Proposed amendments modify: exemption provisions, emission factors, and certain monitoring and reporting requirements. Of particular note are the revised requirements for non-operating and infrequently-operated major sources. This was reviewed by the Stationary Source Committee on December 5, 1996.

4. Execute Contracts for AQIP for the Third Quarter of 1996

Rule 2202 - On-Road Motor Vehicle Mitigation Options was adopted on December 8, 1995. As one compliance strategy, Rule 2202 allows employers to invest in the AQIP. Monies received are placed in a restricted account to fund programs that result in equivalent emission reductions that would otherwise have been achieved by the participating employers. Staff evaluated the proposals received during the third quarter of 1996 and this action is to recommend several for funding. The adjusted amount available for this quarter is $986,068. This was reviewed by the Administrative Committee on December 20, 1996, and recommended for approval.

5. Transfer $1.5 Million from the Air Quality Assistance Fund to the General Purpose Agency Fund to be held for the Regional Transportation Agencies Coalition Pursuant to Health & Safety Code Sections 40458 and 44243.5

The AQMD is required by Section 44243.5(a) of the Health and Safety Code to provide $1.5 million, on or before January 15, 1997, to the Regional Transportation Agencies (RTAC) or its successor agency for the purpose of enabling regional or county rideshare agencies to provide marketing and client services to maximize voluntary ridesharing in the air basin. Since RTAC does not have the authority to receive and safeguard funds, AQMD will transfer the money to an agency fund pending direction from RTAC for disbursement.

On September 13, 1996, the Board approved the release of an RFP to select contractors to assist with permit processing when needed to respond to temporary work load increases. A panel has reviewed the proposals submitted in response to the RFP and recommends awarding bids to two firms. In its September action, the Board also reallocated $200,000 in the FY 1996-97 budget for this purpose. This was reviewed by the Administrative Committee on November 22, 1996 and recommended for approval.

7. Issue RFQ to Acquire Continuous NOx Analyzers for the Ambient Air Monitoring Network

The streamlining and modernization of AQMD’s air monitoring network is necessary to accomplish mandated requirements in the face of declining revenue and resources. This RFQ is for the replacement of 17 NOx analyzers with modern, state-of-the-art equipment. The newer technology would be more reliable, easier to maintain and less costly to operate with proposed staffing levels. A total of $156,000 is available in the FY 1996-97 budget. This was reviewed by the Administrative Committee on December 20, 1996, and recommended for approval.

8. Issue RFQ to Acquire Meteorological Sensor Systems for the Photochemical Assessment Monitoring Stations Program

The newer technology is more reliable, easier to maintain, and less costly to operate with proposed staffing levels. The FY 1996-97 budget includes $72,000 allocated to Applied Science and Technology, and $18,000 to Planning and Policy, for the purchase of the Meteorological Sensor Systems. This was reviewed by the Administrative Committee on December 20, 1996, and recommended for approval.

9. Issue RFQ to Acquire Automated Gas Chromatograph System for the Photochemical Assessment Monitoring Stations Program

The Photochemical Assessment Monitoring Stations (PAMS) program is in its fourth year of implementation and an Automated Gas Chromatograph System is needed for the Burbank PAMS Type 2 Site, slated to be on-line for the 1997 smog season. This equipment is the most cost effective way to develop the required air monitoring data. There is $70,000 allocated for the purchase of an Automated Gas Chromatograph in the FY 1996-97 budget. This was reviewed by Administrative Committee on December 20, 1996, and recommended for approval.

10. Issue RFP to Hire Outside Worker’s Compensation Counsel

From time to time the AQMD requires the assistance of outside litigation counsel having expertise and experience in worker’s compensation law and procedures. The purpose of this RFP is to solicit qualified law firms or sole practitioners to establish a prequalified list that District Counsel may use to represent the AQMD in possible future litigation where outside counsel is required. The maximum dollar amount that may be contracted out is up to $70,000 per year for three years. This was reviewed by the Administrative Committee on December 20, 1996 and recommended for approval.

11. Appointees to Designated Deputy Positions

12. Adopt Resolution Regarding Advisory Council to Create Final Charters for Advisory Groups, Modify Method of Appointment of Advisory Group Members, and Add Performance and Attendance Criteria for Advisory Council and Advisory Group Members

At its December 13, 1996 meeting, the Governing Board adopted Resolution 96-24 Regarding Advisory Council which established six Advisory Groups and adopted interim charters for them; reorganized the Advisory Council; and specified membership, duties, compensation and other administrative matters relating to the Advisory Groups and the Advisory Council. The Board also referred the item back to the Administrative Committee to review Board Member suggestions. This action is to adopt the Administrative Committee’s further recommendations. This was review by the Administrative Committee on December 20, 1996 and recommended for approval.

State law requires the AQMD to prepare and submit annually to the state board a three-year budget forecast based upon existing programs and rules and new programs or rules to be adopted. This is the seventh annual Three-Year Budget Forecast.

28. AQMD Comments Regarding U.S. EPA’s Proposed New Ambient Air Quality Standards for Fine Particulates and Ozone

On November 27, 1996, U.S. EPA proposed revised ambient air quality standards for fine particulates and ozone. The proposed standards have been published in the Federal Register for a 60-day public comment period. Staff has reviewed the proposed standards and companion documents on an interim transition policy, and monitoring requirements for PM2.5. AQMD comments are provided for Board consideration and upon approval will be forwarded to U.S. EPA for inclusion in the record.

29. Technical Guidance Document for Regulation XXX - Title V Permits

AQMD’s federally mandated Title V Operating Permit Program is expected to receive interim approval from EPA in January 1997. Facilities subject to Title V are required to begin applying for a permit within the first year of program implementation. To assist these facilities during this process, AQMD staff has prepared application forms and a Technical Guidance Document (TGD) that will provide simple instruction and clarification on compliance with Title V. The TGD will be updated as needed to respond to program changes and the needs of regulated facilities. This was reviewed by the Stationary Source Committee on December 5, 1996.

30. Amend Rule 1145 - Plastic, Rubber and Glass Coatings

Proposed amendments will: 1) lower VOC requirements for electric dissipating and shock-free coatings; 2) replace solvent cleaning operations language with a reference to Rule 1171 provisions; 3) add a transfer efficiency requirement of 65% to be consistent with other AQMD coating rules; 4) replace outdated compliance test methods with current AQMD test methods; and, 5) add an exemption for air brush operations from transfer efficiency requirements. Proposed amendments will result in an emission reduction of approximately 1.4 tons of VOC per day. This was reviewed by the Stationary Source Committee on December 5, 1996.

31. Amend Rule 403 - Fugitive Dust and Adopt Proposed Rule 1186 - PM10 Emissions from Paved and Unpaved Roads and Livestock Operations

The 1994 PM10 SIP identified candidate best available control measures (BACM) for fugitive dust sources and established technical and cost feasibility criteria for their adoption by February 8, 1997, as required by the federal Clean Air Act. AQMD staff has completed the BACM feasibility analysis and has incorporated the BACM that meet the feasibility criteria into proposed amendments to AQMD Rule 403 and Proposed Rule 1186.
