5. Set a Public Hearing on September 8, 1995 to Consider Amendments to the
AQMD's Rules and Regulations, and to Adopt Any Necessary California
Environmental Quality Act Documentation for the Following Rule:

Amend Rule 1130 - Graphic Arts (Fray) (909) 396-3030

The proposed amendments will include changes required by U.S. EPA and address issues identified by industry and AQMD staff. These proposed amendments include: (1) addition of a purpose and applicability section, (2) language clarifications, (3) increasing the overall control efficiency for publication gravure to a minimum of 75 percent, (4) addition of an equation for calculating the required equivalent overall control efficiency, (5) addition of a prohibition of specification and sale provision, (6) updating the test methods, and (7) limiting the flexographic metallic and matte finish ink exemption to facilities with a potential to emit 10 tons or less per year of volatile organic compounds.

9. Recommendation to Adopt an AQMD Customer Bill of Rights (Bowen) (909) 396-3235

This proposal implements Point XII of the Action Plan of the Business Clean Air Partnership adopted by the Board at its April 14, 1995 meeting. The plan calls for the creation of an "AQMD Customer Bill of Rights" to assist businesses, the public and AQMD staff in understanding of their rights and available public services. A statement of the customer's "Bill of Rights" on a pocket-sized card distributed to staff and the public, would help improve customer service and facilitate greater mutual respect and trust.

10. Recommendation Regarding Requests for Proposals for Fiscal Years 1995-97 AB 2766 Discretionary Work Program Projects (Longville) (909) 396-3237

Approximately $12.5 million annually in AB 2766 vehicle registration fee revenues, including projected interest earned, will be available to fund vehicle emission reduction projects in Fiscal Years (FYs) 1995-96 and 1996-97. The Mobile Source Air Pollution Reduction Review Committee (MSRC) has proposed a two-year, $22 million program for FYs 1995-97, subject to reauthorization in FY 1996-97 assuming the AB 2766 funding remains available. This program consists of the following: 1) Three Alternative Fuel Requests for Proposals for Public Transit, School Buses and Heavy-Duty Vehicles; 2) A Zero-Emission Vehicle "Quick Charge" Program consisting of three components: a Request for Qualifications for vehicle buydowns, a Program Opportunity Notice (PON) for participation in a Corridor Communities Program, and an RFP for an Outreach Coordinator; and 3) Three RFPs for projects to enhance or implement Rail Feeders/Stations, Transportation Control Measures and Research and Development. On June 22, 1995, the MSRC approved these RFPs, the RFQ and the PON, and requests the Governing Board's approval to release the documents to solicit proposals. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

11. Recommendation Regarding Retention of Contractors to Provide Technical and Contract Administrative Support for the AB 2766 Discretionary Fund Program as Part of the Fiscal Year 1995-96 AB 2766 Discretionary Work Program (Longville)

The AB 2766 Discretionary Fund Program receives thirty cents of every dollar of vehicle registration fees collected pursuant to AB 2766. It is estimated that approximately $11.7 million will be available in FY 1995-96. Of this $11.7 million, AB 2766 allows 5 percent to be used to support program administration. On June 22, 1995, the MSRC approved the reimbursement of technical, clerical and contract administrative support consistent with the level currently provided by AQMD staff. In addition, due to the complexities of the FY 1995-96 Work Program, as well as the continued need for support of past contracts, the MSRC committed additional monies to provide enhanced technical and clerical support in the form of two contract employees. The additional technical support will be provided by Ray Gorski, previously of SAIC (the MSRC's former Consultant Advisor), and one clerical contract employee. The MSRC is requesting that the Board approve funding these two non-benefited contract employees as part of the FY 1995-96 AB 2766 Discretionary Work Program. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

12. Recommendation to Execute Amendments to Contracts with the University of California, Riverside's College of Engineering - Center for Environmental Research and Technology (Lloyd) (909) 396-3245

The Board previously authorized two separate contracts with the University of California, Riverside's College of Engineering - Center for Environmental Research and Technology (CE-CERT) to conduct a variety of projects involving low-emission technologies and clean fuels. Staff recommends that both contracts be amended to allocate additional funding for CE-CERT to conduct follow-on work. In the first contract, CE-CERT is conducting Phase I of a baseline gasoline composition study, in preparation for wide-scale introduction of advanced reformulated gasoline in March 1996. Staff recommends AQMD funding in the amount of $80,000 to conduct Phase II of this project, which calls for sampling and analysis of 1996 reformulated gasoline. Under the second contract, CE-CERT is conducting seven mobile source projects designed to provide technical support and emissions testing for AQMP-related technologies. Staff proposes a contract amendment to fund additional work by CE-CERT on four of these seven projects, in an amount not to exceed $490,000. The total proposed amount of new funding for this Board action is $570,000. This recommendation was reviewed and approved by the Technology Committee on June 14, 1995.

13. Status Report on the 1994 Air Quality Management Plan (Wallerstein) (909) 396-3131

Upon adoption of the 1994 AQMP the Board directed staff to evaluate the impacts of the Final Federal Implementation Plan, the revised on-road emissions factor program, and the ARB long-range mobile source control program, relative to the 1994 AQMP control strategy and to recommend any necessary revisions to the Plan. ARB has yet to adopt the revised on-road mobile emissions factor program. However, the State did adopt a long-range mobile source control program as part of the State Implementation Plan approval. In addition, the U.S. Congress has rescinded the Federal Implementation Plan. Staff has prepared a report which reviews the impacts of the above actions on the 1994 AQMP.

14. Status Report on Lead Agency Projects and Environmental Documents Received by the AQMD (Broadbent) (909) 396-3789

This report provides a monthly listing of environmental documents received by the AQMD, and a summary of projects for which the AQMD is preparing environmental documentation. Monthly listings which are shaded note those environmental documents for which AQMD staff has or will prepare and submit comments to the lead agency.

15. Recommendation to Appropriate Funds for Phase II of the PM10 Technical Enhancement Program (PTEP), Recognize Co-Sponsor Revenues, and Release Request for Proposals in Support of the PTEP (Broadbent)

Last December, the Board appropriated $600,000 to initiate the PTEP. Some projects are now underway, and some projects are scheduled to begin after July 1, 1995 as part of the second phase of the program. Because not all of the AQMD's funds were committed during the first phase in the FY 1994-95 Budget, staff recommends that the uncommitted portion of the PTEP funds ($375,000) be re-appropriated in the FY 1995-96 Budget for their original purpose. Staff also recommends that the additional funds by PTEP co-sponsors be recognized as a supplement to the FY 1995-96 Budget, and that the Board approve the release of the RFP for PTEP projects. This recommendation was reviewed and approved by the Administrative Committee on
June 23, 1995.

16.Recommendation to Amend Contract to Determine Limits of Best Available Control Measures for Fugitive Dust Under High Wind Conditions (Broadbent)

In 1994 the AQMD awarded a contract to the College of Engineering - Center of Environmental Research and Technology (CE-CERT) of the University of California, Riverside for $69,574 to conduct a field study for determining when fugitive dust "best available control measures" become ineffective under high wind conditions. This information is needed to provide improved technical data as part of the federal PM10 SIP process. Due to abnormal weather conditions during 1994, there were insufficient high-wind events to meet the project objectives. To gain enough events, it is necessary to continue the project through the 1995 fall windy season. Staff recommends that the existing contract with CE-CERT be increased by $19,872 for a contract total of $89,446. The additional funds are available in Planning and Policy's Professional & Special Services Account in the FY 1995-96 Budget.

17. Recommendation to Recognize Revenue and Appropriate Funds to be Received from the Environmental Protection Agency under the Section 105 Grant Program (Broadbent)

The U.S. EPA has informed the AQMD that an additional $10,454 in FY 1995 Section 105 Grant monies is available to supplement the previous $250,000 grant to the PM10 Best Available Control Measures (BACM) Working Group. These funds will augment the maximum five percent allowed under the previous grant for administrative support to the BACM Working Group. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

18. Recommendation to Qualify Vendors to Provide PC, LAN, and WAN Replacement Parts and Repair Services (Mathur) (909) 396-2722

On May 12, 1995 the Board approved the release of an RFP for PC, LAN and WAN replacement parts and repair services. As a result of successful responses to this RFP, three vendors were identified as capable of providing these personal computer and telecommunications repair services and supplies. These vendors will be the primary source for all hard disk, printer, modem and other telecommunication subsystem repairs and supplies. Staff recommends that these top three vendors be approved and qualified to provide services and supplies to the AQMD. Funds have been allocated in the FY 1995-96 Information Management Budget for these services. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

19. Recommendation to Qualify Vendors to Provide Library Services and Supplies (Mathur)

On May 12, 1995 the Board approved the release of an RFP for Library Services and Supplies. As a result of successful responses to this RFP, three vendors were identified as capable of providing library services and supplies. Staff recommends that the top three vendors in each specific category be approved and qualified to provide services and supplies to the AQMD for FY 1995-96. Funds have been allocated in the FY 1995-96 Information Management Budget for these services and supplies. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

21. Recommendation to Receive and Allocate Environmental Protection Agency Funds for the Market Incentives Conference (Leyden)

The AQMD is designated to receive $10,000 in EPA 105 supplemental grant funds to help offset program costs, including the cost incurred by out-of-state personnel who attended a two-day States/EPA Market Incentives Conference, held at the AQMD's Diamond Bar Headquarters in January 1995. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

22. Recommendation to Implement the Home Rule Working Group (Leyden)

A Home Rule Working Group would be established, in partnership with the regulated community, to streamline regulatory compliance and eliminate duplicative local, state and federal requirements. This proposal will implement Item VI in the Board's Business Clean Air Partnership. This recommendation was reviewed and approved by the Stationary Source Committee on June 23, 1995.

23. Recommendation to Award Bid for Small Business Assistance Fund Consulting Services (Fray) (909) 396-3030

At the April 14, 1995 meeting, the Board approved the release of an RFP for Small Business Assistance Fund Consulting Services. These services are necessary in the implementation of the provisions of Health & Safety Code Sections 40448.6 and 40448.7 (AB 2444) relative to the Air Quality Assistance Fund loan guaranty program with the related financial services industry. Bids were received and reviewed consistent with the AQMD consulting criteria and a contractor is recommended.

24. Recommendation Regarding a Request for Proposals for Program Development to Simplify and Streamline Permitting Requirements (Fray)

Item II of Chairman Mikels' Business Clean Air Partnership is to simplify and streamline the permit requirements for most small businesses through the certification/registration program. Staff has identified over 20 types of commonly permitted equipment that do not trigger offset or toxic requirements for this program. This RFP seeks qualified contractors to obtain detailed information on the identified equipment and to prepare evaluations and certification requirements for that equipment. The Stationary Source Compliance Project for FY 1995-96 includes $75,000 for this contract. This recommendation was reviewed and approved by the Administrative Committee and the Stationary Source Committee on June 23, 1995.

25. Recommendation to Appropriate Funds to Purchase Monitoring Equipment and Conduct Monitoring Studies (Liu) (909) 396-2105

The AQMD has received funds from EPA and ARB to conduct a number of monitoring projects. These designated funds must be carried over from the FY 1994-95 Budget to the FY 1995-96 Budget to complete these studies and purchase needed equipment. Staff recommends that the Board appropriate funds from the Undesignated Fund Balance to the Applied Science and Technology Division FY 1995-96 Budget as follows: (1) $50,000 for an EPA-funded study on the Demonstration of Optical Remote Sensing Techniques, (2) $70,000 to purchase equipment for the EPA-mandated Photochemical Assessment Monitoring Stations program, and (3) $150,000 for the ARB Children's Health Study in the South Coast Air Basin. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

26. Recommendation to Allocate Environmental Protection Agency Funds for the Photochemical Assessment Monitoring Stations Program (Liu)

EPA has allocated $671,361 in grant funds to AQMD for the purchase of equipment and supplies, and for staffing to implement the third year of the Photochemical Assessment Monitoring Stations (PAMS) program. Staff has prepared a list of resources needed to meet the third-year PAMS requirements. Staff recommends that the Board allocate $208,345 of that money for necessary equipment and supplies. The balance will be used to support staffing needs during FY 1995-96 to continue the monitoring and analyses. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

27. Recommendation to Establish Classification of Telecommunications Supervisor (Nikkila) (909) 396-3010

With the adoption of the FY 1995-96 budget, Information Management will delete one Telecommunications Analyst position and add a Telecommunications Supervisor position. This efficiency enhancing action will allow more direct supervisory control over the AQMD's communications-critical telecommunications and network operations functions. To permit allocating the new position, it is recommended that the Board approve the establishment of the classification of Telecommunications Supervisor.

28. Recommendation Regarding Memoranda of Understanding With the Federation of Public Sector Workers (Nikkila) (909) 396-3010

This recommendation is to obtain Board approval of the Memoranda of Understanding between the AQMD and the Federation of Public Sector Workers regarding the terms and conditions of employment for employees in the Technical and Enforcement and Office Clerical and Maintenance bargaining units.

29. Recommendation Regarding Memorandum of Understanding With the San Bernardino Public Employees Association (Nikkila)

This recommendation is to obtain Board approval of the Memorandum of Understanding between the AQMD and the San Bernardino Public Employees Association regarding the terms and conditions of employment for employees in the Professional bargaining unit.

30. Recommendation to Amend the AQMD's Salary Resolution to Establish a Provisional Salary Reduction Plan (Nikkila)

This recommendation is for a voluntary salary reduction plan that would allow the AQMD, upon written authorization of an employee, to withhold a designated amount from the employee's pay which softens the financial hardship over a period of time if unpaid days off are required. Employees not opting for the voluntary salary reduction plan will have their pay reduced, in the corresponding pay period, for the actual unpaid days off. In addition, if the Executive Officer determines unpaid days off are not required, employees will be reimbursed the salary deducted from their pay. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

31. Recommendation to Adopt Resolution to Renew General Services Agreement with Los Angeles County(Jason) (909) 396-2065

Since its inception, the AQMD has contracted with the County of Los Angeles to provide various services: processing of AQMD warrant and investment services, retirement program administration, purchase of vehicle oil and gasoline; radio system equipment maintenance and associated facility costs; and acquisition of various supply items. Staff recommends that the Board adopt a resolution authorizing the Chairman to execute a five-year General Services Agreement with Los Angeles County, for an annual estimated amount of $155,000. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

32. Recommendation to Award Bid for Security Guard Services at the Diamond Bar Headquarters (Jason)

On March 10, 1995 the Board approved an RFP to solicit bids from qualified security companies to provide guard services at the Diamond Bar Headquarters. This recommendation is to award a three-year contract to the most qualified bidder for an amount not to exceed $223,036 per year. Funding for this work has been allocated in the FY 1995-96 budget. This recommendation was reviewed and approved by the Administrative Committee on June 23, 1995.

33. Recommendation Regarding Appointments to the Advisory Council (Mikels)

On July 31, 1995 the term of the current Advisory Council members will expire. At this time staff is requesting reappointment of the current members for another two-year term. In addition, the Council may be requesting the appointment of some new members to fill vacant positions.

PUBLIC HEARINGS

43. Amend Rule 1149 - Storage Tank Degassing (Fray)(909) 396-3030

The proposed amendment stipulates that underground tanks excavated prior to degassing shall meet the same standards as tanks degassed in-ground and within a specific time frame.
Pre-notification requirements are changed from 14 to 1 day prior to degassing. Certain emergency operations are exempted from pre-notification requirements.

44. Amend Rule 1166 - Volatile Organic Compound Emissions from Decontamination of Soil (Fray)

The proposed amendments will require contractors to possess an approved excavation plan prior to excavating an underground storage tank. Rule language is also amended to be consistent with other AQMD rules and to reflect current practice in the handling of VOC-contaminated soil.

45. Adopt Proposed Rule 2100 - Registration of Portable Equipment (Fray)

This proposed new rule will begin the implementation of Point II of the Action Plan of the Business Clean Air Partnership. Certain types of portable equipment may be registered for a reduced fee. Registered equipment may then be operated here or in any other participating California air district. Participation on the part of the applicant is optional.
