administrative Committee on April 18, 1997 and recommended for approval.

11. Execute Contract to Acquire Meteorological Sensor Systems

On January 10, 1997, the Board approved an RFQ to acquire Meteorological Sensor Systems for the PAMS program. The replacement sensors are more reliable, easier to maintain and less costly to operate with proposed staffing levels. This action is to execute a contract with Met One Instruments in the amount not to exceed $83,000 for the purchase of seven Meteorological Sensor Systems. Sufficient funds are allocated in the FY 1996-97 budget. This was reviewed by the Administrative Committee on April 18, 1997, and recommended for approval.

12. Execute Contracts to Purchase Hardware and Software Necessary to Implement Middleware Technology in Support of AQMD Applications

On February 14, 1997, the Board approved an RFQ to obtain the necessary fixed assets for Middleware in support of software applications used by AQMD staff. Middleware technology provides users with an easier way to connect to multiple data sources through networks and to bring the data to their desktops for processing. This action is to execute contracts with Mikon Computer Systems, PC Systems Design, and ThirdWave Corporation. Funds for these fixed assets ($180,000) are included in the FY 1996-97 Budget. This was reviewed by the Administrative Committee on April 18, 1997, and recommended for approval.

13. Amend Contracts to Provide Short- and Long-Term Systems Development and Maintenance Support

At its February 14, 1997 meeting, the Board executed task order-type contracts with four companies to obtain short- and long-term systems development services on a task-by-task basis. As further system development requirements are identified, additional funding must be added to each contract. This is to amend the contract with three (COMSYS Technical Services, Majesco Software, and Sierra Cybernetics) of the four task-order firms to incorporate essential system development tasks. Funds for these services ($563,500) are included in the FY 1996-97 Budget. This was reviewed by the Administrative Committee on April 18, 1997, and recommended for approval.

14. Issue RFP to Perform Data Analysis of PAMS Network Data and 1997 Southern California Ozone Study Field Measurement Data

As part of the PAMS program, a comprehensive database of ozone precursors and meteorology has been collected in the South Coast Air Basin, and a data analysis study has been recommended by the U.S. EPA. In addition, during the summer of 1997, an intensive ambient field measurement program will be conducted to update existing aerometric databases used in developing meteorological episodes for ozone attainment demonstration purposes. The proposed RFP seeks proposals to analyze the PAMS and Southern California Ozone Study data at a cost not to exceed $250,000. Funds for this project are available in the FY 1996-97 budget, and are part of the federally provided funding for the PAMS program. This was reviewed by the Administrative Committee on April 18, 1997, and recommended for approval.

15. Establish List of Prequalified Vendors for the Purchase of Personal Computer Hardware, Software, and Installation Services

On February 14, 1997, the Board approved the release of an RFQ to prequalify vendors for personal computer hardware, software, and installation service purchases. This action is to approve nineteen vendors for a period ending June 30, 1999. Funds have been allocated for these expenses with estimated totals of $150,000 in FY 1996-97, and $200,000 in FY 1997-98. This was reviewed by the Administrative Committee on April 18, 1997, and recommended for approval.

16. Establish List of Prequalified Vendors to Provide Compressed Gases and Cryogenics

On February 14, 1997, the Board approved the issuance of an RFQ to establish a list of prequalified vendors from whom the AQMD may obtain needed compressed gases and cryogenics for laboratory use. In response to the RFQ, eight bids were received and reviewed. This action is to prequalify seven vendors of compressed gases and three vendors of cryogenics for AQMD use. Funds, $130,000, for these services have been included in the draft FY 1997-98 budget. This was reviewed by the Administrative Committee on April 18, 1997, and recommended for approval.

17. Approve Compensation Package for Designated Deputies

The recruitment and selection process for the Deputy Executive Officer/Public Affairs & Local Government Assistance and Director of Planning & Policy has been completed. In addition, the current contracts of the Executive Officer, Deputy Executive Officer/Planning, Transportation & Information Management, Deputy Executive Officer/Stationary Source Compliance, Intergovernmental Affairs Officer, and Director of Small Business Assistance expire July 31, 1997. This action is for the Board to approve the compensation packages for the DEO/PA&LGA, Director of Planning & Policy, and several other Designated Deputies, and to renew the contract with the Executive Officer. This was reviewed by the Administrative Committee on April 18, 1997, and recommended for approval.

18. Approve MOU with the San Bernardino Public Employees Association Regarding the Professional Bargaining Unit

AQMD management and representatives of San Bernardino Public Employees Association (SBPEA) representing the Professional Bargaining Unit have reached agreement on a labor contract for the period May 9, 1997 through June 30, 1999, which has been ratified by the Professional Bargaining Unit members. This action is to present the ratified agreement to the Board for its approval as a new multi-year labor contract covering Bargaining Unit members represented by SBPEA. This was reviewed by the Administrative Committee on April 18, 1997, and recommended for approval.

19. Approve Salary and Benefit Adjustments for Noncontract Management, Confidential, and Attorney Employees

At its February 14, 1997 meeting, the Governing Board approved an MOU with two of AQMD`s three represented bargaining units. A proposal to approve an MOU with the San Bernardino Public Employees Association regarding the third, the Professional Bargaining Unit, is scheduled for consideration by the Governing Board at this May 9, 1997 meeting. Approval of said MOU would result in salaries and benefits for all union-represented employees being adjusted as provided for in the new union contracts. This action is to approve similar adjustments for noncontract management, confidential, and attorney employees.

Proposed amendments increase fees consistent with the 2.4% increase in the California Consumer Price Index for 1996. Other amendments establish AQMD`s authority to collect fees for facility registration permits; propose new fees for permit modifications under Title V, plan cancellations, certain types of toxics equipment, change of operator and reinstating expired applications and permits; establish a charge-through system for recovering fees for analytical laboratory services performed by outside contractors; simplify and streamline fee tables; reduce plan fees 50% for small businesses; and increase consistency within and among Regulation III rules. This was reviewed by the Stationary Source and Administrative Committees on April 18, 1997.

35. Adopt Executive Officer’s FY 1997-98 AQMD Budget and Work Program

The Executive Officer’s Budget for FY 1997-98 represents the input over the past several months from staff, Board members, and the public. This year’s process included meetings of the Budget Advisory Committee; a public hearing on February 14, 1997 to take input on the AQMD’s Program Goals and Objectives; and two budget workshops, one for the public on April 16, 1997 and one for the Board on April 25, 1997. This submittal transmits the required appropriations and reserves necessary to adopt the proposed budget. This was reviewed by the Administrative Committee on April 18, 1997, and recommended for approval.

36. Amend Rule 1610 - Old-Vehicle Scrapping

Additional language is proposed to Rule 1610 - Old-Vehicle Scrapping to further safeguard against potential toxic impacts and/or potential violations of criteria pollutant ambient air quality standards. The proposed amendments to subdivision (i) were continued from the April 11, 1997 Board meeting at which the Board approved administrative amendments to Rule 1610. This action is to secure Board reaffirmation of the quantification methodologies used in issuing mobile source emission reduction credits. This was reviewed by the Mobile Source Committee on April 25, 1997.

37. Adopt Proposed Rule 2501 - Air Quality Investment Program

Proposed Rule 2501 will provide an alternative compliance option to sources subject to source-specific AQMD rules and regulations by creating an AQIP reserve of real, quantifiable, permanent, enforceable, and surplus emission reductions. Source operators could voluntarily participate by submitting a specified fee to use the emission reductions from the reserve as an alternative to compliance with a specific emission limitation under Regulations IV, XI or Rule 2202. This fee would be used to fund stationary and mobile source projects that would produce surplus emission reductions for the reserve thereby ensuring that this program will produce emission reductions equivalent to or greater than those required by the source-specific rules. This was reviewed by the Mobile Source Committee on April 25, 1997.
