Proposed amendments will extend the expiration date for portable engine registration from August 1, 1997 to July 1, 1998, to allow time for transition from Rule 2100 to state registration. In addition, the proposed amendments will end registration for other emissions units included in the state registration program, effective July 1, 1998. Further, the proposed amendments will make Rule 2100 ineffective July 1, 1998. This is scheduled for review by the Stationary Source Committee on June 20, 1997.

2(A). Set Public Hearing July 11, 1997 to Amend Rule 1122 - Solvent Degreasers

Proposed Amended Rule 1122 will establish VOC limits of 50 g/l for cleaning materials used in cold cleaners; or alternatively, require the use of airless or air-tight cleaning systems. Work practice and design requirements are also proposed for cold cleaners, vapor degreasers and airless and air-tight cleaning systems. VOC emission reductions of 40.2 tons/day are expected by year 2010, mostly through greater use of aqueous cleaning technologies in batch-loaded cold cleaners, at a cost-effectiveness of $1400 per ton of VOCs reduced. This is scheduled for review by the Stationary Source Committee June 20, 1997.

3. Audit Report of AB 2766 Fee Revenue Recipients for FYs Ending June 30, 1994 and 1995, and Set Public Hearing July 11, 1997 Regarding Final Resolution of Unresolved Audit Findings and Recommendations

Health and Safety Code 44244.1 requires any agency that receives fee revenues subvened from the Department of Motor Vehicles to be audited once every two years. This audit of AQMD’s share, MSRC’s share, and local governments` share of such subvened funds, performed by independent Certified Public Accountants, has been completed and makes certain recommendations for improvement in some areas. This was reviewed by the Administrative Committee on May 23, 1997 and recommended for approval.

4. Execute Contract to Develop and Demonstrate Low-Emission Alternative Fuel Commercial Lawn and Garden Equipment

Commercial lawn and garden equipment contribute significantly to Basin VOC and CO emissions inventories. Based on results of a competitive solicitation, IMPCO Technologies, Inc. has been selected to develop and demonstrate low-emission alternative fuel commercial lawn and garden equipment. Total project cost is $996,080, with AQMD share not to exceed $246,080. This was reviewed by the Technology Committee on May 16, 1997, and recommended for approval.

5. Execute Contract to Cost-Share Development and Demonstration of Fast Charging System for Electric Vehicles

Automotive manufacturers have announced the introduction of EVs. Because of battery capacity and recharging time, these EVs will be limited to a daily range of 50 to 120 miles. Besides higher-capacity batteries, fast charging systems have been identified as an area which can improve the effective range of EVs. Based on the results of a competitive solicitation, two firms were selected to develop and demonstrate fast charging systems, AeroVironment and General Motors. The Board approved execution of a contract with AeroVironment at its May 9, 1997 meeting, and the General Motors contract is currently being presented. Total project cost is $2.93 million, with AQMD cost-sharing of $500,000. This was reviewed by the Technology Committee on May 16, 1997, and recommended for approval.

6. Execute Contract to Develop and Demonstrate the Most Efficient and Cost-Effective Control Technology for Underfired Charbroilers

There are approximately 10,000 restaurants in the Basin using underfired charbroilers. The AQMD`s proposed Rule 1138 would control PM10 and VOC emissions from these charbroilers by establishing emissions limits. Based on results of a competitive solicitation, CE-CERT has been selected to develop and demonstrate a cost-effective control technology to achieve the desired limits. Total project cost is $149,382. This was reviewed by the Technology Committee on May 16, 1997, and recommended for approval.

7. Execute Contract to Conduct Performance Audit of AQMD for FY Ending June 30, 1997

Health and Safety Code Section 40453 requires the AQMD to contract every three years with a qualified auditing firm to conduct a performance audit of AQMD activities. The Board approved the issuance of an RFP in March 1997, and this action is to award the contract to Thompson, Cobb, Bazilio & Associates at an amount not to exceed $136,900. Funds for this service are available in the FY 1997-98 Budget. This was reviewed by the Administrative Committee on May 23, 1997, and recommended for approval.

8. Execute Contract to Acquire Continuous Ambient NOx Analyzers

On January 10, 1997, the Board approved an RFQ to acquire continuous NOx analyzers for the AQMD’s Ambient Air Monitoring Network. The replacement analyzers are more reliable, less costly to maintain and operate, and consistent with the long-term air monitoring network streamlining process. This action is to execute a contract with Horiba Instruments, Inc. in an amount not to exceed $156,000 for the purchase of 17 Continuous Ambient NOx analyzers. Sufficient funds are allocated in the FY 1996-97 budget. This was reviewed by the Administrative Committee on May 23, 1997, and recommended for approval.

9. Execute Contract to Develop RECLAIM CEMS Performance Audit Program

On February 14, 1997, the Board approved an RFP for the development of a RECLAIM CEMS Performance Audit Program. An evaluation panel has reviewed all the proposals received in accordance with established criteria and AQMD policy on consultant selection. This action is to execute a contract with Carnot Technical Services, Inc. for an amount not to exceed $95,300. Sufficient funds for these services are included in the FY 1996-97 budget. This was reviewed by the Administrative Committee on May 23, 1997, and recommended for approval.

10. Execute Contracts to Provide Source Emissions Testing Services

11. Execute Contract to Participate in Statewide Public-Private "Californians for Clean Air Progress" Communications Campaign

CARB has initiated a statewide communications campaign under a public-private consortium called "Californians for Clean Air Progress" administered by the non-profit American Production Fund. AQMD has been asked to contribute up to $100,000 toward the $3.7 million campaign, with each $1 AQMD contribution matched by $30 from other sources. In return, AQMD will be identified as a sponsor in campaign ads and materials. This was reviewed by the Administrative Committee on May 23, 1997, and recommended for approval.

12. Execute Contract to Provide Technical Advisor Services to the MSRC in Support of the AB 2766 Discretionary Fund Program

On March 14, 1997, the MSRC released an RFP for technical advisor services in support of the AB 2766 Discretionary Fund Program. Two proposals were received by the April 26, 1997 deadline. A subcommittee, consisting of four MSRC-TAC members, one AQMD staff member, and one independent reviewer, evaluated and scored both proposals. Based on the RFP criteria, including technical experience and cost-effectiveness, the MSRC unanimously recommended awarding the contract to Raymond J. Gorski. This action is to request Board approval to execute a contract with Raymond J. Gorski for an amount not to exceed $115,200. This was reviewed by the MSRC on May 22, 1997, and recommended for approval.

13. Amend Contract to Support Socioeconomic Analyses of AQMD Trading Programs

Barents Group LLC has been assisting the AQMD in refining the trading model for RECLAIM and assessing the potential for emissions spiking associated with banked credits for the Intercredit Trading Program. Additional analyses in these areas will continue to be required and used to support rulemaking activities. The proposed funding for the analyses is $30,000, bringing the total contractual amount to $80,000. Sufficient funds are in the FY 1996-97 budget. This item was reviewed by the Administrative Committee on May 23, 1997, and recommended for approval.

14. Recognize and Appropriate Funds and Execute Contracts for Tracer Dispersion Study of Shipping Emissions During the 1997 Southern California Ozone Study

Funds have been allocated by the U.S. EPA, U.S. Navy, CARB, Ports of Los Angeles and Long Beach, the Pacific Merchant Shipping Association and the AQMD to conduct a tracer study of shipping emissions during the summer of 1997. The proposed study will be conducted in conjunction with the 1997 Southern California Ozone Study beginning June 15, 1997 so that the enhanced aerometric data can be used to analyze the tracer data. To expedite the awarding of contracts, the sponsoring organizations requested the AQMD to recognize and appropriate their funds to the FY 1996-97 Budget and execute contracts for the tracer dispersion study at a total cost not to exceed $370,000. This was reviewed by the Administrative Committee on May 23, 1997, and recommended for approval.

16. Approve Consultant-Recommended Salary Revisions for Three Noncontract Management Classifications

Outside contract consultants who recently completed a salary comparison study of three noncontract management classifications, Atmospheric Measurements Manager, Source Testing and Monitoring Manager, and Technology Implementation Manager, have recommended the salary levels for these classifications be moved one band higher, from Salary Band F to Salary Band E, for reasons of pay equity. This action would provide an approximately ten percent salary increase for the three classifications and for the four employees currently holding positions in these classifications. This was reviewed by the Administrative Committee on May 23, 1997, and recommended for approval.

17. Approve the Updated Boilerplate Language for Executive Management Agreements and Resolve an Ambiguity in Agreement Language to Clarify Intent of the Parties

In 1987 the Board established the Designated Deputy program whereby senior management employees serve under an Executive Management Agreement. These Agreements contain language to ensure that Designated Deputies receive the same benefit and cost-of-living adjustments as are provided to non-contract management employees. The boilerplate for the Executive Management Agreement was modified in January to bring it current and Agreements executed since January have used the updated boilerplate language. However, an ambiguity has been identified in the case of five Deputies with contracts containing the old boilerplate language: Oscar Abarca, Joe Contaoi, Carol Coy, Chung Liu, and Patrick Pearce. Their Agreements need to be clarified to ensure that they will receive the same across-the-board increase in compensation as all other Designated Deputies. This was reviewed by the Administrative Committee May 23, 1997, and recommended for approval.

18. Issue RFQs to Prequalify Vendors to Purchase Publishing Services for Legal Notices and Advertisements, and Miscellaneous Office and Consumable Computer Supplies

This action is to issue RFQs, the responses to which will be used to establish lists of pre-qualified vendors. From these lists, competitive bids will be solicited to publish legal notices and advertisements and to purchase miscellaneous office supplies and consumable computer supplies. 23. Status of Regulatory Reform Initiative - "Green Carpet" Priority Permitting Service

On April 12, 1996, the Governing Board approved a twelve-month pilot project to study and report to the Board the benefits and challenges presented by a priority permitting service offered for selected construction projects. To date, the AQMD has received about 20 inquiries regarding the program. Staff has issued Permits to Construct to three companies and are processing applications from two others. It is difficult to render an adequate pilot project recommendation with this low level of program participation. Therefore, staff recommends the program be continued for another twelve months to allow more time for data collection and evaluation. This was reviewed by the Stationary Source Committee on May 23, 1997, and recommended for approval.

33. Adopt Resolution Regarding Advisory Council and Advisory Groups to Provide that Members are Eligible for Compensation; and Increase Membership of Two Advisory Groups

On January 10, 1997 the Board adopted a Resolution creating final charters for six Advisory Groups and the Advisory Council. Those charters provided that compensation continue through June 30, 1997 for those individuals serving on groups which presently receive same, and that all advisory group members shall serve without compensation effective July 1, 1997. At the request of some Board members, the Administrative Committee reconsidered this issue on May 23, 1997 and recommends that all such members be eligible to receive compensation of $100 per diem for attendance at the meetings of the Advisory Group and Advisory Council to which the member belongs, plus mileage and parking expenses, in accordance with District policy.

Pursuant to California Health and Safety Code Section 40440.2, the Board shall establish an advisory committee on or before July 1, 1997. The committee shall be established for the purpose of reviewing the RECLAIM progress report for the first three years of program implementation, to be submitted to the Board by July 1, 1998. The advisory committee will serve a maximum of one year or until the progress report is made to the Board. The Health and Safety Code further specifies that this advisory committee be composed of representatives from specified industries and types of institutions. A proposed list of advisory committee members has been prepared for Board approval. This was reviewed by the Stationary Source Committee on May 23, 1997, and recommended for approval.

35. Permit Enhancement Pilot Program

In October 1996, staff implemented the Permit Enhancement Pilot Program (PEPP) . Staff committed to report back to the Board on the effectiveness of the PEPP. Review of the six-month pilot program ended March 31, 1997. Major PEPP elements are discussed with a recommendation for further improvements. This was reviewed by the Stationary Source Committee on May 23, 1997, and recommended for approval.

36. Appointments to the AQMD Hearing Board

The terms of office for Attorney Member Kim Abel and alternate Herbert M. Schoenberg; and Engineer Member Ed Camarena and alternate Farooq A. Khan expire June 30, 1997. Pursuant to California Health and Safety Code Section 50501.1(b), an Advisory Committee, consisting of one representative appointed by each of the Counties of Los Angeles, Orange, Riverside, and San Bernardino, and the City of Los Angeles, reviewed the resumes submitted by all of the applicants, selected a short-list of applicants to interview, and made its recommendations to the Board’s Administrative Committee. The recommendation for appointments for the Attorney Member and the Engineer Member, and their alternates, to three-year terms expiring June 30, 2001, was reviewed by the Administrative Committee on May 23, 1997, and recommended for Board approval.

37. Approve Compensation Package for Designated Deputies

The recruitment and selection process for Director of Planning & Policy has been completed. In addition, the current contracts of the Executive Officer, Deputy Executive Officer/Planning, Transportation & Information Management, Deputy Executive Officer/Stationary Source Compliance, Intergovernmental Affairs Officer, and Director of Small Business Assistance expire July 31, 1997. This action is for the Board to approve the compensation packages for the Director of Planning & Policy, and several other Designated Deputies, and to renew the contract with the Executive Officer. This was reviewed by the Administrative Committee on April 18, 1997 and recommended for approval, and on May 23, 1997 and recommended for public hearing.

38. Amend Rule 1421 - Control of Perchloroethylene Emissions from Dry Cleaning Systems

Proposed amendments have been developed to replace current Rule 1421 provisions with the state Airborne Toxic Control Measure (ATCM) Title 17 CCR, Section 93109, except the existing Rule 1421 secondary control requirements will be retained. The amendments propose to eliminate requirements not contained within the state ATCM and that have an insignificant impact on airborne emissions from perchloroethylene dry cleaning equipment. Additionally, reporting and recordkeeping requirements are streamlined. This was reviewed by the Stationary Source Committee on April 18, 1997.

Proposed amendments add tetrachloroethylene (perchloroethylene), 3,3-dichloro-1,1,1,2,2,-pentafluoropropane (HCFC 225ca), 1,3,-dichloro-1,1,2,2,3-pentafluoropropane (HCFC 225cb), and 1,1,1,2,3,4,4,5,5,5-decafluoropentane (HFC-43-10mee) to the "Exempt Compound" definition in Rule 102. Perchloroethylene is proposed to be added as a Group II Compound. The other three compounds are proposed to be added to the list of Group I Compounds. The proposed amendments will also allow the use of cyclic branched, or linear, completely methylated siloxanes (VMS) and parachlorobenzotrifluoride (PCBTF), currently listed as Group II Exempt Compounds, and perchloroethylene in operations regulated pursuant to Rules 1106.1, 1151, and 1171. Other definitions were also removed from Rules 1171 and 1302 and referred to Rule 102. This was reviewed by the Stationary Source Committee on May 23, 1997.

40. Amend Rule 701 - Air Pollution Emergency Contingency Actions

The proposed amendments to Rule 701 will address changes made in state law which have rendered portions of the rule unenforceable; eliminate references to work trip reduction plans and rescinded Rules 1501 and 1501.1; and modify the source-receptor area map used for forecasting and reporting air quality. The proposed amendments are mostly administrative and will have no significant emissions impact. This was reviewed by the Mobile Source Committee on April 25, 1997.

At its regular meeting on May 23, 1997, the Administrative Committee of the Governing Board elected to schedule a public hearing June 13, 1997 on Agenda No. 37 regarding Designated Deputies. The Administrative Committee also directed that a closed session of the Board be agendized pursuant to Government Code Section 54957 for the sole purpose of evaluating the past performance of public employees, in the event the Board elects to hold a closed session. The public employees are: Executive Officer, Deputy Executive Officer/Planning, Transportation & Information Management, Deputy Executive Officer/Stationary Source Compliance, Intergovernmental Affairs Officer, and Director of Small Business Assistance.
