This is a joint presentation by the California Air Resources Board and the Western States Petroleum Association and will provide an overview of the progress made on the implementation of the California Reformulated Gasoline (CaRFG) program. CaRFG is a state-mandated program that requires production and use of a cleaner-burning gasoline. The use of CaRFG will significantly reduce emissions of unhealthful pollutants and help the AQMD meet its air quality objectives.

2. Regulatory Relief Options for Primary and Secondary Schools Subject to Rule 2202 - On-Road Motor Vehicle Mitigation Options

At the January 12, 1996 meeting, the Board directed staff, at the suggestion of Chairman Mikels, to evaluate several options for providing regulatory relief for primary and secondary schools subject to Rule 2202 - On-Road Motor Vehicle Mitigation Options. A staff report has been prepared in response to this request and is presented for Board consideration.

3. Set Public Hearing March 8, 1996 to Amend Subdivision (l) of Rule 2202 - On-Road Motor Vehicle Mitigation Options, Pertaining to Possible Establishment of an Exemption for Primary and Secondary School Districts

At the December 8, 1995 Board Hearing, the Board adopted Rule 2202 - On-Road Motor Vehicle Mitigation Options, and directed staff to bring back information and necessary documents to allow consideration of a possible exemption of primary and secondary school districts. This report discusses background information on the school exemption issues, including potential pollutant emissions impacts. Rule language that would exempt primary and secondary schools as well as other school district facilities is provided in the event the Board elects to adopt such an exemption.

4. Amend Contract with Telos Consulting Services to Increase the Funding for Systems Development Work

At its June 10, 1994, meeting, the Board approved a contract with Telos Consulting Services (Telos) to provide system development services on a task-by-task basis. This is a basic ordering agreement, where specific work is defined, and individual task orders issued. During the contract period, additional funding is needed as system development requirements are identified. Staff recommends that the contract be modified to add additional funding in the amount of $100,000 to accommodate identified projects through June 1996. Funding is included in the Fiscal Year 1995-96 budget for Information Management to cover these expenses. This item was reviewed and approved by the Administrative Committee on January 19, 1996.

5. Reallocate Funds for Contracted Communication Services to Support Rule 701-Episode Forecast and Declaration Dissemination to Schools

Rule 701, as amended on September 8, 1995, removed the requirements for schools and industry to maintain an antiquated radio system to receive daily air quality forecast and episode declaration. In its place, the AQMD committed to explore new-technology methods to provide episode notification to school districts. Staff recommends that the Board authorize the reallocation of $40,000 of budgeted funds into the Professional and Special Services Account to fund contractual services for providing a communications link to the school districts. This item was reviewed and approved by the Administrative Committee on January 19, 1996.

6. Award a Contract to Privatize Portions of the Annual Emissions Report Program

At its October 1995 meeting, the Board approved the release of a Request for Proposals to privatize portions of the annual emissions report program. All proposals submitted were evaluated and ranked by a panel comprised of AQMD staff and representatives from The Gas Company and the California Council for Environmental and Economic Balance. Staff recommends that the Board award the contract to the successful bidder. Funding is included in Planning and Policy's FY 1995-96 budget. This item was reviewed and approved by the Administrative Committee on January 19, 1996.

7. Issue a Request for Proposals for Source Emissions Testing by Outside Contractors

AQMD has used private sector source emission testing services since 1987 to augment and enhance its source testing capabilities. Applied Science and Technology proposes to continue this contracting effort at a level between 125-150 source compliance tests annually, beginning August 1, 1996. Such compliance testing will be conducted using AQMD test methods in accordance with AQMD quality assurance practices and subject to AQMD review. The maximum total dollar amount to be contracted out is $300,000. This item was reviewed and approved by the Administrative Committee on January 19, 1996.

8. Approve Memorandum of Understanding with the San Bernardino Public Employees Association

Collective bargaining mediation discussions between AQMD management and representatives of the San Bernardino Public Employees Association resulted in a tentative agreement that was subsequently ratified by members of the Professional Bargaining Unit. Under the terms of the agreement, Professional Unit employees would, as of May 1, 1996, work the same Tuesday-through-Friday work week as other AQMD employees. All other terms of the previous Memorandum of Understanding would be extended through June 30, 1996. This recommendation is to approve the ratified labor contract. This item arose after the January 19, 1996 Administrative Committee meeting.

9. Issue a Request for Quotations to Pre-Qualify Vendors for Providing Mailing Services

On March 10, 1995, the Board received and filed a report outlining administrative policy and procedure changes made by the Executive Officer relating to the purchase of nonconsultant services and supplies. One of these changes was a requirement for establishing, through Board approval, a list of prequalified vendors of such services and supplies. Staff is recommending the release of a Request for Quotations which will be used to establish a list of pre-qualified vendors from whom competitive bids may be solicited for mailing services as needed in the remainder of FY 1995-96 and through FYs 1996-97 and 1997-98. This item was reviewed and approved by the Administrative Committee on January 19, 1996.

PUBLIC HEARINGS

26. Annual Report on the Air Toxics " Hot Spots" Risk Assessment Program

Air districts are responsible for implementing requirements of the Air Toxics "Hot Spots" Information and Assessment Act of 1987 (AB2588). One requirement of the program is an annual report. This report highlights activities and progress through 1995 and provides a summary of anticipated activities during 1996. A significant number of Health Risk Assessments (HRAs) are under final review. Forty-two HRAs have been approved and one in five have required facilities to provide public notice.

27. Public Hearing to Receive Public Input on the Executive Officer's Program Goals/Objectives for Fiscal Year 1996-97

A set of Program Goals/Objectives for Fiscal Year 1996-97 has been developed. The Executive Officer wishes to receive public- and Board-member input on these Program Goals/Objectives as they will serve as the foundation for the AQMD's Fiscal Year 1996-97 Work Program.

28. Staff Recommendation and Rulemaking Action Plan on Intercredit Trading--Increasing Flexibility for AQMD's Mobile and Stationary Source Emissions Credit Programs

In April 1995, the Board initiated the Intercredit Trading Study. The objective of this study is to assess the feasibility of linking the AQMD's mobile and stationary emissions credit trading programs to increase compliance flexibility while achieving air quality goals. In October 1995, AQMD staff released for public review a draft paper on issues surrounding intercredit trading. Four workshops were held in November. Based on public comments received, staff is finalizing policy recommendations and an action plan for rulemaking. Actual rulemaking would occur later. The report will be made available prior to February public hearing.

31. Issue a Request for Proposals for a Management Firm to Operate the Diamond Bar Headquarters Child Care Center

On April 14, 1995, the Board awarded a bid to Bright Horizons Children's Centers, Inc. to manage and operate the child care center at the Diamond Bar Headquarters facility. Bright Horizons notified the AQMD on January 30, 1996 that it has decided to terminate the contract, and staff is requesting permission to develop a new RFP and seek new bids. Because the AQMD was only notified on January 30, discussion leading up to development of RFP language will prevent the RFP from being provided at the February 9, 1996 Board meeting. This item arose after the January 19, 1996 Administrative Committee meeting.

At the end of the agenda, an opportunity is also provided for the public to speak on any subject within the AQMD's authority. Speakers may be limited to three (3) minutes each.

Additional matters can be added and action taken by two-thirds vote, or in the case of an emergency, by a majority vote.
