The proposed rule will take a stepped approach to potential flare emissions reduction by gathering data on flaring operations at petroleum refineries to assess the need for, or the level of, any future controls to reduce flare emissions. The first step will require refineries to monitor flaring activities for the amount and composition of gases being flared. If the data demonstrates a need to control flaring operations, step two of the rule will be to develop specific control requirements to reduce flare emissions. This item was reviewed by the Stationary Source Committee on November 21, 1997.

On August 8, 1997, the Board issued an RFP to purchase a new Laboratory Information Management System to replace the current system which is nearing the end of its life cycle. This action is to execute a contract with Accelerated Technology Laboratories, Inc. to provide this system. Sufficient funds for this equipment ($75,000) are available in the FY 1997-98 Budget. This item was reviewed by the Administrative Committee on November 21, 1997, and recommended for approval.

5. Execute Contract for Janitorial Services at Diamond Bar AQMD Headquarters

On August 8, 1997, the Board approved the release of an RFQ for Janitorial Services at the Diamond Bar AQMD Headquarters. This action is to execute a three-year contract with Diamond Contract Services, Inc., for an amount not to exceed $705,869. Funding has been included in the FY 1997-98 Budget and will be requested in successive fiscal years for this contract. This item was reviewed by the Administrative Committee on November 21, 1997, and recommended for approval.

6. Execute Contract to Co-Sponsor Development of the Best Design Practices and Assessment of Cost-Reduction Potential for Conductive Charging Support Systems for Electric Vehicles with Advanced Batteries

Acurex Environmental Corporation proposes to develop a commercial conductive charging system suitable for electric vehicles with advanced batteries and conductive charging systems. Total project cost is $578,483. AQMD’s contribution shall not exceed $264,233. The remaining balance will be co-funded with $25,000 from the ARB, $100,000 from the California Energy Commission, $70,000 from Honda, and $119,250 from customers of the prototype units. AQMD shall act as a pass-through for the ARB funds. This item was reviewed by the Technology Committee on November 7, 1997, and recommended for approval.

7. Execute Contract to Cost-Share Demonstration and Evaluation of Fast-Charging, State-of-the-Art Advanced Lead-Acid Batteries

Southern California Edison, jointly with ARB and the Advanced Lead Acid Battery Consortium (ALABC), has proposed to demonstrate and evaluate the performance and durability of advanced lead acid batteries under fast-charging conditions. Edison, through ALABC, will purchase advanced batteries from different lead-acid manufacturers, and use 100 kW fast-chargers to extensively test these battery packs at Edison’s EV Tech Center in Pomona, California. The most promising batteries will then be installed on several EVs, fast-charged and further tested at ARB, El Monte, California. The total cost of this 24-month project is $655,000 which will be cost-shared by Edison ($220,800), ALABC (226,800), and ARB (105,400). The proposed AQMD cost-share is $102,000. This item was reviewed by the Technology Committee on November 7, 1997, and recommended for approval.

8. Execute Contracts for Local Government Subvention Fund Match Program as Part of FY 1997-99 AB 2766 Discretionary Fund Work Program

Within the FY 1997-99 AB 2766 Discretionary Fund Work Program, the MSRC created a $6.5 million Local Government Subvention Fund Match Program which, through a simplified application process, provides a 25% match to cities and counties within the AQMD’s jurisdiction that receive AB 2766 City Subvention Funds. Eligible match categories include alternative fuels/electric vehicles, transportation related land-use strategies, public transportation (transit & rail), traffic management, transportation demand management (non-Rule 2202), market-based strategies, bicycles, and public education related to clean vehicles or transportation. Funds will be allocated on a first-come, first-serve basis. The application process is May 15 through March 3, 1998. At this time the MSRC is requesting approval of another round of applications recently submitted by local governments.

9. Terminate Contract with RES Environmental Inc. for Field Study to Determine Effectiveness of Increased Watering to Control Dust during High-Wind Conditions

During the February 14, 1997 adoption hearing for amendments to Rule 403, the Construction Industry Air Quality Coalition (CIAQC) raised a concern that during high-wind conditions at construction sites, additional watering by water trucks might result in a net increase in entrained dust emissions. The Board resolution directed staff to cosponsor a study to determine the effectiveness of increased watering to control dust emissions. In June 1997, the AQMD contracted with RES Environmental Inc. for $39,460. However, CIAQC recently requested that AQMD terminate the contract for technical reasons unrelated to performance. Staff concurs and acknowledges payment owed for labor expended. Because this study was initiated at the Board’s direction as part of its Rule 403 amendment resolution, staff is seeking Board approval to terminate the contract.

10. Appropriate Funds to Cost-Share Evaluation of In-Use Vehicles Retrofitted with Advanced Aftermarket Catalytic Converters

At its April 11, 1997 meeting, the Board authorized an agreement with New Emission Reduction Associates (New ERA), to be co-funded by the AQMD and ARB, to evaluate the effectiveness of replacing factory-equipped catalytic converters with advanced aftermarket units. Execution of a contract with ARB for their funding portion was not completed during FY1996-97, making it impossible to complete appropriation of funds for the contract with New ERA. In order to execute a contract with New ERA, as already authorized by the Board, funding for this project must be reappropriated using FY 1997-98 funding. This item was reviewed by the Technology Committee on November 7, 1997, the Administrative Committee on November 21, 1997, and recommended for approval.

11. Appropriate Funds from Equipment Replacement Designation in General Fund, Approve Release of Purchase Orders for Equipment, Approve RFP for Toxics Emissions Inventory Development, and Approve Workplans in Support of Environmental Justice Initiative No. 2

On October 10, 1997, the Board approved a set of the Environmental Justice Initiatives proposed by Chairman William Burke. Initiative No. 2 - Ambient Monitoring of Air Toxics is directed at characterizing toxic hot spots and associated risks across the Basin. A workplan will provide the procedural guidance for conducting Multiple Air Toxics Exposure Study II and a Microscale Study, guided by the Air Toxics Study Technical Review Group . This action is to appropriate $400,000 from the Equipment Replacement Designation in the General Fund to the FY 1997-98 Budget, approve release of purchase orders for equipment, approve release of an RFP to develop a point source air toxics emissions inventory, and approve workplans. This item was reviewed by the Administrative and Stationary Source Committees on November 21, 1997, and recommended for approval.

12. Authorize Purchase of Network File Servers

On August 8, 1997, the Board approved an RFQ to obtain network file server replacements and upgrades for the purpose of improving network access and reducing downtime. This action is to authorize purchase of the equipment. Funds for these fixed assets ($150,000) are included in the FY 1997-98 Budget. This item was reviewed by the Administrative Committee on October 24, 1997, and recommended for approval.

13. Issue RFQ to Lease Radio/Cellular or Cellular Telephones for AQMD Field Staff

Consistent with the use of modern advances in technology for enhanced field inspection purposes, this RFQ will enable AQMD to replace its outdated radio communications system with state-of-the art radio/cellular or cellular telephones. A total cost of $112,640 is available in the FY 1997-98 Budget for leasing and operating a maximum of 85 radio/cellular or cellular telephones to support field communications. This item was reviewed by the Administrative Committee on November 21, 1997, and recommended for approval.

14. Approve Issuance of Seven RFPs for Heavy-Duty School and Transit Buses and Other On-Road and Off-Road Heavy-Duty Vehicles, Three TCM Categories, and High Occupancy Toll Lane Demonstrations for the FY 1997-99 AB 2766 Discretionary Fund Work Program

The Board’s April 11, 1997, approval in concept of the two-year, $26 million FY 1997-99 AB 2766 Discretionary Fund Work Program included funding solicitations in FYs 1997-78 and 1998-99. Funding solicitations and awards for FY 1997-78 have already been undertaken and contracts are being executed. The MSRC is recommending the issuance of seven more RFPs as part of its FY 1997-99 Work Program for funding in FY 1998-99. These seven RFPs are as follows: CNG School Bus Buydown Program ($2.8M); Alternative Fuel Transit Bus Program ($3.65M); On-Road and Off-Road Heavy-Duty Vehicle Diesel Pollution Reduction Program ($3.0M); Three TCM Categories for Bicycles Projects, Videoconferencing, and Land-Use Strategies (share $1.5M); and High Occupancy Toll Lane Demonstration Projects ($0.5M). The MSRC requests Board approval to issue these RFPs.

15. Six-Month Pilot Program to Use Teleconferencing or Videoconferencing for Board Committee Meetings

Amendments to the Brown Act effective January 1, 1998 permit legislative bodies to meet by teleconference or videoconference, subject to certain limitations. The Administrative Committee requested that the Board committees selectively test this process over a six-month period. A report will be provided at the end of the pilot program period.

16. Remove Various Fixed Assets from Inventory

AQMD Policy and Procedure No. 20 requires a biennial Districtwide fixed asset inventory, an annual Applied Science and Technology inventory, and the disposal of fixed assets declared surplus. In 1995 a Districtwide fixed asset inventory was conducted for the whole AQMD and in 1996 for AST alone. This action is to approve the removal of unlocated fixed assets and to declare as surplus the equipment determined to be obsolete or broken and not worth repairing. This item was reviewed by the Administrative Committee on November 21, 1997, and recommended for approval.

17. Resolution Delegating Appointment of Acting Treasurer; Approval of Treasury Operations Contingency Plan and Procedures; and Status Report on Implementation of AQMD Investment Program

The Treasury Operations Contingency Plan represents the final element in the implementation of AQMD’s Investment Program. This plan provides for the necessary authorizations and steps required to appoint an Acting Treasurer and shift investment and cash management responsibilities from the Los Angeles County Treasurer to the AQMD should an emergency arise. In addition, a report identifying the current status of the major investment program milestones and costs/benefits is provided. This item was reviewed by the Investment Oversight Committee on November 7, 1997, and recommended for approval.

18. Best Available Control Technology Guidelines Update

The BACT Guidelines are updated for the following two equipment categories: (1) Charbroiler, Chain-driven; and (2) Degreaser, Batch-loaded or Conveyorized Cold Cleaners. This proposal complies with state BACT, federal Lowest Achievable Emission Rate, and AQMD Regulation XIII - New Source Review requirements.

20. Pre-Approve Stationary and Mobile Source Emission Reduction Proposals for Rule 2501 - Air Quality Investment Program

On August 8, 1997 the Board approved issuance of an RFP to solicit proposals to reduce emissions from stationary and mobile sources for the AQIP. AQMD staff has received three proposals and verified that the proposals meet the eligibility criteria for providing Rule 2501 emission reductions. This action is to pre-approve proposals that meet the eligibility criteria. Certified pre-approved proposals will await selection for implementation as the emission reductions are needed and based on monies collected. Certified pre-approved proposals will establish the participation fee that Regulations IV and XI businesses seeking an alternative to a compliance limitation must pay to purchase AQIP emission reductions. This item was reviewed by the Administrative Committee on November 21, 1997, and recommended for approval.

21. Pre-Funding the Rule 2501 AQIP Emission Reduction Reserve

On May 19, 1997, the Board adopted Rule 2501- AQIP. Rule 2501 allows Regulations IV, XI and Rule 2202 sources to purchase emission reductions from the AQIP Emission Reduction Reserve as an alternative compliance option to specific emission limitation requirements. The adopting resolution directed staff to report back to the Board by January 1, 1998 regarding the type, origin, and amount of emission reductions that will pre-fund the AQIP Reserve. The pre-funding of emission reductions for the Reserve will be excess mobile source emission reductions achieved under Rule 2202 including VOC, NOx, and CO emission reductions. These emissions will be returned to Rule 2202 once reductions are achieved through Rule 2501 investment fees. This item was reviewed by the Administrative Committee on November 21, 1997, and recommended for approval.

22. Approve Workplans to Develop Testing and Analysis Technology Refinements and to Improve In-Field Enforcement Capabilities in Support of Environmental Justice Initiative No. 8

Initiative No. 8 - Field Inspection Technology is directed at implementing modern technology advances to enhance field inspection efforts. Workplans to refine testing and analysis technologies and improve in-field enforcement capabilities will define the milestone schedules to accomplish activities to identify, evaluate, recommend, and implement these technologies. This item was reviewed by the Stationary Source Committee on November 21, 1997, the Technology Committee on December 11, 1997, and recommended for approval.

23. Report Regarding Informational Hearing on LAXT Project Held November 15, 1997

An overview of public comments presented at this informational hearing is provided. In addition, the Board directed staff to (1) ensure a health risk assessment is prepared for open petroleum coke storage at the Los Angeles Export Terminal (LAXT) project and that a socioeconomic analysis of the costs to enclose the LAXT petroleum coke storage piles is prepared and evaluated as part of its Rule 1158 Interim Petroleum Coke Storage Plan; (2) bring to the Board recommendations regarding approval of the Rule 1158 plan; and (3) develop a policy for Board review of multi-year, multi-phase projects.

24. Status Report on Rule 1168 - Control of VOC Emissions from Adhesive Applications

On April 11, 1997, the Board amended Rule 1168 to defer certain future VOC limits and directed staff to conduct a study regarding the feasibility of complying with several lower VOC limits that become effective January 1, 1998 due to sunset dates in the related exemption. This report indicates that in several cases it is necessary to postpone the January 1998 compliance deadline to 2000 or beyond. In addition, the U.S. EPA has requested several changes as part of the SIP. Staff is developing amendments to Rule 1168 to address these issues.

25. Report on AQMD/California Trucking Association Implementation Study Regarding Rule 1171 - Solvent Cleaning Operations

On September 13, 1996, the Board amended Rule 1171 and also directed staff to conduct an implementation study with the California Trucking Association (CTA) to address their concerns regarding aqueous cleaning systems for the repair and maintenance of heavy-duty trucks. The study has now been concluded and the report indicates that water-based cleaning systems are effective in the repair and maintenance of heavy-duty trucks. Therefore, no change is recommended to the rule provision requiring repair and maintenance operations to use cleaning solents containing no more than 50 grams of VOC per liter of material, effective January 1, 1999. Staff will continue to work with CTA member companies by providing information and assistance in selecting the appropriate water-based technology.

On November 15, 1997, at the informational hearing on the Los Angeles Export Terminal, the Board directed staff to develop a policy for Board review for multi-year, multi-phase projects. These projects are large significant projects that are designed, permitted and constructed in phases over an extended period of time. A review of the universe of affected permits and policy review options was reviewed by the Stationary Source Committee on November 21, 1997, and recommended for approval.

41. Review of Proposed Action by the Acting Executive Officer Regarding Rule 1158 Plan for the Los Angeles Export Facility (LAXT)

On November 25, 1997, LAXT submitted its application for a Rule 1158 Interim Petroleum Coke Handling and Storage Plan. A Health Risk Assessment (HRA) and Socioeconomic Evaluation was also submitted. This information and District Staff’s analysis will be presented to the Board. The Board may also provide policy direction to staff regarding evaluation of Rule 1158 plans, consistent with the requirements of existing Rule 1158.

The Administrative Committee met on November 21, 1997 and discussed the report and recommendation of the Board’s Executive Officer Search Firm Proposal Evaluation Panel. The Administrative Committee recommends that the full Board, rather than an executive search firm, review the candidates and make the selection for Executive Officer. In addition, the Committee has forwarded, without recommendation, the issue of Board reconsideration of the requirement that the Acting Executive Officer is excluded from competing for Executive Officer.

On November 14, 1997, the Board adopted amendments to Regulation XXX and directed staff to meet with industry and U.S. EPA to discuss portable equipment operation at Title V facilities and return to the Board on December 12, 1997 with additional amendments to Rule 3004. The proposed amendments to Rule 3004 address industry’s concerns to the extent allowed by U.S. EPA. This item was reviewed by Stationary Source Committee on November 21, 1997.

43. Adopt Proposed Rule 2503 - Enforceable Procedures

Proposed Rule 2503 will expand on the enforceable procedures guidelines developed in Rule 2501 - Air Quality Investment Program; and establish monitoring, recordkeeping, and reporting requirements for AQIP emission reductions as an alternative to compliance with the emission limitation requirements of Regulation IV - Prohibitions and Regulation XI - Source Specific Standards. The proposed rule will also specify the quantification methodologies necessary to determine the amount of AQIP emission reductions required. This item was reviewed by the Mobile Source Committee on September 26, 1997.

44. Adopt Proposed Rule 1146.2 - Emissions of Oxides of Nitrogen from Large Water Heaters and Small Boilers

Proposed Rule 1146.2 will establish emission limits for NOx for new water heaters and small boilers rated between 75,000 and 2,000,000 Btu/hr heat input. Beginning January 1, 2000, new units sold or installed in the AQMD would be certified by the manufacturer to comply with NOx standards. In addition, beginning January 1, 2001, existing units rated at 400,000 Btu/hr or greater would be phased into compliance with NOx emission standards. It is estimated that the proposed rule will reduce about 9 tons per day of NOx. This item was reviewed by the Stationary Source Committee on November 21, 1997.

45. Amend Regulation IX - New Source Performance Standards

Federal Clean Air Act Section 111(c)(1) authorizes EPA to delegate authority to local air districts to administer and enforce federal NSPS . These federal standards were initially adopted by reference as AQMD Regulation IX on December 3, 1976. Periodic amendments to Regulation IX incorporate new or amended NSPS by reference as necessary. Currently proposed for incorporation by reference into Regulation IX are NSPS governing municipal waste combustors, sewage treatment plants, municipal solid waste landfills, hospital/medical/infectious waste incinerators and nonmetallic mineral processing plants. This item was reviewed by the Stationary Source Committee on November 21, 1997.

Members of the public are afforded an opportunity to speak on any listed item before or during consideration of that item. Please notify the Clerk of the Board, (909) 396-2500, if you wish to do so. All agendas are posted at AQMD Headquarters, 21865 E. Copley Drive, Diamond Bar, California, at least 72 hours in advance of the meeting. All information concerning agenda items may be reviewed in the Library at AQMD Headquarters one week before Board meetings. At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Note that on items listed on the Consent Calendar and the balance of the agenda any motion, including action, can be taken (consideration is not limited to listed recommended actions). Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote. Matters raised under Public Comments may not be acted upon at that meeting other than as provided above.

Written comments will be accepted by the Board and made part of the record, provided 25 copies are presented to the Clerk of the Board.
