3. Set a Public Hearing April 12, 1996 to Amend Rule 201 - Permit to Construct

This proposed amendment to Rule 201, along with recently amended Regulation XIII, is necessary to make the AQMD's preconstruction review program complete and SIP approvable.

4. Issue a Request for Proposals as an Element of the Fiscal Year 1995-97 AB 2766 Discretionary Work Program for the Final Component of the Zero-Emission Vehicle "Quick Charge" Program

As part of the FY 1995-97 AB 2766 Discretionary Work Program, the MSRC proposed a three-component, $7 million Zero-Emission Vehicle "Quick Charge" Program, including an Outreach Coordinator, a buydown incentive, and an Electric Vehicle Corridor Communities Program. The first two components were previously approved by the Board. The EV Corridor Communities Program component will assist communities in preparing for EVs by testing the consumer market and demonstrating the infrastructure, permitting process, and coordination necessary for the smooth introduction of larger quantities of EVs. This RFP provides $600,000 for this effort, including a $75,000 minimum award to each of the four counties.

5. Award Sole-Source Contract to Southern California Association of Governments for a Regional Transit Database Information Exchange project as Part of the Fiscal Year 1995-97 AB 2766 Discretionary Fund Work Program

As part of the FY 1995-97 AB 2766 Discretionary Work Program, the MSRC set aside $550,000 for a Regional Transit Database Information Exchange project. The RTDIE will facilitate the interagency exchange of transit route and schedule information for all fixed route transit and rail operations within the AQMD through the Internet or by making one phone call. The MSRC recommends that this project be carried out by the Southern California Association of Governments through a sole-source award. As a regional governmental agency, SCAG is uniquely qualified to provide the project management necessary to coordinate with the multiple transit agencies.

6. The AQMD's Program Cost Estimate for Implementing the Air Toxics "Hot Spots" Information and Assessment Act (AB 2588) During Fiscal Year 1996-97

The Air Toxics "Hot Spots" Information and Assessment Act requires air districts to transmit annually to CARB an AQMD Board-approved cost estimate for local program implementation. This proposed estimate must be approved and transmitted to CARB before April 1, 1996 to be included in the state's new approved fee rule. The AQMD cost estimate for FY 1996-97 is based on the Three-Year Budget Forecast. Staff recommends approval of this cost estimate and its transmittal to CARB. This was reviewed and approved by the Stationary Source Committee on February 16, 1996.

7. Issue a Request for Proposals for a Management Firm to Operate the Diamond Bar Headquarters Cafeteria

On August 2, 1991, the Board awarded a bid to ARA Services to manage and operate the cafeteria at the Diamond Bar Headquarters facility. This contract expires on March 31, 1996, and staff is requesting permission to seek new bids in order to secure a new contract.

8. Issue a Request for Proposals for Independent Audit Services

A financial audit is annually performed on the AQMD in compliance with the Government Code and Single Audit Act of 1984. This audit is performed by independent Certified Public Accountants, and their reports are addressed to the Governing Board. The three-year contract with the AQMD's current auditors expires on June 30, 1996. This RFP is for financial audit services for FYs 1995-96, 1996-97, and 1997-98. This was reviewed by the Administrative Committee on February 16, 1996.

9. Fiscal Year 1995-96 Budget Transfer

At Board direction staff has periodically brought to the Governing Board all necessary budget transfers occurring during the fiscal year. Budget transfers are the result of Board actions, further definition of programs approved in the budget, reorganizations, or budget corrections. These transfers move moneys to the appropriate expenditure accounts and do not require additional appropriations.

10. Fiscal Year 1995-96 AQMD Contracts

Last year ARB recommended that the AQMD prepare a periodic report to the Board on AQMD contract activity. This is the first semi-annual report on the number of contracts let and dollar amounts for competitive and sole-source contracts signed by the Executive Officer and the Board Chairman. This report covers the contracts executed during the first six months of FY 1995-96 (July 1 through December 31, 1995).

11. Award Contracts for Air Quality Investment Program

On September 8, 1995, the Governing Board approved the release of an RFP to solicit proposals for Air Quality Investment Program ( AQIP) funds. Staff has reviewed and evaluated the proposals received during the second quarter. The total amount available for the contracts will be $414,545. The recommendations for the contracts were reviewed by the Mobile Source Committee on February 23, 1996 and recommended for approval.

12. Execute a Contract to Cost-Share Heavy-Duty Vehicle Chassis Dynamometer Testing to Improve the Current Emissions Inventory and to Analyze the Impact of Clean Fuels

The current State model may not accurately reflect on-road heavy-duty vehicle emissions or the impact of these vehicles on the inventory. In this proposal, in-use heavy-duty vehicles of various weight classes and fuel types will be recruited for emissions testing. Data collected will be used to improve the on-road heavy-duty vehicle emissions inventory, and to assess the benefits of clean fuels. Staff recommends executing an agreement with the California Air Resources Board in an amount not to exceed $200,000 to cost-share this $850,000 project. This was reviewed by the Technology Committee on February 13, 1996 and recommended for approval.

13. Execute a Contract to Cost-Share an Evaluation of Three-Way Catalyst Technology for Off-Road Equipment Powered by Gasoline and Liquefied Petroleum Gas Engines

Emission reduction goals have been established for off-road equipment powered by gasoline and/or liquefied petroleum gas engines of 25 to less than 175 horsepower in the State Implementation Plan. The objective of this project is to demonstrate the technical feasibility of utilizing closed-loop three-way catalyst technology on these engines in order to meet the SIP's targets. Staff recommends executing an agreement with the California Air Resources Board in an amount not to exceed $150,000 to cost share this $450,000 project. This was reviewed by the Technology Committee on February 13, 1996 and recommended for approval.

14. Execute a Contract to Sponsor Follow-Up Emissions Testing of High-Emitting Vehicles Recruited in Orange County Using Remote Sensing Devices and Repaired

In the Spring of 1995, the AQMD sponsored a project entitled "Program for the Use of Remote Sensing Devices to Detect High-Emitting Vehicles," in which over 100 high-emitting vehicles were recruited using remote sensing devices and repaired. Staff recommends executing an agreement with the University and Community College System of Nevada in an amount not to exceed $40,000 to conduct a follow-up project to re-recruit these vehicles one year after repair to evaluate the durability of the repairs. This was reviewed by the Technology Committee on February 13, 1996 and recommended for approval.

15. Execute a Contract to Cost Share the Evaluation of Fuel Cell Reformer Emissions

The AQMP calls for deployment of ZEVs. Under current ARB definition, fuel cell vehicles (FCVs) with fuel reformers cannot qualify as ZEVs. On a life-cycle emissions basis, however, they are expected to be as clean as battery-powered EVs. ARB, working closely with AQMD, issued an RFP for a study to quantify emissions from FCVs with on-board reformers. The evaluation team selected Acurex Environmental to conduct this $250,000 study. Staff recommends executing a contract with ARB to provide an AQMD cost share of $125,000. This was reviewed by the Technology Committee on
February 13, 1996 and recommended for approval.

16. Execute a Contract to Cost-Share the Development and Demonstration of a Propane Medium-Duty Engine

Medium-duty vehicle applications, such as street sweepers, shuttle buses and pickup and delivery trucks, lend themselves well to the use of alternative fuels. Although there are several natural gas engines available in the marketplace, there are no commercially available propane-fueled medium-duty engines. Staff recommends cosponsoring, in an amount not to exceed $313,400, The ADEPT Group to develop and demonstrate a propane Cummins 6B engine in a shuttle bus application with the City of Pasadena. The total estimated cost of the project is about $2.5 million. This was reviewed by the Technology Committee on February 13, 1996 and recommended for approval.

17. Execute a Contract to Cost-Share the Development and Demonstration of a Long-Range Natural-Gas Van

Certain manufacturers have developed low-emission vehicles fueled by automotive compressed natural gas (CNG). However, because of space constraints for the CNG tanks, these vehicles are limited in range to about half that of gasoline vehicles. CALSTART proposes to develop a modified frame structure for the Dodge Ram Van to incorporate larger CNG storage tanks and double the vehicle range. The total estimated cost of this project is $750,000. Staff recommends that a contract with CALSTART be executed for an amount not to exceed $100,000. This was reviewed by the Technology Committee on February 13, 1996 and recommended for approval.

18. Execute a Contract to Evaluate Allergens in Paved Road Dust and Airborne Particles

The objective of this proposed study is to determine the contribution of road dust to the toxicity of ambient particles (PM10). The information can subsequently be used to determine the extent of health benefits likely to be derived from road dust control measures to achieve ambient PM10 target levels in different areas of the Basin. Staff recommends cosponsoring this study by the California Institute of Technology in an amount not to exceed $50,000. The California Air Resources Board will provide $104,000 to cost-share this study. This was reviewed by the Technology Committee on February 13, 1996 and recommended for approval.

19. Amend Contract to Cost Share Year 3 of the GasRail USA Program

The Board previously authorized AQMD cost sharing for Years 1 and 2 of the four-year GasRail USA program. This is a cooperative program conducted by Southwest Research Institute to develop and demonstrate low-emitting natural gas locomotives. This $9.5 million program is cost shared by ARB, DOE, SoCal Gas, General Motors Electromotive Division, the Gas Research Institute, and the Southern California Regional Rail Authority. The total cost of Year 3 is estimated to be $1,555,000. Staff recommends an AQMD cost share of $500,000 for Year 3. This was reviewed by the Technology Committee on February 13, 1996 and recommended for approval.

20. Adopt Technology Advancement Plan and Include it in the Clean Fuels Program

The proposed Technology Advancement Plan for the Clean Fuels Program outlines planned project expenditures for the balance of Fiscal Year 1995-96 in accord with SB 199 (Kelley). This legislation includes a requirement that research, development, and demonstration projects for vehicle applications within the AQMD's Clean Fuels Program do not duplicate the efforts of 69 different organizations. Based on communications with these organizations, staff has determined that the projects proposed in the Plan are not duplicative. The Plan will be updated periodically to reflect new developments. This was reviewed by the Technology Committee on February 13, 1996 and recommended for approval.

21. Issue a Request for Quotations for Car Scrapping

At its February 1996 meeting, the Governing Board directed staff to prepare a Request for Quotations (RFQ) to develop a qualified list of car scrappers eligible for Air Quality Investment Program (AQIP) funds. Attached is the RFQ. This was reviewed by the Mobile Source Committee on February 23, 1996, and recommended for approval.

22. Approve Memorandum of Understanding with the San Bernardino Public Employees Association

Collective bargaining mediation discussion between AQMD management and representatives of the San Bernardino Public Employees Association resulted in a tentative agreement that was subsequently ratified by members of the Professional Bargaining Unit. Under the terms of the agreement, Professional Unit employees would, as of May 1, 1996, work the same Tuesday-through-Friday work week as other AQMD employees. All other terms of the previous Memorandum of Understanding would be extended through June 30, 1996. This was reviewed by the Administrative Committee on February 16, 1996 and recommended for approval.

23. Approve Memorandum of Understanding with the Federation of Public Sector Workers Regarding the Technical and Enforcement Unit
This item is a place holder on the agenda pending the outcome of the union ratification vote set for March 6. If the agreement is ratified, this notice would meet public notification requirements.

AQMD management and representatives of the Federation of Public Sector Workers reached a tentative agreement that was subsequently ratified by members of the Technical and Enforcement Unit. Changes include establishing new vehicle assignment criteria, a catastrophic leave fund, an administrative grievance process, a one-year probationary period for newly hired employees, and a 10-day-per-year limit on paid jury duty leave. Most other terms of the previous Memorandum of Understanding would be extended through June 30, 1996. This recommendation is to approve the labor contract. This issue was finalized after the date of the Administrative Committee meeting.

The February 16 Legislative Committee agenda was referred to the Governing Board at Chairman Mikels' request. That agenda includes four recommended positions: AB 924, Air Standards--Oppose; AB 1240, VOC Exemptions--Oppose Unless Amended; AB 1983, Chlorofluorocarbons--Oppose; and
AB 1996, Freon--Oppose. At the Governing Board's special meeting on February 23, 1996, Oppose positions were taken on five measures: SB 836, repealing Rule 2202; SB 1601, the AQMD's budget; SB 1602, Governing Board; SB 1603, indirect sources; and SB 1518, AQMD's fiscal authority.
Staff is recommending Oppose positions on two more bills: SB 2070, County opt-out; and SB 2130, deregulating schools.

At the February 9, 1996 meeting, Councilman Braude proposed several regulatory reform initiatives in addition to those introduced at the January 12, 1996 meeting. The Governing Board directed staff to evaluate the potential to implement these additional regulatory reforms.

39. Regulatory Reform Initiative - "Green Carpet" Priority Permitting Service

During the last two years, AQMD has worked closely with a number of companies to expedite permitting for certain large, complex projects. This experience has been very successful. The Board's Regulatory Reform Initiative offers similar green-carpet service to projects that meet certain environmental, technology or job creation criteria. A pilot project is proposed to evaluate implementation of this concept. The details of the pilot project have been developed in collaboration with the California Council for Environmental & Economic Balance (CCEEB). This was reviewed by the Stationary Source Committee on January 19 and recommended for approval.

40. Analysis of AQMD Treasury Management Options

This report identifies and evaluates various treasury management options available to the AQMD, including the costs and benefits of implementing each option. Over the last several months the Administrative Committee has been reviewing AQMD's investment and cash management programs performed by the County of Los Angeles. Based upon concerns highlighted by the Orange County bankruptcy, the Administrative Committee has directed staff to provide to the Board an objective comparison of the various treasury management options available to the AQMD and the costs, risks, and benefits associated with each recommendation. This was reviewed by the Administrative Committee on February 16, 1996.

The rescinding of Rule 1129 and proposed amendment of the other coating rules are necessary to make AQMD rules consistent with Section 41712 of the state Health and Safety Code which prohibits local districts from enforcing or regulating VOC limits on aerosol coatings. In addition, the proposed amendment of the definition of "exempt compounds" in each rule will reference Rule 102 - Definition of Terms, to provide a consistent definition between rules.

42. Amend Rule 1610 - Old Vehicle Scrapping

Proposed amendments regarding the destruction of engine blocks are recommended to: 1) make Rule 1610 more flexible in enabling antique and classic car enthusiasts to salvage engine parts, and 2) provide added options for auto dismantlers to render engines inoperable. The revised rule language would allow for alternative methods to render the engine inoperable and would allow the classic car enthusiasts to rebuild these engines to their original emissions certification standards.

43. Staff Recommendation and Rulemaking Action Plan on Intercredit Trading--Increasing Flexibility for AQMD's Mobile and Stationary Source Emissions Credit Programs

In April 1995, the Board initiated the Intercredit Trading Study. The objective of this study is to assess the feasibility of linking the AQMD's mobile and stationary emissions credit trading programs to increase compliance flexibility while achieving air quality goals. In October 1995, AQMD staff released for public review a draft paper on issues surrounding intercredit trading. Four workshops were held in November. Based on public comments received, staff finalized policy recommendations and an action plan for rulemaking. Actual rulemaking would occur later. The report was made available prior to the February public hearing.

44. Consider Regulatory Relief Options and an Amendment to Subdivision (l) of Rule 2202 - On-Road Motor Vehicle Mitigation Options, Pertaining to Possible Establishment of an Exemption for Primary and Secondary School Districts

On December 8, 1995, the Governing Board adopted Rule 2202, and directed staff to bring back information and necessary documents to allow consideration of a possible exemption of primary and secondary school districts. At the January 12, 1996 meeting, the Governing Board directed staff to evaluate several options for providing regulatory relief for primary and secondary school districts. This report discusses background information on these issues and provides several options for providing regulatory relief for schools, including exemption from Rule 2202 requirements. This report was discussed at the Mobile Source Committee Meeting on February 23, 1996.

45. Amend the Control Measure Adoption Schedule for the 1994 State Implementation Plan (SIP) Submittal

AQMD is seeking EPA approval for the inclusion of the 1994 AQMP and SIP submittal into the State Implementation Plan. Prior to approval, AQMD must submit a revised adoption schedule for the 1994 SIP control measures contained in the 1996 Rule Forecast Report (March 1996 version). The 1994 control measures in the 1996 Rule Forecast Report and provided in this package shall serve as the Amended Control Measure Adoption Schedule.
