3(A) Set a Public Hearing on March 10, 1995 to Consider Amendments
to the AQMD's Rules and Regulations, and to Adopt Any Necessary
California Environmental Quality Act Documentation for the Following:

Amend RECLAIM Rule 2011, Appendix A - Protocol Monitoring,
Reporting, and Recordkeeping for Oxides of Sulfur (SOx); and
Amend RECLAIM Rule 2012, Appendix A - Protocol Monitoring, (Leyden)
Reporting, and Recordkeeping for Oxides of Nitrogen (NOx) (909) 396-3120

Staff had proposed to amend Rule 2011, Appendix A, to make the missing data procedures for major SOx sources consistent with the major NOx requirements of Rule 2012, Appendix A. Missing data procedures would then apply where there is no prior continuous emissions monitoring systems (CEMS) data available. An additional proposal allows Cycle 1 major sources that do not have approved CEMS to apply different missing data procedures during the period of January 1, 1995 to June 30, 1995. This proposal will amend Rule 2011, Appendix A, and Rule 2012, Appendix A. As a result, staff recommends continuing the public hearing on Agenda No. 26 to the March 10, 1995 Board meeting for Proposed Amended Rule 2011, Appendix A, and set a public hearing on that date for Proposed Amended Rules 2011 and 2012, Appendices A. This action will ensure Cycle 1 and Cycle 2 facilities in both NOx and SOx markets are treated equitably as to the missing data requirements. Staff has revised public notification on both rules.

5. Addendum to Report to the California Air Resources Board on the
South Coast Air Quality Management District's Assembly Bill 2766 (Eichhorn)
Program for Fiscal Year 1993-94 (909) 396-3240

AB 2766 and AB 434 require that local agencies imposing vehicle registration fees for air pollution programs shall report to CARB on the use of the fees and results of the programs funded. In December 1994, District staff prepared a report consisting of two segments: A) the District's use of AB 2766 funds for its own programs; and B) the Discretionary Fund program. The third segment of the report, the local government subvention program, was prepared in January 1995 after required information from subvention fund recipients was received. This information is being submitted to CARB as an addendum to the original report.

6. Audit Report for the Fiscal Year Ended June 30, 1994 (Pearce)

This agenda item transmits the annual financial audit performed by a firm of independent certified public accountants. The financial statements have again received an unqualified opinion, the highest obtainable.

7. Recommendation to Award Contract for Update Training Sessions to (Wasikowski)
Employee Transportation Coordinators as Required by Rule 1501 (909) 396-3264

Staff recommends awarding a contract to provide support for update training of employee transportation coordinators. The contractor will make arrangements to provide classroom spaces, pre-registration materials, enrollments and confirmations of attendees. There will be no funding required by this contract. The project must be entirely funded out of the enrollment fees charged to training participants.

8. Recommendation to Accept Funds Into the Pass-Through Agency Fund

The 1994 Air Quality Management Plan (AQMP) emphasizes the use of alternative transportation technologies throughout the transportation sector as an air quality attainment strategy. The South Coast Alternative Fuels Fleet Project (CleanFleet) is one of the most comprehensive tests of alternative fuels in fleet vehicles ever conducted. Proposed federal funding of $400,000 will be appropriated into an agreement with the Battelle Memorial Institute for production of final project reports, including engine performance and durability, vehicle emissions, and fleet economics.

9. Recommendation to Cosponsor an Evaluation of Factors that Affect
Diesel Exhaust Toxicity (Lloyd)

Diesel-fueled, heavy-duty vehicles are targeted in the 1994 AQMP for their significant emissions. Diesel exhaust has also been identified as a probable human carcinogen, and is undergoing evaluation as a potential toxic air contaminant by the ARB. Under the proposed project, the University of California, Riverside, Center for Environmental Research and Technology will compare the speciation and mutagenicity of diesel exhaust from heavy-duty vehicles using pre-1993 and new, reformulated diesel fuels. Total cost of the project is $450,000--$400,000 provided by the ARB and proposed District funding of $50,000.

10. Development of the AQMD Delegation and Substitution Process (Wallerstein)

The 1994 AQMP called for the development of a voluntary process of delegation and substitution that would give local governments flexibility in the implementation of Transportation Control Measures and Indirect Source Rules. The Board is being asked to approve these procedures as general guidance for the rulemaking process.

11. Status Report on AQMD Listing of Environmental Documents and Lead (Broadbent)
Agency Projects Received by the AQMD for Review and Comment (909) 396-3789

This report provides a monthly listing of environmental documents received by the AQMD, and a summary of projects for which the AQMD is preparing environmental documentation. AQMD review and comment are subject to the screening criteria established by the Governing Board in March 1990. This document also evaluates the Lead Agency response to AQMD comments.

12. PM10 Reasonable Further Progress Report to the U.S. Environmental
Protection Agency for the South Coast Air Basin and Coachella Valley (Broadbent)

The 1990 Clean Air Act requires that PM10 Reasonable Further Progress (RFP) Reports be submitted to the EPA in three-year increments. The first report is due to EPA by February 28, 1995. Staff has compiled RFP reports for both the South Coast Air Basin and Coachella Valley, and these reports show that reasonable progress has been made toward the attainment of the PM10 ambient air quality standards in both areas. The RFP reports will be forwarded to CARB for subsequent submittal to EPA.

13. Recommendation to Approve Vendor List and to Purchase Personal (Mathur)

On November 18, 1994 the Board approved the release of a Request for Quotations (RFQ) for Personal Computer Hardware, Software and Installation Services. As a result of successful responses to this RFQ, staff is requesting approval of a certified computer hardware, software and services vendor list to remain in effect for two years. Additionally, staff requests approval to purchase computer hardware, software and services from these certified vendors in an amount not to exceed $300,000. This purchase will help standardize the District's desktop computer environment. Funding for this purchase is allocated in the Fiscal Year 1994-95 Budget.

The annual report on air quality and wildland fires summarizes the status of controlled burning of brush and vegetation by fire protection agencies in the South Coast Air Basin.

16. Recommendation Regarding a Request for Proposals for Source (Liu)
Emissions Testing by Outside Contractors (909) 396-2105

The AQMD has used private sector source emission testing services since 1987 to augment and enhance the AQMD's source testing capabilities. Applied Science and Technology proposes to continue this contracting effort at a level between 125-150 source compliance tests annually, beginning August 1, 1995. Such compliance testing will be required to be conducted using AQMD test methods in accordance with AQMD quality assurance practices and subject to AQMD review. The maximum dollar amount to be contracted out is $300,000.

A set of Program Goals/Objectives for the Fiscal Year 1995-96 Budget has been developed. The Executive Officer wishes to receive public and Board member input on these Program Goals/Objectives, as they will serve as the foundation for the AQMD's Fiscal Year 1995-96 Work Program.

27. Amend Rule 1302 - Definitions (Leyden)

(Continued from the November 18, 1994 Board Meeting)

The public hearing for Proposed Amended Rule 1302 was continued from the November 1994 Board meeting to the February 1995 Board meeting. Staff is recommending to the Board to close the public hearing for Proposed Amended Rule 1302 with no action. The proposed amendments will be incorporated with the 1995 amendments to Regulation XIII currently scheduled for a June 1995 hearing.

28. Adopt Proposed Regulation XXXI - Acid Rain Permit Program (Leyden)

The purpose of Proposed Regulation XXXI is to adopt and implement the requirements of 40 CFR, Part 72, whose air quality objective is to reduce emissions of sulfur and nitrogen oxides from electricity generating units. The federal regulations also include requirements for monitoring of emissions. The necessary CEQA documentation is included.

29. Amend Rule 1121 - Control of Nitrogen Oxides from Residential Type (Lockie)

The proposed amendments to Rule 1121 will not change the existing emission limits specified in this rule, but will clarify existing rule language. The proposed amendments will also replace the existing certification testing protocol with a new, more accurate and reliable protocol which was developed jointly by AQMD, water heater manufacturers, independent testing laboratories, and the gas industry. It will also include any necessary CEQA documentation.
